so i'm going to keep insisting we stop accusing people of crime when there is no evidence of crime. judge jeanine: let me be a little more specific. under the campaign finance laws, there is a claim that if you get something of value -- and they are alleging information from a value from a foreign national could be stretched out to mean words, is that something that's ever been prosecuted? >> of course not. if it were to be prosecuted the first amendment would trump. candidate has a right to get information from whatever source the information comes it's like the "new york times" publishing the pentagon papers or the washington post publishing material stolen by snowden and manning. you don't prosecute the newspaper and you don't prosecute the candidate or the cad's son. if the material was obtained unlawfully you prosecute if you

can the people who obtain the material. but there is a first amendment right of a candidate to use information. you can't include information under the campaign finance law, that would be unconstitutional. judge jeanine: let's talk about treason. how can they even use the word treason in you have got nancy pelosi and the rest of them. nancy pelosi said after these latest revelations it's clear we suffered a desecration of our democracy conclusion has been proven. >> collusion is not a crime unless it's committing a criminal act. but the treason thing upsets me. when we with wrote our constitution the british were using treason broadly against their kings. so the writers of the constitution put a very narrow

[♪] robert: this is a fox news alert, i'm robert gray. senate majority leader mitch mcconnell is delaying a vote on the healthcare bill. chad, what's the latest from d.c. >> what this stems from is a medical condition with republican arizona senator john

mccain. they found a blood clot above his left eye and they performed surgery where part of a bone is partially removed from the skull so doctors can access the brain. we are told senator mccain is doing well, and there could be further treatment necessary. he's at the may oh d at mayo cln arizona. what that means is it puts the healthcare bill on ice. what happened here, robert, the senate majority leader mitch mcconnell determined it's not in the best interests of the senate to forge ahead. they already lost two votes. the key vote coming up in the next two days is the motion to proceed. you can't just start debate on a bill, you have to have a vote.

often times it's a proforma thing. but because the healthcare bill is such a controversial piece of legislation, they plan to conduct a roll call vote. and you need 51 votes to get off the bill. there were two senators already against it, susan collins of maine and rand paul from kentucky. jeff flake expressed scepticism about this bill. if you only have 99 senators. if the vote holds you could probably vote to proceed to the bill and probably pass the bill with 50 senators. but if you are down to 99, people might say you are playing dirty pool and say think got the bill passed when john mccain is out. and that's not way the senate

operates. they won't do that to one senator. robert: where do we go now? it was unclear whether senator mccain was going to back it anyway. where does that leave us now in terms of will there be more modifications for this? will it be how quickly it's going to go? and may it push things back farther on the calendar, on the agenda? >> sometimes you have these hiccups. in. >> instances it can help. it helps to get other proposals together. sometimes it hurts because you feel like you are right there to the cusp and you have the votes and you want to move as expeditiously as possible. mitch mcconnell was trying to move this bill in late june, and it was clear he didn't have the votes then. they took the time over the july

4 recess to alter it and revamp' it. they just rolled this out thursday morning. but there were a lot of senators up in the air and john mccain was one of them. he facetiously said to fox, the process is wonderful and he kinds of rolled his eyes. he said earlier in the week prospects are dim. and said they should have taken more time with this. the revised bill was released thursday morning and he said it does not include a lot of the provisions i have fought for for arizona. he was concerned how this would affect his state and he would be speaking to his state governor to see if changes could be made. robert: do you think it could go back to the committees or provisions added to sway his

vote over to the yes column? >> the criticism is in the united states senate, it went through some committees in the house. and some question whether it was with we call in washington the regular order. that's where mitch mcconnell was catching a lot of flack. there were several senators who are usually team players who confided to me, mcconnell doesn't understand what he has done here, we don't like the process. lisa murkowski from alaska, certainly flake from arizona. dean heller of nevada might be one of the most of crucial ones on the first version of the healthcare bill and his governor from nevada is also going to be

one of the most crucial characters. here is -- if they can get the governors on board say the way you are change medicaid and some of the provisions in these states, maybe they can go along with that. if you can get those governors to fly air cover then those senators are willing to follow the lead of their governors. robert: how is the agenda shaping up? could we see a recess before there is a vote at this point? what are the odds looking like? i realize it's very early and this is a breaking and fluid situation. what does your experience tell you? >> this has made the healthcare question as mercky as possible it was murky before. we were anticipating a new
