that is tonight's very opening monologue. >> we are at a turning point tonight with forces now forming an alliance to try and remove president trump from office, it's that serious. here are the five dangers we are facing, especially the president. one, the destroyed trunk media that has been lying to you now, provable lies for 11 months, nonstop. trump, russia collusion. black helicopter theories, no evidence whatsoever. two, you have what i've been calling the deep state, selectively leaking information to damage the president and anyone associated with him. three, special counselor mueller's special counsel. it's now turned into when aldo don't like out of control, political witch hunt, he needs to be stopped. four, all the manufactured turmoil putting his agenda in jeopardy, which ends up directly impacting everyone of you out there, the american people.

five, the effort to overwrite the will of the american people, change the results of a presidential election is now creating a national security crisis. america is now suffering from a massive informational crisis because i call them the destroyed trump media, they've been routinely exposed now, agenda-driven, propagandists. more than happy to push, debunked tinfoil hat conspiracies. for example, the media relentlessly peddling one of the biggest lies in american history that is that the president colluded with the russians. that's because members of the media are nothing more than left-wing ideologues pretending to be journalists. remember, they are the one that colluded with hillary clinton and exposed by wikileaks in the 2016 relaxed until my collection. the media has one clear, shared goal in mind and that is to damage, stop and destroy his presidency sadly fired it appears, any means necessary.

>> sean: for the next threat and perhaps the most dangerous, the deep state, what i call the fourth branch of government, unelected consisting of a lot of obama holdovers, anti-trump bureaucrats who now are routinely targeting the president, his administration with selectively came to hurt him. that's deep state works closely to destroy trump media to disseminate false information about the president and his administration. with even more sinister is that they are willing to break the law leaking classified information like in the case of general foreign and you have the former fbi director james comey admitting under oath he had his memo leaked to "the new york times," he had a goal, he wanted the appointment of a special counsel and a prime example is the unmasking of general flynn. it was a violation of the espionage act, that's a crime, that's a felony, by the way. his fourth amendment rights totally trampled on, you've heard nothing about it, there's no investigation or.

why? the deep state doesn't care. their only concern was taking down president trump and his associates. you got number three, the special counsel. look at his investigation mission creep. president trump is called is the greatest political witch hunt in american history. i'm here to tell you the president is right. his sole purpose was to investigate so-called trump-russia collusion but mueller is now expanding that investigation and he's digging into finances and jared kushner and obstruction of justice and guess what? is not going to stop there, why? because there is no trump of a russia collusion so he has to move onto other things. what's most alarming about this, mueller is having massive conflicts of interest. he should recuse himself, he is incapable of carrying out a fair and impartial investigation. mueller needs to end the witch hunt right now. he's best friends with james comey. they've been best friends for a long time. who do you think mueller is going to side with when it comes

to the president and his work versus james comey's? that's pretty obvious, pretty unfair. then there's the fact that members of mueller's investigative team, the lawyers he's hiring, they've all, many of them donated big, big box too, let's say, barack obama, hillary clinton and on top of that perhaps the most sinister, one of the lawyers he has hired actually was clinton's attorney at the clinton foundation defending the clinton foundation against getting you information and preventing freedom of information act request. isn't that great about the foundation? imagine for a second, understand that, if republicans ever tried to pull anything like this, let's hire donald trump software to investigate president hillary clinton. the left-wing outrage would be like nothing you've ever seen before. if mueller wants to investigate actual crimes, actual collusion, by the way, real conspiracy with

russia, maybe he should focus his attention on other things, let's start with loretta lynch, let's start with the clinton's. james calmly testified that lynch influenced his investigation, is that not that textbook definition of obstruction of justice and if the democratic media want to talk about collusion, we can talk about collusion. was it wrong for loretta lynch to meet bill clinton on the tarmac or to convince jane comey not to say it investigation, but a matter, or as sharon carter and john solomon have reported, was it wrong when she reported that comey confronted her and having been in the tank hillary all along and put the kibosh on any indictment? what about when serving a secretary of state? hillary clinton handed over 20% of america's uranium to who? vladimir putin, the russians. the corrupt uranium one deal. and the people involved in the deal donating, kicking back big dollars, millions of dollars to the clinton foundation, her

husband doubling his speaking fees in moscow. all this manufactured turmoil from the left, the democrats destroyed trump media, the deep state is creating a completely dysfunctional environment in washington and for the country. and you the american people, you are the one suffering because these forces are slowing down what you voted for, a president enacting the agenda he promised. fewer jobs, less economic growth, no border wall, no tax reform, no repealing and replacing obamacare, no getting people out of poverty, off of food stamps, back in the labor force. the longer these attacks continue the longer it will take for you, the american people to benefit from what from what yod for, the president's policies and agenda. all of this now creating a very clear, present danger to the country, the left is suffering well beyond trump derangement

