up from there. he is running as live from the courthouse in pennsylvania. have we heard from the jury yet rick? >> not yet julie. we certainly hope to. and so does the da.they want to know how many men and women believe that bill cosby was guilty and how many believe that he was not and why. that answer is very important to the das he considers every trial. the jury deliberated for more hours than the trial itself. the interrupted deliberations a dozen times of questions including for the definition of reasonable doubt. and the definition of it without her knowledge. they also asked for effects of testimony from police and the victim's mother, both cosby and his accuser,? this is now 79-year-old comedian drugged her and sexually assaulted her in 2004. in the end this was a case of he said she said. there was no agreement on which

questions is how long has the search been going on? >> good afternoon kelly. this is been going on for about 24 hours. it is right now about 3:00 a.m. local time in japan. the japanese coast guard is leading search efforts but being hampered by the darkness. the commanding officer was airlifted off of the ship and the executive officer took command. uss fitzgerald limped back to the port. 16 hours after a cargo ship hit the us warships right side causing flooding into compartments with dozens of sailors were sleeping at 2:30 am local time.there is also flooding in an auxiliary space in the ships radio room. the commanding officer statement was damaged. the warships crew barked quickly in the dark over many hours to prevent the ship from sinking. >> it is been a tough day for our navy family. it is hard to imagine what this crew has had to endure and the

another attack on us forces taking place in afghanistan today? >> a short time ago i spoke with a us military spokesman in kabul who said that seven us army soldiers were wounded when afghan soldier opened fire on them at a base in northern afghanistan. with the military because an insider attack from afghan forces that are supposed to be our friends. this comes as 8400 us troops in afghanistan training some of the afghan forces and it comes as the pentagon weighs the decision to send up to 4000 more american troops to afghanistan. to help rollback telegram gains. it is noteworthy that in the last few months the trump administration has been stepping up airstrikes inside the country. in april the us military dropped more bonds in afghanistan than any month since 2012. >> thank you. new development in the investigation into the shooting rampage targeting republican

lawmakers at a baseball field. we are now learning the government james t. hodgkinson had a handwritten list of republican names in his pocket at the time of the shooting. meanwhile congressman steve scalise remains in critical condition today. we are live outside of the hospital with the latest hello garrett. >> hi julie. the list of names found is not part of the fbi investigation to determine what james t. hodgkinson was doing in the area and what his motive was behind the shooting. the list includes the name of six gop congressmen. scott tennessee, trent of arizona, jeff duncan, south carolina, jim jordan of ohio, brooks of alabama and morgan griffith of virginia. handwritten list also included the numbers of the congressional offices on capitol hill for those congressmen. at this point law enforcement officials tell us it is too early to draw any conclusions about the list and investigator try to determine if he was

trying to visit the offices or otherwise interact with the congressman. what we do know though is that all six are associated with a conservative house freedom caucus in at least two of the congressman were at the baseball field the morning of the shooting. and one of them responded to his name be on the list. >> there are certainly many indications now that the shooter was premeditated in his actions. i have been notified that there is an investigation and that yes, that i might be involved in the investigation. but you know i certainly cannot go any further than that. >> as the investigation continues, so does the recovery of those who were injured in wednesday shooting.doctors tell us that the house majority steve scalise was facing imminent death when he first got to the hospital. after a number of surgeries

we thank you for this service you get to the country. and trying to govern the country and legislate by the people and for the people. having seen that we see how dangerous it sometimes can be. particularly given the fact that you replace congresswoman gabby giffords who survived an assassination attempt. in 2011. what can you tell me about the climate today and how it might be contributed to people for a bit unstable? >> the climate is extremely hot as he is seen and reported. and just yesterday a man was arraigned in tucson for making death threats specifically against me, three separate counts. so this is very real and i often use the analogy of the frog in the water we turn the temperature of one degree at a time. ultimately the frog parishes. it is one reason i ran for congress honestly. i served in the military and

found myself frustrated with what was going on. i was frustrated with the rhetoric and divisiveness. part of our mindset as veterans is to serve the good of the country. serve what is best for your community. find common ground and funimation executable. it is really the mindset that i've had since i have been there. i think this crisis equals an opportunity for all of us to look inside of our hearts across the country and asked how did we get here and what is it each of us can do in order to bring the temperature down. we talk often the military muscle has committed a real crime, i was a commander so we say get the perpetrators. so clearly the assailants are responsible for this violence everything of the bystanders which of the vast majority of people. i would just as always, don't be a facilitator, don't be a bystander. if you see something say something. we all have to do our part to find a way that we can have civil discourse of our sincerely held disagreements and have the vigorous debate. but don't take it out on each

