that is it for us tonight. i won't be here next weekend because my daughter, kiki, is getting married. thanks so much for watching. i won't be here next week, by. j, three people including two law enforcement officers killed during violent clashes at a white nationalist rally in virginia. hello and welcome to a special two-hour edition of "justice." i'm jeanine pirro. one driver under arrest after his car plowed into a crowd of people protesting the white nationalist rally in charlottesville today. one was killed and 20 others injured. then a few hours later a helicopter crash near the rally killing two law enforcement officers on board. virginia's governor declared a

state of emergency. ellison barber is live at the university of virginia medical center where many of those injured are being treated. ellison? reporter: five people are at this hospital in critical condition. four are listed as serious condition. a spokesperson for the university of virginia medical center tells fox news 20 people were brought to this hospital today in addition to the nine in critical or serious condition. six are listed as fair, four listed in good condition. one person passed away. many of those injuries came after a car plowed into two other cars and a crowd of what witnesses describe as counter-protesters or anti-white nationalists. >> i was 10 feet away from them. and all of a sudden you heard the impact of a person being thrown over a car. in my footage you can see the

car coming in at 30-40 miles per hour. reporter: the driver sped away, leaving behind 9 people who needed treatment for injuries and a 32-year-old woman who did not survive. >> the crash claimed the life of a 32-year-old pedestrian at the intersection as she was crossing the street. we are in the process of notifying her next of kin. the suspect vehicle was located moments later and the male driver is in custody with charges pending. reporter: the governor of virginia says the city and state spent long time preparing for this unite the right white nationalist rally. he blames most of of the blame for today's chaos on that group. >> i have a mess knowledge to all the white you presentists and nazis who came into charlottesville today. our message is plain and
8:03 pm
simple, go home. you are not wanted in this great commonwealth. shame on you. you pretend that you are patriots, but you are anything but. you came here today to hurt people. and you did hurt people. and my message is clear. we are stronger than you. reporter: that rally never began it was set to start at noon. by noon authority had shut it down. there were clashes. governor terry mcauliffe declared a state of emergency. police say they are considering a criminal homicide investigation and charges against the driver are pending. judge jeanine: president trump condemning hate on both sides.
8:04 pm
>> we are closely following the terrible event unfolding in charlottesville, virginia. we condemn in the strongest possible terms this egregious display of hatred, bigotry and violence on many side. on many side. it's been going on for a long time in our country. not donald trump, not obama. it's being going on for a long, long time. it has no place in america. what its vital now is a swift restoration of law and order and the protection of innocent lives. no citizen should ever fear for their safety and security in our society. and no child should ever be afraid to go outside and play or be with their parents and have a good time. i just got off the phone with the governor of virginia, terry
8:05 pm
mcauliffe, and we agreed the hate and division must stop. and must stop right now. we have to come together as americans with love for our nation and true affection. i say this so strongly. true affection for each other. we have so many incredible things happening in our country. so when i watch charlottesville, to me it's very, very sad. i want to salute the great work of the state and local police in virginia, incredible people, law enforcement, incredible people. and also the national guard. they have been working smart, and working hard. they have been doing a terrific job. federal authorities are providing tremendous support to the governor. he thanked me for that.
8:06 pm
we are here to provide whatever other assistance is needed. above all else we must remember this truth. no matter our color, creed, religion or political party, we are all americans first. we love our country, we love our god, we love our flag, we are proud of our country, we are proud of who we are. so we want to get the situation straightened out in charlottesville and we want to study it. and we want to see what we are doing wrong as a country where things like this can happen. my administration is restoring the sacred bond of loyalty between this nation and it citizens. but our citizens must also restore the bond of trust and loyalty between one another.
8:07 pm
when must love each other, respect each other, and cherish our history and our future together. so important. have to respect each other. ideally we have to love each other. judge jeanine: did the president go far enough? in addition to the comment you just heard, the commander-in-chief also tweeted this upon learning of the attack. we all must be united and condemn all that hate stands for. there is no place for this kind violence in america. let's come together as one. the president clearly decrying hate. but he's taking some flack from both side of the aisle not specifically coming down on white supremacists or the white nationalist movement in his tweets or public remarks. more on that in our next half-hour. but for more on the developments in charlottesville, virginia,
8:08 pm
let's bring in virginia congressman tom garrett. you just heard the president. he condemned the hate and division. are there other steps the government should be taking? >> public safety is a legitimate purview of government. the individuals that descended upon charlottesville, virginia were counter in their efforts to that public safety so we need to do everything we can to insure individual can as the president said feel safe when their children go outside to play. that's an underlying principle of government at any level. judge jeanine: i have been in charlottesville. it's truly one of the most of beautiful cities i have ever been in. there is talk that the people who came in and did this protest, the white nationalists, most of are not even from this area. is that correct?
8:09 pm
>> look, i have been in touch with law enforcement in the area. the number i was given was north of 90% of the and 8ors were from outside the area and outside the state. i heard from law enforcement they were from arkansas, colorado and new york. the individual in question with the vehicle is inio, louisiana. so the good news is if there is any, to find 500 macist lunatics. they aring if to leave charlottesville and go back home across this country. so we need to be united. i think there is real room for folk on the left to welcome us to join them in condemning this hate-filled rhetoric that is antithetical to thomas jefferson's comments that all
8:10 pm
men are created with inalienable rights. it's an amazing place. thomas jefferson wrote the declaration of independence in charlottesville, virginia. james madison, justice marshall, patrick henry, the civil war ended in the fifth district and the civil rights movement began in virginia in the district. this is a scar on it face that it doesn't deserve. i'm saddened. i'm saddened for the victims. there is no.
8:11 pm
judge jeanine: what brought these white nationalists to seek a permit in your city. >> it's our city. there has been a controversy for a number of months over the decision to remove the statue of a confederate general. so these folks have used that as a rallying cry essentially to say they are defending heritage. ultimately everyone should be able to agree with dr. king when said 54 years ago this month in this city that we should judge individuals by the contents of their character and not the color of their skin. judge jeanine: what is going on in charlottesville right now? is there a curfew? what is it like there now? >> thomas jefferson said a lot about free speech. he gave us a near perfect document, the declaration.
8:12 pm
they are trying hard to let people peaceably assemble. the first order was enforced earlier today. there is a black lives matter rally on the university of virginia right now and to my knowledge this is peaceful. i want these folks to go home and america to know who they are so we can stand united. that these racists who don't understand that no person is better than another by virtue of how they worship and what they look like have no place in the america i love. judge jeanine: this is pure hate. hate leads to violence and that leads to retaliation and that leads to community unrest. you were the sitting d.a. there is criticism that the feds need to be brought in. there is one individual under arrest, and homicide, i believe. are you comfortable with the
8:13 pm
level of law enforcement involvement locally? >> i'll tell you this as an aside. i was not the prosecutor in charlottesville. when the feds came into our cases we were sceptical. let's let the facts unfold. but i have great confidence in the professionals in the city of charlottesville to do this right. tragically sometimes in cases the prosecutor works on when we see the darkest event unfold. there are great people doing great work. judge jeanine: congressman tom garrett. indeed a dark day in charlottesville. thank you so much. >> please all of you pray for the victims and some healing. judge jeanine: more on this developing story throughout this hour and the next street. governor mike huckabee is live with me to weigh in on this

