reporter. we go from issue to issue. let's begin with the number one issue. this is something you were talking about on your show yesterday. steve: james comey yesterday at 10:00 in the morning went into that famous room 216 in the heart office building where essentially he started two and a half three hours worth of some have depicted it as james comey's revenge tour. what it was revealed was he said that donald trump appears liar. but then it was revealed that mr. comey himself is a big leaker in this exchange. listen. >> the president tweeted on friday, after i got fired, that i better hope there's not tapes. i woke up in the middle of the night on monday night because it didn't dawn on me originally that there might be corroboration for our conversation there might be a tape mile. judgment was i needed to get that out into the public square. so i asked a friend of mine to share the content of the memo with a reporter. i didn't do it for myself for a variety of reasons but i asked him to.

i thought that might prompt the appointment of a special council. i asked a close friend of mine to do it. >> was that mr. whiteus? >> no. >> who was that? >> a good friend of mine a professor at columbia law school. brian: that was pretty shocking. i was stunned. to me by the way i have explosive story that i'm going to say on same level. harris: important detail is the friend. if you are in trouble, this is the kind of friend you would call. this wasn't just any friend. chief appellate attorney for the u.s. attorney's office. he has actually been an expert witness testifying before congress and hearings numerous times. he is a consultant to the doj. not just a law professor, they worked together until 2013. he and comey say they have a past professional relationship. this is not just any friend. he would have connections to the media. he would know how to get out a message. this is not like hey i'm going to phone a friend and

you are going to help me win some money on a game show. this is the resul result manhattan. thiresultmanhattan. the chances that he feels comfortable going to the names to get his story across a lot of things makes sense. makes you want to go back over the last two years and see what else turned up in the "new york times." has anonymous sources to the investigation. now you find out for the first time through that, steve, there was one on one memos from his one-on-one interactions with the president of the united states. steve: as james comey tries to prevent himself as the last honest man in washington, d.c. kept a secret file which some have depicted as insurance policy so he could keep his job. there are instances yesterday where he depicted where he did something and we are going to talk about it a little while during the last administration essentially to keep his job.

sounds like he went along with some stuff he was uncomfortable with to keep his job in this administration. harris: there were a lot of moments during that hearing that popped that got heated. one stood out and that was with senator marco rubio. he pressed him. brian: smooth and measured. harris: measured. there was one thing that actually didn't leak. it was a pertinent piece of information about how president trump was actually not under investigation. somehow or another, comey managed to keep that quiet. brian: let's listen. >> the three requests were number one, be loyal. number two, let the michael flynn thing go and number three, can you please tell the measure people what these leaders in congress already know that i'm not -- personally under investigation. >> those are the three things he asked, yes, sir. >> this investigation is full of leaks left and right. you ever wonder boy of all the things in this investigation the only thing that's never been leaked is the fact that the president was not personally under investigation despite the fact that both democrats and republicans and the

leadership of congress knew thanks i don't know. i find marries leaked to the gang of eight are pretty tightly held in my experience. brian: that has nothing to do with it a couple of things, too. the earlier report earlier in the week that the president was going to have, the fact that he said three separate times james comey to him that he is not under investigation, that was going to be debunked yesterday. that didn't happen because he actually was told at least throw times by james comey that he was not under investigation it just seemed like a president to try to say, listen, i'm just trying to get a gem to pass. you can tell everyone i'm not a subject of this so can i start moving things through washington? harris: what was interesting was the texture of who james comey became as he talked yesterday. he wanted us, i believe, through his words and actions, believe he was the victim. i'm not captain courageous. i couldn't stand up to president trump. brain brian that's the only consistency thing he never stands up to everyone whether is he loretta lynch or the president. he thinks it and doesn't say

