"outnumbered" starts now. >> sandra: fox news alert, roger ailes, a television pioneer and founder of fox news has died. he spent much of his career advising presidents, including ronald reagan. he launched fox news in 1996 and changing the media landscape forever. howard kurtz is live in washington with more. at this news coming as quite a shock to many of us this morning. >> as shock to me as well. roger ailes had an undeniable impact in everything he did. he was a colorful and confidential character before he advised ronald reagan and he took richard nixon and helped get him elected through his use of television and 1968.

also going into the media business, founding fox news in 1996 and turning it into the powerhouse it is today. let me read a couple of statements. first from rupert murdoch. everyone is shocked and grieved his late wife elizabeth said i am profoundly sad and heartbroken to report to my husband, roger ailes, passed away this morning. it roger was my best friend, the most wonderful loving husband and father to her son zachary. roger was a patriot, grateful to live in a country that gave him so much opportunity to work hard, to rise, and to give back. roger ailes was forced out of fox news last summer amid a tangle of sexual harassment allegations which he denied and that's part of his record that

can be expunged. it's important as we look back on his life and accomplishments that he not be defined by that. he should get credit for many of the things he, polished >> sandra: many of us who work here today worked for him for years. he hired me personally and october 2007. we are sharing stories today. i remember the best advice he ever gave me was go on air and just be yourself. many of us are sharing those stories today. what was her personal story? >> i covered roger ailes for years. sometimes he got into trouble because he would say very strong things with colorful language. he hired me, despite the fact that i had been aggressive in covering him. he created the show, media buzz, and barely talk to me because he wanted to give me independence knowing that i would be covering fox news as well as the rest of the media world.

no secret that roger ailes and fox have a lot of detractors out there, but one thing people will miss about him is his genius and how he made everybody follow his lead. secondly, for all the criticism of fox by people who define it by its opinion commentators often on the right, he was a guy who connected with middle america because they felt they were not hearing their voice or their viewpoints in the mainstream media. as an outsider, he founded a channel. even his detractors have to say that he saw this opening in the marketplace for what he called fair and balanced television and a way that created fox and overtook cnn within five years. this is the machine that he built that will outlive him, unfortunately. so sad to talk about his passing today at the age of 77. the >> sandra: he said in a recent interview when he was

named media visionary. he was asked about his legacy and how he wants to be remembered. he said i don't care about my legacy. it's too late. my enemies will create it and they'll push it. he went on in that same interview to say my best talent is hiring good people come around me who can execute. i make a television producer. i miss the days of going into the studio and it just producing a show. i think that's really a point to point out. he had a competitive spirit that we will always remember. he always wanted to win, but he knew television from the ground up and loved every minute of it. >> he was a guy who would call the control room if he didn't like the shot or anything like that. at the same time, that was really true and not caring about his legacy because he knew -- he said to me, he would never get a feller fair shake. he did not care, he was proud of what he had built. he often said to me that if he had been a little bit more

#oneluckyguy, richard fowler. >> richard: hello ladies. >> sandra: so much going on this morning. let's get started. he is not holding back, president trump lasting a pointman of former fbi director, robert mueller to lead the federal investigation. along with "related matters. the president on twitter writing with all the illegal acts that took place in the clinton campaign and obama administration, there is never a special counsel appointed. this is the single greatest witch hunt of a politician in american history. the number two democrat in the senate, dick durbin with this reaction to the president's twitter blast. >> i would say to the president that he should get to know bob mueller as i do.

