judge jeanine: we are continuing our coverage of the chaos and violence that his left three dead in charlottesville, virginia. welcome to the second hour of justice. i'm janine. as we have been reporting, a car plowed into a crowd of protesters marching against the white nationals rally today. that driver killed one person and injured at least nine other people. please do have one man in custody right now facing murder charges and he is a 20 -year-old

james alex field and police have not confirmed that he was the driver in this attack. although, other news outlets have indicated that the arrest was in connection with it. not long after the attack a helicopter crashed in the area killing two law-enforcement areas. that crash according to officials was also tied to the rally. those officers identify tonight as virginia state police lieutenant j cohen and trooper burke bates. president trump this afternoon telling the nation quote the hate in division must stop. let's go straight out to allison barber who is in charlotte for untrained charles, virginia. reporter: he's facing a number of charges in the announcement coming from the charlottesville police department moment ago. he is charged with one account of second-degree murder and three counts of malicious wounding and one count of hit and run failure to stop with injury. paramedics brought 20 people to the hospital that i'm standing

in front of now, five people remain in critical condition at this point in time. a spokesman for the university of virginia says that paramedics initially brought people to the hospital and we now know one person has died in addition to those five in critical condition. for other are in serious condition tonight, six are listed as fair and poor as good. many of those injuries came after the car plowed into two other cars and a crowd of what witnesses described as counter protesters. listen to one person thought all. >> i was 10 feet away from them and all of a sudden you heard the impact of a person being thrown over a car and you could see in my footage the car coming in 30-40 miles an hour. reporter: the driver sped away leaving behind nine people who needed treatment for injuries and 32 -year-old woman who did

not survive. >> the crash also clean the life of a 32 -year-old female pedestrian at the intersection as she was crossing the street. we are still in the process of notifying her next of kin. the suspect vehicle left the scene of the crash and was located moments later and the male driver is in custody with charges pending. reporter: at least 35 people were injured today and the governor of virginia says that the city and the state spent a long time preparing for this white nationalist unite the right rally in the group said they intended to protest the city's decision to remove the statue honoring confederate general robert e lee at a park in charlottesville at the emancipation part. that rally actually never began and it was set to start at noon but by noon authorities had

already shut it down and there were violent bloodied clashes between whites a promise and anti- fascist, counter protest group and governor declared a state of emergency. this places most of the blame on the violent turn of events on that group behind the unite the right rally and said in part, quote i have a message to all nationalist today that our message is you are not wanted in this great commonwealth and he told them you thank you are patriots but you are not. at one point, he told them they should all go home. back to you. greg.judge jeanine: strong words earlier today from virginia governor in the wake of these deadly clashes. take a listen to the governor from earlier. >> i have a message to all the white supremacist and the nazis came into charlottesville today. our message is plain and simple. go home. you are not wanted in this great commonwealth. shame on you.

since that time many people have come to our great country to unite us. our diversity that mosaic tile of immigrants is what makes this so special. we will not let anyone come here and destroy it. please, go home. never come back. take your hatred and take your bigotry. there is no place. if i could give you a piece of advice, user time and energy to help people. come with me to a homeless shelter; come with me to help a veteran find a job or a place to live; that is what we need help on. i spoke to the president this afternoon and we a comp had a conversation and i told the president that there has got to be a movement in this country to bring people together. the hatred and rhetoric that has gone on and has intensified over

the last couple of months is dividing this great nation. we need to work together and i told the president that twice and we are willing to work with you if you are willing to work to bring people together. stop the hate speech and rhetoric in this country. we have got to bring people together. we are a great commonwealth and we are a great nation. we are stronger today because of those actions of those people who came with their country and hatred. judge jeanine: joining me now is a member of the virginia house of delegates. good evening, representative. is there anything new we should know about what is going on in the ground in the charlottesville? >> know, other than the fact that you have a mom or dad that has lost a son or in the daughter and i think today was absolutely some of the worst that we've seen in america and at the same time the best in our law enforcement that were there.