anything. harris: i kind of backed off on that moment. steve: just a little bit. he revealed he leaked this stuff through the guy at columbia university law professor in hopes that they would come up with a special counsel and a couple of weeks later they absolutely did. what's interesting on may 3rd mr. comey was up on capitol hill. he told charles grassley, the senator from iowa oh i have never leaked anything secret in my life. what's curious, brian, one of the online blogs went back and looked at the deep state leaks that have come that have damaged the trump administration. out of the 39 deep state locates, i think it was about 10 of them related to jim comey. so you have got to wonder whether or not jim comey was actually the source of it. we don't know for sure. only jim comey and the reporter knows for sure. after he revealed yesterday in public, you have got to wonder why we reveal that suddenly yesterday? is it the fact that it's

been b. to be unveiled? harris: i don't believe anybody in this scenario is doing anything coincidental. i know you just mentioned loretta lynch. i was reading but online, you actually forecast this is where we would be with james comey that maybe that information, that we have learned about those conversations inside the oval office might have been coming directly from him. brian: yeah. essentially we just read everything and seems so succinct and so detailed know noe way that's going to get in the "new york times" unless james comey okayed it and certainly he did through a professor at columbia. >> steve: brain did, james comey release that information to you? thanswer. yes or no. brian: special thanks to media for putting that in there. i just would like to add this. i do know new news to me at the time, when he come out and talked about loretta lynch and he said loretta lynch i had a little problem with her because i asked to get cleared to give my

testimony back in 2015 and about hillary clinton. he said yeah, i don't want you to call it an investigation. and he said really she says i want you to call it a matter. steve: in fact, we have got that exchange right here with senator james burr. >> at one point the attorney general had directed me not to call it an investigation but instead to call it a matter which confused me and concerned me. it gave the impression that the attorney general was looking to align the way we talked about our work with the way political campaign was describing the same activity, which was inaccurate. we had a criminal investigation open. harris: all right. so to get on a record a source familiar with loretta lynch wanted to respond to that discussion and did so this way. no one,including the director, contested that view. it didn't take long to say that. steve: that they called it a matter. if you remember back in the time there was a story, i think it was in the "new york times" where they referred to the fact that james comey was not the director of the federal bureau of investigation but the je'kel was he was the direct of the director of

when you think of the southern border, i mean, it's the perfect place. have you sunlight there more than any place else in the united states. so it's the perfect place for a solar. this in fact would be a border barrier with a solar farm. steve: stretch sea to shining sea or couple hundred miles here and couple hundred miles there. >> we believe if you take the critical hot spots where the crossings are occurring. if you did 300 miles you could 80% of the illegal crossings. such as human that, el paso, del rio and el centro and build out from the border crossing 30 to 50 miles each direction east to west. the rest of the patrols could handle from land and air. the rest of the monitoring. steve: this is infrastructure week at the white house where the president has been talking about fixing everything.

>> she has continued to talk about that. a lot of the people want to hear what else went wrong. we talk about that in this book. there were problems with message and that they were data, and didn't have -- they didn'mix in the art with the science. that was something that bill clinton -- >> harris: i want to talk about that whole idea of facts and evidence and all of that i'm not going to ask you who you talked with you about i know you talked about just about everybody around hillary clinton. was there ever a thought that at some point we are going to have to show some evidence of collusion here. anybody got any of that? anybody? >> they have continued to make that point. but what they did is they failed to make that point during the campaign. they had an opportunity, particularly after one of the debates when they focused on alicia that chad dough instead of making the case that 17 intelligence agencies had talked about collusion. that was a problem. there were missed opportunities there.

steve: it's seven months later and mr. comey said yesterday on his last day with the fbi there was no evidence that there was collusion between the russians and trump. >> he does make this point and he says let's, you know, it was definitely out there. i think he uses the word buzz and says i don't want to leave. brian: john podesta emails reveal the inner workings of the campaign certainly hurt. now let's talk about the revolutions of 20150 and attorney general loretta lynch who evidently meets on the tarmac by some happenstance meets with a reporter by bill clinton. we find out yesterday or reaffirmed yesterday that james comey said i was told bylor let that lynch along with a whole group of people don't call it an investigation. watch. >> we were getting to a place where the attorney general and i were both going to have to testify and talk publicly about it i wanted to know was she going to authorize us to confirm we had an investigation she said yes, buy don't call it that. call it a matter. i said why would i do that?

