while appearing before a senate judiciary committee he dropped a massive bombshell about hillary clinton and her aide huma abedin's handling of classified information, take a look at this. >> october 22nd, the investigative team that finished the investigation in july asked to meet with me. i met with them that morning in my conference room and they laid out for me what they could see from the metadata on this fellow anthony weiner's laptop that had been seized in an unrelated case. what they could see from the metadata was that there were thousands of secretary clinton's emails on that device including what they thought might be the missing emails from her first three months as secretary of state. we never found any emails from her first three months with respect to ms. huma abedin in particular, we didn't have any indication that she had any sense that what she was doing

was in violation of the law. couldn't prove any sort of criminal intent. >> sean: why is james comey only revealing this information now and we are really supposed to believe that huma abedin has no idea that sending classified material to anthony weiner's laptop isn't a crime? aren't we supposed to protect that? how stupid do they think we are? he should, comey, ed at a minim done a full investigation of huma abedin. president trump tweeted this, fbi director "the five" and gave her a free pass for many bad deeds, the phony trump russia story was an excuse used by democrats as justification for losing the election, perhaps he just ran a great campaign. clinton got a free pass and it so did huma abedin and that creepy anthony weiner guy. take a look at this on your

screen, our friend jay sekulow who will join us in just a minute. look at the laws he pushed together, a list of loss that hillary clinton very well would have broken and has broken. if it was you or if it was me or jay or monica who's going to join us, if we did a tiny fraction of what they did, we would be wearing a striped suit, sitting at a nice little tiny cell somewhere. there's the issue of the alt radical left in their bizarre ongoing conspiracy without empathy evidence of president trump colluding with the russians in the lead up to the election. comey has been more than forthcoming and that investigation of course. one democratic senator al franken asked about the russia collusion story, we don't comment on these things, watch desperate >> is there any evidence that the trump campaign assisted or directed those efforts?

>> that's something i can't answer here, i would refer you back to the center of the investigation, was there any coordination or collusion between elements of the campaign and the russians? >> sean: how many months have you been investigating this? really, you want to sing at a think >> he was also asked about loretta lynch and her infamous meeting with bill clinton, talking about their kids and grandkids. that was the middle of a campaign that hillary was being investigated and then of course loretta lynch made an announcement shortly thereafter? watch this. >> what i struggled with in the spring is how do we credibly complete an investigation of hillary's emails if we conclude there is no case there. the normal way to do it we would have the department of justice announced it. a number of things went on some of which i can't talk about yet

that made me worry department leadership could not credibly complete the investigation and declined prosecution without grievous damage to the american people's confidence in the justice system. in the nightcap capper was i'm not picking on the attorney general loretta lynch, her meeting with president clinton on that airplane was the capital for me. >> sean: it was the capper for you but you won't condemn what loretta lynch did and you praise her? that's tarmac meeting was a slap in the face to everything the american justice system is supposed to stand for. also tonight, a very disturbing report from the ap about your privacy. they are reporting last year under the obama administration the federal government requested that the identities of 1900 plus fellow americans were caught up in nsa surveillance be unmasked, over 1900. were also learning to match that

former national security advisor susan rice who was at the heart of the massive unmasking of people who are attached to the trump campaign, she's not going to testified before a senate subcommittee next week? here with reaction, jay sekulow and monica crowley. let's put it back on the screen and let's go over the potential loss that we are talking about here. isn't it illegal to send classified material, special access, program material, isn't that in and of itself a violation of the law? >> under section 7093, the general espionage statutes and sections a, e, and f, the standard is if you conduct this kind of activity, use gross negligence and how the information is handled, that's a felony. the thing that i found absolutely puzzling besides the fact that the fbi director had a selective disclosure disease, he

discloses what he wants to disclose and doesn't want to disclose what he doesn't want to disclose rather than say i'm not going to talk about an ongoing investigation. this selective disclosure i don't understand for the life of me did not impanel a grand jury to look at the former secretary of state but also huma abedin and then anthony weiner who gets this information, unless he immediately returns it to the person who sent it, he committed a crime. 793e, that goes to any person not just federal employees. >> sean: with all due respect with the facts as we know them, facts, they all committed felonies here, am i wrong? >> no, the thing that's so perplexing here is based on not only what the fbi director said, raised a whole host of issues

but then the subsequent statements to date leads that conclusion. how in the world was is not prosecuted? what is the basis on which they decided that gross negligence which is extreme carelessness is not violated at a minimum? as a whole list of other statutes as well. i don't understand how in the world the department of justice department of justice and james comey with a straight face, he got mildly nauseous because someone accused him of interfering with a campaign? is that the new standard? mildly nauseous? this whole thing is making me more than mildly nauseous. >> sean: we don't even know if there's investigation about all the millions of dollars, monica, that were paid to the clinton foundation, these exorbitant, double the normal rate fees, moscow speeches, bill clinton. all the people associated with her signing off personally, 20% of american uranium going to russia. the liberal news networks will not focus on that aspect of

russia that we know is true, not the conspiracy that they've been spreading. >> this is exactly why donald trump's message of drain the swamp had that such power during the campaign and it still had a so much power with him in the white house now. exactly what you laid out what he was talking about today, the series of allegations and crimes and violations by the clintons, this is the kind of entrenched corruption and cronyism and double standard that the american people had enough of. they expect donald trump to stick by his campaign promise of draining the swamp. >> sean: fundamentally the average person watching the show knows instinctively that if a republican did this or you did this or monica did this, this would have been taken to the nth degree of the law. it hasn't happened yet. why are the republicans pushing it, why is the justice department all over these thing

things? >> no they haven't, even though they sometimes make the statements they've closed the case, it's not close with prejudice. we don't know if it is possible that the fbi and department of justice have impelled a grand jury here, and are investigating this. we aren't hearing that. >> sean: doubtful. >> i would urge that this be looked at again with a new team in place to review the law and the evidence. the statement that james comey made about loretta lynch and how he was so concerned about how it was going to be perceived -- you know what he should be more concerned about? has the law been violated or no not? >> sean: last question we only have about 30 seconds, i'm sorr sorry. what about the unmasking? over 1900 americans in one year unmasked and we know seemingly that they were targeting the trump campaign at the time?

