send us your songs this morning friends@foxnews.com. everyone had such good suggestions. clayton: we're leas and it gets us off the hook a little bit. jeff sessions a guy who we thought was on his way out. interestingly we hear from the new white house chief of staff calls him and says your job is safe. it seems like he is unshackled now. great, i can actually go after the leakers inside of this white house. pete: this is one of the complaints of president trump was, hey, you recruited yourself that's one thing i'm frustrated about that. the leaks have been a problem. the place put hands on that is the department of justice. they came out strong yesterday and here is what the attorney general had to say. >> let me say that i strongly agree with the president and condemn in the strongest terms the staggering number of leaks undermining the ability of our government to protect this country. this nation must end this culture of leaks.

when few investigations take place, criminal leaks may occur more often in a culture of leaking can take hold. so, today, i have this message for our friended in the intelligence community. the department of justice is open for business. and i have this warning for would-be leakers. don't do it. abby: so that was a strong message. one thing i think we needed to hear even before now because these leaks have been happening for months. he also went at the media. i have been talking about this a lot of what their role is when we talk about leaks. they are the ones that get these documents dumped on their desk. what do they do with it, do they actually leak it out to the american people or decide it's in the national interest to not make it public. he hit on this yesterday he said to the media your role is not unlimited. >> one of the things we are doing is reviewing policies for affecting media subpoenas. we respect the important role that the press plays and will give them respect.

but it is not unlimited. they cannot place lives at risk with impunity. we must balance the press' role with protecting our national security and the lives of those who serve in the intelligence community beyond forces and all law abiding americans. pete: that's a very important point. journalists are not bullet-proof. they don't get extra free speech rights. you can't yell fire in a crowded theater there are certain things can you and cannot do. at what level does a journalist have a patriotic duty to say this is sensitive information, could put our troops, our diplomats, our undercover agents in a dicey situation, i'm not going to publish it. palace intrigue is one thing. that's a lot of what we have seen from leaks. another thing is classified and highly classified information that makes it way into the paper that has no business being there. clayton: another is whistle blowers.

something cease as hurting the american people and they go to a member of the press with this information, this raises all sorts of questions about whistleblower laws and protection and whether or not then the press could be, you know, rounded up and subpoenaed and getting access. pete: that's where the press always goes. you are going to round us up. be more responsible what you publish. one man's whistleblower is another man's leaker. clayton: that's the problem. it comes down to your own conscience. whether you deem the information is it going to hurt the troops in the field and our government and american people. abby: i do think times have changed. i do think we used to live in a world where reporters would actually say i'm not going to leak this out. and now we are at a place where there are some fabulous journalists out there that are very respected and i commend them for doing their jobs. many others so concerned about themselves and click bait and them having that breaking story, they don't think about the problems that may have on our national security, how

that may harm people overseas serving this country, for example. that doesn't necessarily cross their mind. and, if it does, their own interest is more important than the country's. pete: that's a good point. two issues there, one broaden what a called journalist is internet, social media, means anyone could get a leak and publish it maybe they didn't have the same responsibilities that former journalists had. you have a journalist class that is of leftist culture that is maybe less invested this idea of patriotic journalist. inknock columbus responsibility to do anything to undermine this president and get even more leaks. we have a double problem there get our arms around it and get rid of self-inflicted wounds in the west wing and justice department. let's not do it to ourselves. clayton: you know who doesn't mine these leaks is maxine waters. she is encouraging the leaks. she thinks it's a good thing. what was on "the view." abby: still on the air by the

♪ ♪ >> this week the dow jones industrial average reached an all-time high. in may, the unemployment rate hit a 16-year low. prosperity is coming back to our shores because we are putting american workers and families first. clayton: that's president trump making good on promises making major milestones this week. the academy added over 1 million jobs since he took office. this after the dow hits sixth straight record high. what's behind all of these gains and can all of the winning continue? joining me now with insight is economics editor john hilsenwrath. >> good morning. thanks for having me. clayton: candidate trump used to say on the campaign trail when you talk about 4.9% unemployment rate, phony number. one of the biggest lies in all of politics.

he would say i think it's more like 42% unemployment. now is he championing these numbers. he loves them. he is tweeting about them. what's changed? >> what's changed is that he became president. and, you know, we usually see this in campaigns when bill clinton was running for president in 1992, it's the economy, stupid. how horrible the economy was. and obviously when he became president, when we got good numbers, he pointed to them, that's exactly what this president is doing. i think the change in his attitude is a little bit more stark, perhaps, than previous ones. but, you know, the other thing that's changed is the economy is doing very well. we had a good run of jobs growth even before he became president. but now we do have stock prices hitting new highs. consumer confidence is picking up. so, you know, despite all the noise you hear in washington these days, out there in real america in the private sector, the economy is not doing that bad. clayton: so we see consumer

confidence. also we have seen some interesting numbers about hiring low wages employees, also seeing some wages increases which is great. can president trump hang his hat on that? is it a result of stuff that is he doing or just a cyclical nature of this economy? what too you say based on your experience? >> a lot of what is happening is a continuation of trends that were in place before. so i don't think he can take full credit for it. so, you know, right now, we're adding about 180, actually the number was 182,000 jobs a month. so far this year. last year the average was 184,000 jobs a month. so we're exactly in line with where we were last year. but there is more optimism and the stock prices are rising. so, you know, i think he can take some pride and comfort in what's happening but he cannot take full credit for the economy that he has got right now. clayton: you know, businesses are encouraged and excited