and she said just call it a matter. it gave the impression that the attorney general was looking to align the way we talked about our work with the way political campaign was describing the same activity which was inaccurate. brian: rambling behind the scenes, how significant. >> pretty significant. massive revelation. i think it gout battered from the broader trump news yesterday. it's quite a story. consternation inside the campaign particularly after that lynch-clinton moment on the tarmac. even at the white house, obama aides were scratching their heads saying we are senatorrer than. this. brian: what were you thinking? >> it was a bad moment for the campaign. >> harris: what was interesting. even supporters of the campaign said that might have been a tipping point. one of the biggest moments when bill clinton and loretta lynch were on that plane on the tarmac. >> we still talk about that. on the book tour that's one of the biggest questions why didn't they see that was a problem?

miscaucus. they wermismisscalculation. yes she won more votes. she won the most seats but not enough to form a majority. nevertheless, she is going to try and do just that which is why she is on her way to buckingham palace at the moment. the conservatives won 319 seats. and labor 261. with a smashing other parties winning the rest of them. theresa may called the election because she wanted a personal mandate. that has absolutely back fired. and already there are questions about how long she can stay as prime minister. though she has announced that she will not resign. >> at this time more, than anything else, this country needs a period of stability. and if, as the indications have shown, if this is correct, that the conservative party has won the most seats and probably the most votes,

then it will be incumbent on us to ensure that we have that period of stability, and that is exactly what we will do. >> she may have won the most seats, but it was supporters of jeremy corbin the far left leader who was celebrating this morning. though it is looking very unlikely that he is going to be able to form a government. >> if there is a message from tonight's result is, is this. the prime minister called the election because she wanted a mandate. well, the mandate she's got is lost conservative seats, lost votes, lost support, and lost confidence. >> but very much a fluid situation at the moment. and the fact that theresa may is on her way to buckingham palace does suggest she is going to try to form that government. we suspect that is going to be in partnership with the northern irish unionist party. they hold 10 seats so combined is going to push them just over the amount. again, whether or not she can survive in the long term is a different thing. of course it raises many

questions about the ongoing brexit negotiations and value of the pound at the moment. back to you. harris: before we move on, they tried to cobble this together and bring government into a stable position, what does it mean for brexit? >> well, the dup is one of the few parties that has actually tended to agree with conservatives on brexit. hard brexit is seeming less likely the irish party have a border with ireland. only part of the u.k. that does. they want free transport across those. so that's one thing that's going to change and the market is really resounding because they were afraid of a hard brexit. we might see a much softer brexit now. now all up in the air. steve: indeed the pound -- brian: benjamin hall, great job. even if do you get a government. how can you govern? so hard to get anything done with something so brokered. harris: you mean it's divided?

something i saw was kind of somatic. you saw the white house jumping out in front of the hearing asking for support from republicans. we saw steve rice. we saw from marco rubio. it was crickets out there outside that room. why is that among republicans. >> harris, i noticed the same thing yesterday. typically at a hearing like this you will ask question and pound the table and state a conclusion. defend the president. >> they didn't do it. here is why. it's the president's fault. the president has given republicans pause before they jump into the fox hole. in parlance because is he not very popular. his numbers don't give confidence they can defend him and some of his tweets. the message president has got to get if he wants people in his fox hole don't make it hard for those people. the two tweets about barack obama wiretapping trump tower and then the tapes about comey give republicans on the hill pause. they are not sure thowf go to defend him. they want to defend him. they should be pounding the table. it's important for the policies to get enacted that

the president be successful. harris: but the president is on the line here. a lot is at stake. i get all that maybe you are not going to always agree with him and saw what the establishment did in the run-up. they ran away until they had to come to the table with this president. >> right. harris: i get all of that. had you had an opportunity with james comey saying i'm a weakling. i couldn't stand up to the president and loretta lynch. the tweets wrote themselves. press releases wrote themselves. >> bowl was on the table to come to the defense of the president. the point here is having been in the white house. if it gives them pause. they are plirgses they will weigh both sides and judge how far should i go? brian: they don't want to be contradicted. >> my message here is the president can create more allies. he should create more allies. but he has got to be more judicious about what he treats and how far he goes. steve: they are all in the same fox hole together. ultimately with the midterms and every member of congress is going to be -- is up for election. they hope to be reelected.

