>> julie: clayton is jump jiving over here. good morning. >> come on in. clayton: welcome in to "fox & friends." sandra smith back in this morning. you look lovely in green. sandra: thank you for having me back. i wasn't sure after yesterday. pete: she was a try-out. clayton: we talked about it in the afternoon you got in under the wire. sandra: i had fun. pete: break to vote with a third person. clayton was for. i was against. clayton: frankly no one else was up and awake and availabl available. jampacked show. sandra: big weekend of news and big week coming up on capitol hill by the way. pete: last week of course you had james comey testifying. had you president trump fighting back in the rose garden. now you have the white house continuing to fight back. they are saying attorney general jeff sessions will testify on tuesday of this upcoming week in front of the senate intelligence committee. he was set to testify in front

of the house and senate budget committee, but he will be sending his deputy to those and going straight to the very same committee that comey testified to set the record straight because there was a lot of accusations not just at president trump but at the attorney general as well from comey. clayton: absolutely because james comey said he didn't trust him. the fact he was going to leave the room. he gets up and leaves the room. let's listen to what he had to say this week about sessions. take a listen. >> are you saying that you also told him that he had made a request that you let it go with regard to part of the investigation of michael flynn? >> no. i specifically did not. i did not. our judgment, as i recall is that he was very close to and inevitably going to recuse himself for a variety of reasons. we were convinced, in fact, we already heard that the career people recommending that he recuse himself, he was not going to be in contact with russia-related matters. longer and that turned out to

be the case. clayton: response now from the trump administration over of the weekend saturday night. late last night making news in washington. here is the actual letter from jeff sessions in light of reports regarding mr. comey's recent testimony select committee on intelligence it is important that i have an opportunity to address these matters in the appropriate forum. so, june 13th he will testify. pete: i think it's important move. ultimately comey said of sessions one he shouldn't have left the room. it was a private conversation between he and the fbi director. he didn't feel like he could tell attorney general sessions what he thought because he was biased or would recuse himself. may third in testimony you had james comey saying he never was asked to end investigation for political reasons. now changing tune i felt pressure at that moment he said nothing to the attorney general. sandra: then donald trump jr. going on jeanine justice last night defend his father calling james comey a

dishonest man of bad character. watch this. >> when i see what's going on right now. when i see what went on for 10 months with the russia nonsense and smear and see what happens on thursday. it's like give me a break. they literally spent 10 months chasing a rabbit down the hole with essentially the sole purpose to try to take down my father. i think it's clear, you know, everything that went on in the comey testimony was basically ridiculous. i think he has proven himself to be a liar in all of this. i think he has proven himself to be a dishonest man of bad character. sandra: so obviously not holding back there. clayton: this the is tactic from this side smear james comey. say he is a bad guy. bad character. that he is weak. he is spineless. that he is the leaker. he is the guy where all these leaks are coming from. i wonder if it's a good strategy for them. pete: it's the tactic because it's the tactic waged against them by deep state and by comey and the press and by democrats endlessly since the inauguration. so they are saying, listen, you have been trying to indict us. we are pointing out the fact

that comey waffled all over the place and he admitted to being the leaker. he said i had a private conversation with the president. i wrote it down. i put it in my drawer and i pulled it out and gave it to the "new york times" to benefit myself. clayton: we have had intelligence guys on the show who are friends with comey. former members of the fbi saying comey is a great guy. i have worke for him for years. is he a stand up guy. obviously the trump administration has had some difficulties with the intelligence community in the past. i don't know if it helps or hurts them. we will have guests on the show to dive in later on that question. pete: op-ed caught our eye in the "new york post" by michael goodwin. he connected some of the dots. something in common. the author of the "new york times" and leaker. here is a quote from an op-ed by. if comey didn't trust the dishonorable president the honorable thing to do was for comey to resign.

