white house believe the president has the vast majority of the country behind him on an issue. as you say he's doubling down tonight. sending out even more tweets about the nfl, despite the criticism all around the country. the president basically tweeting and lashing out at a cnn report suggesting that john kelley his chief of staff was appalled at the president lashing out and calling for the boycott. the president tweeting out: remember the retired marine general actually lost a son in cam would the in afghanistan back in 2010. so john kelly tonight is speaking out on the president's behalf telling cnn in part, quote: i believe every american when the national anthem is played should cover their hearts and think about all the men and women who have been maimed and killed, every american should stand up in sync for three lousy

minutes f there's anything coming from all this division tonight we can report that the hottest selling nfl jersey belongs to that man, alejandro villanueva previously little known pittsburgh steeler, former army ranger who served multiple tours of duty in the afghanistan. he came out in defines of his coach. the coach said he was looking for 100% participation in a plan for his players to stay in the locker room during an them. all kinds of back peddling tonight. that player is saying he regrets that he went out there alone. he thinks in his words he threw his teammates, and coach mike tomlin under the bus. then on the other side of this you have the steelers quarterback saying he regrets that he didn't leave the locker room. he wishes he had gone out on the field and maybe brought other teammates, with him to stand for

the anthem. the president meanwhile as we noted tweeting about this, standing firm in his view about all of this, digging n the president claiming the backing as well of nascar. saying, quote, so proud of nascar and its supporters and fans, they won't put put up with disrespecting our flag or our counsel from you. they said it loud and clear. nascar said they support standing for the anthem, they support free speech. all americans are granted rights to peaceful protests. those who make peaceful revolution impossible will make violent revolution inevitable. interesting because even some of the president's close friends from the new england patriots, tom brady, saying basically in the last 24 hours they don't agree with what the president said at the rally in alabama, basically saying an sob, any player who doesn't stand should

be fired. his press secretary sara sanders today defended the president. this isn't about the president being against anyone. this is about the president and millions of americans being for something. being for honoring our flag. >> so interesting because there were a lot of reporters pressing sara sanders at the daily briefing today. you've been there before dana perino, basically saying, look, most of our questions have not been about about the puerto rico crisis, most of the questions have not been about healthcare, instead many of the questions are about the nfl. didn't the president mess up by distracting? sara sanders said basically look you're the ones asking the questions, i have no control what you ask. . >> dana: i used to try mind control to see if i could get you to ask something. that didn't necessarily work. i wanted to ask you ed about a book you've written about sports and politics. for people who want to keep them

separate i think that you might say from a historical perspective that hasn't been the case. >> i wrote a book about jackie robinson called 42. i focused on his re listening juice faith helping him overcome the discrimination of being the first black baseball player. a lot of people on the left have been taking something that jackie rob ib robinson said he wouldn't stand for the national anthem because he was angry about a lack of progress in the national anthem. a lot of people are saying jackie robinson would support these. sadly he died so long ago. in my bookie write about a sermon he gave in 1966 that gives more perspective that he said in part for a meth though date of church, he wrote, quote:

in alabama, continued on twitter. and he attacks them for protesting peacefully, for equality, for standing up for what they believe. and he does it once again to dog whistle to his base and to try to detract attention from other things that are going on. but it's quite telling that he is willing to attack black athletes. he never says anything of an insulting toward white supremacy or neo saz it's or vladimir putin, right? >> dana: hillary clinton is basically continuing the 2016 campaign. it doesn't end. she is on her book tour, she has every right to say what she wants to say. does this crystallize something put say in your pod cast that that is an ongoing thing that doesn't end and it might not end well? >> it never ends. we're in a vortex of stupid and

we're never going to escape it now. we're going to be creaselessly reliving 2016. pp did a couple of things in the alabama rally. he condemned people kneeling during an them which is totally fine. he called for people to be fired is not appropriate for a government official. when hillary clinton suggested this is routed in racism, what i think that president trump has wrong footed on racial issues i've been clear about it. i don't see the racist intent here. if she is talking about people that are white, she should look in the mirror. trump this isn't about race, this is about trump felt he had an issue, he got to club that issue like a baby seal. that's essentially what he did in alabama. >> dana: richard one of the things i tried to do was take a step back. we went to road yeses and we always stood for the anthem. one of the things i've always loved about it i always felt like when i was in church you have that moment of unity,