about what tax reform could be coming down the turnpike so to speak. >> right. clayton: this stock surge that we have seen hitting this major milestone. do you see this continue and do you see a disconnect? i keep wondering because i hear people like mark could cubn and others getting nervous about the economy. yet you see the stock market surging. what's going on here? >> underneath the surface we spend so much time every day all day talking about what's happening here in washington and democrats this and republicans that. the truth is, you know, out there in the private sector, in the global economy, things are getting better. and most importantly profits are rising. global profits are rising. you know, for one, the few times in this expansion we have the whole world moving in the same direction. europe has been in and out of recession really for the last 10 years. their economy is finally starting to get moving. the chinese economy is stabilized. so, you know, i think we have

waters, she is running for the impeachment of president trump. she sort of in some ways elm bodies the extreme perspective of the left these days. will they ever get past it or are they stuck ton? >> in some ways i agree that maxine waters is an outlier. i think she also reflects a more mainstream sentiment. this was actually encouraged even by obama and hillary in the period leading up to and the immediate aftermath of the election that trump is somehow illegitimate. and i think if -- i think that's been the perspective of a lot of democrats. and one of the reasons i talk about fascism in my new book is that the premise is that trump is some sort of a fascist. and the republican party reflects this fascist sensibility. and obviously if that's the case, remember hitler was elected in 1933, the idea is that the democrats are justified in talking about impeachment, justified in trying to mount a sort of quasi coo against trump. even if there is no real

underlying offense. abby: yeah. and even if it really has zero impact on the potential future of the democratic party. i listened to that statement, and i can't help but think about the governor of west virginia that came out and changed his party two nights ago. i know you watched that a lot of people were surprised by it but he said look, the democrats lost me. i can only best serve this state of west virginia by switching parties and becoming a republican governor. that just gives us a sense dinesh the mood of the democrats focusing on impeachment and focused on hitting the production as much as they can without a message. where is that going to go for the democrats? >> well, i think it's a road to disaster for them. the extremist wings of the party have taken over. and i don't just mean in terms of their tactics, but also ideologically, the democratic party has moved sharply to the left even after obama. and he was quite a leftist himself. pete: dinesh your new book

"the big lie" they call them anti-if a, anti-fascist. you lay out an argument that fascism actually lives on the left. that's where its roots come from. tell us about it? >> certainly we can see that the tactics that these anti-if a guys look at them. they wear blacks, costumes. they carry baseball bats and bike locks as weapons. they threaten and intimidate and use violence on the campus as well as in the cities. so they are the closest resim ambulance today to mussolini's black shirts of the 1920s or hitler's brown shirts of the 1930s. so these are the main difference, i think is, that the old fascists were proud to call themselves fascists. but the new fascists march under the banner of antifascism. pete: interesting. i think people in our audience see the full title is the nazi roots of the american left. any time you hear that word you rear back.

grassroots out there. we have majorities we are going to do it and then they didn't. you know what i'm going to court. clayton: i would love to get our team this weekend, tomorrow we can have a lawyer on to talk about this. abby: how far can this go? clayton: how many doors does this open? abby: how many more will do this feel just as upset giving money hoping they will fulfill their promises and nothing happens. it. pete: it's totally symbolic. i love the sentiment of it screw you guys. abby: shows how angry some of the american people are. we talk about this all the time. any other type of business you would be fired. so his only option right now is to sue because these people are still on their jobs on vacation. clayton: they work for him and hire a pest control company to clean things up and they don't do their job you want your money back or sue them take them to small claims court to get your money back. pete: maybe he will get it back. abby: other headlines we are

following. martin shkreli now convicted of security fraud. is he not going quietly. the former pharmaceutical ceo caught on live stream bragging about his wealth and even shrugging off jail time to a reporter. take a listen. >> what if it turns out that you are sentenced to jail time. how do you think you are going to cope with that? obviously -- >> i'm not so sure that's true. >> it definitely will be different. >> okay. thanks for your advice. abby: shkreli was found guilty of three of eight counts of security and wire fraud last year. he notoriously hiked the price of a life saving drug by 5,000%. he faces 20 years behind bars. many new york city cops are boycotting dunkin' donuts. have you heard this story after officers were denied service. store employees in manhattan telling the "new york post" little to no officers have come in for coffee. this after a worker allegedly told two officers, quote: i don't serve cops as they waited in line at a brooklyn

store. dunkin' donuts has issued an apology but it's unclear if the worker will face any kind of discipline. unbelievable. and vladimir putin is vacationing again. and, yes, he is shirtless. the russian president has been kicking back in the mountains of siberia. the 64-year-old photograph going shirtless to fish, sun bathe and even swim. this isn't his first time visiting the region. here is he in 2009 where the famous photo of him riding a horse with no shirt was taken. that picture has lived on forever. clayton: it's beautiful right now in siberia. check in with rick reichmuth for the forecast in siberia this morning. rick: i don't know. you stumped me again, clayton. clayton: siberian weather forecast. abby: a lot of downpours, rick, including right here. rick: here a lot of the west. monsoonal activity which we love it's the rainy season we need the rain. we have had too much of it. flooding around las vegas yesterday certainly problematic. tropics, got to remember in hurricane season. not all that active.