instead he was a sneaky note-taker collecting grievances as insurance for himself. he included with the. he cemented brotherhood with leaks. clayton: same author in the "new york times" reporting this story and we heard from the james comey testimony, of course, that he had given this diary entry basically to his friend. and here are these headlines that wound up in the "new york times" from the same author of these articles on march 5th comey asks justice department to reject trump's wiretapping claim on may 11th that other story in a private dinner trump demanded loyalty, comey demurred, one of my favorite words. another comey memo says trump asked him to end flynn investigation. pete: leaks aren't rocket science, right? if you know somebody who can get information to a by lined author of the "new york times" that author and maybe with others put together a story with unnamed sources and makes the front page of the "new york times."

and if you just start to pull back these articles and look where they come, they are all pro-comey, all from the same author, all involve anonymous leaks from high level sources in the intelligence community or the justice department. i mean, it may turn out that james comey as much as people may want to think he is the honorable guy, he was actually king leaker all along, trying to take down a president that he thought was dishonest that he didn't believe in. that's party of the argument that's being made. sandra: this is going to shape up to be incredible leak. you have already heard from the family defending him and jeff sessions, of course, we'll hear from him later this week. but then there is this. shakespeare in the park. clayton: i love shakespeare in the park. sandra: taxpayer funded depicting the assassination of president trump and obviously if they're okay with this, it's corporate sponsors stand by this art ahead of its official opening on monday night. of course, all of this happening in the wake of the recent kathy griffin scandal. clayton: happening at the public theater.

shakespeare in the park. this guy is playing, portraying donald trump. pete: that's right. plays go on in central park. this guy in the left, not calling him president trump, but every attribute from the hair to the long tie to the open jacket is meant to depict someone that looks exactly like president trump. this is taxpayer funded. both city, state, and federal dollars for this play. what you see right there is our president being stabbed to death as part of an assassination plot in this play, in central park that debuts tomorrow night. so the question is, would this ever be acceptable of any other president, especially barack obama or anyone else. but with president obama, four months, five months into his term. we are seeing him stabbed to death in central park as an acceptable part of that is right we pay for? sandra: will corporate sponsors involved in w. this will they be held accountable for depictings a violent death of a u.s. president? clayton: are they even aware half the time when they are

pete: welcome to the second floor of the studio. shocking revelations from james comey's testimony this week about the fbi's probe into hillary clinton and how it should be handled. >> the attorney general had directed me not to call it an investigation but instead to call it a matter which confused me and concerned me. pete: what if a republican attorney general ordered the fbi director to call an investigation a matter? let's bring in our panel katie pavlich is the editor of town hall and fox news contributor. and a former consultant to the homeland security under the bush administration and rob meyer is the editor of red alert politics and a g.o.p. strategist. good morning to you all. katie, i will start with you. obviously, it was a democratic attorney general that asked the fbi director to do this. what would it look like if it had been a republican that said don't call it an investigation. call it a matter? >> well, the first thing is that the attorney general would have been asked to recuse himself from any investigation that they were

overseeing in this case the clinton email scandal. every republican from the president down, including the head of the rnc would have been called on the carpet to condemn the comments and there would certainly be accusations of corruption. obstruction of justice as we have seen. let's ♪ forget this was a habit of the obama administration especially in the justice department. eric holder who served before lorreta lynch was the first sitting cabinet member in history to be held in contempt of congress. pete: that's right. my staff if a you take all of that on top of the tarmac meeting is lorreta lynch getting away with something republican never could a lot of evidence in there. >> concerning. and comey reported that back. a matter of semantics, didn't change anything. what's really important now is that true president of the united states, sitting president asked the fbi director not to follow through on investigation. that, i think is, a much more significant problem. as all americans, we should be

concerned about that. pete: turning it toward trump. rob meyer, he says it's a matter of semantics. have you said and others have that this might not just be semantics, it's criminal. >> that's right. hope is not a directive first of all when it comes to trump. going back to if republican would have done this in the first place, here's the thing, not just recuse themselves. this is against the law. it's against two laws that i just found this morning in cursory search against the hatch act and fec prohibiting government collusion with a campaign. there is no coordination allow you had. in fact, message coordination which is what happened here saying we are going to use campaign language putting matter into the fbi's press conference, that is actually considered an inkind donation. in kind donation from the fbi and the attorney general to the clinton campaign. that is obviously illegal. so if it would have been a republican that did it on the other side, there would have been an investigation, there would have been charges pressed and frankly the fbi director and attorney general would have lost their job under the hatch act rules.

