he could potentially see life in prison. do you think he gets that? he spent 5 years in captivity already. >> he did and i don't think he gets anything close to that though it is legally possible. jillian: people are having a hard time, someone who for years has been saying this isn't true, i haven't done this, not quoting here but now he is pleading guilty. how is he going to handle this in court? >> yesterday he had his plea. in the military system you have to personally convinced the military judge that you are in fact guilty of what you are pleading to. if in fact he had his pleas to desertion accepted by the judge, he had to admit that when he left he had the intent to stay away permanently, to never turn back. that is certainly at odds with what he has been saying for

months. rob: there is a disparity between the way some people view this case. the president and a lot of members of the military saying we should have left him, never trade for a traitor and all these things and the former administration got him back and traded five of our worst for him. how is there such a disparity in how people view this story? >> it is a great question. you can say that about a lot of issues that are swirling in our country today right now. everybody has different views on lots of things. this particular case, again, if you believe what apparently has been brought to light, when he left, he intended to desert. was he a traitor? did he intend to join the taliban? we speculated about that but i have seen no evidence of that.

jillian: how much time do you think he will get? do you think he will receive a dishonorable discharge and losing things like benefits? >> i think either a dishonorable discharge or less likely a bad conduct discharge, that is in the cards for him. confinement is the big issue. starting on monday when he has a sentencing hearing it is the government's job to show why the fed should be a high sentence and the defense's job to show why it should be a lower sentence but the fact that he spent five years in torturous captivity is certainly extenuating and mitigation of his offense. jillian: do you think he gets life? >> i don't he gets life. rob: it will happen pretty fast, just one guy deciding, thanks very much. jillian: 17 minutes after the error, hillary clinton taking her blame game to a new level