everybody together, with the common thread and maybe afterwards there's a problem. i tried to be open mind &ed look and see, is the original protest, which was about the complaint that kaepernick had that black -- that white officers were being let off the hook for unjust killing of black, especially children, or youth. and i'm trying to understand, do they see this as a racist attack by president trump? >> they do. and let's talk about one case in particular. tam mile an hour rise, a 12 year old boy in ohio, police drove up and shot him in the face. he had a toy gun. he was 12 years old. he was shot in the face. there was no freeze. there was no put your weapon down. he was shot in the face by police. >> dana: right. >> it was on tape. everybody saw it. the country watched in shock and horror. i can go on and on and on. colin kaepernick decided to kneel and that is where we were,

right? donald trump this weekend then took it further, first he used inflammatory language. no president in american history in recent history since i've been alive has ever used that type of it language. every american, the idea, the president of the united states should be a role mod 'el to eve child. i wouldn't use that language in front of my mother. the fact that the president uses that language is disgusting, right? then let's move forward. he's saying the individuals should be fired for using their right to protest. people have tried to make it about the troops, the flag, they've tried to make it about an them. that is not what this protest is about. this protest is about racial in justice for people of color in this country. and that is what these athletes are using their platform to do. to protest racial in justice. mohammed alley did it, jackie robinson did it, jesse owens did

it, when they did it, it was unpopular. protesting a lot of times is unpopular. but our first amendment right allows us to be unpopular. >> dana: absolutely. here is something i wonder about, then. the original protest from kaepernick had basically n. my opinion, and i don't watch a ton of sports had been dying out. we the weren't dying about, he wasn't getting picked up by a team and president trump rifted on it friday night and it became explosive and the left tends to overreact to president trump, and then what you get at the end is basically people saying yeah i think you should stand for the national anthem and we should friday to continue to do more to calm racial tensions in the country. but the national anthem doesn't seem the place to do that. >> yeah i mean there's a series of over reactions that happens here. just to talk about the underlying issue with regard to police brutality being systemic across the country. out here in the country there was a white homeless guy named

kelly thomas who was beaten up on tape. there is such a thing as police brutality having nothing to do with race. 760 shootings according to the washington post, nine of them were black people. >> police brutality is wrong no matter if it's black or white. >> colin kaepernick started a protest. the didn't turn into a movement. the vast majority of americans didn't like it. president trump decided to bring it up again and then the left reacted as they always do to president trump by falling directly into whatever trap i think he inadvertently set. trump says anyone who kneels for the national anthem should be fired. now everybody on the left says then everybody should kneel for the national anthem t they react to him the same by my three year old daughter reacts to me when i'm trying to use reverse psychology. it doesn't seem like the smartest way to do that it is to create the booing stadium

audiences across the country seem to be good evidence this is not a protest movement that is gaining steam. it's under cutting its own message. if you want to protest perceived police brutality there are police stations right down the street. >> dana: my sense is that this does not end well for the nfl. i'm not exactly sure how it ends. i hope that it does. richard from your perspective do you think this has been helpful until i want to make a couple points. i don't think this is left or right. today it's the dallas cowboys game the owner of the cowboys which is not the left by any stretch of means of the organization. neither it is the patriots or many of the quarterbacks who hang out and take pictures with donald trump, who golf with donald trump all understand there is racial in equities in this country. they said so and they have protested the national anthem. let's be clear this is not a left or right issue.

what donald trump did this weekend erase bated, he called colin kaepernick's mother an sob and engaged in this type of racial debating in the front of a group in alabama which is his base he framed an argument that set up a situation where he would upset a group of americans, african americans, right, that got us to this place, where people, white and black people said not left or white, white people and black people, all americans, like this is wrong, mr. president. that's why 200 members of the nfl said there's something wrong here and we're going to protest this. i think that's part of the problem with this president. this is the problem that we're having. he continues to put his foot in his mouth over and over again. and then there are folks like ben that says oh it's the left. it's not the left. it's common sense americans saying this president is wrong. he goes out and says the race car drivers are okay. how many black race car drivers are there?

there's only four. so there you have it, right? >> dana: i'm going to give ben the last word if that's alright. ben how do we all move past this? if put had your prescription pad and could write a prescription for america for moving past this, how do we do it? you've talked about the culture wars driving us apart. i thought of you this weekend. i knew you were observing the jewish holidays, i thought when he gets back on line he's going to seal the cascade of more culture wars. >> it never ends. the only way to get past it is to go what we said before. kaepernick started this, trump didn't. if you want to get back to consensus here we need to go back to public opinion which is it's inappropriate to protest the national anthem or doing the national anthem. protest all you want in other venues. at the same time no one should be fired for this.