he is smart, he's principled, there is no doubt in my mind that he will put country first when it comes to this investigation. this won't be a witch hunt. follow effects. >> sandra: paul ryan had this to say just moments ago. >> i believe that the professionals at the justice department need to do their jobs independently, objectively, and thoroughly, and i believe the special counsel, which is robert mueller now, helps them do that. >> sandra: catherine herridge joins us live from washington. sma continues to break, where we now? >> a special counsel -- the work is done when an investigation by the justice department would present a conflict of interest or some other extraordinary set of circumstances. robert mueller can request

additional resources from the justice department. he can issue subpoenas, and access class what information and declassify it for public review. there is strong bipartisan support and a renewed commitment to the ongoing capitol hill. >> i am heartened by the news of mr. mueller's appointment, but in no way, it diminishes the need for congress to play an active role in helping to get to the bottom of recent events. >> the special counsel will set the direction and scope. one republican told fox this morning they want mueller to post contacts between the democratic national committee and the justice department. as you recall, the fbi warned the dnc that russians hackers

were targeting their systems months in advance. >> sandra: thank you. single greatest witch hunt. let's go to you first, richard. >> richard: i think mueller has a lot of credibility and i think the president yesterday, he was wise not to tweet. i would urge him not to tweet anymore, just let this investigation take its course. i think republicans did a great job today. focus on that and let this investigation take its course. >> elizabeth: he wiped out $3 billion and market value yesterday when the word was out that now republicans are calling for an investigation and impeachment. i think the markets are telling even republicans, get backbone. they do want tax reform, they want reform in washington, d.c. now we're hearing we're going to

be the white knights writing to president trump's rescue with a 400 million potential campaign to get tax reform done by the fall. >> meghan: if you think president trump has nothing to hide, a special counsel shouldn't be an issue for you. the problem i have right now as i think there's going to be an incentive to prosecute no matter what. if you are michael flynn, i would be lawyering up as much as possible right now because we know you've had some ties of some kind in the case of michael flynn, pre-nefarious ties to russia. one way or another, a head is going to roll. when it comes to getting legislative action done, is a terrible day for conservatives and republicans. the most cursory of problems he made to the american people and i implore him to staff twitter. it is terribly distracting, and makes you look guilty.

the impulsiveness of it is why we are in the situation right now. i'm not deeply concerned but i am concerned that we will not get anything done in the next year. >> sandra: if he doesn't tweet out directly, the media do something else with his words. here's what jason chaffetz says about the special counsel. >> i have not seen any evidence of actual collusion. where is the actual crime that they think they need a special prosecutor to prosecute? i haven't seen that. there's been a lot of flailing, but that started before january january 20th. the >> kennedy: he's absolutely right. i think democrats are rushing to try and turn this into a scandal. the difference here between watergate and what we are seeing developing for us every single day, and obviously changes,

where their crimes committed? that's something democrats are acting as though it's an absolute certainty, but unfortunately, i realize time is an important part of investigation, but in this day and age, with social media and the immediacy of news and news gathering, it's really hard for people to wait. i think that's something so critical. >> elizabeth: it can lead to a conviction. the context in general, the fbi said we are clearing michael flynn of any illicit activities and then in february, >> teen comey sits down with president trump. if it wasn't problem then, why would he announce it and set of whoever leaked it to the press making it a problem now?

>> meghan: there's going to be more selective leaking from comey people, people who want his reputation to stay intact. the problem that we are talking about, we are getting anonymous leaks from everywhere, mostly from people within the fbi which paints him in a certain place. the leaking is so unbelievably out of control. >> richard: this is why a special prosecutor is perfect because he can take all the politics out of it. he will have a chance to look at comey memos. he can make an assessment and a determination. i think more than just those three need to get lawyers. if you are in the white house and you have any involvement in this, you need to lawyer up quickly. >> kennedy: he needs to hire people who we can trust. the problem is, if he's hiring people he's worked with within the fbi, how much more weight they get? >> richard: i agree with you.

i said this on the radio this morning, democrats need to let this investigation take its course. if we turn to take it into our own hands, if we use committees to subpoena people, we can really destroy this investigation. >> sandra: a couple of hours from rod rosenstein, he will brief the entire senate. hit tomorrow he will do the same for house members and there is a whole lot on his plate among other things. senators will certainly ask him about his decision to appoint robert mueller as special counsel. the memo james comey wrote saying the president asked him to shut down the flynn investigation and of course, the memo rosenstein wrote himself that the white house initially pointed to as the reason the president fired james comey. >> i would like to hear exactly the rationale. i read the letter, why the deputy attorney general, in terms of why he had some real problems. >> do you think we've learned

