from several countries including ones in the original ban with north korea and venezuela now added to the list. a chief white house correspondent john roberts joining all of us. >> good morning to you. and the president all morning brushing off the push back on the nfl over the weekend. insisting that players who take a knee during the national anthem should be disciplined by the league. tweeting out that the new hashtag stand for anthem. a big show of defiance yesterday, a lot of players took a knee during that anthem. the seattle seahawks, pittsburgh steelers stayed in the locker room during the end them. but one pittsburgh player you see there, alejandro villanueva came out of the tunnel. he by the way, he did three tours of duty. an army ranger in afghanistan. this whole thing started on friday night when the president said that any player who kneels for the national anthem is a sob

heart, locking arms with another player. he said this this morning on boston radio station. >> i certainly disagree with what he said and thought it was just divisive. >> the nfl communications adviser who happen to be president clinton's press secretary back in the 1990 he said in a conference call "everyone should know including the president that this is what real locker room talk is." in the feud with the nfl, the president as you mention reconfigured the travel ban, eighth countries are now covered by it. some of them off the list, some on the list. including libya, syria, yemen, somalia, from the original list. but also adds chat, north korea, and some people from venezuela. but the difference with the new list is that there is no expiration date. all these countries have individually tailored restrictions. the president tweeting that the necessity for keeping the travel ban in place and making changes

saying "making america safe is my number one priority. we will not admit those into our country that we cannot safely event." by the aclu challenging the saying that the administration's order is still a muslim ban. the original scene cannot be cured by throwing other countries onto the enemies list. to the supreme court oral arguments for the original travel ban happen on october the tenth, heather, so it is likely that this will be in the news fr some time to come. >> heather: very busy week on tap. john roberts, thank you. >> jon: more on the fallout from the president's comments of the nfl and the national anthem controversy. it let's bring in bret baier, the anchor of "special report." it is interesting to me, the controversy over cullen cabernet taking a need, that's where it all started. pretty well died down, then the president found a way to judge it up on friday. i guess the question is why? >> that is a good question.

i think that there were six kneeling protest before friday. then the speech friday and the tweets that followed, 200 plus as you just heard from john roberts over the weekend. in the nfl. that has supercharged a very emotional issue, and people are on both sides of this issue. the people who are kneeling say that it is their rights because of free speech to do that. there are many people who are in the middle of the country saying, why are they doing that? and they do not see the connection with these football players on this issue. i think that the president clearly has stirred this up, and it is an emotional discussion. what we are not discussing is that he may likely loose in senate primary in alabama, looks like it is an uphill battle for luther strange there. we will see. we're not talking talking about the fact that the health care repeal and replace bill is probably on life support in the

senate. and we are not talking about the troubles that north korea is just in the past hour putting out there. so it is an interesting dichotomy to be talking about all this that has been stirred up in the past three days. >> jon: even some of the most ardent supporters have said that they disagree with him on this one. rex ryan one former nfl coach who is a big tromp pan says that he does not like what the president had to say. >> clearly, i think the sob part of the speech was the part that went over the line for some folks. and i think that his supporters are -- there was the moment that they kind of broke off. they said that that was not the right kind of terminology to be using. the issue itself about whether teams should allow the kneeling or the back and forth is one issue, but how the president characterized it in that speech

in alabama i think it's another. >> in "the new york times" quotes christopher reddy as saying, i don't think his intention is to be divisive. he wants to be viewed as strong, but also somebody who speaks the truth as he sees it. and not afraid what the establishment says about it. he enjoys a fight and a challenge, so that may play into some of this. enjoying a fight and a challenge is one thing, but there ought to be a goal at the end of it. a lot of people are mystified as to what the president's goal is here. >> he knows when he says something what is going to get attention and what isn't. he knows by adding "rocket man" to the sentence in the u.n. speech that that sound bite is going to get attention. he knows by using sob that that moment is going to get a news cycle. he is the ultimate marketer. sometimes the motivation behind it, why he is doing it is in

question. and i think that it has created this divisive moment where it is definitely a conversation around kitchen tables around america, and to that water coolers and coffee shops, but does it come to a resolution? we will see. >> jon: it doesn't distract from the g.o.p. efforts to try to repeal and replace obamacare, as you said earlier. senators cassidy and graham who have introduced the legislation are releasing a revised version of their bill that sends more health care dollars to the states have a couple of key holdouts republicans. ahead of the move to vote on the legislation this week before the production -- protections against the democratic filibuster are set to expire. does the idea of sending more money to alaska and maine to perhaps sweeten the pot for pot for lisa murkowski and susan collins, does that -- how is

that going to fly? >> i cannot imagine that rand paul is going to be persuaded to vote "yes" if there is more money going out the door. the problem was the taxes of obamacare are still in place. i doubt that susan collins is going to move off of her "no." lisa murkowski, possibly. then you have john mccain who has said that he is a "no" already. if you do the math, probably one short. and that is what we saw last time. if there is a loss here, it is going to be a big loss as far as looking forward to tax reform and trying to get that across the finish line. so for the g.o.p. has been dysfunctional in getting big pieces of legislation through. >> jon: when democrats were trying to pass obamacare republicans were hugely critical of what they called the corn husker kickback in

other injured parishioners who are the real heroes. but ultimately it was engel who confronted the suspect during the shooting spree. police say that the gunman pistol whipped the usher, but during the scuffle the suspects gun went off injuring the suspect, and that is what effectively ended the shooting spree. he issued a statement saying "i ask everyone to pray for the victims family members, our church community, please pray for healing. also please pray for their shooter, the shooter's family and friends, they are hurting as well." emmanuel sampson has been released from the hospital, he faces one murder charge in connection with the death of 39-year-old melanie smith. known to parishioners as melanie crow, fatally shot in the church parking lot before the gunman went in the sanctuary opening fire and injuring six others. others. authorities say more charges are pending. >> heather: from what i understand, the usher had a gun that was registered, went out to the car, got the gun and then