obviously. it gets active right around now. we have two things we are watching. one here in across parts of the caribbean. this bought bottom moisture is going to move in towards the western part of the caribbean and eventually into the gulf of mexico. we will watch that one closely. another one we are likely going to see form into a storm that's out here, one of the waives coming off of africa. getting to that active point. everybody needs to be watching, especially along the eastern seaboard. right now the eastern seaboard is one big line of storms that moved through the cold front sagging down to the south. good news, that will drop your temperatures and humidity way down. we have temperatures here for highs tomorrow only into the 60's. here we are in august. feels like fall. abby: here i was hoping for tank top weather. rick: it will be back, don't worry. clayton: we want to bring in lee carter.

republicans love the notion of draining the swamp. that's why he is in office. independents are not willing to give him a complete pass because they want to see him doing something. this speech was the worse i have seen democrats dial in quite some time. the last two weeks has certainly taken their toll. abby: why do you think that is? >> the last two weeks have been really tough. this belief about russia has taken hold on the left. independents are starting to get what they believe right now. pete: next one is he talked a lot about patriotism as he often does. here is the next clip. >> we didn't win because of russia. we won because of you, that, i can tell you. state changed parties to the republican side. >> that's right. whenever he gives things back to the people. when he hears the people talk about why that's there it resonates. it resonated with republicans and independents they gave it a minus. democrats are on the floor because they are buying into the idea on russia. one in four people believe something terrible happened with russia. one in four say nothing happened. 2 in 4 say they don't know what to believe. clayton: it's really confusing. >> it's really confusing the folks. clayton: talked about the prosecutor in this russian investigation, bob mueller and says he shall now look into hillary clinton's deleted emails. let's play that. >> what the prosecutors should be looking at are hillary clinton's 33,000 deleted emails. clayton: see the democrats plunge down. >> no surprise. they are like enough already with hillary clinton. she lost. democrats gave an f. republicans gave it an a while

clayton: welcome back. attorney general jeff sessions putting white house leakers on notice. >> this nation must end this culture of leaks. we will investigate and seek to bring criminals to justice. we will not allow rogue, anonymous sources with security clearances to sell out our country.

abby: so county administration finally flush out of the culprits. joining us now is anchor and attorney gregg jarrett. nobody better to break down this topic. this is one of the biggest issues the white house is facing right now is cracking down on these leaks. what did you make of the attorney general's statement yesterday. is that going to do anything? >> yeah. for about a day. you might deter leakers for 24 hours and then they will be back at it the department of justice does need to vigorously go after leakers because look at what's been leaked. classified information, intelligence information, national security information. all of those are serious felonies punishable by 10 years behind bars. and even if it's none of those categories, converting government property to your personal use and conveying it to somebody else is a different felony, punishable by at least one year behind bars. abby: what can they do then? can they do like a lie detector test. >> sure. abby: what are the tactics

they can put in place. >> when you work at the white house, you have to sign all kinds of essentially contracts of employment. and one of them is you cooperate with all investigations and, if warranted, consent to a polygraph. so, yeah, sit people down, hook them up, start asking questions. look, in this day and age, there is such a paper trail electronically that you can narrow down the people who had access to those transcripts. clayton: speaking of paper trails bob mueller special investigator right now looking into the white house and possible collusion with the russian government for the election has impaneled -- put a grand jury together for this. >> in washington, d.c. clayton: in washington, d.c. now, judge napolitano, our friends here at the network says he is in favor of a grand jury because it legitimizes the investigation. you are able to go after subpoenaed documents in a way that moves beyond just voluntarily handing over documents. have you a different take on this. i would love to hear it.

>> i disagree. grand juries are the most undemocratic device ever created. they are completely one sided. the defense is not allowed to be there. there is no crx. cross-examination. it excludes exculpatory evidence. there are no rules of evidence. everything that would be inadmissible at a trial is admissible in front of a grand jury. it's a charade. abby: look how things went for donald trump. 11,000 votes. >> there he did, 4% of the vote. hillary clinton gets 93% of the vote. i dare say there is not a single person on that grand jury who likes donald trump. it's inherently unfair. he should have used the virginia grand jury that is already convened for michael flynn. clayton: you will find the 12 people, 16 people in d.c. that voted for trump. greg, great to see you this

undermining the ability of our government to protect this country. this nation must end this culture of leaks. when few investigations take place, criminal leaks may occur more often and a culture of leaking can take hold. so, today, i have this message for our friends in the intelligence community. the department of justice is open for business, and i have this warning for would be leakers, don't do it. we respect the important role that the press plays and will give them respect. but it is not unlimited. pete: what do you make, governor, he wants to go after the leakers but says the press is not immune. >> the one thing the attorney general might want to do is subsuit the word leaker for criminal. that's what they are. they are not just unhappy with the consequences of the election. they are taking it to a level that is criminal activity. gregg jarrett who has done

some of the most stellar reporting on the entire network regarding some of the legal aspects that are gone on with regard to this and other issues, pointed out just a little bit ago, that it is a criminal activity to take property of the government, possess it as if it is your own and disseminate it as if you have a right to do it. you are violating a number of laws against your own government. this isn't about donald trump this is about a betrayal of trust. the trust that was placed in you and the trust that was given when you get a paycheck. and when people are leaking and giving out unauthorized information, that is protected, i'm not talking about leaking something that is, you know, just embarrassing to the government. that's foolish, but it's not criminal. but when you start taking classified information, information that a president should know is protected in private and leak it out, that's criminal activity. i'm delighted that the attorney general is after these folks. i hope he puts some in prison and serves as an example to others.

