>> thank you for joining us. >> "outnumbered" starts right now. have a good weekend. >> fox news alert on the investigation into the las vegas massacre. authorities now reported they are looking at a note left by the killer inside his vegas hotel suite and they are searching for why he did it, behind the deadliest mass shooting in modern history. why in america? they're also looking at whether the gunman planned to escape and pull for attacks and other major cities. reportedly tried to buy tracer rounds to give himself better aim and kill more people. this is "outnumbered." i'm harris faulkner. here today most of kennedy on fox business kennedy. also republican strategist and fox news contributor lisa boothe is here and today's hashtag one lucky guy, the opinion editor for "the washington times," ox news contributor as both charlie hurt. could have you as always. have a lot breaking.

>> thank you for having me. good to be here bread let's get to the news. investigators say they are no closer to finding out why he did it, but they are learning new details about the vegas killer. who opened fire as you know on more than 20,000 music fans sunday night. he killed 58 people, wounded hundreds more. many still in the hospital. investigators looking at whether he was scouting other big music festivals in las vegas, chicago, and boston. >> the fbi reached out to us let us know boston was on the radar screen. we just have information that he was on both sides looking up boston but there's nothing to indicate he ever made here. all we know is he might have visited sites where he was looking in the area. >> harris: claudia cowan is live or is in vegas. claudia? >> harris, you mentioned those tracer rounds report this morning that the only reason he did not get those tracer rounds is because the vendor was sold

out. and also this morning, we are learning more about how he was able to move and get so many weapons into his sweet here at mandalay bay. according to a published report data las vegas review journal pretty got to know the movements of the hotel staff and he transported 13 cases of guns and ammo to his room during shift changes. the associated press for citing sources who say his suite was comped because he was a frequent guest who gambled thousands of dollars. on them with his arsenal of weapons and bomb making material found in his car, officials have revealed he had some kind of escape plan and possibly an accomplice or at least someone who knew he was going to do. the sheriff suggesting would be some kind of superman to pull this off all by himself. as we get new cell phone video of people running for their lives on sunday night, officials say paddock might've wanted to target other music events this past summer in las vegas, chicago, possibly boston as well.

this video shot by a traffic technician who was working at the show sunday night and just by chance the firefighters happen to be passing by when the shooting began. >> the captain said that's gunfire. we were right there at the fence to the event. the captain picked up the radio and said dispatch? you have any reports of gunfire going on right now because i'm hearing a lot of gunfire. oh, now we do. it was that fast. >> officials are now trying to identify a mystery woman, not his girlfriend who was seen with paddock in las vegas as they tried to build a timeline for his movements in the days leading up to the massacre. that we are heading into a weekend, there a lot of big music events set to start at the austin city limits, bluegrass festival in san francisco and even though stephen paddock is dead, security at these and many other events will be stepped up because of what he did here.

back to you. >> harris: claudia wrapping up the facts for us to talk about. thank you very much. as we come to the couch, charlie, there's a lot to chew on. we want to go back to those tracer weapons and the ability to be able to see things particularly at night. that's why you want those tracer bullets with tracer ammunition. >> charles: it is and of course, this will be something that we will be debating for a long time. but what i don't get here is there so many questions here. the biggest one is how it was possible for this guy to do this all by himself. it's a physical feat and i'm not talking about curing stuff up to his room, i'm talking about our military, they don't use fully automatic weapons usually because you can't aim which goes to the reason that they thought about the tracer rounds. since you're not aiming, he is not a sniper. he was just spraying bullets or whoever was just spraying bullets. i've a real hard time imagining

how this guy managed to pull this off completely by himself. >> harris: you anna sheriff, by the way. >> charles: i don't know how a single person put thousands of rounds through several different guns and managed to actually keep them going in the direction that he wanted to go. another question that i have is nobody has talked to anybody at any gun ranges where this guy -- that we know of yet, exactly. but that's a key question for me. this guy had to have spent, he had to spend hundreds and hundreds of hours either at a gun range or at private propert property. he could go out and go into the desert. a lot of people do that. people would've seen it. >> harris: one of the things that we are hearing so much about him starting to hear from people who own some of these hotels who previously have run security for them, they are huge security operations. when you hear details of