you know, if they don't get stuff done, you know, if tax reform. doing something about the affordable care act. it's either they hang together or hang separately. >> i agree with that what makes a politician a politician is they decide if they want to jump in a fox hole with you. you want to create environment want to jump in that fox hole. you have to earn it. politicians never give it. brian: james comey came out and stunned me by saying yeah i leaked that the "new york times" to a surrogate you can find him at columbia and go send it in. makes you wonder what else is going on. also his private notes which ultimately might be government property. steve: are. brian: never turned over to the senate investigative committee or the house intelligence committee. do you think the president should go in the direction of legal action for that? >> the very fact that james comey says he no longer has them are not personal. they are government property. harris: exactly. >> is he on thin ice here. i don't know because i'm not a lawyer. if i were the senate i would have pounded comey and kept

the questioning going. have you ever relied on. how many times has this columbian professor ever done. this how many other third parties outside the done it. they let him go answered needs to explain that. steve: the president tweeted this morning despite some false statements and lies complete vindication for him and wow, comey is a leaker. that really is very damning for mr. comey because he likes to presented himself as boy scout or last honest man in washington, d.c. >> right. steve: turns out how many times have we heard donald trump say the real story regarding russia are the leaks from the deep state that are out to destroy him. >> the president is right. he is not a subject of the investigation. with you that fact never leaked. that's troubling. two, there is no evidence of collusion. i understand why the president feels so strongly about this and wants to lift the cloud. if you know you never did anything wrong and the fbi is still investigating you or anybody. harris: and they have nothing. >> have you legitimate human desire and need to say it's not true.

somebody should make it go away. we all know it's not true. in the political realm, the president has to do this with discipline and wise approach. not just a smack them approach. harris: how do you turn the wheel? now you are going into the weekend with all these different narratives coming out of the hearing. the choice act happened with dodd frank and rolling back some of that in the house. that was one tweet that republicans could have -- i'm still beating the drums on why republicans aren't stepping up. and they have a weekend to do this. what should be next? >> the lesson is the clinton years, frankly. when all this noise was taking place in the clinton era. they got very good and smart announcing initiatives making news. harris: exactly. >> that's what president trump needs to do and keep doing. harris: and republicans. >> fbi director announced fracture he competes with himself. spread it out on the planning calendar, you are not going to win every day you will win more days than not. brian: more to do what bill clinton did. lanny davis answers all these questions. all my lawyers answer all those questions. if you want to talk about anything else, you know,

brian: 14 minutes before the top of the hour, former fbi director james comey wrote his memo employees about his meetings with president trump because he couldn't trust the president, for example. >> i was alone with the president of the united states or the president elect soon to be president. the subject matter i was talking about matters that touch on the fbi's core responsibility and that relate to the president -- president-elect personally. and then the nature of the person. i mean, i was honestly concerned that he might lie about the nature of our meeting, so i thought it really important to document.

brian: so andy pudzer. he joins us now with reaction to the testimony as someone dose close to the president. andy, you heard he didn't trust the president so he took some notes right afterwards and then leaked them to the "new york times." that's how he found out about it. does -- when you think of the term obstruction, does that come to your mind because have you a legal background, too. you are a lawyer. >> i would say number one, what you need to keep in mind is, this is a disgruntled former employee testifying about the boss who fired him. you have to look at his testimony in that con texas. secondly, is he a very, very live law enforcement official who wrote a bunch of memos. the only reason he would have written them is to cover himself later. when is he writing them, that's what he is thinking. this is to cover me if anything happened down the road. testifying against somebody who fired him. was there obstruction? look. number one, of the president denies -- the only possibility with obstruction was this mike