i'm not saying kaepernick doesn't have the right to do it, they certainly have the right to do it. owners have the right to react how they want to. the president should not be calling for people to be fired to express their protest opinions any way they have. i think there are only few symbols we hold together, the flag, an them and football. as those disappear the country becomes almost irreconcilable. >> dana: let's not do that. i think the three of it us agree and the people watching agree. >> i think we have to go back to the beginning here and figure out how we level the playing field and solve in just isz. that's by stopping violence happening to white and black people by the excessive the use of force by police officers. >> dana: there's a lot to debate there. gentlemen thank you for being here. i appreciate it. directly ahead there's a new escalation with the north korea crisis. calling it a declaration of war.

♪ . >> dana: welcome back. tensions are incredibly high tonight between the united states and north korea. two nuclear powers who both seem

increa increasi increasingly credible in their ability to use weapons against each other. today the foreign minister said president trump's warnings amounted to a declaration of war. that's serious stuff. joining us is daniel headinger. and marie heart and john. if i could start with you, you believe kim jong-un is finally starting to feel isolated. why do you say that? >> i think for a couple of reasons, dana p things have happened in the last few weeks. the united states last week announced that it was raising sanctions against north korea, which is to say secretary of state minnesota announced they would not do business with any country doing business with the north koreans. that was significant in the level of sanctions. that happened simultaneous with the chinese which youing after

in's bank account completely. that means trade across the chinese border has fallen by 75%. fuel prices in north korea are rising. i think kim understands he is becoming increasin increasingly. you've heard chinese scholars saying kim jong-un has to go. which is unusual. kim understands his problem is not only the united states but the chinese. i think there's a bigger wedge between china and north korea than most people believe. ever since kim assassinated his uncle until 2014, it there has been little contact between kim and the chinese. kim has to feel he doesn't have options left to him. marie you have said there is a concern about an escalation of rhetoric. so what dan was talking about is concrete actions that have possibly led to more isolation

which might hopefully lead it a change of behavior. in the meantime what do you think about the war of words? >> well, that's the exact issue. you're exactly right. what dan outlined is actually a strategy that a lot of democrats and republicans support, putting more pressure on china, getting additional sanctions. that is a strategy that might get us to a better place. my question has always been what does president trump want as the end goal here? i am concerned that some of this rhetoric, this cycle, this tit for tat of calling each other names on the world stage that has the real potential to balloon out of control. for the a leader like kim jong-un who is so irrational most would say or at least crazy, how he views what president trump says, that impacts his calculation. i just worry that we're rolling toward a situation where military force might have to be used or might be used against us or our allies because of the

outlandishly war of words. i want a strata i didn't, i don't want our presidents tweeting at each other. >> dana: we're not going to be able to stop them from talking to each other. dan you think there is a possible end game option. can you describe that. >> dana: >> i don't want to create strategy for kim jong-un, but if he were smart what he would do is grab something that is already on the table and that is the iran nuclear deal that president obama and john kerry struck with iran. i'm not a big believer in that deal. if kim jong-un were to say i'm willing to sit down and talk about doing a deal of the sort that iran did with the united states, i think president trump would be under tremendous pressure to do that. it would allow kim to at least have the space within which i think he would probably cheat but it would allow him to have an m.o. without giving up much of his program over the short term. >> dana: so in the next couple of weeks i understand that the president has to under the law

basically certify whether iran is complying with the agreement or not. there is mixed signals coming from the administration as to how that is going to go down. what do you think is going to happen? >> well the challenge for the administration is that within the 159 pages of the deal, iran is technically in compliance. now the administration doesn't like things they're doing outside of the deal. i would argue the best way to deal with those other things, like support for terrorism, ballistic missiles is to deal with them with all the other tools you have. why would you walk away from a nuclear deal that today is preventing them from getting a weapon? north korea shows us that our options with countries are much more limited when they get nuclear weapons. after they cross that threshold, the options for action go way down. iran is not there. why would you walk away from an agreement that while not perfect is preventing them from getting there? >> dana: let me ask dan a final quick word.