what goes on inside that meeting today? i ask because you're living in a town that's filled with leaks. >> there are many secrets in this town. my guess is what's said in that meeting will be made public eventually. >> sandra: what you expect we will learn today? >> elizabeth: nothing. we'll have leaks. that's the problem. that will drive the narrative. i want to see evidence, i want to see facts. my thoughts and opinions are facts, that he is to stop. may 3rd, james comey testified. he said we are told to stop talking for political reasons. there is all this conflicting information i'm glad robert mueller is on the case. i do agree to stop the tweening because you're setting yourself on fire and her credibility is shot. >> kennedy: tweet about health care and tax reform.

the most important thing is to stand up for americans, talk about that. there are plenty of people who would love to engage about those very subjects. >> richard: that's one thing he should learn from clinton who did that. he pivoted and talked about everything else. >> sandra: we have a fox news alert, a breaking story. we are getting word of a car plowing into pedestrians and a very crowded neighborhood of manhattan. david lee miller is on the phone with us right now, he's got the story, what is happening? what did happen? >> apparently, a car plowed into people in times square. the area is a shutdown. there is a vehicle that is on some type of median on the corner of 45th street and broadway. it appears that this vehicle was probably heading in a westerly direction on 45th street and into "new york times" square. a very busy area.

it's not clear exactly what happened here. whether it was an accident. we are getting wire reports that as many as ten people are being treated for injuries. the new york city police to and fired a partner on the scene. it seems to be under control. the vehicle, very badly damaged, hitting some type of a median. i'm about 30 30 meters away frm the vehicle. it appears to be on two wheels. the other two wheels are in the air. the car was probably airborne at some point, by looking at what remains of the scene. the question now for authorities is to figure out was this an accident or was this a crime

scene. i do not see the driver here. it appears to be a bicyclist who is being handcuffed and taken away by authorities. he may have been interfering with the investigation. it is not clear if he was in any way connected with what happened here. as of this hour, "new york times" ," times square completely shut down. pedestrians are behind the barricades. the areas roped off as authorities are trying to figure out exactly what happened. >> sandra: if anyone is just tuning in, we are word of a vehicle mowing down pedestrians in times square. globally, this is the center of the world. this is a very warm day in new york city, the crowds are out. this is an extremely normally populated area. here is the new video of the car

that david lee just described. it is open, it is completely sideways and it appears to be on the sidewalk. at some of the individuals you just saw, this neighborhood in times square, 43rd street and broadway, just outside of nasdaq. you may have seen it in the background there. this is the new image of the vehicle that apparently mowed down pedestrians on a populated sidewalk in new york city. on the right side of the screen, you can see onlookers as the situation is developing. we don't have any further details on the driver, number of injuries, victims and any of this, so we will bring this to you as it happens. david lee miller, we are seeing right now, police officers are searching the vehicle, opening doors, anything else that you are learning at this moment? >> police are still trying to figure out what happened.

the fire department is on the scene here working on this vehicle, trying to ascertain what happened leading up to it. there are now in the back of the vehicle. right now, i'm watching police bring in a stretcher, although it appears that all of the people who were injured have now been taken away and have gone on to a hospital. we are getting reports that one person in connection with what happened here is in custody. not clear if that is the driver. i do not see anyone being detained here at the scene by authorities. to give you a little time text, this is a very busy area of new york city. it is a very warm day, people are out today, enjoying the nice weather times square has many pedestrians, zones that were recently designated for pedestrians only. this is an area that was teeming

with thousands and thousands of people when this vehicle careened into some of the new yorkers and tourists were out here today enjoying the nice weather. one other thing we are noting here, i don't know if you can see on the video to get a sense of what's happening here, it appears to be a tour bus that is blocking part of broadway and 45th street. all the occupants of this bus, they have been removed. it gives you a sense of the degree of paralysis here in midtown new york. just a short time ago, this was an area where people are living their lives, enjoying a nice day. now it has come to a grinding halt. still too early to tell exactly what happened. >> sandra: we also want to share with you the news that is breaking on reuters right now.