pete: katie, not to mention the headlines that would have been endless, yet, we have seen almost nothing in mainstream press about lorreta lynch. >> funny how this little nugget about lorreta lynch telling the fbi director to call the criminal investigation, after all the fbi does criminal investigation not looking into matters, a matter. and i want to just point out that the semantics matter here because hillary clinton's campaign was calling this a, quote, security review. and as james comey testified last week, he was concerned that the language the justice department was using at the directive of loretta lynch was far too close to the language being used by the clinton campaign to try and quell the concerns surrounding the criminal investigation into her miss handling of classified information. semantics actually do matter here when it comes to the justice department looking like they were taking a side in the election. pete: unfortunately, we will have to leave it there the timing of tv tells us we have to but thank you very much. we will get back to you as well.

thank you very much. we appreciate it sandra, over to you. sandra: thank you, pete. turning to your headlines this morning. 8 people are hurt after a car slammed into pedestrians outside of an amsterdam train station. police say the car was parked in illegal spot near the central station as the driver was approached by officers. he sped off hitting pedestrians before crashing into a concrete wall. two of the injured are in serious condition we are told. police say this was not an act of terror. and a semi explodes into a ball of fire, black smoke, billowing into the air. the tractor-trailer struck a barrier and burst into flames north of tampa, florida. the driver critically injured was airlifted to a trauma center with burns covering 40% of his body. the highway is now open after crews were forced to repave the roadway. friday's crash is currently under investigation. and this: outrage at knowledge high school after president trump's campaign slogans are removed from

back. i mean, there are limits to what they can do without legislation but they are doing what they can. remember how aggressive mr. obama was without legislation. clayton: absolutely. robust hiring that's another area where we are seeing 594,000 jobs created since the president took office? >> the obama administration put all kinds of road blocks in place to hiring. by encouraging the cities to go to $15 an hour on the minimum wage and with obama care costs going up and up and up and so forth. now we have hiring increasing again. people are adopting productivity, labor using devices and so forth to enhance productivity. manufacturing is hiring. construction is hiring. so this is good news. clayton: we have the unemployment rate which also fell to 4.3% in may. that's the lowest level since 2011. we had andy budser on the show yesterday. he withdrew his nomination back in february. one of the things he said was look, we have a problem we don't have the skilled labor. companies want to hire having

trouble finding people with the skills. what can the trump administration do about that. >> the trump administration is going to announce on wednesday a big build out of apprenticeship programs. something the obama people were very big on as well. i'm going to be very interested to see if chuck schumer poo poos that as well. this should be a motherhood issue. the real question here is are the democrats going to get in line on common sense reforms and programs that will help make the environment better for hiring and for workers to get jobs? clayton: so you do point to president trump being credited with this big boost that we're seeing right now? >> well, i think that he has to be credited because businesses are expecting more hospitable environment. expecting environment where regulators will be more reasonable so i think that's good. clayton: finally when you have bloomberg saying his economic agenda is dead, do you think we're going to see the tax reform the' cans ar the companie waiting for. >> that's up to the house and the senate.

thanks for joining us this morning. alive day. the day your platoon was attacked in afghanistan. before we get to the three soldiers killed in afghanistan talk about your platoons in afghanistan. >> sure. yesterday june 10th, 2006, 11 years ago was a rough day for my platoon and i. 25 guys on a ground outpost in eastern afghanistan. on the morning of june 10th, 2006. we got attacked by 250 insurgents. these weren't just farmers with pitch forks. heavily arnold and heavily trained jihadists two support by fire positions. two massive assault units and six machine guns and air burst mortars and rocket pro-he will 'ed grenades and i was knocked unconscious by rpgs and mortars three times in that engagement. almost every single member of my platoon was wounded. that was a refuse day. pete: tour that stretched for well over year having read your book.