is north korea already -- have they crossed that threshold until. >> it depends how you define it, if you define it as being able to attach a nuclear war head, which they have to an ibm, which they have, in other words they've created a delivery system, then you have crossed the nuclear threshold. then we are going to be in a grave and unfortunate new world. that's why i think donald trump is in his rights to talk tough with kim jong-un, and i have the slightest doubt that john mccain and mr. mcmaster and the cia are getting together an array of options to get kim jong-un to step down. >> dana: thank you. excellent commentary. breaking news about hillary clinton's e-mails. this is not 2016. it's 2017. you're not going to believe this story. we'll be right back.

told the egyptian prime minister the truth, she told her daughter the truth and she lied to the american people. that's in part what started this. it was an inspector general who found hillary clinton was housing classified information a non-classified setting. they started this. we as the oversight committee the continued that investigation. what hillary clinton told the american public in a series of statements that turned out to be totally false she perpetual waited "the story." she ee road the confidence in the american people that she had this ability to lie to the american people. it eroded her credibility. she did that unto over self. it wasn't somebody like jason chaffetz or trey gowdy who was out there playing gotcha. we hold people accountable and she couldn't handle the truth. >> dana: in this book what happened she walks up to the line of taking responsibility for things but can't quite make

herself do it. >> she can't. she can't get r she doesn't understand it. remember this whole email scandal, it was hillary clinton on the very day that she started her senate confirmation she set up the search verl. it was her staff that did. that do you think that was really a coincidence? >> dana: no. >> do you think maybe that was the mindset that really started this whole series of events? >> dana: i always thought it was remarkable. i worked in the bush administration from october 2001 until the end. i didn't have a personal email address until after i left the white house. it never would have occurred to me because i knew that it was wrong and you could possibly lose your clearance and it was illegal and all of those things. let me ask you, though, because some people are trying to compare apples to apples here with the news story that's developed about additional leaks of what we knew earlier. the new york times reporting that up to six of the president's top aids have been using private email to do government business. take a listen to what hillary

clinton had to say about jared kushner and his emails. >> now we have this story about kushner and apparently others in the white house, and i am waiting to see the outrage on the part of republican members of congress about this. you will not see it. >> dana: i just can understand where she's trying to go with this, but i do not see it as the same thing. i the wonder if you as the investigator, how do you see it? >> it is wrong if somebody set up their own private email or used private email. in the case of jared kushner we're told its less it than 100t but trey gowdy & companyings sent a joint statement to don mcgahn the white house the general counsel saying give us an accounting of everybody at the executive level there that is using personal email. you can tell you personally as a former member of congress, the former chairman, if they're viewing that it also is wrong. >> dana: one of the things that

kushner's lawyer says if they did -- sorry, government business on personal email they also forwarded it to an email address that would be captured by the presidential records act so they are n. their words, saying they are in compliance with the law. >> well, so it's incumbent upon the oversight committee to hold them accountable to doing that. that's exactly what we did with hillary clinton although still to this day there are tense of it thousands of records she's not turned over. it's not her responsibility, it's the state department. that still the hasn't happened. i'm disgusted there are nearly 200 plus people that are still under open investigation that still have a degree of security clearance even though they're under investigation by the state department for traversing classified information in a non-secure setting. but that is so different than hillary clinton who set up her own server and domain name on the very day she started her senate confirmation. and what she said tonight about

susan collins came out. mccain and rand paul, they're at 49 with a couple more senators leaning against the bill. this thing is dead. republicans are going to have to move on. it's been one more in a series of follow his. they couldn't even bribe their own members. they were throwing money and it backfired. the bill and the effort to the repeal and replace is officially dead. >> dana: it is quite remarkable that we're at this stage of the game. bob, let me ask you about the way forward. even hillary clinton said in the campaign if she were to become president she would have work to do to abofix obamacare. how does the senate pull together to fix something that the majority of people say they don't want or i guess they're happy with it now because they didn't have an alternative. how do you actually get the fixes that are necessary? because premiums continue to go up, deductibles are going up and people feel they can't use the doctor they want.