abby: i believe there are four charges charged and they are going to start using interesting spy tactics to crack down to get at these rats which is probably the biggest problem that the white house faces. we love your reaction as well to a big moment that happened two days ago, the governor of west virginia. i'm sure you watched it when he was speaking before president trump there. and surprised a lot of people by saying, look, i'm a democratic governor. i have been. the party has lost me. they have left me behind. i am now switching parties. i'm going to become a republican governor. that's how i feel i can best serve this state. you have been a governor, a good governor huckabee, give us a sense of your reaction to that. >> it's a very significant situation because this governor was just elected a year ago. he realizes there is no place for a guy like him in the democratic party. i mean, west virginia is an energy state. democrats have declared war on our own domestically produced energy. how can he continue to say i want to be a part of a party that's going to put many people in my state out of work and on the unemployment line? democrats also are closing

their ranks on ideological positions like abortion. they have become the party of proabortion. republicans are pro-life. but there are some republicans who aren't. i wish they were pro-life. we still allow them in the party. people who are pro-life are not even welcome in the democratic party anymore. abby: what does that mean for joe manchin because he is up for a big election in way. as you know it's an important state. you know, they have moved a little bit more to the right. it's become more of a red state. is he going to feel pressure to switch parties, too? >> i just don't know how a person who has deep convictions about the values of this state, not only the economic values but the social values of this state, that in west virginia, it's still a very pro-life state. it's an old fashioned traditional morals state. i don't know how a person could continue to be in good

conscience a democrat in that environment and embrace leaders like nancy pelosi. chuck schumer, max seep watters. my gosh, how did she become a leader of anything? this is all bizarre to me. pete: speaking of maxine waters she has a different view as you would imagine on all of these developments. this is what she had to say. >> dear lord i hope so. >> many of these people believe is he going to bring back the coal industry. it is not going to happen. they stick with him not because they think he is going to change government as such. i think they stick with him because he has made them believe that somebody else is responsible for their problems. >> yes. >> but these small towns and these areas where the stores have closed down, the jobs have left, it is those people over there, i'm going to build a wall, i'm going to keep those people out. they are the cause of your problem. they are getting something for nothing. it's not you and they believe that. clayton: governor you, your reaction? >> one of the things that i

find myself saying when i watch maxine waters, the only thing that is more troubling than when a person is attempting to be funny and they are not, is when a person is attempting to be serious and they are taken to be a joke. maxine waters is becoming a source of great hilarity for comments. this is a great example. here is a person who under obama had 8 years of seeing energy policies dramatically shift. let's be honest it favored nations like russia because they are in full production. we were scaling ours back. when people want to talk about how russia is involved. donald trump's energy policy is a gut punch to russia. there is nothing that is more devastating to them than taking their energy capacity away by our being the energy producer that sells to europe and asia and that provides for our own domestic needs. why didn't maxine get that? why don't democrats get that?

tallahassee here about four years ago. and when i did, i put -- i went up to ace hardware and got an american flag wrap and put it on the mailbox. it stayed there for four years and nobody said anything about it my neighbors never complained about it then i got this sort of nasty gram from the homeowner's association here stating that i have 15 days to remove it or i would face some sort of dire consequences, fines, a lack of privileges at the tennis courts, et cetera, et cetera. i thought this was a little bit of legal bullying and i quite frankly felt that their position was wrong. i don't think there is anything wrong in displaying an american flag. pete: of course. i think a lot of our viewers feel the same way. here is what the homeowner's associatioassociation had to sa. one of the goals of the srca

is to protect the aesthetic appeal and property values of the neighborhood. to accomplish this provisions have been established by the board of directors. so, aesthetic appeal. apparently the american flag is detrimental to the aesthetic appeal to your neighborhood. why now? why do you think this has come up and they are coming after you now? >> oh, i don't know. i understanding that they might have a new compliance officer. as i understand it, she is a very nice young lady who has been given a list by the board of directors of things to write up. and perhaps she just felt that this was part of her job. and i respect that fully, however, i disagree with the fact that an american flag anywhere is going to destroy the aesthetic value of anything. abby: john, you meet with the hoa on tuesday this next week. what do you think will happen from here? >> well, i'm hoping -- i

understanding i have a lot of support, a lot of emails. i'm going to go before the board and i'm going to make my appeal and my appeal essentially is going to be this: i will go there with my flag wrap in my hand. and i will show it to them that i have taken it off. and i will admit that i did violate one of their covenants or restrictions but quite honestly i didn't know that and as i said the flag has been there for four years and nobody complained. but i will also ask them to change the rules and to allow the american flag to be put on any and all mailboxes in this community. pete: john ackert retired u.s. navy officer still in the fight. i'm sure have you a lot of neighbors and others standing with you. there is no reason why the american flag should ever be seen as a political symbol or aesthetic nuisance for sure.