they're reporting that witnesses are telling their reporters at the vehicle drove against traffic, onto the sidewalk, striking pedestrians in new york city's times square. we are starting to get some eyewitness accounts of what went down there, but we still don't have a lot of detail as far as what led to that vehicle, it appears to be a maroon sedan, to leave it hoisted onto the sidewalk there. we are waiting to get more information. as you can see, there are police and amulets officials on the ground there. we see them searching the vehicle, we don't know yet if the driver of that vehicle is in custody. >> the driver is not reportedly in custody. i'm taking a look at the car. you mentioned that it may have been going against traffic. that is very possible, but if you look at the way the car's

position now and you look at the flow of traffic, there is a possibility that this car was heading with the flow of traffic in a westerly direction down new york's 45th street, crossing the intersection of broadway outside of a watch door and that is where it came to a very abrupt stop after hitting as many as ten people. ed may have been going in another direction. we don't know what happened during the impact. it appears to have become partially airborne, and ed may have been feeding along 45th street. we have to emphasize, this is an area that is filled with people, but vehicles as well. it's difficult for a car to go more than 15, 20 miles an hour here. this car was going much faster than that.

it appears to have been intentional, but i don't want to speculate right now. the traffic and times square is notoriously horrible. for any vehicle to get up to this much speed, you have to ask what happened here? >> sandra: to give you an idea what you're describing, how difficult it is to drive very fast through times square, there's always a lot of traffic, a lot of pedestrians. just some facts about this neighborhood. by the way, we are sitting in it. we are a couple blocks away from there. more than 300,000 pedestrians enter the heart of times square each day. you're kind of the high season right now our kids are finishing school. in april 2017, 360,000 daily visitors. >> i'm with a man, you saw it happen?

he was heading in the wrong direction on broadway. >> sandra: david lee miller is getting an eyewitness account. >> apparently that eyewitness, he said it was coming in the wrong direction, against the flow of traffic, heading northerly on broadway. that would be against the flow of traffic. is now resting in a westerly direction. apparently, from what that witness suggested, this car

seemed intent on inflicting some type of damage here. that's exactly what happened. we don't want to jump to any conclusions. it's difficult to drive in the wrong direction on broadway. >> sandra: the fire department just tweeted out that 13 total come of the new york fire department has tweeted out that 13 total patients currently reported at the scene of a motor vehicle accident and times square. that is the very latest from the new york fire department. >> i'm going to get in front of our camera right now and try to get a better sense of what's going on as i stand before the camera on this corner of 45th street and broadway. i don't know if you can see my picture yet, but over my

shoulder off in the distance, you should be able to see the vehicle and where it is now positioned. at least seven or eight new york city officials are scrambling, but no word. all the ambulances seem to have left times square. traffic remains at a halt. not just here, but in all the areas surrounding midtown manhattan. again, an extremely busy area. this is the theater district, people come here not just to see all the neon signs, they come here to buy theater tickets, they come here to enjoy the restaurants. no doubt, this has been one of the busiest times of the day. >> sandra: david lee miller, thank you. we are still waiting on a lot of

details about what exactly has gone down here. as you can see on the bottom of your screen, that is a maroon sedan. the news just breaking a few minutes ago that this accident of some sort, we don't know if it's an accident or intentional. we have no details on that, but we do know that multiple eyewitnesses are reporting that this car drove up onto the sidewalk and a very busy and populated times square. it is now hoisted against a pole on the sidewalk. multiple pedestrians were mowed down in this incident. 13 people are being treated for injuries after all of this. no word yet on what is happening with the driver of this vehicle. again, if it was intentional or an accident, we are waiting on reporting to come out of the scene. right now, eyewitness accounts do say that the car was driving and the opposite direction of traffic. it could be an accident, we