you are hearing the governor's words and reminds me of ronald reagan's first inaugural year he said how can we claim to love our country, if you don't first love our fellow countrymen and that is not was on display today and it breaks my heart to see charlottesville go through this. judge jeanine: my understanding is that there has been a curfew imposed or, at the very least, the rights of the police to already impose a curfew. let me ask you this representative. this is your area. people have been saying that these individuals are not from the area and upwards of 90% or more are not from the area in this james fields who has been charged with murder along with the hit-and-run is actually from ohio. does this make sense to you? >> know, it's clear that the

white supremacist to showed up in virginia to create may come and mr. in this case, murder. i understand that david duke made comments as well and i think that's exactly what these people want. they want these fringe groups that are on the far, far outer rim of society to get this media attention and in this case they killed to do it. i think it's utterly heartbreaking. what is so heartbreaking about this, as well, is at the end of the day for a fundamentally good indecent country and we are the most successful multiracial society in the history of the world but what these people want to do is put their evil twisted ideology and say that's what america is but that's not how we live our life and i think the ironic thing is that in a hometown of charlottesville where thomas jefferson made those words that all men are created equal what we saw today are individuals that clearly don't believe that to with

tragic consequences. judge jeanine: other than the prosecution of these individuals although right now there's only one individual under arrest and the charges outside land will be increased many times -- you know, what do we do? there is a first amendment right to protest and we have seen some protests on the west coast where there will be 12 hours of destroying buildings and trying to burn buildings and one person is arrested after 12 hours. what do we do now? how do we get out of this? >> we have always tried to find that balance. several of your commentators say you don't have a right to go into a movie theater and shout fire and you can't incite a riot. i think and gillespie put it well when they said you have a right to say something but it doesn't mean that -- some speech is deplorable and reprehensible but the problem is what do you

take your first amendment right, free speech right and in this case you intentionally try to harm others in incite a riot. for you take a further step in and take a vehicle and turn it into a weapon. as a former prosecutor, i fully anticipate that the charlottesville office will add additional charges on this as more facts come to light. judge jeanine: what is interesting is that representative, the two police, state troopers were killed in a helicopter crash -- i'm curious as to whether you think there will be a nexus in terms of prosecution to the individuals on the ground or those that we can prove intent where we can prosecute them additionally for those deaths. >> it all depends on the facts of the ground. right now i have not seen anything that says they could charge those individuals with the death of the state troopers. what happened today is that everyone in law enforcement it's one of their worst nightmares, to be outnumbered ten: one and

two control mobs that are intent on causing harm for the other and that's not the virginia way. our brave and brave women did the very best that they could and tragically two of them lost their lives today. right now i caution everyone not to rush to judgment in the prosecutor's office in charlottesville will look at the facts and they will find, if they will charge an individual they will try to charge for the fullest extent of the law. judge jeanine: congressman, i mean, representative, thanks so much for being with us. more reaction to today's tragic developments in virginia from a sitting member of congress. i will speak live with him next about that as well as the grow

they were covering the rally when their helicopter crashed. in the meantime the world is watching as the stand up in the united states and north korea heats up. joining me now to talk about this is arizona congressman. good evening, congressman. i want to ask you about your reaction to the events today in charlottesville. >> well, judge, i don't know how to express the lover of heartbreak that that should be to all of us. of all of the self evident truths that are the essence of america it is this notion that all human beings are children of god and today that truth was desecrated along with innocent human beings and i almost am at a loss for words which must steal our resolve to not only bring those evil perpetrators of this horrific tragedy to justice but to remind ourselves of who we are as americans and that

this is a country that believes all of us should be treated equal and if you miss that and somehow get in a debate over that that i think we would miss our moment in history. i pray for all of the victims and wounded and for those that are bereaved. judge jeanine: right now there are three dead, many in critical condition, serious condition. some caused by this one driver from ohio, interestingly enough. the other 11 were injured we are not quite sure cause their injuries or whether it is one side or the other. let me ask you this, congressman. there's been criticism of the president and how do you feel about that -- by some in your own party said we didn't go far enough and i can't go much