represents the best interpretation of the constitution." finally they assert "we realize that the presidential immunity of indictment and chemical prosecution while the president is in office. the author of a soon-to-be best-selling book, look at her right there. rediscovering americanism and the tyranny of progressivism, i call in the great one, mark levin. love the cover, you will be on next monday, we will talk about the book, not tonight. let's talk about what you found here, this is profound to me. >> let's talk about this, because we had a debate the last several weeks as a result of the gym comey illegal leak from his law professor buddy to "the new york times" that the suggestion is that donald trump obstructed justice. you and i know and anybody with any competence knows that the president of the united states not only didn't obstruct justice, he can't obstruct

justice, that aside, this has been a debate for weeks, obstructing justice, will mueller investigate and? he has investigated him, that's not the question, that's media insanity. the issue is why would mueller investigate a sitting president at all as a criminal matter? because it's been the position of the united states department of justice under republicans and democrats and in 1973 memorandum and in october memorandum under the clinton administration that you must not, cannot indict a sitting president, not that this president would be, that's not that my point. as a matter of constitutional interpretation, for 44 years that's been the position of the department of justice. we had law professors, homeless people, would be law professors all over tv and radio talking about obstruction of justice. we had media types talking about it. we've had members of congress talking about it. it doesn't matter, the official position of the justice department is we don't charge a sitting president with a crime.

you don't have to trust me, here's part of the memo, this memo was written october 16th 2000. that incorporates writings from the 1973 memorandum. the office of legal counsel which advises the president and the attorney general on constitutional issues at one time it was headed by william rehnquist, who had been chief justice and one time antonin scalia. that's how important this office is. i memorandum in 1973. proceeded to this issue examining whether criminal proceedings against a sitting president should be barred by the doctrine of separation of powers. what they concluded is it is barred by the doctrine of separation of powers. here's the reason. there's only one person who runs the executive branch was the commander-in-chief, the president of the united states. it's not like congress, we have 40 -- we have 100 members of the senate, or the courts where there's a thousand federal judges and so forth, the president is it, one national

election, one president, specific duties under article one of the constitution of the united states. what they explained in the memoranda is this. you cannot have a prosecutor who is responsible to nobody digging into the background, charging a president of the united states, debilitating his presidency, making it impossible for him to focus on his constitutional responsibilities, domestic and foreign. you cannot have a judge and a jury determining whether an election is going to be reversed. you cannot have average citizens, yes i said average citizens, 12 citizens sitting as they typically would in an average case involving an average other citizen defendant, that's not this case, if the president of the united states and the framers of the constitution set up a completely separate system for him or her call the impeachment process, we will not get into that now. what they said is that it's

quite clear that if a president of the united states has to spend time defending himself, if a president has to spend time going to trial, being deposed, the president has to spend time protecting himself tenant damages, it handicaps one of the branches of the federal government and thereby destroys separation of powers. this is the position of the department of justice. why does that matter? because mr. mueller is not an independent agent, they can call them independent, special prosecutor, they can call him a kumquat, it doesn't much matter, the fact of the matter is the rules and regulations that apply at the department of justice to all prosecutors apply to mr. mueller. the fact that jim comey leaked his memo, try to push and obstruction of justice scenario and prepped for a special counsel, which he gotten her, his dear, long time good friend robert moeller, doesn't change

scandal. the report is entitled "obama, unmasking material is at obama library? "her to explain literature collection, also sarah carter, gregg jarrett, tom explained, how does she get access to unmasking the first place? how did she get to that level? >> i'm sure special investigator mueller is investigating it, right, sean? we asked the national security council which advises the president on those matters for documents about the involvement in the masking of the trump team about the dnc hacking, russian collusion, everything you would think you would want from susan rice's files over at the national security council and we got a letter back from the national security council saying all documents from the obama administration have been turned over to the obama presidential library and they hopefully give us the address of the library. >> sean: really? mr. obama, can i please have

those please? >> now that they are at the library with the archivist that gathers records for the presidential library, under the presidential records act, the freedom of information act, which is what we typically used to get documents doesn't even begin applying so five years after obama leaves office. something can be done in the meantime. the president can get the documents, president trump and bring them back in. certainly there's other possibilities as well. >> sean: sarah, you and john solomon had reported as part of your ongoing investigation that there was in this last 2015-16 election season 350% -- 350% increase in unmasking. unless we have greater security threats that they never told us about that seems to be weapon i think the intelligence agencies to go after political opponents. >> that is certainly what our sources were concerned about.

we had the documents to prove it. it wasn't just relying on unnamed sources. we were actually able to get those documents to be able to show that. think the concern here, back in march we reported this, it wasn't just susan rice, it was cia director john brennan, attorney general loretta lynch, very interesting. and the question that i have, i want to know when did they send all of these documents over to the library? that's what i'm concerned about. are they trying to hide this from the american people? these are actual federal documents. i assume there's a lot of concern here. >> sean: i think tom just told us why. >> what about the intelligence committee? >> sean: we don't have access to them. check them out quick, right? right, you've done so much investigative work on all of these issues, mueller, rosenstein, comey, mission creep, investigative creep, i agree with you, mueller needs to be recused, comey needs to be

looked into for crimes possibly committed. loretta lynn should be investigated, hilary investigated. rosenstein recused, none of it happening, it keeps going on and they keep digging deeper because they can't get russia-from collusion. >> and because they are not recusing themselves you have to wonder why, is there a reason other than the law and the statutes and so forth? is this a vendetta? is this retribution revenge for the firing of james comey because comey and mueller are best friends and are they now acting in collusion to bring down the president? the problem is a special counsel has unfettered, unchecked latitude and discretion to make a false accusation of obstruction of justice because he doesn't have to prove it in a court, all he does is handed over to congress in hopes of triggering -- >> sean: you agree you can get a president on this and it doj or your policy?