don't know. emergency vehicles and personnel are blocking off the entire area of times square they are. you can see fire trucks, ambulances are present. as we were just reminded, this is an extreme the busy time of day in new york city. the noon hour eastern time and many kids out of school. tourists are there. it's an unbelievable scene to see times square shut down. >> elizabeth: we are hearing that a number of buildings are now in lockdown. people are in lockdown mode and it should be pointed out that former mayor, michael bloomberg, times square went through a major security upgrade, about $40 million was spent. to make it more pedestrian friendly, but also more secure. were talking cameras, we're talking -- this is a concern for

officials to keep times square safe. that's been the focus for a number of officials. >> sandra: all of the nypd -- all they put out so far, they say a vehicle collision with pedestrian injuries, emergency vehicles are in the area of times square, expect delays in the area. at say for sure. they've got this area on lockdown. you can believe that there is a serious congestion. >> richard: we are also getting words from andrew comeau that he's in route to times square. >> meghan: i walk through there every morning on my way to work. i have these moments, snap chatting or putting it on my instagram it's amazing that it's been so secure for so long.

>> kennedy: there is a lot vehicular traffic. on all parts of the world, tourists were coming to take pictures, but you have people come along lines of people waiting to get broadway tickets for tonight's show discounted. add to that, you're getting people who are going out to eat in these massive skyscrapers right in the middle of midtown manhattan and that they are outside at the lunch hour. it's really a testament to the nypd how quickly they respond to things like this. we can't jump to conclusions and talk about intent or anything like that. you do look at some of the terrorist events all around the world and you see how vehicles have been used in the past. it's such an easy device. there is nothing at this point that suggests it's terrorism, but you do see how quickly -- >> sandra: the department got

a phone call of a motor vehicle accident on west 43rd street and seventh avenue and reports of multiple people, pedestrians being struck. the fdny so far has reported 13 people are being treated. they would not confirm if anyone is dead as a result. want to bring in david lee miller. were you able to get to a camer camera? >> i am on the ground. i have been on the ground, but we didn't have a camera crew in place. now over my shoulder off in a distance, you can see this maroon car at the intersection of 45th street and broadway. this is the flow of traffic here. you can also see that this vehicle is in a westerly direction.

this is a pedestrian mall. traffic is no longer allowed in this area and that may account for the number of people who were struck. the fire trucks are facing south, this vehicle was heading against the traffic. it's very hard to do that by mistake. i have a woman here who is a witness. can you describe for me what you saw? >> we were in that area and we crossed the street and we were halfway down the block we heard a big crash. we turned around and saw people running from the scene. we went running back we saw people laying on the sidewalk another block with crowds of

people around trying to help them. we also saw there is a ticket person who is down on the ground and there were cops all around him. he was injured. we are standing on the corner, the car started on fire. we got many pictured. >> did you see someone lead away? >> we did not. at that time, our backs were to the crash. we heard different stories, but we do not see anybody getting out of the vehicle. >> how serious were the injuries? >> we didn't see because there are so many people around that it was hard, but you can see clumps of people down the sidewalk with people trying to help them. i saw the great line ticket person laying on the ground. we couldn't see how injured he was.

he wasn't moving very much. we don't know the extent or how may people were injured. >> before it happened, did you see it moving? >> no. we did not see the actual accident happened. >> is the car on fire? >> after it hit, we saw people running away. we turned around went back to the corner where the firetrucks work. there were flames shooting out of the hood. the police made us get back a block. you could see flames shooting out of the front of the car. >> how many people did you see injured? >> i didn't see how many people. we saw people laying on the sidewalk with people trying to

help. i don't know, like i said, there were crowds of people on the block before hand. >> thank you very much. we're glad glad you are all right. unfortunate, as many as 13 people were injured. we have another eyewitness here. >> were live on fox news channel. use of this incident as it happened? >> after it had happened. my wife and i were taking pictures to post on facebook. we turned our backs and started to walk away. we got about a half a block away when he heard the crash. as we turned around, pedestrians were running in this direction is what we could see.

