it gives nonprofit if free political speech. it gives us a right to take a position upon what candidates should be elected, opposed which ones shouldn't be. but it does not allow us to spend our money to promote candidates. that's a perfect balance and i'm so proud of the president forecrafting this. judge jeanine: i was so proud to see the president calling up the little sisters of the poor who went through so much from the obama administration and eric holder dragging them up to the the united states supreme court. that case is still -- he could have overturned that particular employer mandate. but what he did was, he directed the head of health and human services to remove at some point the requirement that people of religious beliefs be required to provide the contraceptive mandate. >> i think most of the laws that

require religious organizations to hire people that's against their conscience are state and local laws. i don't think he could have signed an executive order that would eliminate those bad laws from places like california. that's something that people who live from have to deal with. but he did all he could in an executive order. he restored the free speech rights of non-profits, churches, universities. it many funny, the johnson amendment was never used against the ivy league schools when they supported one candidate over the other. now it levels the playing field. judge jeanine: jerry fall well, jr., thanks for being here. hillary is back in the news. that's ahead.next, we'll talk ae aforementioned presidential election.

of other interesting things, and i think that's what hillary clinton will do. judge jeanine: why is she saying she'll be in charge resistance and raise money? this woman thinks she should be in charge again. >> she is saying she'll be part of the resistance. she has a lot to add to the public debate. she has demonstrated leadership capability. she can add to the rhetoric and description of why president trump is not the right president for the country right now and is not leading us in the right direction. but she won't be the leader of the democratic party. judge jeanine: can the public believe what she says? matt: i have a big smile on my face. i feel she has so many people to blame for her loss. she gets paid to give these speeches where she seems to be

untethered from reality in her own failure. but you said it better at the beginning of your show. judge jeanine: let's talk about healthcare. matt, i'll start with you. preexisting conditions, that seemed to be a stickler for the freedom caucus on the right and the tuesday group. kellyanne conway says it's about leadership and about the president being involved. why all of a sudden are preexisting illnesses okay, and then the bill? >> i think there has been a whole conversation throughout the he election. what do republicans believe on healthcare. donald trump stepped into that conversation and said i want to make sure preexisting conditions are covered. judge jeanine: how did he convince the freedom caucus to include preexisting conditions?

>> he said i'll gift governors of states the ability to opt out of certain essential benefitsen other mandates. but they will have to demonstrate the need not president of the united states that they have a way to take care of those with preexisting conditions. there is $108 billion in refundable tax credit to make sure people can purpose health insurance. judge jeanine: i think we have some sound from nancy pelosi. let's run it, take a listen. >> trump care destroys protections for preexisting conditions and not only that, it guts essential health benefits such asthma turnity care, pre2345eu9al and prescription drugs and emergency coverage. this goes on and on. judge jeanine: kellyanne conway says preexisting conditions are

covered. what is nancy talking about. david: preexisting conditions are not covered by this house bill. they give the states the right not to cover people with preexisting conditions. if you live in a state you are potentially in a position -- let me finish -- judge jeanine: you said you potentially are out. not that you are out. david: states are a choice to eliminate the mandate that you have to cover people with preexisting conditions. matt: that's not true. david: that's what the house did. that's what the house did. i think the senate is going to take up its own bill and it's not going to do the same thing as the house. it will try to protect people with preexisting conditions. the polling suggests the american people want preexisting

conditions covered. judge jeanine: matt, david says potentially it can be re-removed and eliminated. what do you say to that. matt: what david is confused at. this bill gives governors in states more flexibility about the insurance options for those folks with preexisting conditions. judge jeanine: what does that mean? matt: it means there is not a one size fits all way to take care of folks with preexisting conditions. the states are allowed just like governor walker has done with welfare. he has to couple his own system. and he has to demonstrate that those people will be covered. to say they are not going to be covered is simply untrue. judge jeanine: david, you can't deny everything is a mess and the insurance companies are opting out of the exchanges, premiums are so high people can't afford them. david: you were right to ask matt what does that mean?

narrative. judge jeanine: if the president put a billion into the issue. why is it not something the republicans are able to take hold of the narrative? you have the house and senate. why? lee: there is no reason why they shouldn't be able to own the narrative. nancy pelosi send out her five talking points. and those messages have been on repeat since friday. republicans were excited to get the bill passed. but they didn't get it passed with the support of what was involved tonight. starting tomorrow morning they need to get out there and say there are three things people need to know why this is better for the american people. so much of what people believe is what's covered in the mainstream media. and what is not being covered is

the republican talking points. judge jeanine: with this issue of the senate being able to start from scratch. do you think that given you have got portman on one ends. rand paul on another end. what do you think the chances are of preexisting conditions staying in the bill in the senate? >> i think there is a good chance they will city in the bill in the senate. that was one of the promises that was made. i think that's what the american people want. if we are going to see a big boost of supports for donald trump it would come down to that it's something that will go a long way to the support of the president and the republican senate. judge jeanine: we have a strong jobs report. we also have got stocks are up. we have record closing in

standard and poor's and nasdaq. how is the president doing in terms of coal? lee: he had a rough start. starting in syria and continuing this week with healthcare. we are seeing a stabilization in his numbers. they are not high. but it looks like he's in a good place right now to move things forward, especiallyf with tax reform going forward. one thing i thought was fascinating as i was looking through the numbers today. when you look at registered and likely voters who just voted in the last election. they are more likely to approve it's up to 5 to 6 points they are approvalling of him more than just average americans. when we are look at polling numbers. it's important you look at the kinds of people the they are