further than we condemned in the strongest possible terms what happened. >> i think sometimes there are people trying to sound self-righteous when the president made it extremely clear, all of us condemn this horrifying tragedy and sometimes the left maybe those around this racism title so much that they diminish when something really truly racist and evil happened like today. there's always an effort to somehow put this racism that is so evil on your political opponent or somehow to tag someone with that in it's a wrong thing in and of itself. it's something that we should reject in the strongest terms. judge jeanine: all right. i want to move on. you are a member of the armed services committee, as well as a chairman of the missile-defense caucus strategic nuclear forces and i want to talk about north korea. now, i haven't heard a lot of strong rhetoric today and i think like most of the world, in

guam particular, were hoping something is happening behind the scenes so that there is no further escalation of potential for a nuclear assault by north korea but does north korea and you and i have spoken about this over the many few years but does north korea have the ability to launch a nuclear warhead into the hemisphere in a position to inflict damage or an electromagnetic pulse and subsequent damage to our bridge which runs all of our electricity in all of our power? >> the head of the missile-defense agency here about a month ago or said clearly in open committee before the world, not in a class by setting, that we have to assume

clearly at this point that north korea had the ability to target the united states with missile and it would reach from there to hear and obviously, we now know, those can be a nuclear armed which means they don't have to be accurate. they don't have to have a reentry vehicle if they are detonated at the right attitude they can, indeed, inflict an electro pulse which would damage our grid and in the worst-case scenario cascade and damage significant portions of the grid to the extent that an untold number of americans to die. it is very real and something i think the president knows. as you know, you worked to help us pass the critical infra structure protection act and now this administration is implementing that so the president is acting on that. i would say one other thing. they've given the president a hard time for speaking in strong terms but his number one purpose as president is to protect the united states and to make sure that no nuclear missiles are fired which would create the

escalation that you mentioned. it is so vital and for him to make it clear to kim jong-un that it's not in his best interest to do that is an important, critical foundation here. the president is absolutely right. judge jeanine: congressman, when you talk about reentry of not just a nuclear warhead but one that will affect an emp is there a difference in the need for precision of one versus another? >> you are hitting it on a critical point judge. first of all, to affect an emp with a nuclear blast you don't need a reentry vehicle at all and you don't need to be accurate. if you can just get in the general vicinity at the right altitude and we don't know for sure but there may be some speculation that some of the warheads that north korea uses may be enhanced in the area of gamma ray emission which would mean their emp capabilities would be even greater and we do

know that north korea has an advanced emp or emi effort so that this is something that is not foreign to them and they have developed that capability so we have to be very, very vigilant about it. judge jeanine: emp, or what is emi smart. >> intentional electro manic in appearance. that's a localized effort and that they have that capability is a more advanced capability than even a nuclear first because a nuclear burst is simple. it's almost archaic. if you can get a nuclear blast at the right altitude you will create an emp. emi is more technologically advanced and that makes me think that they are well aware of what they are doing. judge jeanine: and frightening. congressman, thank you for what you are doing in congress. is very important to my viewers, i must tell you. thank you again. washington dc, as you expect,

marianne rafferty is live with the latest. >> we will get to that in a moment but first new tonight, senator ted cruz on the past hour has called on the department of justice to immediately investigate the deadly violence in charlottesville today as an act of domestic terrorism. the call from senator cruise is coming hour after a driver identified as 20 -year-old james alec field who rammed his car into a crowd of counter protesters at a white nationalist rally in charlottesville. both sides of the aisle are quick to condemn of the violence and chaos which has reached a boiling point. president trump speaking earlier urging to end the brutality and condemning hatred in all its forms. >> we condemn, in the strongest possible terms, this egregious display of hatred, bigotry and violence on many sides -- on many sites.