named james alex fields is? custody tonight facing attempted murder charges. police are tight lipped about the specific circumstances. but one outlet, the "washington post" is reporting that the arrest may be in connection with the violence that erupted at that white nationalist rally in charlottesville. it results in three deaths and prompting the governor to declare a state of emergency. two of those dead were law enforcement officers who were on duty for the rally and the clashes that ensues. our condolences and prayers to their families as well as the victims at that rally. here with reaction to all this is governor mike huckabee.
8:19 pm
a very, very dark day and a very long day in charlottesville. a city that was once one of light stained by what happened today. ways your take on the events of today? >> judge, i have got a special repull shun to white supremacists, it's part because i'm white. it's part because i have seen this evil and hateful attitude that elevates some people above others. as a believing christian i'm especially offended because anybody who believes the biebility, especially the gospels will have to accept that there is no way that god as a respecter much persons be he doesn't love some people more than others because of their color or affiliation with him. so i find it disgusting and repulsive. i don't know of anything who is doing anything other than
8:20 pm
condemning the violence and the very spirit of white supremacy. i find as disgusting as i do those who say some people have a greater right to live. it's why i'm pro-life. how can i say i believe the goss pels and every person has equal right before god and intrinsic value but some people aren't as valuable as others. it's why i'm pro-life and repulsed by white supremacists. judge jeanine: what do you say to people who say the president wasn't specific enough or hard enough. he condemned the display of hatred, bigotry and violence. it's been going on too long and has no place in america. are these trump haters who will look for any reason to dump on the president.
8:21 pm
>> it seems like a lot of them are. i don't know what they expect the president to do. at the time he made the comment, the driver of the car had not even been identified. ways he supposed to say? is he supposed to do with barack obama used to do and jump to a conclusion and make a decision like he did ifr in ferguson, missouri which turned out to be untrue? i thought what he condemned is what we can all immediately condemn. some coward in a car drove into innocent people to try to kill them. he condemned that. what else is he supposed to do. some criticized him because he said violence on both sides. judge jeanine: on the screen is the individual we just referenced, james alex fields. this is a man in custody right now. the post is saying he's the
8:22 pm
individual who is responsible for the drive in the crowd today. governor, go ahead. >> i hope this individual -- i don't care what his philosophy is. i hope he's prosecuted as a domestic terrorist. because that's what he is. i'm not hesitant to call him that. he's a terrorist. what he did was vile. he attempted murder and he murdered a person. this was not just a vehicular homicide. this was intentional murder. i'm glad he's in custody and i hope he's prosecuted to the fullest extent of the law. judge jeanine: of those nine injured in addition to the one deceased, five are in critical condition. let me quickly ask you before i come up against a break.
8:23 pm
what do you say to those individuals who say that the alt-right are white nationalists? >> i think most of people who use that term don't even know what it means. what is alt-right? what is that supposed to mean? is it a person more conservative than they are. do we also condemn the at-left? i think we ought to stick to individuals and rather than giving people labels that may not be very definable. let's just call it horrible when people do something that's horrible rather than identifying with a political ideology. judge jeanine: thank you for being with us tonight. what is this white nationalist movement that touched off all this violence and what are its roots? we'll get into that with my next guest as our hour of coverage in this developing story continues. then a special two-hour edition