flynn him saying he hoped that he could. brian: see his way through to clear him. >> because there is no conclusion. with respect to the russia investigation, there is no obstruction. so those issues are dead. the only thing left is this mike flynn, number one the president says it didn't happen. number two, even if it didn't happen, i have to tell you as a ceo which is what i was for 17 years. if you call one of your subordinates in the office and want them to say something you don't say i hope you'll do it? you say do. this is not what happened in this discussion. this is not the way donald trump would have viewed that. no, there is no obstruction there. number three, even if he said what comey claims he said, allen dershowitz who is highly respected attorney. a liberal, a democrat said he had absolutely had the constitutional right to do this. the fbi director doesn't control the president. the president is in charge of the attorney general and of the fbi. they report to him. he is the nation's top law enforcement. not comey. brian: let me push back the

president cleared the room to have a one-on-one, number one. number two is he has been accused or the rumor is that he did the same thing with the national intelligence director saying come on put an end to the russia stuff. there is nothing there. would that complicate issues when robert muller goes through it? >> i think everybody, whether it was rogers or the director of national intelligence, what's his name -- begins with a c. >> couts. >> they never had pressure in any respect. the only thing there is this conversation between comey and the president that the president denies on flynn. one of the top legal experts in the country says there is no legal problem with that. brian: ari fleischer says get back to work. get the economy going. >> the economy is on fire and just not getting covered. 400,000 more people are working since the beginning of the year. last year. 600,000 full time jobs and 200,000 fewer part-time jobs. so they are better jobs.

that trillion trump has never been under fbi investigation, which we knew anyway. harris: almost didn't get out with many members of the media. john king, says this will probably get buried. it is not going to break the headlines. >> the reason being what we saw about jim comey last night. he is a leaker. washington leaker. he is the deep state. everything wrong with washington. self-promoting, taking memorandums he written, following meetings, i was so stunned, so shocked didn't know who to call. head of fbi, career law enforcement officer, so stunned by a private meeting, he initiated the first private meeting with the president. brian: he denies that? you mean in january. >> he asked for a private one-on-one meeting. this was standard operating procedure that the president meet with the fbi director one-on-one because jim comey set that agenda. steve: extraordinarily when you think about it, come to leakers, something like reality winner or somebody as low level.

now former director of the fbi be a leaker is extraordinary. a month ago under inquiry by chuck grassley, senator from great state of iowa, mr. comey said i never leaked top secret stuff. denied doing it through his sure row bat and talking testimony, this is he revealed he is as cory said a leaker, watch. >> president tweeted on friday after i got fired i better hope there are not tapes. i woke up in middle of night on monday nights because it didn't dawn on me originally, might be corroboration for our conversation. might be a tape. my judgment i needed to get that out in the public square. i asked a friend of mine to share content of memo with the reporter didn't do it myself for variety of reasons. i asked him to. that might prompt a appointment of special counsel. i asked a close friend of mine to do it. >> was that mr. witis? >> no. >> who was that.

>> a good friend of mine, a professor at columbia law school. steve: that good friend is daniel richmond, professor at columbia law school. special counsel as james comey when he was fbi director. do you follow his timeline, cory? do you agree with the timeline he gave? >> timeline does not add up, but what he testified under oath, he knew, jeff sessions attorney general would recuse himself from the russian investigation. this is statement he made on february 15th. i know jeff sessions is going to recuse himself from this investigation. jeff sessions did not recuse himself from the russia probe until february 2nd. two weeks full in advance. we also know "the wall street journal" wrote a story on march 1st. what it said, this hand-wringing at fbi how to get the attorney general to recuse himself because there is no procedure in place except public pressure. steve: corey, you're saying james comey the former fbi

director was making stuff up yesterday? >> i'm saying candidly, jim comey had information about jeff sessions and wanted jeff sessions removed from the investigation, he said so basically yesterday, wanted him removed, and timeline doesn't add up and comey isn't telling truth. brian: you're seeing on theme of leaking that the fbi director knew about the kislyak meetings, knew if that payment exposed, public pressure would be so great he would have to recuse himself. knowing he has it in the arsenal how do you leak it to the press. sessions is forced to own up to it, without telling the president he recuses himself which causes, eventually spurs special counsel. >> exactly right. harris: we don't know if that went through another friend. that wasn't just a friend, daniel richmond. he is so good at what he does as an expert has done it in front of congressional hearings. that is a special friend to call at 3:00 not morning. i want to move on from that. i want to talk about the