also having read your book afghan partners. three killed one wounded ultimately being considered insider attack. someone they were training or working with turned their gun on these americans. talk about the difficulties working with the afghan army. >> it's hugely complicated. every commander on the ground has to do a risk assessment to keep an extra eye on the afghan national army. the afghans that we work with on the ground. have you got to understand, when you serve in afghanistan, just to put it out there just like it is, it's like the flintstones meets the jetsons, really. you go -- want to go back to a time where jesus christ walked the earth, that's afghanistan, ak 47 pickup truck and there you are. not awful lot with regards to vetting that you can do. keep an extra eye on them at the ground level. working with the afghan 99% of the time it's great. it's just part of the war in afghanistan and risk you have to take. pete: most americans know nothing of the war in afghanistan let alone think about it or follow it in the news. we are still there this many

years after 9/11. these kind aare of attacks remind us of the costs and difficulty. what is your opinion of the -- do you have confidence we can turn a tide in afghanistan? >> absolutely we can turn the tide in afghanistan. the mission has to be right. for a long time now we have been implementing a counter terrorism strategy. we knead toe shift to a counter terror strategy and go after the enemy. the only patty to victory in afghanistan resides on issuing defeat after defeat to the enemy in afghanistan. you have to destroy them and destroy their will to fight. you know. and also commit to the afghans that we have their backs as well for the long haul. this is a really important war. we have been there for 17 years. we owe it to every single soldier and family member that's been touched by this bar to win. we have a moral obligation to win. otherwise we will have a whole generation of americans wondering what the heck their sacrifice is for. the stakes are high. pete: obligation to win otherwise we are there longer lose three brave men.

then a couple days later. what happened? >> well, i had just gotten out of the national academic games competition. i was out of school a couple days for that as soon as i get t out i receive a phone call from the front office basically telling me i many disqualified from the presidential election for harassing the other candidate. and i have detention on thursday. sandra: and detention. but the principal had a phone call with your mother, by the way, the school principal's reaction to this was quote speeches must focus on realistic and pertinent issues. the insulting language used of his speech was in the nature of that created a situation of public humiliation and therefore violated school district rules pertaining to harassment was the word that the principal used. but he also had a phone conversation with your mother and said that you had caused a mess. how did you respond to that? >> i thought it was completely outrageous. i never thought that this speech could ever evolve into

what it's become. really. it was completely a joke from the beginning. and completely satirical. clayton: i'm curious where the harassment part comes. in you said my opponent wants to raise taxes and dress code. what was harassing about that? >> the school told me that accusing her of advancing communist ideals on student government was considered harassment. pete: wait. so was there any part of that speech that was true or were you just saying saying hey i'm going to have fun with this. >> completely joking around. i could see the camera. but i didn't expect it to be -- sandra: j.p., you have involved an attorney in all of this to respond to the school. what was that response? >> well, mark miller and specific legals foundation reached out to me after seeing editorial in the paper, our local post tc palm by larry reissman and marc miller reached out to me and offered

plentiful cookie jar that you will reach your hands into. guess what came out of comey, a big fat nothing cookie. sandra: still, michael, democrats plan to keep getting in the way here. >> democrats plan to pursue this. the president has fired -- he fired the former a.g. he fired, you know, members who have tried to investigate this russian collusion, this obstruction of justice at every attempt the president has obstructed the investigation. i think that's something that democrats and republicans should both want to investigate and find out why. sandra: big question is will the president be able to get his agenda done. everybody talking about obamacare moving forward and repealing and replacing that talking about tax reform whether that's going to get done by end of year, tammy. there is a lot on the president's agenda. still as the headlines do point out his administration has been bogged down by. this those are headlines, that's not reality. this is what the president has to do.