as he walks closer to the automobile, we were taking some pictures before the fire started. you can see for groups of people lying on the sidewalk or other pedestrians were trying to offer assistance to them. to the right, and front of the crashed automobile where the firemen are standing now was a greenline salesperson kneeling on the ground next to what appeared to be a victim and to law enforcement officers. they seem to be alone. shortly after that, the automobile started to smoke. that's when the law enforcement officers were trying to clear the area. before we got more than half a block away, the automobile caught on fire. the fire department was already on scene. we took pictures of everything. the fired apartment put out the smoke and about 13 minutes after

that, the news crew started to show up. >> did you see anyone who might've been the driver? >> we wouldn't be able to tell who was driving. >> anyone arrested? >> we saw someone being arrested, but it was a bike messenger. there were several persons trying to get through the area and the lawn law enforcement or were trying to get through. i'm sure the person was obstructing and it had nothing to do with the accident itself. >> did you hear the actual collision? you didn't actually see it, but you heard it? >> yes, sir. >> can you tell us how fast this vehicle might've been going? >> i would have to imagine that the vehicle is traveling more

than 30 miles an hour. the traffic is quite congested. to hit people and to be catapulted up onto there, it had to have easily been exceeding the speed limit. this b would only be a guess. he would have had to be speedin speeding. we are kind of baffled on how it got so high on the pole itself. >> according to reports, it was going the wrong direction. the >> the automobile is traveling north. >> which is against the flow of traffic. how serious were the injuries? >> i can't tell you that. i couldn't tell you if they were men or women, i couldn't tell

you if there were male or female, i couldn't tell you much about the groups of people who are were around them. i could only tell you there were people lying on the sidewalk. that's about the best i can tell you. >> thank you very much. he appreciate your accounts. let me get back in position. this vehicle was heading in the wrong direction against the flowchart stomach the flow of traffic. a rammed into nearly 13 people at a pedestrian mall. one thing i want you to take a

look at. you can see that barriers have been set up here. these steel stakes are designed to keep vehicles away from the pedestrian areas. somehow this vehicle tried to make its way into this pedestrian zone. as i look at the vehicle now, if we can zoom into it. i believe the car is being propped up on one side because it's resting on one of those steel stakes that are designed to keep it away from pedestrians to keep people safe. unfortunately, it was not entirely successful. >> sandra: david lee miller on the ground for us. we'll see you in another minute. right now, we are going to pause for one moment to let our fox stations join in.

a call came into the fire department of a motor vehicle accident at 43rd street and seventh avenue. this is a neighborhood that is times square in times square. the nypd confirmed one person is in custody. they're not saying it that is the driver, but that is what they are reporting. the fire department again moments ago confirming one dead, 12 injured in the incident. this is the area and it's hard to imagine times square and complete lockdown. it's extremely populated, it's a beautiful warm day in new york city. it's hard to imagine all of this happening. david lee miller is on the ground. >> fox news is getting information that there is one dead confirmed.

these numbers are changing as they so often do in a situation like this. to recap, it does appear that this vehicle was trying to enter a pedestrian portion of times square. this may be an accident, it may be something more sinister. if you take the following into consideration. zoom into the vehicle and you can see, this is significant that this car is now resting on one of what appears to be one of the metal stakes or poles that are used to prevent any type of vehicular traffic from entering this pedestrian zone. if this is what the driver

intended, that's why there are so many injuries. also take into consideration the fact that it was heading in the wrong direction. those two factors are what authorities will have to consider. the car was heading at a relatively high rated speed, over 20 miles an hour and a very congested area of new york city which is difficult to move at all. it was moving against the flow of traffic and the car, apparently struck a pedestrian barrier designed to prevent these types of injuries. at this hour, it appears that all of the internet been taken away. midtown manhattan is completely frozen. not just this area, but this is a major intersection. you can get a sense of what is unfolding in the very heart of new york city on a beautiful thursday afternoon.

an area that would normally be teeming with people to enjoy the nice weather. tourists as well as new yorkers has now come to a grinding halt. the pedestrians on now behind the police barriers. now i'm getting an updated figure on the number of people who are injured. now we are told that figure has been put at 12 people. 12 people injured, one person confirmed dead. no information at this hour about the driver of this vehicle. we are told he is in custody. no mention of his identity or where he has now been taken. was he possibly injured when this car hit the steel pole and finally came to rest? it we heard one of the witnesses say that a bicyclist was arrested and taken away.