president and his friends, where you stand supporting the p in the situation. donald trump, jr. was only person tweeting yesterday. sarah huckabee sanders seemed to be caught flat-footed that the president wasn't a liar. you've been a messenger for the president when he was candidate. it is very frustrating? >> i'm unapologetic supporter of president to get his agenda done. what you have to understand the president is the best messenger. what we saw yesterday his attorney came out and said that the president has been vindicated by jim comey, reaffirming what everyone already knew the president has never been under investigation of fbi in any way, shape or form. very important to know. what jim comey said under oath the president is liar. jim comey has absolutely zero credibility left. this is person -- brian: every democrat believes him. >> this is amazing part, director of fbi "the five" years. his boss attorney general lynch told him not to speak about a certain investigation, call it a

matter but jim comey never had wherewithal or courage to report that to anybody? harris: coming out strong enough from the white house. brian: they're not. i want you to hear this. this is yes, ma'am comey describing why at six foot seven, probably 240 pounds, with a brand new president he didn't come forward to tell somebody how upset he was about the one-on-one meetings. >> why didn't you stop and say, mr. president, this is wrong? i can not discuss this with you? >> a great question. maybe if i were stronger i would have. i've seen the tweet about tapes. lordy, i hope they're tapes. brian: he didn't come forward. so upset jots it down but didn't come forward. >> it is very clear as government official, if you think someone asked you to obstruct justice, a obligation, duty, responsibility to report that. if you don't it is punishable by three years in jail. we clearly know there was no

obstruction of justice. president says i hope you get the flynn thing on its way. jim comey was not strong enough? director of fbi and wasn't strong enough to pick up the phone and call somebody. this is all politics. >> couldn't stand up to loretta lynch. >> guy is weak as can be. i'm glad the president fired him. he is swamp creature. everything wrong with washington. if he had been fired he should have been fired for leaking information. steve: the president's lawyer said donald trump never asked him for loyalty. what that would suggest is, maybe there aren't any tapes? >> maybe the tape, maybe there is not a tape. it doesn't really matter. brian: oh, it matters. >> i don't know the answer. i don't work in the white house. here is what i know. i know two people were part of that conversation. jim comey and president trump. what we saw yesterday, was jim comey has a problem telling the truth. look back at previous testimony in front of congress. he had to correct his statements then have hard time remembering what took place then. brian: called the president a liar. harris: nobody asked him to do

i'm actually somebody over the year who has defended director comey because i thought he was really, and i've known jim comey for many years. i don't know him well but i worked with him back in the 1990s, i always thought he was a good, solid person. this is so disappointing for me to learn that for political reasons he undermined this president, for his own personal gain. steve: it was after he got fired by this president. >> it doesn't matter. leaking information about a private conversation with the president of the united states, may be a violation, we're going to let law enforcement figure out if james comey broke any laws about that. but whether he did or not, in a time when this president is under siege by the deep state, by this bureaucracy that is permanent here in washington, by the intelligence communities, including the fbi, that are undermining his presidency and

trying to delegitimize him, at a time when that is happening, for former director of the fbi, to set an example for the rest of the government, to leak these types of documents, is, to me is devastating to jim comey and really harmful to our nation. brian: but, david, here's the thing, right now the democrats are saying what a great guy he is. it is wonderful and so believable. the president's the liar. however there is a different story about a few months ago, we caught most of it on tape. let's watch. >> we're all disturbed, first of all, by the letter which really broke precedent, was over the advice of leaders in the justice department. i'm not challenging mr. comey's motivation but i do think it was unwarranted. it was a mistake. >> he has got a big burden of proof so to speak on him for why he did what seems to be such an appalling act that goes against the tradition of prosecutors at