it has no place in america. what is vital now is a swift restoration of law and order in the protection of innocent lives. >> the president also facing criticism tonight from both sides of the aisle for its reaction and specifically the fact that he didn't mention white supremacy or the white national in a public way. very important for the nation to hear potus describe events in charlottesville for what they are, a terrorist attack by white supremacist. republican senator orrin hatch also taking a veiled shot of the president saying quote we should call evil by its name. my brother didn't give his life fighting hitler for not the ideas to go unchallenged here at

home. the president has not addressed the criticism but says he is in close contact with the virginia governor and he says that he and they agree that the hate and division must end and stop right now. house speaker paul ryan among leaders urging these views are feeling the spectacle in charlottesville and are repugnant but it only serves to unite americans against this kind of violent bigotry. he goes on to say our hearts are with today's victims, white supremacy is a scourge and it's hate in terrorism and it must be confronted. this is from senator john mccain. white supremacist aren't patriots, they are traitors. americans must unite against hatred and bigotry and a strong reaction all around but you can bet the president's critics will continue to listen carefully to his comments on this developing story in the coming days. judge. judge jeanine: let's get some reaction from our panel. me now lauren, most of the blaze and chuck schumer, radio host chris. gentlemen, what you think of the call by senator ted cruz for the

individual james fields, 20 -year-old from ohio came to charlottesville and is being charged with mowing down and killing one being charged with rustic terrorism. >> clearly he was watching our last hour when i called exacting that to happen. i agree with him 100%. it is domestic terrorism and it should be treated as such. very rare that i agree with ted cruz. very rare that he agrees with me but senator, i'm with you on that. judge jeanine: this is one time when we should all be in agreement with each other and not be surprised. this is hate and violence and killing that is the result of an evil dagger at our throat. people who wake up every day hating other people. lawrence, let me ask you. domestic terrorism or should this be a local prosecution? >> domestic terrorists, we should call them white supremacist, i challenged

president obama when he was in office to call radical islam by its name and i'm challenging the president to do the same when it comes to white supremacist. >> amen. >> this is the time when we should put the politics aside and call it what its name. when there's moments of hate and terrorism that is a time when america should be unified. we should be doing just that. judge jeanine: chris, going forward as these white nationalist -- let's talk about free speech for a moment. they are not point to stop here. they're going to continue going around the country and it seems that the reports are that most of them are from different parts of the country, certainly not charlottesville. their first amendment trumps just about everything else other than violence and will be able to conduct rallies in other towns and get a federal judge to allow them to do so as they did

last night in the district of charlottesville. >> you have the right to free speech but do not have the right to incite violence. it is very clear that these 12 groups came to charlottesville with the intent to incite riots. that could go into consideration for any permit they have for a family in any city around the country because they are there but not just to express their views, which i file file and repugnant but they have the right to say it but they are there to incite riots in those divinities. judge jeanine: chris, everyone agrees with that. if you are there to incite a riot but if the white nationals go to get a permit and they are not allowed to get a permit based upon the fact that you think they will be violent, a federal judge will come in and force the community to give them a permit. am i right? >> that is correct. as they should. it is the first amendment. one thing i saw that was a flaw

in this was it is that it turned violent quickly. this should have been and i'm not trying to criticize law enforcement but it didn't seem like they were prepared for an event like this. i saw people pushing and punching each other and they should have been in patty wagons very quickly. i don't know if it was a failure of leadership or they didn't know this would take place but that should be something that they should correct quickly and i would suggest all of the cities that are planning to allow these permits to go out to have a plan before they allow them to do that. judge jeanine: that is the point. there was -- there didn't seem to be a reason to assume that this was going to be violent. law enforcement, it seems, was simply trying to keep the two sides apart and they suffered a loss today to whether it was the two individuals, the two troopers and the helicopter that was up there to identify dangerous areas -- you know, let's talk but one thing. let's be straight about one thing.