pete: absolutely. one week on the job, a difficult one as chief of staff, based on what you know about him and his background. what do you think this last week has been like? >> well, i would say for everybody on the staff it's probably been a pretty tremendous week. you know, john kelly is a very high energetic individual. and, pete, you know his type of -- type a general officer. and coming over there to the white house. i'm sure that -- i'm sure that he has pretty well squared things away the first week. it will be interesting to see where he goes from here. >> sure, absolutely. tell us how you first met with him. how did you work with him? >> john kelly and i worked together when we were in the legislative arena. and it was about 17 years ago. i was lieutenant colonel john kelly was colonel. he was running marine corps legislative affairs over in the house of representatives.

and even though i was in the army, he became a mentor of mine just because he was the best in the business. and if you wanted to learn your craft, you went to the best in the business and he afforded me the opportunity to kind of learn arm's length. pete: reports out of the white house are schedules are tightened. appointments are being made. folks are told to get in early. you call him the best of the business. what tributes in particular do you think is he emphasizing right now. >> pete, you know i mean you have been there and you have done that general kelly has served this country since 1970 when he came on active duty as a marine enlisted. man. and he has honed his craft his entire life. and just the organizational

skills that he brings to the job, and the ability to communicate effectively with subordinates. he commands respect. he is just the type of individual who has a tremendous personality. his inner communication skills are just phenomenal. and he could speak to anyone, pete. like common person on the street. and infantry men in the fox hole or the president of the united states. pete: and do you believe in that context his life experience has brought him to the point where he would say, mr. president, here is why we shouldn't do that? >> absolutely. you know, you keep hearing all of this noise about chaos here and chaos there. listen, nobody knows chaos more than a warrior. you train for it your entire life. and that's called real chaos. chaos on the battlefield, pete. you know that being a good

clayton: welcome back, canada is feeling the impact of their laid back immigration policy. this week refugee shelters became so overcrowded that they were forced to open the none tree olympics stadium for new asylum seekers flowing into this country. abby: is that evidence that open arms policy on immigration is starting to back fire. here to weigh in is author of green card founder and warrior executive director of liberty and american justice nick adams. great to have you with us. >> good morning. abby: what's going on here? >> look, i think canada is finally feeling something that they may not have felt before. i think that this is a self-correction. i think that we're seeing that

when you put out a very strong message and you are unequivocal and make it very clear that people are not going to be rewarded if they do the wrong thing, they end up doing the right thing. obviously, there are lots of people that have left the united states to go now to canada and i just think it's wonderful that the pajama boy prime minister is going to be dealing with all of that in canada. pete: nic, in addition to anybody that may come from the states. have you immigrants coming from elsewhere around the globe as well. this is not just the u.s. >> that's right. there are people everywhere coming in there to canada. look, this is one of the things that happens. when you open the door, when you don't put any restrictions, when you don't put any limits, you end up getting a situation that is completely and entirely out-of-control. that's what we're witnessing now. and i think it's a very cautionary tale for any country and any culture anywhere when it comes to immigration policy. clayton: nick, tell us about

your story for our viewers who aren't familiar as a proud immigrant yourself. >> well, look, i came to the united states because i wanted to be a part of the greatest country in the history of the world. i wanted to come to a country where ambition was encouraged and risks was nurtured and so i came here. it took me a long time to come here, pete. it cost me a lot of money. but if i had to do it again, i would. i followed all the legal processes. i did all the right things. and i'm really insulted by illegal immigrants and people that don't do the right thing being rewarded. abby: immigration is important topic for the president. he campaigned on it the white house backed a new immigration plan this week. i'm sure you saw it. it led to this heated exchange between one of their main sellers of this plan steven miller and jim acosta from cnn. it really was a back and forth of who sounded more ignorant and racist. do we have that bit we can play?

>> your statements also shock another respect too. look at the history of immigration, it's actually ebbed and flowed. we have had periods of very large waives followed by periods of more immigration and less immigration. >> period of right now wants to build walls. >> exactly. >> bring about a sweeping change to immigration. >> surely, jim, you don't actually think a wall affects green card policy. >> talking about how border crossings -- >> -- i want to be serious, jim. do you really not know the difference between green card policy and illegal immigration? >> jim acosta got absolutely schooled. he think he proved if f. brains were dynamite he wouldn't have enough to blow his own nose. it back fired tremendously. he was totally beyond what was being discussed. pete: certainly seeing canada and the united states two different immigration policies and we will see how that plays out. nick adams, president of flag. we appreciate you being here this morning. abby: dr. sebastian gorka

for the next 20 years. i want to bring in deputy assistant to president trump dr. sebastian gorka to help elevate the conversation this morning for us. good morning, sir. how are you? >> you are having far too much fun there in new york. abby: too much. clayton: we have to. let's go back to not having fun in washington, d.c. and cracking down on these leakers. we saw attorney general jeff sessions this week unshackled back in front of the podium issuing warnings to those who are trying to undermine the president. look, he said don't do it or you are going to be prosecuted. what lengths will they go to to stop this? >> right, so good morning, everybody. yesterday, we had the four star general, former four star general john kelly give all hands speech first thing to everybody inside the eisenhower executive building that works for the white house. he started the day by saying loose lips sink ships. and if you leak, there will be consequences.