transporting weaponry and materials 13 times during shift changes, he was there for several days watching people. we know he had cameras that were station to your bread is chilling to think about what he was capable of, whether he had help or not. >> we are hearing about explosives and his arsenal and to charlie's point. i am still so dumbfounded by his motivation because if you read from behaviorists and people who work with the fbi, people who study mass shootings, they always leave something behind it are there some sort footprint whether someone called them on 911, professes their allegiance to isis or makes a facebook post or leaves some sort of a written manifest of some side of trail. there's nothing like that. it's so confusing, but given the amount of weaponry that he had in the amount of time that he spent planning just one massacre, now we are learning about the other city, you would

talk about the gun range. think about the hours in the amount of time it takes to maximize the body count. from that perch, whatever city he was looking at, there so much research and he had access because of the money that he has lost in the casino and he capitalized on it. >> people have a right to be ingrate as how did he sop out as many weapons? you make a large cash. >> harris: it was over period. it didn't happen over a period back of weeks. >> if you have somebody who is accumulating 33 weapons including semiautomatic weapons over a year. we make one cash transfer and it gets flagged. but to cody since he had a live-in girlfriend as well, you would think that he would see this going on. >> harris: we know what the facts are so far and we also know that we don't know all of

them yet because they're not going to tell us in totality their investigation. now policymakers in the white house are saying they're willing to consider banning bump stocks. that's the attachment that enabled the killer to use a semiautomatic rifle to fire 100 rounds per minute which was used by the vegas killer. now the head of the national rifle association has told sean hannity bump stocks many more restrictions. but noting the group is not calling for them to be outlawed. watch. >> the other side on the other end is so right right trying to politicize a strategy, we did feel a need to speak out today on this whole bump stock issue. what the nra has said and as we ought to take a look at that, see if it's in compliance with federal law, and it is worthy of additional regulation. that being said, we didn't say band. we didn't say confiscate.

>> harris: house speaker paul ryan says lawmakers are also turning their focus to bump stocks. >> fully automatic weapons have been outlawed for many, many years. this seems to be a way of going around that two of is that we need to look at how we can tighten up the compliance this law so that they are banned. >> house democrat leader nancy pelosi played down the reporter's question about some republicans being concerned would open the door to more gun restriction. >> so what? they're going to say you give them bump stocks, it's going to be a slippery slope? i said i hope so but i don't think that they should be a substitute for the background check and by the way, the background check is a compromise for many more things members want to do. >> harris: president trump has also said he is opening to considering legislation banning bump stocks. we are going to start rather seems to be a little bit of consensus. the mood to go back to the nra

statement which starts off with heartfelt words to the victims and to the people of las vegas, and that does something that i believe is a little bit groundbreaking. it looks at the nra, looks to the request of the bureau to the atf to immediately review whether bump stocks should have some instructions on them. >> charles: i thought that was a pretty deft statement because it puts it back on actually the obama administration which it was under the obama administration's atf that approved this a number of times. but i do think that it also clearly the bump stock is a workaround. it is a loophole in what has been accepted law since al capone in this country that we don't want people having automatic weapons whether you agree with that or not, it is kind of settled, it's been settled for a long time. i think that people, is this

going to be a -- it's not going to prevent anything. like most of these laws, it's not going to prevent anything. before we should point out it is an outright felony punishable by ten years in prison to modify any weapon and turn into an an automatic weapon. so it is a felony. >> lisa: that was made legal under the obama era. >> harris: let me read this real quick from "washington post" a few years ago right when this happened. it's a goofy lead little dooda, former atf official who signed off first on the recommendation that the borough did not need to regulate bump stocks. that was under the obama administration that was the first person to sign off on it. >> kennedy: the problem is criminals they are criminals because they're going to break the law so by definition, they are lawbreakers. the problem with this as we know that bump stocks can be

replicated at home. they don't even need this tool to do this. that's the problem is the fact that people that want to inflict harm on folks are going to find a way to do that and we've seen that in cities that have strict gun laws, places like chicago, places like baltimore. we see them taking a truck and killing 86 people in france. we see obama killing 186 people. that's the problem and i think the problem you're facing is anything that gun legislation can touch upon. >> harris: we don't hear anyone say that they could have prevented this because as of the madman who had a lot of time. >> lisa: that the ultimate question is how could someone like this invade every grasp and every piece of radar and how do you keep it from happening again? as of the two major questions that are certain pieces of legislation that might make a lot of people feel better. but in an, they don't get to the

heart. >> dagen: in the end, government, people do believe that lawmakers can somehow regulate away evil and depravity in this country. they can't even enforce the laws on the books. the shooter in the charleston church shooting should not have gotten a gun. he should not have gotten the permit, but it was an investigator at the fbi who fell down on the job who didn't find the drug confession. >> kennedy: a look at gun town where guns are stolen because they were denied because of a background check. criminals are going to get their hands on things and tools if they want. >> harris: one thing is for sure, the nra stepped into this conversation in a different and new way is we've been talking about and you bring attention to that because it's all hands on deck. we will move forward. should nancy pelosi's days as minority leader be numbered? atop democrat is calling for her to step down from her leadership post. she is she is a master legislator. what this means for democrats as

