people file it was wildly inappropriate and you see the swift reaction. set your dvrs and never miss a crazy episode of "the five." hannity is up next. this is a fox news alert. protesters and riot police clashing on the streets of st. louis. and demonstrations have turned violent. they gathered outside the mayor's home and evangelized the outside. and there's reports that people rung the doorbell with no answer. please deploying teargas. and they've entered an confrontation with the police. and continuing on into the evening after a 2011 shooting.

former police officer was acquitted of murder following a high-speed chase in 2011. no more than a dozen protesters have been arrested so far. mike is live in st. louis and has been there throughout the day and evening. what is the latest year on the streets. >> we are at the corner and you can see a lot of the officers are matched up. they've done a pretty effective job clearing out the area. and they spent the whole street and now they're retreating back to a different position. the probably going to a staging area where they won't have friction with the demonstrator until the trouble starts. and there was a bit of trouble in this intersection.

we have windows that were broken out. and eight officers were injured. we watched on the earlier street and it was further up in that direction. they were indeed throwing bricks at the officers. and we saw the guys taking the bricks. it looks like the situation has diffused for the moment. we saw the situation get diffused. they will start some trouble and it will go handle it that location. >> do we have a sense on if they are trying to impose a curfew or set a perimeter or how does this relate to taking back to ferguson and other areas you

seen the police came out a show of force. >> there's been no discussion of a curfew at this stage. what they trying to with a lot of these demonstrations is go ahead and walk out. an exercise your first amendment rights. and then the police movement. in different restaurant owners have their rights and the please try and protect the property of the individual owners. and these guys are stein standing down. so we don't have everyone active and ready. this intersection become more of a staging area. and they are responding to incidences as it blows up. but observe the demonstrators and get an idea of where they're forming up.

>> and i'm looking at the twitter account of the st. louis police. the agitators have been warned and it's no longer a lawful assembly. have you noticed arrests or dispersing of crowds or the occasional troublemaker. i saw the rest earlier this evening. what they will do with riot police is and will form a pot at the back of the police line. they will rush through the police line and plucked an individual. they identify someone who needs to be arrested. or sometimes he will bust through to be unpredictable. and you see a lot of police

officers resting and waiting for information about where to go next. >> there dispersing and they've clearly done the damage. any idea where they're trying to force them to. deciding where the trying to funnel the people. >> some of them do communicate and largely it seems in a situation like this they organize and the group up and bump into each other in the street and start again. all the police can do is get out of a particular area by using teargas okay some will

stay and resist and becomes a game for a lot of them. and you don't necessarily have all the people arrested and waiting to form a persona demonstrators. >> you're talking with many of the demonstrators and they've been very orderly and calm. it's kind like a block party. took a different turn here. is there any indication of this happening and then the cover of darkness and the bricks are flying. there wasn't any indicators of this happening. we knew this would be ten situation.

since the michael brown case as pete. there's a chance chance of his verdict could come down on the side of the officer. and the clergy was out here earlier saying if you kill our youth, we will kill you. that's much different than people are taken to. that's not what they meant. they want a lawful demonstrations and boycotts of businesses. an economic weapon within the law. in all filled with emotion, some of them believe they have the cause and others are troublemakers. >> do you have a sense that the troublemakers have been around where locals have been agitated

or outside of the area knowing this is going to be ten situation. >> the numbers of people we seen tonight been coming from outside. talking from police sources there wasn't any intel like outside groups, the anarchists national buzz was on this particular case. they are distracted by other things that have been going on. so the attention of the national movements but i did see some of the black panthers. i'm not sure if there dressing up playing the part, they just communicate over social media and wearing masks over their face and they come join in. some of them do believe there doing something.