that's a four star marine corps legend. then we have the -- i had a long meeting with the attorney general. and then he had his press conference. the facts are the facts. we have had five times as many criminal indictment referrals to the doj on classified leaking on just the first six months of our administration as opposed to the whole year last year. and he has prioritized these issues. i know the base is concerned sometimes. but these things cannot be done overnight. but the attorney general is a serious man. he has told the fbi, he has told the national security division of the doj this is the priority and there will be results because he will get to the bottom of the leaks. abby: you mentioned general john kelly, a four star general, someone who is still so respected on both sides of the aisle. is he now in as chief of staff. you were there behind closed doors. give us a sense of the mood with him now in charge over the past week. halls the mood changed inside

the west wing of the white house? does it feel like it's more clamped down like people won't be able to get away with the things they might have before? >> well, for those like myself who have nothing to hide we are glad he is there we are sad he left dhs because he made things for dhs. those abiding by federal law when it comes to sensitive and classified information. i think they have got the message and i think you will see things change very rapidly because this is john f. kelly. this is a man you do not toy with. pete: dr. gorka, talk about toying with people. reporters in the white house and elsewhere have been reacting to this crackdown on lease because jeff sessions went a step further saying you know, journalists aren't immune from our scrutiny as well. trusting and understanding their first amendment rights.

but at some point, if you are a part of leaking of information that has national security consequences, there will be consequences for you as well. what can you say about the purview of this influence on reporters as well? >> right, you know, we are not going to talk about the inside baseball right now. what a.g. sessions has planned. he is absolutely right. a democracy thrives upon a free press. it's essential, okay. that's one of the markers between a free society and a society that's a slave society. but the fact is there is a reason that this information is classified. it's not a joke. you are endangering the lives of americans when you release secret or top secret information. just the idea, just the idea that the president of the united states cannot have a confidential phone call with another head of state is outrageous. and when you get democrat politicians on the hill say that that leak is disgraceful, you know we have sunken to a

new low, pete. pete: absolutely. i want to ask you about another angle inside the white house. there have been reports recently that there has been shakeups at the national security council h.r. mcmaster getting rid of some people seen as trump loyalists and keeping obama holdovers there. with concerns about leaks is there any sense in that shuffle where the national security advisor is going with his staff? >> look, the national security advisor is there as the highest ranking advisor, the most senior advisor to the president on national security issues. and he is there to provide a slate of options to the president. we have seen that we have a very robust debate inside the white house. especially on afghanistan. h.r. mcmaster has a team. he has every right to have the people he wants work beneath him. at the end of the day, it's not about h.r. mcmaster. it's not about his team. it's about the president. it's about donald j. trump and commander-in-chief providing him with the requisite options and information. then he decides.

and look at what he has done. whether it's the moab bomb, whether it's the 59 cruise missile strikes and revitalizing of nato what we have done additional whether i russia recently. we have replaced or the president has replaced divisiveness with divisiveness. clayton: dr. gorka, i want to get your take on afghanistan. the longest war in american history at this point. the president has been reluctant to send additional troops to that region, to get bogged down in this morass that it's become. reports are that trump's national security advisors are searching for ways to overcome president's reelectric tawns tans on this issue. are we going to send more troops to afghanistan? >> right now, we're going back to the fundamentals. the president had a very, very robust meeting with his principles in the white house two weeks ago. and then he went to the pentagon and discussed national security issues there. the fact is he is asking the right questions. he comes in to thi this with ths

businessman mentality. he is not ideological. he says okay, what is the relevance of afghanistan to america in terms of national security? and the most important question, clayton, he says we have inherited 16 years, not 8 years, 16 years of bad strategies. i want you to go back to the basics and ask the are your assumptions correct? and if they are not correct, we need to have new plans and we are working on those new plans right now. pete: are the public comments on this accurate that you have got generals wanting more but instincts of this president who didn't run to nation build saying if we send more, those underlying premise cease have been wrong for 16 years. we have been throwing good money at bad and haven't made as much progress as we want. is that tension there and where do you think he comes down? >> there is a healthy debate. it's not just mudge the generals and the president. it's amongst the civilians and principles. it's a healthy robust debate. we don't have group think. think about it. we have had an administration

had in the history of this country. as far as the economic bump, the trump bump of what has happened since the election. business is booming because business believes this is going to be a business friendly president and already has been. abby: if this continues on we have talked about elections and what draws people to the polls and what issues matter most to them time and time again. the economy is always, always number one. if the economy can stay where it is and even continue to get better, we still struggle with wages. people need continue to crease their wages. democrats are going to have a tough time in the mid terms. because that still is the number one driving force for anyone to go out and vote. clayton: here is what the president tweeted. excellent jobs numbers just released and i have only just begun. movement back to the united states. so, not to be a wet blanket but let's put this in historical context because john was on the show earlier this morning and i asked him, he studies the market day in and day out. i said can the president take responsibility for this? is this his economy? and he said not really. he said a lot of things that we're now seeing have been put