>> kennedy: this is a fox news alert. the trump administration last hour announcing it is up rolling back obamacare is requirement that most employers provide coverage of birth control to their employees. the administration vastly expanding an exception. those that cite moral or religious objections. the new rule fulfills a campaign promise by the president and are sure to touch off a firestorm of criticism from democrats and around the block. the president of the american college of obstructions and gynecology says this is a step back for women's health. saying "affordable contraception for women saves lives. it prevents pregnancies, improves maternal mortality, it prevents adolescent pregnancies." so charlie, i will start with you. this is always my question whenever we run into the scaling back of some sort of a

government-funded plan. was this ever the role or function of government in the first place? >> charles: has that ever happened that anything was scaled back or rollback? welcome to obamacare. it is a failed promise. i love that the doctor there was talking about affordable. there's nothing affordable about this. that's the problem with obamacare. this is a new era in which we live. everyone of these little things have become a public debate. as become a government even taken something away. you're going to be debating this forever until we junk obamacare. >> lisa: think it's also important to point out the supreme court twice pointed out there were accommodations both with the hobby lobby case and saying it was protected under the religious freedom restoration act. and also another thing i think that is important to note as well is president obama did this as a political issue. if you remember in 2012, he was running ads saying that mitt romney did meet favor this. he was the one that made this a political issue so if anyone is

pointing out president trump and saying he is somehow not making this a political issue, it is simply lying that is not the case. >> dagen: why should women pay for their own birth control or manual or at least part of it? this is about free birth control, and it's this guy is falling proclamation from from these groups that the world is going to come to an end if this is rolled back even slightly, it's just simply hogwash. and why are people so gung ho with the government taking more control of their own health care because that's the argument that you hear with single-payer and i don't want the government making decisions about my health care and my. >> kennedy: estimate from the department of health and human services saying "no american should be forced to violate his or her own conscience in order to abide by the laws and regulations governing our health care system. today's actions are from the trump administration's commitment to upholding the freedoms afforded all americans

under our constitution. what you think of that? >> harris: and that we touched on this issue but i think it's important to know that this does not actually create any exemption that doesn't already exist. so then the question becomes that is about timing. so why under the last administration and i think politically we can probably guess why but that doesn't go any further than what they had already put. i see you nodding at me. >> kennedy: you're so right but we know that that's not what's going to be reported. what we are going to see what we are going to see in campaign ads and probably going to have her publicans the midterm elections is that republicans are evil and trying to take away man's right to contraception. these are the ad that we are going to see and it's completely disingenuous. >> kennedy: no one is going to make contraception illegal. do what they could do is take oral contraception and put it over the counter so you don't have to have a prescription for it. so maybe there can be greater free-market competition and it will bring prices down for a product that's already

inexpensive. i think senator cory gardner of my memory serves me correct has introduced something along those lines of making it available over-the-counter. >> harris: the morning-after pill is over-the-counter but anyone can drive that over the counter. >> kennedy: daily oral contraception is still only available over-the-counter. >> harris: it's the dudes. >> dagen: but a lot of this can be taken care of that state level. if they don't like what the government is doing with the federal mandate on contraception, you already have left-wing states like california, maryland, vermont denying laws to protect the free birth control coverage and it's almost the country has moved on this in some way, shape, or for form. >> lisa: is part of their data package and i'll pay for it. >> harris: i'm looking at some of these details on this and the exemption is now brought in to

as we gather for the celebration, our hearts remain heavy and sad for the victims of the horrible mass murder in las vegas. on wednesday in nevada, i visited with brave survivors still recovering in the hospital and with her relic police officers, first responders, and everyday americans who acted with speed and courage to save countless lives. no evil on this earth is more powerful than the love encourage of the american people. all of america is praying for the wounded and the grieving, and we will be with them today, and we will be with them foreve forever.
