covered from every angle tonight. five days from the attack we still have so many questions. breaking news federal authorities arrested three people over a thwarted isis plot in new york, three suspects aging from 18-32 were targeting concerts and other soft targets. related? perhaps. 2016-2017. the mindset is the same, the city is different. joining us for reaction in las vegas is fox news senior correspondent dan springer. dan you're covering "the story" and we still have so many questions. and the frustration from the under sheriff was so evident. what do you pull from that presser today? >> well the under sheriff and the fbi. i mean the fbi had a spokesperson there and he came out and spoke very briefly and basically said what we're doing now is putting up billboards throughout las vegas because we believe somebody must know something important. the billboards will ask them to call the authorities.

they're obviously frustrated. they've never experienced something like this. think about all the different big mass shootings that we've had, columbine, you name them. we newly instantly exactly what the motive was. we're four and-a-half, almost five full days since the shooting and they still don't know. they're still kind of just around the edges looking at, you know, his movements beforehand, ammunition, all of his planning that went into, planning in other cities that he may have been targeting. but nothing that goes to the heart of the motive yet. it's frustrating for them. >> sean: some of the rumors have been rampant. for example a second shooter. that was kicked out today. however they didn't rule out that he had some help. how do you broker the two? >> yeah, well interesting. there was a news report in nbc did it, which indicated that there may have been a second person because the report said at the very same time that the

vehicle that was packed with explosives was gone from the parking garage, somebody used a -- the key, the room key to get inside that room on the 32nd floor in the mandalay bay. well the police were asked about it today and they said that did not happen. there was never the room key used at the same time that the car was gone. and that nobody other than stephen paddock ever went inside that room. so they discounted "the story." they have didn't shoot down the possibility that somebody else may have been involved in procuring all those weapons and all the planning that went into the attack. >> sean: right. absolutely. the other thing that came clear was that he did buy tracer ammunition. he did not use it that we know of. also ballistic experts say this device that was supposed to make a semiautomatic begun into an automatic begun that actually might have hindered thank goodness the carnage because it actually slowed him down because it hurts in terms of accuracy and often causes the jamming of

a rifle. >> i wonder if that tracer ammo if some of that was in the guns, the bump stock guns that then got jammed, forced him to go to other guns. 12 of the 23 weapons in the room had the bump stocks. we now know from a report that for several reports that he did buy this tracer ammunition. that's significant because what that would allow the shooter to do is see where those bullets are landing in the crowd and would increase his accuracy. every fourth or fifth bullet would send out a light beam that would go and show exactly where it's landing. so it could actually have made the situation more deadly. it also would make those weapons more likely to jam. maybe that happened. maybe that's why the shooting ended up stopping because his weapons got jammed, we just don't know. >> sean: we do know some things and probably a lot more because everything is under surveillance in vegas especially to high stakes good morning employers like him. we know there was no sign he was

radicalized. we know there was no signs that economic conditions caused additional stress. there was no social pressure necessarily on him. we know there was no outward look at a type of religious convergence that we see. the under sheriff did say we acknowledge the fact that isis continues to claim that he was one of theirs and this was their operation. however they do know he was gambling all day and he did complain about loud music underneath. so agitated perhaps, eight hours concentration there, extremely good gambler. it seems as though one thing is clear, very intelligent. >> very intelligent, very thorough in his planning. the fact that he was booking rooms in other cities. weeks in advance of events there. scouting out locations. yeah, but there was also reporting that marilou danley his girlfriend reported to the police in the interview that he

was agitated recently, during the middle of the night, waking up agitated and screaming in the middle of the night and shouting. but again does that paint the picture of a mad man who is going to kill dozens of people? not necessarily. >> sean: you've got baseball games, people concerned, apartment buildings go and offices around that might be a perch for somebody that wants to do the same thing, there's concern. dan you noticed when you landed today in terms of secretary everything has changed in las vegas right now. >> absolutely. when i went into the hotel, i went into the parking garage and i was met by a number of different security guys. and what they had to do is every single person who pulled up had to open up their trunk and open up their doors and those security guards were going through and just kind of looking to make sure everything looked okay. i think las vegas changed forever. i asked them how long will this go on? they said we just don't know.