in place over the past many years. and really you can never really look at a president and say that their there are immediate results in the economy. it takes about 10 years before you actually see results from that previous president. pete: if you look at the trending of the dow it started the day after election day. the current rally. clayton: the dow, yes. pete: third largest rally in american history as far as percentage growth. abby: speaks to the hope that people have that could potentially change. clayton: is that true word, hope. that's what i was asking him. okay. they are banking on tax reform. they are banking on being able to spend money to hire employees right now based on these numbers. so they have got to get tax reform through. because a lot of these companies are hiring based on that. there is all this hope right now in the market because of that. so republicans better get off their did you have and get something done on tax reform. pete: the president is challenging maxine waters. the jobs aren't coming back. abby: is he blind. pete: is he challenging that premise. he believes america is still the best place in the world to

the avery family didn't fit into the community. clayton: u.s. appeals court thrown out earlier decision to overturn the conviction of brendan doesy. he was convicted of helping. the court will now reconsider that decision in september. pete, twists and turns. pete: thanks, clayton. american atheists are up in arms after the white house hosts weekly bible study with high ranking cabinet members. some say bible study is illegal use of taxpayer funds. is this okay or is religion not welcome at the white house? here to debate it andrew seidel is a constitutional attorney for the freedom from religion foundation and student and founder of student leadership university and faith leaders. one of the faith leaders on the white house faith based initiative team. andrew and jay, thank you very much for joining us this morning. andrew, i will start with you. the name of your foundation is freedom from religion. however, when you read the

first amendment, it talks about freedom of religion. why would these leaders not have the ability in a country with a lot of faith-filled people to simply host a bible study? >> well, look there are two major concerns here. there is the legality and propriety of this. first, these are government officials on government property using government resources on the taxpayer time getting together for religious purpose. that raises several issues. what is the extent of the government resources being used? are staffers pressured or coerced into attending? pete: you believe that cabinet members. >> committed a number -- pete: do you believe they are being coerced. >> i'm saying this is something we don't know. we have submitted recordings requests to determine the extent of any possible violations. if you leave the legalities aside. the propriety here, it can't be considered proper or in keeping with american values for government officials to get together on taxpayer time to study a book that condones slavery and subrogation of women and internal torture and torment of people who don't believe like you.

if it doesn't violate directly it certainly violates that core principle of government separation of state and church. i will le>> i'm upset that andrs dismayed and appalled and distraught that a group of men and women in the white house who are faced with some the challenges that our world is facing, the planet is on fire, will take a little bit of time to get to know each other, to pray for one another, and then also to pray for wisdom and to see, you know, a verse or two in scripture about how to be focused in life. so, i'm very grateful we have a president. i'm very grateful for a cabinet that gives people an opportunity to do so. and if you were to take away. in fact, i'm afraid andrew and some of his friends would be very upset to have been at that constitutional convention in philadelphia when, i guess their hero, benjamin franklin stood and said simply, sir, i have lived a long time, we

have seen, after praying daily in this building, for divine protection, during the. >> that's not actually correct now, did they? they didn't pray daily at all. pete: they pray pray during sessions of congress. >> what they said. pete: can you hear us andrew? >> that's what benjamin franklin said. that's his own words. >> benjamin franklin proposed a prayer. they did not have any prayer at the constitutional convention. delegates actually rejected his call to prayer. pete: do they have prayer in congress today? do they not open sessions of congress today with a prayer? >> well, in the freedom from religion foundation is actually suing because they have rejected atheists attempts to get invocation done. james madison who wrote the bill of rights and father of constitution says shap palestinian in congress are violation of first amendment. again, we don't have. pete: you are invoking what many invoke a wall of separation between church and state.

except the wall of separation of church and state is not in the constitution, is it? it was in a letter drafted in 1803. the entire premise. >> no. i mean, absolutely not. that is a phrase that is used to sum up the relationship between religion and government. and it has been adopted by the supreme court as early as 1878. i mean, fair trial isn't a phrase that appears in the constitution, but everybody recognizes that there is a right to a fair trial. pete: doctor, difference between freedom from religion and freedom of religion. >> there is no question. i don't know how it can trauma advertise somebody, people of their own free will have chosen. they have the freedom to say i am a man of faith. a woman of faith. i need prayer. and i would like to do this. and i'm very grateful that we have an administration that says part of what made america america is our faith. you know, andrew is right. nobody should have anything imposed upon them. and no one at those weekly bible studies and those of us that have the privilege to

falls, what do you make of this story? >> well, i think that's brilliant. and the danger of the republican party is that there are millions and millions of people across the country who would join him and make it the all eye time class action suit ever been seen on the planet. you can sign me up for that one, too. because, let's -- having just put down maxine waters, i will say this about the democrats, whatever you feel, they get into power and they deliver. boom. right from the first day. they are doing it governmentized healthcare. gay marriage, open borders. transgendered military, climate change. they deliver. for key segments of their -- key niche democrats of their base whereby the republicans basically ease up and they are where -- to the point where they will do what the democrats do two, three, four years later. and that's not enough. if the republicans are just a

