neighbor, this guy grabbed a gun and came over and shot the dad twice in the back and the dad is dead. does she have a case? >> let's talk about the most crazy case i've heard in some time. justifiable homicide is when one person kills another because they reasonably believe that that level of force was necessary to prevent from that person from killing or injuring another person. that's very intensive. as we look as the facts as we know them, this appears to be justifiable homicide. freeman ran over to the house and saw the most disturbing image, two infants being drowned in a bath tube, the mother was being held by knife point. he had to make a split second decision and use deadly force to meet deadly force. jackie: i found it interesting that we brought over the gun, i think that's probably the biggest issue that he has to deal with, that he had a gun, right? >> image the 12-year-old, the

mother's niece told them what the situation was and prepared himself. the question now is was he justified in actually killing foster, many people are saying that he probably could have threatened him with the gun, told him to stop but when you're in that situation and you have a split second to make that decision, who knows what he should have done. three people were saved. this could have been a quadrupled homicide. jackie: what kind of charges could he face this morning? >> it's tough for me even say, but if the district attorney decides to bring charges, first-degree murder, voluntary manslaughter, heat of passion when he saw the situation, the district attorney has to preserve the interest of justice but they're also political and they're not going to bring a case unless they they think are going to win and it's hard to find a jury that would side the with father who was drowning his two children and not see this as justifiable homicide. jackie: he has a history, back

in 2011 he was charged with domestic assault and arson. a guy that was known to police and maybe known to the neighbor and that's why he grabbed the gun -- >> terrible situation when the two children grew up is not going to believe the story. in the end, i'm happy that the mother, the children are safe and it's not a great situation anyway you put it but it could have been much worse. jackie: thank goodness there was the neighbor. what could the mother have been done justified to save herself? >> basically gives people the right to use deadly force in defensive situations particularly in your home and this gentleman ran into the house and disturbed their peace so she would have been justified in killing him herself but she was put in situation where she shouldn't do anything. jackie: the 3-month-old babies are doing better, the mom, everyone involved in terms of victims are good. that's a nice outcome.