crime, targeted violence, school shootings, assassination attempts, all of the modeling that goes into this, the models of this type of behavior are not there. they're not there. there's nobody coming forward saying i saw something unusual. he said something about an attack or he was angry at this group or that group. that usually happens in these types of cases. we're seeing none of that. as dan springer just said we're four and-a-half days in and nobody has come forward that saw anything suspicious? very bizarre. >> sean: danny do you factor this in, the fact that he went on 20 cruises, 9 with marilou danley and the stops include spain italy, agrees, jordan and uae. are we looking there? >> absolutely they're looking as cruise lineman i fests, every place he went. we may never know, we don't like to say that, dan doesn't like to

say that, i never want to say i don't know but i'm afraid we may be approaching the time when we say we don't know what's in this guy's head. we can re-create his life unfortunately we may never know what was in this guy's mind. the only key that we may have is the girlfriend. if anybody knows it would be her. >> sean: or the other woman that he evidently was worth during the day. we don't know the relationship. but if you want to see another woman the best thing you can do is give your girlfriend a ticket to the philippines and indicate you want to break up, dan. >> that's probably not the best sign for your relationship when you give a one-way ticket to another country. danny is right, though. the best vehicle into this guy's mind right now and potentially the only one we know about is going to be the girlfriend. it's very telling as well that the fbi interview was close to six to eight hours long by reports i've seen, which says

they went in there with a bunch of questions that they must have had in advance, information and lease. it's good to know that the public -- we don't need to know anything but the girlfriend is the only solid lead we have. >> sean: i don't know how close you had to look at the acting manhattan u.s. attorney. they have unsealed charges against three persons if against an international terror plot. the ages go from 37 and two 19 year olds. they were going to come here and shoot up the place. the plan was unwound by the fbi. they wanted to create a mini 9/11. they lot to conduct bombings and shootings at the same time in midtown manhattan. they were stopped, and it was thwarted. all three recall under arrest. one goes back to pakistan. for the life of me danny coulson, i don't know how you spot three people like this and stop them ahead of time.

>> yeah they had advance information clearly. this is not an fbi case brian, it's a law enforcement case. this is like a corporation of intelligence agencies, law enforcement agencies literally all over the world, i'm sure it's a product of the jtf in new york city. the tragedy in vegas would have paid in comparison to what would have taken place here. this is a huge plot. it's a great day for the united states. we have a victory here. but you know what? we've got to have the another victory tomorrow because these guys are going to keep coming. >> sean: they are. that's how you celebrate ramadan, you go to new york and try to kill people. this was going to be three guys, one from canada, who was arrested in new jersey, another one from pakistan and by the way there's also a link to the philippines with the 37 year old. he was the one wiring money for

this plot. >> yeah brian this is really sad. we're going to be dealing with this for a very long time. when i say this, i mean the threat from soft target tactical assaults using small weapons, going into sub ways with firearms, shooting and using explosives. they've gotten away from the 9/11 spectacular style attacks, i don't mean that qualitatively, i mean it in their body counts because it takes too much training. it takes no logistics to put together a slow yield explosive and pull a trigger. when the you have the savage mind these people do we're going to be dealing with it for a long time. it's sad but we're in a new world. >> sean: we're right in midtown manhattan. i always walk down times square. we always respond. we respond because we study other terror attacks, for example in nice france as that guy rents a truck and runs over people, killing two from texas, by the way, now we have barriers

on the sidewalks preventing that. you literally can't walk three feet without a barrier. how are we going to react to this plot in particular? this is now public knowledge and how do we react on new year's eve with las vegas a learning tool? >> well i think the world is changed again. dan referred to that. we have to worry about now did you mean trucks that run over people. now we have to worry about high ground. we saw it in dallas texas when there was an attack on a demonstration there, in las vegas, these guys learn from each other. we don't just have to secure the ground i have to secure the high ground and probably next i have to secure against drones. that's the next weapon we'll be dealing with. the world has changed and we have to look at it differently. >> sean: for example to be able to go see the thanksgiving parade from a high end. dan if i gave you the assignment to secure 42nd street down to