8:29 pm
the turn of the century. what brought you to this conclusion? >> first of all i would like to make it clear to everyone that's viewing, that what i saw in 2000 and was published in 2002, this rise of the new white nationalism. that occurred long before the election of president trump. i called it new to distinguish it from white supremacy because it was the people who were being involved were more intellectual. they were not espousing racial violence but they had briefanses. they questioner upset about multi-culturalism and affirmative action and they felt white people's rights were being trampled and no one was rinsing to their briefanses. when they were stressing the

racial double standards, i saw the argument to resonate among the young people. so my book was written as a warning. i saw conditions converging that i knew the movement would grow in the we started addressing the issue. judge jeanine: our saying is the rise of the alt-right is not the same as white supremacists. >> yes. that's exactly what i'm saying. judge jeanine: the alt-right you predicted would increase is doing so because of multi-culturalism and the fact that the whites don't feel like they can be part of it? what are you saying? >> i'm saying white people have grievances and they have for a long time. back when i started work on the research for the new white nationalism, i saw there were conditions that were converging
8:31 pm
to create a devil's brew for racial unrest. what happened in charlottesville, and i would like to say virginia is my home state, i think we'll have more of that unless we start having honest dialogue about the issues. it's not like one side is all guilty. what happened was tragic. but there is a lot of anger and frustration and fear. and the commute community we know they have their own problems. judge jeanine: but, doctor, right now we all abhor, detest any kind of violence based upon hate. and it does ultimately lead to violence. aren't we talking about the extreme right and the extreme anti-far left? in fact let me say one thing. what we do know is the one person who is dead appears to be dead and nine others injured as

into the clutches of the more extreme element. the neo-nazis, the kkk, those groups. but for the most of part what i warned about and called the new white nationalism was new because it was not espousing violence or using racial epithets, it was saying white is like knot iter group. whites are being discriminated against. judge jeanine: we are coming up to a break here. but what you are saying is that the alt-right is different from these white supremacists and we condemn all white supremacists for any acts of violence and acts of hate, we agree on that. >> yes, and i think there are remedies, honest die losing and conversations where people are listening to one another. judge jeanine: reaction from our