>> dana it will be difficult in this environment. there have been bipartisan fixes over the year. the temperature has never been this hot. i don't think they can do anything in the short term. but maybe in a few months. after health care, this fight, is in the background. maybe they can get. i'm not hopeful. it's just the politics of obamacare be so polar rising i don't see any bipartisan fix happening any time soon because then republicans would have to vote for something that's not repeal. right off the bat you will have republicans saying no chance, i'm not voting for that. >> dana: earlier the today senator rand paul's office put out a statement that he would prefer no block grants. i'm not sure how you get things back to the states if you don't figure out a way to separate the money out of washington? >> well look rand paul is one of the guys on the republican side who has just found every possible way to not say yes to this. he was originally wanted it to

be repeal and replace then he said i only want repeal. he voted for the skinny repeal. now he isn't on board. mccain disappointed republicans in a big big way. but i the agree with bob i think republicans are going to put healthcare behind them. they have work to do on tax reform. they want to put some points on the board as soon as they can, certainly by year's end. i think healthcare is done at least for the foreseeable future. bob you said you were pessimistic about healthcare for the congress to get that done. are you optimistic in tax reform? >> yeah i can they've got a decent shot. partly because of the legislative failures they've had in 2017. if you talk to members, republican members are saying we've got to get this done. we saw some, this health care bill actually had momentum last week because we've got to get something done. now they don't have the vote. i think that actually helps them get some type of not major tax

reform but some type of tax cut measure by the end of this year. they've got to get it done by the end of this year. >> dana: tom what about you on tax reform? the president is going to indiana on wednesday. gonna lay it all out. are democrats in the mood to make an it deal with him? >> that's been the most interesting thing about this. the conventional wisdom out of the election was you had red state democrats in states that trump won by 15, 20 votes that they would be able to peel folks off, it hasn't happened on healthcare. but he was with heidi high camp. joe manchin, which would certainly improve the chances of them getting something done. >> dana: let me ask you also, then bob. when you look at this, we're gonna talk a little bit more about the alabama election tomorrow. overall how does the 2018 look for republicans if they can get tax reform done?

the republican primary runoff. both candidates chatted with martha maccallum tonight. >> he's very concerned if i don't win tomorrow this puts the seat in play for the democrats. it creates a weakness across the board for all republicans who are running for election next year. it would be kind of sloppy. >> dana: meanwhile roy moore trashed the rhetoric. >> for the past couple of months he's told miss truths and lies and things on television with money coming out of washington, d.c. and the senate leadership fund run by mcconnell. >> joining us next, you wrote about this on friday night and i was anxious to talk to you about it. president trump was at the rally friday night that's where he did the nfl thing, too. but the focus was on this race. did it help luther strange in the polls going into tomorrow?

>> alabama is trump country, probably state that is the most pro trump state in the country. republicans are overwhelmingly in support of the president. in theory trump's endorsement should have an impact. dana, if you watched that rally in alabama friday night he wasn't talking a lot about the senate race or congress, he was talking about the nfl. you have a big rally for trump to persuade alabama republicans to back his guy, luther strange the instead he talked about so many other issues i don't think a lot of people came out of the rally deciding to change their mind in the primary r it's close, i think roy moore has an edge. trump hedged his bets in that rally when he made that speech. >> dana: mitch mcconnell has been a real focus of this primary race. we see this when nancy pelosi becomes the target when republicans are trying to beat

up a democrat. the republicans are actually now looking at mitch mcconnell. so a drag on this race or because he backed luther strange do you think that could help strange in a behind the scenes way tomorrow? >> it cuts both ways. mitch mcconnell and his allies have spent millions of dollars on behalf of luther strange, they've spent almost ten times as much money as roy moore has. the financial advantage has made this race competitive. if it will wasn't for the money i think moore would win in a run away. but mitch mcconnell has a lot of baggage with alabama republicans. and if you look at the public opinion surveys just among republicans mitch mcconnell isn't that much more popular than nancy pelosi. he's become a real villain. the establishment is really low. steve bannon attacking mitch mcconnell in alabama tonight, attack trey gowdy some of the top republican advisors to the senate campaign committee. this is not a classic primary race. it's establishment versus

antiestablishment. >> dana: mr. bannon was on sean hannity's show back tonight at 9:00 talking about that and really saying he is supporting president trump down there. what about the notion that some people suggest and i don't know if this is true but there is concern if roy moore were to win the primary that he would lose the general election? that's something luther strange was saying to martha maccallum tonight. >> that's the kind of comment you make when you really need to come from behind. when you really need to flow a hail mary pass. alabama is a conservative state. probably one of the toughest states in the country for democrats to crack. democrats want to compete. they know how difficult it is for any democrat in alabama. so he's trying to raise the specter of elect built that roy moore could lose the seat to a democrat but the polls and actions don't seem to match that rhetoric. >> dana: tomorrow night you say the polls close at 8:00 eastern