throughout the hour. >> joining us now from st. louis, kevin jackson. you have been there all week, it's really scary you said you felt there were people that were actually preparing for some type of response tonight all throughout the week. tell us what you know. >> yes, i got in early monday morning, sean, for a personal business as well as some other business here. and as are as i moved u about the city, it was a palpable tenseness. i honestly forgot what was going to happen. started listening to friends of mine, and about the verdict. as i went to various restaurants and places with friends people started to ask you going to be uranin friday. being that i was a management consultant, friends started reaching out to me on social media. we've evacuate our employees, they're all coming home, et

cetera. you could feel the tension of the city i saw members of the national urban league, you started seeing the people that had been flown in and then as i started talking to people it got really interesting. what i found most interesting was a lot of millennial whites who were protesting and i think it was a mixed bag. it was either the trust fund baby or the people that just wanted to say i was here when h*eus or was made. i think a lot of that history and i do believe that people, sean, want to see something happen tonight. it's still young. >> you gotta hope and pray that everyone's going to be okay here. >> absolutely. >> told the reporter he smells weed in the air, people are smoking, you just never know what's going to happen. this guy has a history of unlawful use of a weapon, stealing drug possession, driving with a revoked license. let's now go, we do have the

dash cam video. and then we have another video i believe it was from a building nearby that actually when you see it's the beginning right here, goes on for a pretty lengthy period of time and you see the high speed chase that takes place. at one point the cop hits a tree in the middle of this. when it finally stops pick it up from there and explain what you saw. into the police car. >> are you talking to me, sean? >> yeah, i'm talking to you. i want you to explain. i know you can't see it. but you've seen the video a lot. >> oh, yeah, i've looked that video. the first thing i would tell people to notice about the video was how many people could have been killed by the guy in the high-speed chase. at that point, the police officers saw him as a menace.

and so what happened in the video, you can't see what everybody's talking about with this weapon that supposely was planted. what you see are two police officers who get out. he engages the smith on the other side of the vehicle and you can see he's talking to him and giving him a chance to say something, and then suddenly the, uh, you know the shots ring out. but and i know a lot of people and rightfully so the cops said we're going to get this guy but you're talking about a guy who was in an excited utterance, but he also knew he was on video. what i think people are missing, sean, in this whole thing is what we always come back to. what was mission's responsibility? should he have gotten out of his car and surrendered? we overlooked that and everybody looks at what happens in the end game. he did try to hit the cops with

his car. that alone allowed the police to use lethal force. so, look, i'm not trying to exonerate these guys that's been done, the judge has already done that. for people to now want to back seat drive this thing and again put police officers in the line of fire so to speak, i find ridiculous. >> i find that ridiculous, too. let's go to the shooting part in particular. the shooting takes place. then we got into the whole question in this particular case, putting aside his background. he takes the cops on this long high speed chase, putting everybody at risk in the entire community. okay. then they get to that point. he's claiming that a gun, they didn't find - - . >> right. >> lamar smith's fingerprints on the gun but they found the cop's fingerprints on the gun. and the prosecution was trying to layout the case that in fact that means he didn't really have the gun in the car. the other video shows the cop putting taking the rifle out of the car, and putting it in the

back of the police car. is that not correct? >> that is correct. and i do understand how people want to look at the dna evidence and whatever. i didn't see - - i had no knowledge of it, we can't see that in the video, but the judge was obviously able to look at whatever the evidence was. so there's going to be speculation on that. and probably rightfully so. but i still think we've got a balance this and also look at the long-term ramifications here especially in the city of st. louis, the city that i live that has shrunk from i believe 860,000 people in 1950 - - we had major companies who were moving their employees, 4, 5, thousand people for one company and certainly thousands and hundreds of others moving their employees out because they feared for the safety of their employees. we had businesses boarding up. it look like hurricane harvey or irma was going to hit st. louis