incidents. surrounded by skyscrapers, full of new yorkers pouring outside for lunch time. there is one report that this was a troubled man, possible dui. he is being tested for alcohol consumption. that driver is in custody. one nypd source saying it is not a terrorist incident, but someone who apparently became inebriated and drove his car the wrong way up broadway and nearly completely flipped over, running into one of those barriers. they are meant to protect pedestrians. a former nyc mayor, michael bloomberg tried to bolster security. obviously, because of the high-profile nature of times square, ed is even more a magnet for people who want to do

something. >> sandra: the new york mayor was an route to the area. he is on the ground as well. he is briefing people on the incident. in addition to the fbi, confirming they are aware of the incident, they can't conclude anything as of yet. there is a picture of the governor being briefed on the ground by police officers. we are also hearing that the crowd was being moved and that is important because on the left side of the screen, we are still looking at the vehicle being wasted on the sidewalk after mowing down a pedestrian and it is still actively being searched. they are clearing the area. we are joined by a former nypd detective who is on the phone with us who knows a lot about things like this unfolding. pat, what can you tell us about what we are seeing right now? it does appear that they are searching the vehicle, although they have the driver in custody.

>> what they're doing right now is dealing with a very serious crime scene. they're trying to identify what may have been the motivation, whether -- even ascertaining that it may end up appears to be a perpetrator, a 26-year-old bronx male who has two previous driving while intoxicated. and it is not an active terror, but an act of drunk driving. and a nightmare. as you know, i know the area like the back of my hand. to drive seven blocks north on broadway is really a terrifying and astonishing feet. the complexity of it is terr horror show. it could have been exponentially worse. >> sandra: what we know right

now is one person is dead, 12 others injured, although there are reports that there were many others, many more than that injured in all of this. this all happened at about noon. can you tell us a little bit more about what happens now? they've got someone in custody, what is the process by which they're going to go about determining if this was an accident or intentional? >> here's how it goes from here. now you see the extremely robust and while running machine of the nypd's investigative apparatus kicking into gear. along with the terrorist apparatus. they will decide who is individual is. they will do a deep dive on his friends, acquaintances, ml, past involvements, claims to allegiance, if any and who exactly he is from both his kind are garden maiden names to what he had prerequisites morning. that's extremely important to

things being taken out of the vehicle now? >> that's right. just to give you a sense of where i am. the police have moved us back to full blocks. where in west 47th street. the car is on west 45th street. a few moments ago, it appeared that the authorities removed a box of some type from the back of this vehicle. the sniffer dog was by the vehicle. it did not appear to be working, but authorities are concerned that they may be something in that car that could pose a threat, and it looks like they did take something away from that car. this is still very much an active scene, even though it appears that all the injured have now been taken away by ambulance. it looks like for the next several hours, this part of new york city is going to remain completely paralyzed. this is arguably the busiest

intersection in new york. to those who have visited the city, this is the intersection of 47th and seventh avenue. it appears the tickets both. you can hear the officer on his megaphone instructing people to move further and further away. what's noteworthy again, this incident happened a few minutes before noon. it has now been roughly one hour. and has roughly now been one hour since this car plowed into a number of people, as many as 12 people. one person confirmed dead. one hour after this incident, authorities are moving pedestrians back an additional

block. police are now herewith megaphone. i'll let you hear what they're saying. there may be out of camera range, but they are warning people to move it further back. now i'm getting a report that investigators at at the car removing from the trunk that box i described, cds, jumper cables, essentially everything in that car. the vehicle is described as a honda accord. as you can see, the car was extensively damaged. the front and extensively damaged. witnesses tell us that the car at self burst into flames after this incident happened. there is a still more work to be done. >> sandra: david lee miller, reporting for us on the scene there. we want to update you on what we are hearing from the nypd. one person is confirmed dead, they have no raised the number injured to 13.