law enforcement in this country for years, from the time i was in law enforcement, ten years ago, at this point, i guess, has suffered from all kinds of setbacks, all kinds of budget cutbacks and we expect them to all be at the scene of something in a minute with their patty wagons but let's give them what they need. >> i think the next time groups like these have permits in any city around the country law enforcement will be ready for whatever they bring. i have a lot of faith in our lot respectability around this country and i know they'll do the right thing in these situations. especially, they will learn from the mistake that happened here in charlottesville today. these men and women are brave and facing these crowds and they were widely outnumbered and i think in the future you'll see much more preparation for events like these. judge jeanine: you agree, lawrence? >> at the end of the day, the politicians that we elected into

office have to take the lead. when steve scalise was shot all these politicians said we will come together and they only took two days before they were back fighting each other, calling names and they were all they dispersed to their own ways. i need people, elected officials, to come together pay for our nation and actually do something. stick with a plan and i'm not going to say that everything will be peaches and cream but we have to start working on this. right now the intensity is too high. >> way too high. i agree with lawrence and it's very rare that lawrence and i are in as much agreement as we are tonight. i agree with almost everything he said in this hour in the last hour because this is a big problem and it's something that everyone has to, together and address and i'm happy to get my free advice that's all about peace, love and happiness around

this country. we have to bring people together. we have to love our country and love each other. that's important for healing here. judge jeanine: whether it's peace and love, i don't know if we'll ever get to that point but i have a couple of thoughts. hate tears at the fabric of society. >> yes. judge jeanine: scenes for so many years murders in assault and violent crimes that have their genesis and hate. what we need to do is identify those individuals in congress who do nothing but backed by each other and i don't care what party you are in. cut them out. it's time to start over. >> amen. judge jeanine: it's time to put stability in our country. just like the right right and left left everyone has a problem. now, our job is to identify who they are and basically hold them out. final words, chris. >> hate is never a way to solve

china's position on what it will do if north koreans attack guam. what is fascinating is that the global times announcing beijing's position said that if there was a preemptive us attack on north korea china would come in on north korea's side. therefore, this makes this not just the us first north korea but north korea and china versus the united states. judge jeanine: china is not giving up what the president hopes for. what can we do to squeeze him? >> we enforce us law and that means for chinese banks that have been money laundering for the north koreans including some of the largest chinese banks they need to declare them primary money laundering concerns under section 311 of the patriot act and therefore deny them access to their dollar account putting them out of business especially, outside of china. that will be important because

no one thanks president trump has the political will to do it in the chinese have been holding their breath and i think if president trump actually goes forward what he will do is frighten the north koreans because then they will understand that trump means business. judge jeanine: no question in my mind that he does but i think he's tried all of the avenues including back channels that we just heard about 24 hours ago. all right, i also want to talk to you about the conversation that i had with congressman trent franks. specifically, as it relates to the emp electro magnetic pulse which could be created by north korea and shooting off a nuclear device into the atmosphere. >> yes, you have what -- people have said one emp device could kill as many as 50% and some people have said 90% of americans within six months because if we can't get the grid back up it means all sorts of

things can happen which would be horrible. the north koreans don't need much in the way of guidance and they don't need heat shielding at all. right now they have all the elements in place to be able to land a nuke in the us but they haven't integrated it. that will take them somewhere between nine months and maybe a year before they can put a nuke on us territory. they have some really fearsome missiles that they had yet to test and, by the way, some of these missiles look to be chinese in origin. i think president trump needs to get behind the microphone and asked the chinese how come the north koreans look like they have a chinese arsenal. judge jeanine: do you recall the parade, gordon, about six, eight months ago and it was -- did you say 12? >> april 15. judge jeanine: okay, april. they show the ability to shoot and icbm off a moving vehicle. there was claim that those were made in china. is that what you're talking about? >> for small, you have a chinese

transporter directors and these are the vehicles that brought the missiles that were fired on july 4th and july 28, the intercontinental blister missiles and those are chinese. even more worrisome is that north korea's most advanced missiles, even more advanced that they tested last month look to be variants of china's jl one submarine launched missile. i can't prove that the chinese gave them the plans but the point is we need to find out because there is this disturbing trend of all sorts of chinese equipment showing up in north korea's inventory. also, judge, the chinese have been helping with semi process this material components and equipment for north korea's nuclear weapons program so this is bad news across the board. judge jeanine: do you know what?