can talk about the obstruction of justice. the problem is the core of this. how it all got started. the allegation of donald trump and members of his campaign colluded with the kremlin, with a foreign government to defeat hillary clinton and become president of united states. that's not what anyone is talking about we have gone completely off message. i think a lot of the country is sick of hearing and the problem is some of these outbursts from donald trump have not helped his case. and so it has come to field a little bit of the stuff and it put him in a difficult position with mueller reading of his neck and mueller himself or congressmen leaking to the new york times once again trying to harm the president. >> mueller step appointments speak for themselves. i want to go through some of them. one higher in particular stands out to me is michael - the deputy solicitor general could he specialized in criminal law and the constitution. now is he on hand to make a

legal case for impeachment? and is that mueller's intent to get the president impeached? >> while i would be guessing at his motives. he is an honorable man, decorated combat veteran from the vietnam war. but he is also very very close with james comey and he is somebody who has that self-righteous fbi where your thing about him. he is that a tradition of being maybe overzealous. when he pushed back against george w. bush's white house when george w. bush said you have gone too far in attacking a correct democratic congressman pete of course george w. bush wasn't trained to do that. and he is not espionage, not counterintelligence. looks like he is trying to build, his skill set is building a case for impeachment. >> obstruction of justice, is a obstruction of what? also this week it was revealed through morley said donald trump is being investigated for not only obstruction of justice but also revealed this week by the "washington post" that mueller is court events getting

finances and business dealings of jared krishna. it is mueller basically on a mission to mail anyone bitter has to do with the russian probe are not? >> it often happens with special prosecutors could result with kennedy going after dictating. he wanted a body. he ended up going after libby and that that that was in fair. leave it so that with a republican special prosecutor going after bill clinton.11 america got bored with that and sick of it. they may have gone too far and overstepped. special prosecutors have a history of looking to make the name for themselves and go further. one good thing about mueller is that he is probably not going to be running for office.he doesn't need to make a name for himself. but based on the decisions he has made so far i think we will learn more in the next coming weeks as leaks continue to come out that the president will find that if his motive is just nailing someone to the wall. >> .another uncanny when i have to mention i think a lot of viewers will be surprised if they do not know but this is ready.

there is another higher think should be looked at as a major conflict of interest. mueller has recruited andrew wiseman. he oversaw the enron task was, led the prosecution of the arthur andersen accounting firm he was completely ruined in the press for legal issues. by the way also donated to hillary clinton political campaign. but i'm not dumb. he was highly criticized for his legal conduct by guess what paper? the new york observer newspaper. guess who owns the observer at the time? jared kushner. i mean how can he actually fairly judge the trump campaign? >> yes you would not want these guys on your jury. but they can force a firing of mueller but it would be bad optics. to the point of optics, this team that mueller put together -- that is bad optics as well. already, half the country is extremely suspicious of this. the other half has already

so a mistrial. no take on this. >> i think this is a win for bill cosby and here's why. this case came down to one thing. the credibility of the accuser. this is not a case where the of expert testimony that the jury had to wrangle with. it is not a case of done it. this was a case of if the jury believes the accuser, he gets convicted and if they don't think it's acquitted. so the mistrial means at least one person on the jury can buy her story. credibility is not something that changes were gets better the next time around. >> 20 think the prosecution in this case was looking for? obviously they were looking for a conviction and furthered jury to find mr. cosby as he is charged. but something happened within that jury room where they could not meet as john had talked about, they could not come to

an agreement. >> i am not shocked that there was a hung jury. a lot of people have actually forgot the da ran a campaign based on the premise he would prosecute cosby. because when this occurred, the prior da told mr. cosby and his team they would not prosecute as long as he participated in a civil litigation. that is with the deposition testimony came from. the civil litigation that cosby agreed to participate in. to this day really had a chip on his shoulder specifically for cosby as he was trying to fulfill a campaign promise. they need the jury to convict him. they did not get it. and like they said, a hung jury is definitely a win for the defense because the defense now knows all of the cards at the prosecution has to play and it is all downhill for the prosecution from here. >> let's look outside the case. what does this say to women throughout this country who are exposed to sexual assault in any form or fashion? particularly given the fact that drug use could be applied?