we should be clear what he was up for and why this was an issue for him. he brought it up because he had written an article a while ago and it seemed to bernie sanders that he was anti-islam. that he was -- and as he described it islamophobic and that he thought that that person had no place in the federal government. i mean, that's the litmus test is he talking about. >> as soon as a litmus test is does your religion agree with my religion, and if it doesn't agree with me, then you can't have a job in our government, that's where we go wrong and that's why it had no place in this session. pete: father, there are pretty definitive things said in the bible and quran about what you believe and based on that where you are going and where other people are going. >> sure. pete: beliefs other people have in private that they are not going to apply to someone in office. certainly an office of management and budget. why does he go there? >> i think it's a choice that america is better when all of us just decide we don't believe in anything too deeply about religion and we just all say hey, listen, i believe

sandra: last night attorney general sessions responding to comey's hearing. an the exchange with senator majority of inregarding russian related matters. in light of reports regarding mr. comey's recent testimony before the senate select committee on intelligence, it is important that i have an opportunity to address these matters in the appropriate for m forum." sessions will now testify on tuesday. so where does the russian probe go from here? here to weigh in this morning is anchor of fox news sunday chris wallace. chris: good to be with you guys. clayton: you had a lot of people on the left, people lining chris matthews, said the collusion side of the story looked like it imploded this week. what's your sense of it? where does your part of the story go from here? chris: we don't know. obviously there's more to see. we don't have any evidence of collusion so far. the f.b.i. has been looking at this for about 11 months, so it does raise some questions if there's any "there" there, but we'll find out a good deal from james comey.

first of all, he'll be asked about what james comey -- from jeff sessions about what james comey had to say. remember comey told the story about how the president kicked everybody, including sessions, out of the oval office to have that meeting with comey where he allegedly told him to go easy on michael flynn. we also have the comey testimony that after that he said to sessions, "please don't ever leave many alone with the president." it'll be interesting to hear what sessions has to say about that. there's also the question of sessions' recusal. remember he said i'm not going to have anything to do with the russia investigation, and yet he clearly was involved in firing the man, james comey, who was the head of the russia investigation. so we'll hear about that and then there's also this kind of odd question about whether or not there was another still u unreported meeting between sessions and the russian ambassador, sergei kislyak. this won't be the end of the

investigation but it will certainly be another step forward. clayton: so chris little evidence shown whether there was collusion with russia, but the unmasking or the new revelations about loretta lynch pressuring comey or now that we know comey himself was a leaker potentially multiple times. could the investigation or the discussion move in those directions instead of the russia investigation which has proven to be pretty much a nothing burger? chris: well, i certainly wouldn't say it's a nothing burger. you know, pete, we have to see where it goes. among other things, we still haven't heard from michael flynn and he's one of the key figures into all of this. he was the one who had the most contacts with russia. he's the one who got paid by russia. i certainly would like to hear from him before i say it's over, but you're quite right; there are other elements. there was some collateral damage that happened -- came out of comey's testimony, his comments about loretta lynch, saying seemingly in concert with the clinton campaign, let's not call

amazing story about megan leavey who did two tours in iraq with her military combat dog, rex, and they were wounded by an ied and she wanted to adopt rex and bring him home to live the rest of his life and it really is an incredible story, it's absolutely beautiful. the director really captures the setting very, very well. two interesting things, by the way. the dog itself and the film was never trained as a military dog initially, in the actual movie world, and also the dog was searching for treats during the bomb sniffing scene. it's how they were able to pull that off. but i spoke to kate mara about the idea of being an aren't and do you get connected to the dog and do you want to take the dog home with you after filming the movie. watch this. i'm assuming you got attached to the dog after, like was there an element of, like, i want to take this court and actually adopt the dog? i had my two old dogs at home waiting for me, and i felt actually quite -- it was hard because my dogs are usually on

legal scholar jonathan turley is putting to rest talks of impeaching president trump saying, "i am perfectly willing to accept comey's account in this hearing. however, even accepting those representations as true, they did not describe a crime or an impeachable offense." but this hasn't stopped the media from running with click bait headlines cluing these impeachment headlines: here to discuss this amy holmes. here just a few of the click bait headlines. when we say click bait, these are the things that get you to click on the story. the nation had this the other day: congress has what it needs to impeach trump. newsweek: what happened if trump gets impeached? newsweek again: trump impeachment called surge. on and on and on. what's going on here? amy: i think what you have here is the mainstream media is sort of the perfect marriage of bias and business, that you're seeing this anti-trump bias that is also very good for business. more people are reading, more