my pledge is to be part of the solution to focus on governing to put my experience to work in helping to solve the very serious issues that we are facing in this country. i think i might be the only, if not one of the few former chamber ceos to actually serve in the u.s. congress. and i know i'm one of the few who have come out of local office as a former county commission chairman and i'm also one of the few armor secretaries of state. we have a lot of work to do, a lot of problems that we need to solve, we need to finish the drill on health care.

we need to do a better job for this economy so that we can create more jobs and better paying jobs and we have to do more for creating jobs, especially in the small business community. we have to make sure that we move forward with comprehensive tax reform with lower corporate rates, but ladies and gentlemen, also lower individual rates so that our middle class can participate and are small businesses can participate and finally permanently repeal the death tax. [cheers and applause] to our veterans in the room, we have a high obligation as a nation and i know i have a high obligation as a next congressman to ensure that we provide our military men and women with the resources they need to do the job we are asking them to do. and that obligation extends when their tour of duty is over to them and to their families so that we meet our commitment to them. i have said this before multiple times on the campaign trail and i'm especially reminded of it

tonight, my path has been a somewhat unusual one and i am a pretty unlikely soon-to-be junior congressman from the state of georgia, i never expected any of this growing up in a turbulent home as i left home at 17 and went to work i could have given up and let the circumstances that i was facing dictate and control the course of my life, but i did not. i believe that our life experiences the good and the bad, the unique, the mundane, and the difficult, they are what build our character set our cor core, help us develop discernment in our decision-making and is pat fighting spirit, that perseverance and tenacity that i will take to washington, it's been a driving force in my life and it will be the driving force for you as i represent you.

[cheers and applause] >> so very many people have lifted me up in the tough days of my life. but when all is said and done i know that it has been a great god and a truly great nation that afforded a young girl the opportunity to grow up and be whatever it was she wanted to b be. "karen, if you can win, it says to every 8-year-old girl that

she can do it, too." [cheers and applause] while my name was the one on the ballot, a genuine belief that tonight is not really about me, it's about all of those young and not so young little girls and boys out there, the ones who have been underestimated most of their lives, told that they couldn't do it or that they weren't good enough, the ones that were always counted down and out. tonight reminds us, it reminds me that anything is possible with hard work, determination, great and people who believe in you. georgian, every six district citizen and every citizen of the united states of america as we prepare to send george's first republican woman to congress! thank you, god bless you! >> karen handel, republican, the winner tonight in the most expensive house race in u.s. history leading democrat jon ossoff just moments ago, the president waiting congratulations, karen handel on her big win and georgia, fantastic job, we are all very proud of you. you can see they are watching news there at that handel headquarters. this was a big win because a lot of people said that this was going to be a referendum on the current presidency. chris stirewalt, national politics editor is with us here. it's hard to put into words how significant this is because democrats thought they would pull this out.

you, no one is happier tonight than paul ryan, he's ecstatic, because he now knows that he can go to his member and unsafe we have hard work to do on taxes, on spending, if and when the health care bill bounces back from the senate, now we can say to them there is a way to survive, even in this, what should be the toughest district really that was a republican held district for trump. >> let's point out that the average house race, they sent between 1.6-$1.8 million running an average house race. this was the most expensive, more than 20 million, 25 million on the democratic side, money pouring in from all over the country and republicans managed to tie ossoff and nancy pelosi. >> and it still worked on the good news for republicans is that they can still in the trump environment -- this is a tough district for trump, he underperformed there dramatically. even in a district like that with the voters that trump a struggle with, republicans could still make it a referendum on who do you want to be in control of the house and in those districts -- you can't have a

wave election unless one side's base is fired up and the other side's is unenthusiastic, in this case both sides came up the fight. >> that's the conundrum for democrats because they have to find these candidates, they have to recruit these candidates if they are going to take back the house, they need moderate candidates and district like this one to be able to even come close. >> congressman seth moulton from massachusetts said in a pretty stinging work it his party that it's time to look forward, time to stop relitigating 2016, time to start talk about plans, talking about ideas and division for the future and that's the truth, if you want to win these moderate districts, yes, it's good to be against trump, but what is even better to do is to say this is our plan for how to govern and be a party. >> acute win for karen handel in the race for congressional sixth district, the race the open seat of hhs secretary tom price in georgia. it was a republican-leaning district, but this was a huge loss for democrats. they thought they could pull one