>> can i say something? about the drug use this is what bothers me about this case. first and foremost, anyone who is a victim of sexual assault whether a man or woman, you can absolutely come forward immediately. if you cannot due to the please, do it to someone you know and trust. a parent, brother, sister or friend. to get the ball rolling into the support that you need. but in this case when it comes to the drug use and i think this is maybe why the jury couldn't come to a decision. it's not like she is saying he flipped her in mickey. she is think bill cosby's and here you go! take these and she did! now if you come to my house and i copy of class of wine and hors d'oeuvres that is normal. if you come and i tell you to take two benadryl you're going to look at and say i'm not sneezing! now if you don't want to take them you're not going to end that is where the consent issue came in. i think that's what the jury really had a tough time with. >> eric? >> i agree with john and that is another point.

this woman was given the pill to take and she was an adult. is not as if she was 15, 16 or 17 years old. she was a grown woman who decided to take this. and bill cosby's defense was very poignant in what they said. they had an ongoing affair, a sexual relationship and this was just the norm for them as a couple. so the civil litigation did harm her a little bit. but her consent is the issue that the jury was hung up on. >> some people were singing solo for her to forward it was 2004 and it took place and this is 2017. but given the fact that she was up against a superstar, america's dad if you will, that is who he is best known as as doctor keith huxtable. many people were saying what happens now if the fact that they are able to bring this case forward and in the next six months. is it wise for the prosecution to come forward? gloria albright would certainly agree. >> if it was irresponsible for the prosecution to come out and say they are going to retry the case but even first trying to find out how the jury was

weighing this. we have 11 people for a conviction and one for an acquittal? or was it vice versa? jury doesn't have to say but typically they will. so let's get some information before you come out hard charging for the second time thing we are going to retry this. really? let's weigh your options and do some homework before you decide to do that. >> he did say he was going to do homework that he said he came out swinging saying i'm going to go after this again. but to gloria's point, if she is able to get more women who claim that there were situations that they had with bill cosby that involve sexual assault, she's able to get more people on the witness stand, how will that help or hinder the case for mr. cosby? >> i'm so glad you asked that question because gloria's comments actually bothered me. first of all i think cosby did most of what he has been accused of. but in the justice system you must have a fair trial. and a judge must take that into consideration on the evidence

that he allows to be placed in. for example, if you are on trial for speeding and you have 10 prior speeding tickets, that may overwhelm the jury in their decision to say you must be speeding. instead of concentrating on the one that you are faced with right now. just like with bill cosby, he is talk about this case right now, not all of the prior acts that he had because the judge has to make sure it doesn't overwhelm the jury with all of these acts to cloud their judgment on this particular case. >> and the court of the public opinion.mr. cosby having his image tarnished forever. >> give me a quick answer. >> his image tarnished, yeah. unfortunately. >> he is like a rusty piece of steel right now. early to tell. when you have decided the ship damaged in this case, the left-hand side of the cargo vessel was damaged and the right hand side of the navy ship was damaged. the only way you can put those two together is to have a situation like this. now the question is, you normally yield to the right. now there are exceptions to the rule but in general you yield to the right. so the question becomes, was the cargo ship which is the stand on ship in oracle terms. in other words approaching that way the cargo ship had the responsibility to be predictable which is to maintain course and speed. the giveaway ship which would have been the navy destroyer then has a consistent target that it can maneuver around so as to avoid a collision. if you look at the ais which is an automatic tracking system that ships carry and you can go up on maritime traffic.com and take a look. but it shows the track which

with course and speed of the cargo ship and the cargo ship was doing some amazing maneuvering just prior to the impact. so back to it's too early to tell. if that ship was in the process of maneuvering, it would have confused the crew on the us destroyer where they would not have had a clue on the rules of the road. at that point it is everybody for themselves trying to maneuver out of the way. >> which would have had the right-of-way here? >> if the cargo ship is maneuvering, even though it is on the right it is so unpredictable that it is a very confused situation.that is the point i'm trying to make. if on the other hand, the cargo ship was steady than it would have been up to the uss fitzgerald to avoid the cargo ship. but the track data does not show that.it shows a lot of i will call it extreme