people are watching. i think, in large part, because they're really interested, obviously, in president trump. and he's really great click bait but then you also have the bias where the media now, in its news stories, are talking about obstruction and impeachment, and they're not citing legal scholars that might contradict that view like alan dershowitz, the professor from harvard who said, "i don't see obstruction here." jonathan turley, he's a professor at george washington university said, "i don't see impeachment here or obstruction, either." and in fact mr. turley, professor turley went so far as to say that maybe james comey got himself in hot water during that testimony because maybe he actually didn't have the authority to give out that f.b.i. memo to the new york times. sandra: clearly this paints a picture of irresponsibility on behalf of the media to put this out there just to get the clicks rather than doing real reporting on this. amy: well, one would think so and i talked with an anchor on a competing network on friday and she informed me, she assured me

unknowingly. it's hard to believe, but it's that autopilot part of our brain that kicks in and allows a parent to think they may have dropped off to day care already and continue on to work. so we want to talk about tips to prevent that. clayton: some of the tips, if you don't have, obviously, one of these cars that has some of the safety alerts, i mean, that, you know, now a lot of the new cars are equipped with they'll kick air-conditioning on if they sense weight on in the backseat but if you don't have that, we've got to do some things. if you don't have that, parents should take a couple of simple steps to make sure it doesn't happen, you're going to work, you have your handbag or briefcase and you put that in the backseat so that every time you arrive at your destination even if you don't drive to day care every day you're putting that handbag back there so you'll look before you lock the car. clayton: a stuffed animal? yeah. put a stuffed animal in the car seat, it sounds simply and silly but when you put the baby into the car seat you take the stuffed animal out and i tell you, put the animal in the front seat, and that way when you arrive at your destination, you

have a visual reminder that the baby's in the backseat still. clayton: great. what else can we do? want to make sure that you have a call-in system with your day care provider so that if your child doesn't review at the expected time they call you to make sure that something hasn't happened like the child's been left behind. clayton: and then of course a last resort. we have a safelight was kind enough to provide us with this car. if you have to resort to the last thing, which is you see, you know, breaking through this window, how do you do that and why would you do that? right. because we have a couple of other scenarios where parents think it's okay to leave the child alone in a vehicle for just a few minutes or the children have gotten in on their own and can't get out. if a child goes missing always make sure to look in a car and in bodies of water. say you're a passerby, you're in a parking lot and you see a child or a pet and they look like they're unattended, call 911, get the authorities on scene. if you feel like you can't wait

do under this administration. pete: fake news doesn't report the great economic news since election day. dow up 16%, nasdaq up 19.5, drilling and energy sector way up, regulations way down, 600 plus new jobs added, unemployment down to 4.3%, business and economic enthusiasm way up at record levels. it's got to be frustrate if you're in the white house, you see this happening but no one is reporting it. maria: that's right. things are definitely getting better. we see that not only from the numbers, the monthly numbers that we are watching but from sentiment. you're seeing profits in the first quarter up 15%. that was a big number. even more important than profits for the first quarter was revenue growth. with profits you could always say, well, we cut costs but you can't lie with revenue growth. revenue growth was up 8% in the first quarter. that's a real positive. it's showing you that the area of the economy that was really in recession before donald trump that was the business area, businesses are feeling a little

are taliban. they take credit for stuff. this can happen for a lot of reasons and a lot of times misunderstanding, small scale arguments, certain slang that a lot of people in the marine corps use that if the afghan doesn't quite speak the language take it as insult to the family, you say a couple of things and you get grudge, argument happens and they will get guns out. this could be a big deal. it's gone down. the numbers have gone down recently, but this is a big problem. clayton: let's talk more broadly. we heard from the trump administration more ramped up effort in afghanistan. obviously criticism for the obama administration for pulling up stakes, so to speak. >> you want to stay the course and do what we are doing. we can't blame one administration or the other. this is, i think, in result of too much nation building which president trump has talked about. we don't need to do that. i was there in 2005 and up until