48th street, what do you do? do you go into every apartment? do you knock on every door? you know how costly that is? >> yeah. you don't. people used to ask me in the secret service, how do you secure the inauguration parade route when the president gets out and waves? you don't. you have to make big things really small. danny brought up a fantastic point. the idea of an attack from above, an elevated sniper position on a perch, security people consider it but the general public thankfully hadn't had to consider it before. think about the danger of this attack. everything you've been told about being in one of these active shooting scenarios goes out the windows. the bullets are coming from an elevated place that are going to elevate over the cover. between drones and elevated sniper attacks, no need to panic, the likely is small but

it is a new day. >> sean: i want you guys to comment on this, two law enforcement experts. if i put you in a terror situation you're going to react professionally p i'm listening to these interviews especially sean's with the survivor even though he had a bullet in his leg to meet the president, he said i prethought to myself what would i do if this ever happened to me? he said i could get shot laying on the ground or running away. don't all the viewers and the radio listeners have to think to themselves, what if it's me? how do i act? you all have to be responsible now, not the fbi guys but all the american citizens have to ask themselves what do i do if it's me next, right danny? >> absolutely. one thing to remember the police are minutes away, but seconds matter. the first thing you have to do is believe it's happening. don't stand there in disbelief thinking it's fire crackers and don't get on the ground, run, be

the point is that he's back. he's going to be safely reunited with his family. he served the united states with honor and distinction. >> sean: really? honor and distinction. well according to a report from the associated press that just came out about four hours ago, bowe bergdahl is about to plead guilty in a couple of weeks for desserting his base and misbehavior in front of the enemy. joining us now for reaction from miami is chris oprison a former prosecutor in the marines. bowe bergdahl pleading guilty, does it surprise you? >> no, this has been a mess of a case from the beginning. this is about the right ending. it's taken a long time though. i was here three years ago with bill o'reilly talking about the delays nick and how long it was taking for the investigation, and it's gone through some ups and downs at the court of appeals. finally we're getting closure on this. the question is why do we care about this guy? this is not a service member that stood his ground and

somehow violated the rules of engagement. this is a guy who got up and left his unit. he walked away. he's a quitter. and he left and he went away, and we sent our service members out there to try to get him back, put them in harms way. we traded as you indicated at the beginning five high value targets, put them back on the battle field for this guy. it's astonishing. >> sean: at least one is go known in 2015 to have gone back to the battle. after all if you're a high value taliban terrorist and you're at gitmo, the worst of the worse, what are you going to do as a backup plan? woodworking? you're going to go back to doing the only thing you know to the people you were nesting with before. when our guys are under fire it might be because of their commands and their structure. bowe bergdahl was tortured. he was kept in a cage. nobody wants that for anyone who makes a bad mistake in their

life. the fact that the administration, the previous administration was that off, thinking that he was going to be lauded as a hero that they didn't know what everybody else knew that he put people in harm's way when he left the base astounds me even today. >>er that's right. we don't leave anybody behind. but we got the short end of the stick on that bargain, no question about it. that was not a smart move. i think it was a political disaster for the prior administration. i think now we're seeing things come full circle and we see this guy for what he is. he's a did he desserter, a quitter, he left his unit and we paid a big price for that. you tell the service members out there having to go against these same people on the battle field that we got a good end of that bargain. i don't think so. it's not defensible. >> sean: what is also indefensible the previous president had a promise, he was going to empty gitmo and close