closer to finally repealing and replacing obamacare, i'm being told it could come as early as tomorrow if house republicans do this right and to form a consensus and pass legislation that will improve the lives of you the american people. it will be a huge win for the president, even republican lawmakers but more importantly the american people finally get what was promised, that is tonight's mini monologue. finally it's happening, it's here, perhaps we're hearing tonight a deal between republican lawmakers on the bill to repeal and replace obamacare is close to being done. here's what the speaker of the house paul ryan said earlier today on of the hugh hewitt show, take a listen. >> i have a policy of not committing one were going to bring these votes up, were getting extremely close. were having a very, very productive conversation with our members. the vice president and his whole staff is involved. i feel very good about the

done before they leave for another recess to go back to their districts this weekend. i think they are very close. >> they have another recess? >> they say it's not a vacation but they are going back to their districts to speak to their constituents. >> sean: how long are they out for this time? >> they'll be out for another week at least, it's incredible. the democrats really wanted the government to shut down, chuck schumer and nancy pelosi were hoping to have a story to tell the donald trump and is a administration where incompetence, i think that was a desperation. >> sean: you think it was strategically smart, were going to make sure sanctuary cities, planned parenthood, the border wall, that's okay for fighting in september, let's get health care done, let's get my economic deal done. >> i hate to say this but yeah. i will walk away and we will have a government shutdown get on board and let's get something done, the american people want it.

>> sean: i know you love president obama, big supporter. this is a big blow. it seems the tipping point came down to, something i like a lot and that is the waiver that allows the states to get out of all of this should they choose and i like sending things back to the states. >> i don't know, to me, jim jordan had it right, the leader of the freedom caucus he knows this is no repeal and replace. this is a different version they are trying to of obamacare, what we've got here is a political salvage operation. republicans more interested in what we're saying, it wasn't what we promised. let me finish this point because i think this is really important given your mini monologue. you presented it as they finally did something i remember you fighting the freedom caucus when they blocked the last vote. >> sean: i was on their side!

>> you wanted something done, here we have a situation where they're doing the absolute minimum to try to claim at this as a victory, it's no victory. they're kicking the can down the road in the u.s. senate. >> sean: the senate has been kept in the loop and that i know for a fact. it's not going to blow up and conference in my opinion. ted cruz has been in negotiation, so has rand paul. >> so has the heritage foundation and you see what has happened. >> sean: i talked to jim jordan and mark meadows yesterday on this show, they're saying we've got moderates within our party, we can't do everything we want now, this will lead to health care savings accounts lower premiums. more options, better care. you say that, $5400 average increase for americans and

millions lost their doctors and plans. >> the reason this is a victory tonight is because what the freedom caucus has done and that this constant negotiation over the last two weeks has done is actually make changes to get premiums down. we all know which premiums are doing that it's a big deal. that's what the freedom caucus could not allow. >> sean: it's a much better bill than the one they didn't vote on. >> they've made some real changes here, so it is a better bill and they are expecting the costs to come down paradigm . >> maria and sean lemay say to you, your honest people. you know that in fact this does not lower the number of people without health insurance in the usa, this is not lower premiums. this is still a band-aid on a cancer they had to do something special with pre-existing conditions. president trump money and subsidies for insurance but is in this round. this is a salvage operation.

agree with david axelrod, i think his analysis is right. was it just arrogance and air of arrogance around the campaign, now they're just trying to make excuses? >> it was many things but we also have a better candidate, better message from a better campaign, better strategy and i think more self-awareness overall. i do want to push back on something hillary said. she said that she was winning if the election were on october 27th, that's not true. if you look at the real clear politics aggregate, i did today and the six states it went from obama 2012 to trump 2016. florida, pennsylvania, wisconsin, michigan, ohio, iowa. if you look at these estates, her numbers stay the same improved from october 27th to november 5th, the election is november 8th. what happened is donald trump continued with his strategy of going and connecting with voters doing seven, eight rallies a day toward the end.

a fraction of the money come a fraction of staff, much better candidate and actual economic message for working-class america. under a hell of criticism was real. people came out for him in the end, they wanted to vote for change they wanted to vote against stale policies they deduct what a third term of barack obama. to the extent that hillary clinton had hidden voters, they are still hidden. the lack of self-awareness was stunning, the idea that she ignored wisconsin meant that wisconsin ended up ignoring her. the idea she yet again that mentioned i won the popular vote. you know what the prizes for that? a participation trophy in second place. >> sean: to meet, it's sort of a disconnect but we see this in the may day rallies, we see the rhetoric among the democratic party, the obstructionism, all of those things. it's culminated in maybe i've

been more defensive because we've been friends for more than two decades about the treatments that you've had in the press, now you've got this fire colbert campaign started, i don't participate in boycotts. what he said was despicable, disgusting, just like so many other things that have been said about the president. i know you have been dismissive about personal attacks you've taken which i think have been pretty brutal and unfair. what about when you hear horrible things like that in the new see this effort now beginning. >> i saw your tweet earlier when you said you were boycotts or any type, you don't care for him or his show, people are welcome to change the channel, that's what happens in a free market system. the entire colbert episode to me proves my major point, which is that you have to show basic respect to the president of the united states in its current occupant whoever he is. one day, whoever she is. the reason for that is very