came back inside. it did police have a motive at all? >> police say they are investigating several leads paid to the fbi has launched a civil rights investigation into the shooting spree. if church members say that the suspect was no stranger to head them. he had attended services at chapel church of christ a few years ago, but not there recently. a man who lives across the street says that the congregation is racially diverse and welcomes everyone. >> why do you do something like that to good, innocent people? they were praying to their lord. you don't bother anybody bring in in the lord's house. >> investigators say that sampson has admitted to shooting in the church. a total of four weapons, two inside the church sanctuary and two inside the suspects sub in the church parking lot. >> heather: won the usher pistol whipped him coming he shot himself in the leg.

>> heather: fox news alert for you on the crisis in puerto rico with the scale of devastation becoming more apparent days after the category 4 hurricane's mission to the gallon. several hospitals are completely flooded. depending on diesel generators to keep patients alive. while millions are without water, power, phone service, all of this after a storm that said puerto rico backed decades. live from san juan with more on the recovery efforts there. >> i was just talking with some of the folks who live here in old san juan. growing frustration that they are not getting the help that they need. basic necessities like food, water, and fuel, they are still severely lacking. power is still out for most of the island. that is causing some real issues for folks. you need gasoline to be able to run generators. there are not a lot of generators on the island. but those that have them, they were able to cook, and be able

to cook and clean around their homes as they try to get this recovery efforts underway. there are long lines for just about everything. you can see that these lines, folks have been waiting as long as nine hours just to fill up on ten dollars worth of gas. these lines will stretch for as long as a mile or more, just to fill up on that little bit of gas. across the territory, there is a severe lack of the water, the food, and just the help to be able to clear roads and debris from people's homes that were destroyed. that's what folks are looking for. i spoke with the governor this morning and he said, help is on the way. it is being delayed because of the gasoline shortages. they cannot get trucks out to clear the road. lots of places on the island they cannot get out to to see how bad the damages. earlier on "fox & friends" he laid out what puerto rico is facing going forward.

>> the magnitude of the devastation is unprecedented. everywhere on the island there is devastation. the infrastructure has been severely damaged. it is unprecedented, unfolding of events with telecoms and water and so forth. >> also staying long lines at banks and atms, folks are looking for cash, because a lot of atms are clear out of cash. several banks have reopened this morning, long lines at those as well. folks here saying to get some of those banks as far as 10 miles. so when you are spending all day or waiting in a line for water, food, cash, gasoline, it is a tough spot for folks to begin. another thing with officials still monitoring is the dam in western puerto rico. they still say it is on the verge of collapsing part of this morning the governor met with several engineers. he said they will be getting a status on the dam where they

have evacuated several thousand people who are at risk downstream. this afternoon they are going to give an update on that in the press conference around 2:30. >> heather: live from san juan, thank you. and of course, we are tracking maria's path with a tropical storm warning issued for most of the north carolina coast as the storm continues to weaken. mandatory evacuation order is already in place. parts of that region, maria will move slowly to the north through early wednesday when it should be a tropical storm and turn eastward out to sea and away from the u.s., but other parts of the east coast should be on guard for large swells, heavy surf and rip currents. >> i think that the owner should do something about it. it is very disrespectful to our flag into our country prior to if certainly think that the owner should do something about it. there was great to solidarity. i watched a little bit.

media bubble and then the other bubble. >> i have been known to frequent sports bars on sundays. i have a fancy football addiction. i was out and about speaking to other folks around new jersey talking about this controversy. it was all people who we are talking about. i can tell you the decided majority agree with the president on this one. they do not disagree with the right to protest. who disagrees with that? they disagree with the venue it is being done in in terms of during the national anthem, they say it as disrespectful to the flag and disrespectful to veterans. look, this is not just a sentiment that i am gathering now. ratings are income you know that i like ratings on this breaking segment. and last night's game between the redskins and the raiders, that was the nbc sunday night game, the top-rated show every week, down 10% from the same week last year. down 10% from the week before. this is having a palpable effect on the senate on the ground is not matching what we are seeing from the pounding class in the

has a personal email address fewer than 100 emails -- the business has gone to over the last eight months. he has a white house email address. that is what he uses for the business. that is a total different situation. >> heather: the statement from jared kushner's attorneys has fewer than 100 emails have been between january-august. they were either sent or received from colleagues in the white house from his personal email account. obviously this was at the beginning of the transition. max, at least part of it was. it does that make a difference to you? >> it is not quite accurate to say it is completely different. it is not entirely different. he does have its private email and he has been using it over the course of the first nine months that he has been working an official capacity in the administration. we should start by saying how incredibly ironic it is that he is now coming under fire for the same kind of blistering critique that was levied against hillary clinton during the entirety of the 2016 campaign.

what is most troubling is that the fact that there has not been much more than, hey, this is for convenience, not that big of a deal response compared to suggesting that the trump administration is more than comfortable having a different set of goals for himself and his family members and what you think is appropriate for others. >> heather: at the same time, alex, while it may be ironic while the optics may not be good for a larger narrative, it is not against the law. as you said, it specifically is different because it is not a prime private email server we are talking about. >> that's right, worked in the white house during the bush administration. i am familiar with the records requirements. you are supposed to do all business over the white house servers. but look, the law is a little bit outdated. people do not just use email, they use text messaging and instant messaging. they are all sorts of encrypted apps that are set up that they use in the trunk white house, so we need to look at the law and