it, couldn't do it. he had no place to put these guys, they're the worst of the worse. their home countries want no part of them. this is an example of the previous administration doing anything they could to empty out that prison. we built that prison because these people have to be taken off the battle field and taken away from shooting out americans. that's what it's for. i'm not sure exactly what president trump is going to do, but i hope that they're going to be kept in a responsible containment situation wherever it is. >> well you can't put them in prisons in the middle of new york city. you're not gonna put them somewhere in somebody's backyard. gitmo was the place to put them. that's what it was made for. and we've kept them there for as long as we could. now i don't know what the plan is. i'm not part of that discussion. but it doesn't seem to be any good alternatives on the table at this point i don't think brian. >> sean: when you see what we're doing in africa, getting back into the fight in syria, trying

goes beyond just those, the companies that have any kind of a religious objection. it allows companies in the private sector who may not be a catholic or religious affiliation to make the same determination. here is my problem with it, i think it's sexist and i know you're going to say as a woman i'm going to throw that word around but hear me out. this obviously affects women, it doesn't affect men. the affects costs. it's expensive out-of-pocket if insurance doesn't pay for it. although i love the constitution and respect and uphold the first amendment right the religious free doom of everyone don't we have freedom as women to be able to protect ourselves from a pregnancy. who is going to pay for the pregnancy when you're out of work? that employer? this is really sexist in the my opinion >> sean: you bring up different facets to this. this is freedom for the companies to decide if it's okay for them to provide money for

several major democrats like chuck schumer, ben cardin, senator menendez and joe manchin. so will some of those democrats high five president trump if he decides to decertify the deal and kick it back to congress? joining us now to bring us inside the minds is jonathan walk tell and was side-by-side with nicky haley for a few moss and dennis kucinich. you know, dennis, congressman, great to see you, you know this was not a popular deal when it passed, you know they got under 50 votes in the senate and they used some maneuver to get this through. do you think it would remain unpopular if he kicks it back and decertifies on the 15th of october? >> i know a number of people making this decision. i would say they'll look at the record and the record is that this agreement is working. there's no evidence that there's been any subterfuge.

iran has not been reprocessing, diverting or constructing heavy water reactor. it's working. the members are going to have to take that into account. >> sean: there's no ballistic missile clause in this. they've been shooting off. they've been harassing our ships with their fast boats out in the percent gulf. add to this jonathan, we aren't behind the inspection process and there's a sunset clause on this deal. if they go by the letter of the law in ten, 15 years they can be doing a nuclear deal and not be in violation of this deal and have nuclear weapons. >> it remains the same deal that was flawed right now and there are problems with it. even what the congressman said a short time ago they've been complying, we're working on the faith of the international atomic energy agency. they don't have access to iran's military sites. issues have come to the surface

that maybe some weird activity is going on at one of the primary sites in iran. >> sean: the ieae came out and said they had a nuclear weapons program and they shelved it. the iraniance said we had nothing to shelf. we're not even pursuing that. there's a credibility issue there on something that fundamental. >> news week published an interview today with the foreign minister in which he said iran never pursued a nuclear program and never will. look, they actually were doing something. they had a military dimensions to the nuclear program. it was found and reported on by the ieae, they have the sunset clause that allows them to enrich uranium after a number of years. why do you need to do that if you have no intention of having a nuclear program? >> sean: their whole country is

on an ocean of oil? congressman to your point this program is in place and the shafrngsz are lifted and the money is delivered. they got everything on the front end. in a way they would love if president trump walked away from this deal because they could go back to nuclear weaponry, they got the cash and they could trade with everybody, right? >> well yeah it's an interesting way you put it, brian. this is a nuclear non-proliferation deal. the money that iran got back, that was their money. it was basically released. the question is, as you started to put it, if this deal is canceled then iran would be able to go ahead and go about nuclear activities that they're now prohibited from by virtue of this agreement which was not just with the u.s., there were seven countries that were parties to this agreement. i don't see any reason in the world, there's no evidence why