in solidarity with the all the black people that's been shot and killed by the police. >> in terms of this particular case you're demonstrating about, you know mr. smith rammed the vehicle into the police. the judge didn't support the contention that the weapon was planted. so what are your problems with the facts in this case? why should the police officer be convicted? >> the cop, while he was driving, said we are going to kill this mother [bleep]. then when we got there, he went up to him and shot him five times at the door. >> right. >> there's no need for that. he then goes back to the car, grabs something mysterious, and sits out in the seat of the car. >> so i mean, the judge didn't support the contention that the weapon was planted. you were chiming in from the background. let's hear what - - . >> i don't have anything i want to say. >> what were you going to say, sean? i'm with fox news channel. they wanted it to go. the evidence is clear, and first off, the prosecution, sean, as a you will well know, they had the responsible of proving beyond a reasonable doubt that jason stockley did not act in self-defense, and that's what he had claimed from the beginning. that he had acted in self-defense. now that was the prosecution's responsibility to prove that they failed to prove that beyond a reasonable doubt. that is not this judge's fault. that is the prosecution's fault for not proving more. all these individuals mad about this system, i bet none of them showed up to vote for o this judge.he apparently judges can be voted on and voter turnout in st. louis is ebismal. >> blood will be on the judge's hands and pressuring the judge in this particular case? >> yeah, it's a threat. >> didn't give us the verdict you want. we're running the dash cam video, and i've watched it. it's a long video. it starts out.

this is a high-speed chase. everybody in harm's way as this guy's racing down the street, crashes into police officers. take us at the point of the goings at the point of the to air because we don't really want the audience to see that part. and then it was not only the police dash cam, but there was another video that the judge had for evidence in this case, and that was the police officer going from this guy's car, and putting in the gun inside the back of the car. >> right. >> now they're claiming okay, but there's no dna prints on it, therefore it couldn't possibly have been this guy's done. let's go from there. prosecution wasn't. in this video one of the things they testified was that he was reaching for something in the car that immediately made officers fear for their lives, then there was the question of why stockley was going back to the police car, rummaging around

in the back seat. he had later said in his testimony that he was going for the first aid kit. there was a portion of the video where he did bring his own personal firearm and he did put that in the backseat of the police cruiser as well. apparently that'swell. against the police department policy. understandable. that, the fact that he apparently made clear the revolver inn question and it was from what i understand from what i remember that was reported a large caliber - - . >> he was putting a rifle in the back of the car; correct? >> uh, in the back of the police cruiser he had taken - - in the cruiser? >> go ahead. yes.>> >> yes, he was putting a rifle in the back of the cruiser. that's one of the things that former police chief sam dodson, one of the reasons he ended up suspending stockley was becausee he had his own personal firearm with him along with the department-issued side arm that he had as well. he had his own personal fire arm there. that did not fire. i know when you were going to mike tobin earlier he was

talking to some of the individuals out there protesting, demonstrating peacefully. they had said he used an ak-47. the firearm that he had some of thes protesters are believing that they're being told. >> that was not fired, right. right. that was not t fired. and so ultimately, the bottom s line, sean, is this. if using a vehicle to mow down police officers, that is salt with a deadly - - assault with a deadly weapon.h when they approached anthony lamar, when they approached lamar smith and he was in the parking lot of the church's chicken they saw some sort of deal go down that they assumed was a drug deal, they engaged, and he did not follow orders. in the video he backed up his vehicle, and then gunned it, rammeded forward, actually hittg one of the police officer's hands. when you use your vehicle and you're charging at

officers, that's assault with a deadly weapon. you do not have the freedom to mow down officers with your vehicle. that isu assault. you could lose your life. you could lose your life if you're engaging in a drug deal if you're not following orders and you look like you're reaching for your firearm. the prosecution e sean, they did not prove their case. stockley won because his side had argued that he was defending his life. quitee frankly, when you look at this video, you cannot dispute the video. this is, sean, i have to tell you as a st. louis native this is the same stuff we heard with the mike brown case when everyone said hands up don't shoot. the individuals selected from ferguson, mike brown's community, those witnesses said that never actually happened. that whole lie was able to go around the world and i'm so tired of this happening. you have video evidence, don't run down cops and you won't get shot. police lives matter, too. period.