mechanism for taking money from the rubes and slaps and industrial complex the party works fine. what the last six months parliamentarians like paul ryan and mitch mcconnell simply cannot deliver. or is he a political opportunist? here to debate it eric beach is a republican strategist and co-chair for the pro-trump gait american pack and steve laser a democratic strategist. steve, first to you. is this a sign of the times, more trouble tore democrats or the horizon or something else? >> well, it's a sign of the times. i wouldn't say it's trouble for democrats. first of all, look. jim justice was a republican his entire life. he switched parties because he knew he couldn't win the republican nomination in west virginia. very similar to what mike bloomberg did here in new york. bloomberg knew he couldn't win the democratic nomination. now is he switching back because he doesn't want to face a republican in 2020. very smart state politics by him but it really doesn't have anything to do with national politics at all. clayton: eric nothing to do with national politics. sea political opportunist. do you buy that argument? >> well, no, not really. the democrats have a map and messaging problems. in 20168 states that the democrats have to get back in terms of increasing the

senate. the democrats are going to have a real problem here in 2018 on trying to win an election because they don't have a message and also the math doesn't look too good for them. clayton: steve? >> the situation we have right now going into 2018 if it's a problem it's a problem i would like to have every time. the race that we recently didn't quite make in georgia is a race that democrats have historically not even been close. in we ran close in that race. we will win a lot of the close races this time. you know, this whole thing about talking about this person switching in west virginia. republicans have the entire government. have the presidency. they have the congress. they can't get anything done. they have to talk about something like this. that's, you know, to use a trumpism, that's sad. clayton: eric, this used to be a blue state. bill clinton use. i used to live in west virginia. this in my mind is bigger trouble for democrats than it would appear on the surface or that democrats are willing to

admit. no. >> there is. protect states like missouri. they have to protect states like indiana prosecutor president trump won by 19. they have a real problem here coming. in they haven't communicated to the blue collar voter whatsoever the middle class working man voter and women voter. so they have a problem of messaging. and at the end of the day what president trump is showing is that he knows how to goat those voters out. he also knows how to communicate to those voters. so i think, you know, there is going to be a great contrast here in the next 18 months of whether or not you think that the environment, that the economy is moving, that jobs are being created and when you create 1 million jobs since taking office, that's showing something he think voter are going to reward them forget about the west virginia governor. don't democrats have a major messaging issue right now? >> our major issue, we have created in the last year during the same period of trump is claiming that he created a million jobs. we created 1.2 million jobs

under president obama. we are moving backwards. eric wants to talk about president trump. we are happy to talk about president trump going into 2018. we are going to have our own message as far as, you know, a better deal, a better wages and all those things. we're going to have a message out there. we are just not going to be focusing on president trump. i'm really happy to talk about him. as much as eric wants to going into 2018. clayton: eric, is that a good plan for democrats. >> yeah. they have to talk about president trump. they don't have a plan to run on. steve is talking about a better deal and what we're going to run on. but, i mean, what is their message? who is their leader? it's a leaderless party. who going to guide them? who is going to create their message? there is a lot of fracture within their own party. i think they have to make it about president trump and, if they do, that's fine. >> i would rather -- than him. that's for sure. clayton: great to see both of you this morning. who is right? let us know go to friends@foxnews.com and weigh in. thanks, guys.

>> abby: welcome back. well a brand new document that's bringing uneven more questions about that meeting on the tarmac between then attorney general loretta lynch and former president bill clinton. here was some of the revelations as jordan seculo with the american center for law and justice which received these e-mails as a result of their freedom of information act request. jordan good to have you on. you have been going through these e-mails that reporters have sent to people within the doj. what have you found? >> well you know, it took, we filed this request more than a year ago. couple weeks after the meeting which was in june of 2016 on the tarmac in phoenix. we filed in july. initially the fbi responded and said they would actually do this in a quick way and then ultimate ly sent us this letter. i've got it here and this letter said we didn't find anything. now, interesting enough if you look through the documents you'll see that the f b auto officials are actually in correspondence with the department of justice so they should have found documents this

is all under jim comey's tenure at the fbi but we found washington post reporters talking to the public affairs team at department of justice and new york types reporters and the department of justice reporter for washington post, i mean they're saying basically i'm hoping i can put it to rest this story and editing their story with the talking points from the department of justice to make the attorney general lynch at the time look better. remember she never recused herself from this case. the new york times was saying i'm being pressed into service and then ultimately they say when they're looking at this, well if it's just fox news maybe we won't have to use the talking points and i pull this, abbey because they won't let us see what their talking points were going to be because they said it's just fox news. maybe cbs with a few lines so we don't worry too much about it. >> abby: so what does that tell you when we talk about the new york times, washington post we're talking about mainstream media in some of these cases what does it tell you about what they were trying to down the situation? >> they're trying to down play

this story. now remember, it wasn't just about loretta lynch and at that time, the department of justice or president obama. we were in the heat of a president den shall campaign so what they were really trying to do was not just help loretta lynch out of this situation or president obama's department of justice or the fbi. they were trying to help hillary clinton. when it gets to it. >> abby: just to be clear i want to point out jordan i think we have the e-mail from the washington post that was sent to someone in the doj because i want to get the wording exactly right but basically, along the lines of they are wanting to get to the bottom. it says here my editors are still pretty interested it and i'm hoping i can put it to rest by answering just a few more questions but i do want to point out jordan the washington post later that day did put out a report on this did put out a piece. >> they put out pieces. their pieces were very generic. we actually went through all of them from these reporters and most what they said was some of their staff was surprised that