the u.s. should pull out of this, there's no evidence why this agreement should be canceled. frankly the rest of the countries aren't going to pull out of it. >> brian: france is tentative about it. just think about this, doug really think chuck schumer and gent or menendez are going to get behind the microphone and condemn president trump when they didn't vote for this to begin with? this is beyond how they feel about the president, it's an issue on the united states and the world to start to get rid of nuclear weapons and to stop non-nuclear nations from having them. >> brian: does iran have any credibility at all and did they earn the trust of anyone at the united nations? >> look a lot of countries have a bad relationship with the united states or look at us with some sort of animus. they're going to be supportive of iran. that's just the nature of the world that we live in. one of the problems i have with

what the congressman just said is we don't know everything about iran and what they're doing. there are real issues. it's not our inspectors on the ground. the ieae says this. why are they firing ballistic missiles. >> that's not part of the agreement. >> that's the problem. >> if the agreement were negotiated today, knowing what iran is doing in syria and yemen, firing ballistic missiles, i'm not certain there would have been an agreement. why not ask this question now of iran and the countries who are involved in this negotiation so that we can square away some of these problems? >> well this is a non-proliferation agreement. it's not about whether they're involved in other countries. >> there was the spirit of the anything go shagsz. it was supposed to improve relations between the united states and iran and other western powers. >> sean: it's got en worse. it's started off with renouncing

♪ . >> sean: funding a border wall and finding a solution for daca recipients are two of the most contentious issues in congress and in the country. senator jeff flake joins us right now from scottsdale. wait a second senator, you'll pay for the wall? you have a way to pay for the wall and make daca, get these daca kids legalize did? >> let me take the daca portion first. what we've introduced will allow those kids who were brought here when they were children, to be able to stay, and over a ten-year period, they would be in a probationary stage when then they could obtain a green card. that's similar to some of the other provisions that have been introduced before. then we also add a border security element. we thought the best thing to do was take something that's already passed the house, the house passed a $1.6 billion

request that the president made to do border fencing in texas, california and do planning for additional fort fill indications on the border. so if we combine those two things, that's the best chance of getting something passed. >> brian: you're going to need much more than $1.6 billion. you're more of a fence guy, the president is more of a wall guy. he kind of gave in a little bit saying the border security is telling him you need to see through. have you reached out to the white house? >> yes. yes, we have. i'm very close to mike pence. i've talked to him about what i would be putting forward. and the president came to arizona a couple months ago and went to yuma and saw what they have there. they have some, what's called but hard fencing which is a tall steel fence. that's worked very well in parts of yuma, it's double layer.

in some areas of arizona the terrain is so steep that you really can't put anything there, but sensors are do surveillance. it just depends on where you are on the border. i think the president is realizing that go. >> brian: i talked to senator language ford last week. you have this plan this week. senator corn in is thinking about doing it, too in texas. are you going to merge something and put it together that we could see in november? >> i think so. i think the best chance is to do this as parts of an omnibus spending bill that we have to do before december. the daca fix has to be done six months from when the president made this announcement. that was in late february or early march. but i don't think anybody wants to get close to that date. so i think this fall is the best. and if we combine a border security element and daca, a fix for daca, i think that's the best chance.

remember we have to get 60 votes in the senate. we can't do this as part of reconciliation. when the president talked to chuck schumer and nancy pelosi obviously we're going to need to bring the democrats in, in the senate at least. they showed willingness to do border security elements. i hope that what we've introduced is the best way to get there. >> brian: i know you and the president have had friction in the past and i know you weren't a big fan of his ass a nominee. you seem to vote with the president on just about everything. >> yeah on regulatory issues on judges on tax policy, on healthcare, yeah. i've been with the president on all of these things. i'm a conservative. and these are conservative policies. and i'll support them. we'll have differences along the way. i've had differences with other republican presidents but i'm going to be there fits a conservative policy and it's good for arizona. >> brian: do you hope he decertifies the iranian deal