>> all right, dana, stay right there. um, very good point and people just seem to dismiss all of it. fox news correspondent at-large geraldo rivera is with us tonight as we also put up images from on the ground earlier today. we'll go to a live shot. ggeraldo, what's your take on it? >> i think first of all, sean, let's be real here. i've been covering urban police work for half a century and in my early days as a street reporter in new york city there is no doubt that the whole notion of throwdown guns was a relativelyly common phenomenon n urban police departments throughout the country. now, fulll stop. that's decades ago. but throw down guns are not unheard of in police work. >> everything's on video. >> let me just finish my thought to balance it out here. it is also fair when you have a low down, uh, dirty heroin dealer multi-conviction, uh, you

know in trouble with cops, uh, you know, for years, a real thug, uh, that, uh, you know, as the judge suggests that person in theug judge's experience is usually someone with a gun. so, um, i think that the issue here is an issue of reasonable doubt. as the judge struggled with this verdict of the last month, the finally came to themonth, the conclusion that the prosecution for all their sincerity did not manage to meet the burden of beyond a reasonable doubt. did the cop go into his bag, the duffle, to get a gun out to plant onn the, um, on the perpetrator after he had already been killed? you know, the judge felt that the prosecution did not make that argument beyond a reasonable doubt. when i see these demonstrators, though, you know, they seem genuinely concerned, uh, sean. the vast majority of them. this isn't, you know, a militant, uh, anarchy antifa

kind of crowd. these are people who really are agonizing. >> for the most part peaceful. >> the reality that black men really are at risk, uh, in encounters with cops. >> well, you know, what about the embracing we see a lot of black lives matter signs and t-shirts, and people holding them, ggeraldo, and maybe i'll throw this first to dana. you know, whenever i hear if you listen to the chance what do we want, dead cops, when do we want them, now. what do we want, pigs in a blanket, fry them like bacon, it's loud. it seems to have gone mainstream and nobody seems to care that that group was involved in saying those things about cops in particular. >> you're right, sean. i remember that all too well. sean, i want to point back, everybody, uh, to st. louis when after ferguson when there were the organizations, the organizers that began busing in protesters, because, remember, the number of arrests in

ferguson over 70% of those weree people who actually didn't even live in ferguson. you had, and i think what began as a genuine conversation between members of the community it was highjacked by everybody remembers acorn. they dissolved and became a group called more, a community organizing group in st. louis, they were the ones who paid protesters in ferguson. those individuals highjacked those protests, they got violent, and got all the camera time. we know for a fact they were paid because when the checks weren't cut they protested and they had the whole hash tag cut the check on twitter and a protest outside the offices. >> the most amazing thing that came out of that case with darren wilson, it was people in the community. if i'm not mistaken, if not all the vast majority that were black citizens in ferguson that testified on behalf of darren

2014. let's place this incident in context. this was more than three years or approximately three years before ferguson. this is a 2011 case. who was in office in 2011? civil rights charges in this case. >> we are. but in the night but when the incident was happening we saw the lack of coverage and then frankly afterwards we had all this video tape of all these people committing these crimes that was never followed up on. now we see somebody's window broken up there. >> in this case, sean, we had obama justice department was suing everybody, suing police departments all over the united states for alleged violations of civil rights and brow-beating

with first degree t murder. following a 2011 shooting of a black man. joining us now, fox news contributor davidcq web. you were in ferguson on the ground, a lot for us. you see what's happening here so far peaceful, american flags burning. um, i saw a broken window. you saw what happened to mike tobin, he had some water poured on him. always volatile, always dangerous. we've gone over the facts of the case and looked at the dash cam video. >> my first thought is what you said earlier, sean, and it's good that most of this is peaceful. unfortunately as i watch a lot of the file tape, it looks like there are people there that are - - they're itching to agitate. that's what it appears like. toward the lieutenant governor said clearly there was a little bit moreor preparation here. were put in place. i know this area where they were protesting near the courthouse and down the block from that. we were there in 2014 extensively along with being in ferguson.

there are concerns that people have. if they voice them correctly, they should go out and act on them publicly. >> we actually see the police now having to use pepper spray against the crowd as we speak. you've been in these crowds, you've been there when it's gotten pretty bad, it gets pretty hostile. we saw what happens to mike tobin. i guess as the hours get later, it looks like somebody just threw something atto an officer none of this is good, everybody needs to calm down and keep it calm. we know what could happen after what we've seen in ferguson and baltimore. >> the people who want to take advantage of this are going to wait until dark, wait until people are kind of more riled up so the police don't have clear sight. remember thehe ferguson verdict they didy it at night. the police had no clear line of sight into the crowds and around the police station. this is when they take advantage of it.
