money spent. they have got a lot of money to spend. >> dana: thanks for joining us. i am dana perino. it has been a really great week. there is more to come. here is trace gallagher. he is in for shepard >> the president promising tax cuts but republicans facing resistance from their own members. defense secretary james mattis in the dmz accusing north korea of threatening catastrophe. what he says the u.s. is doing to avoid a war. the secret j.f.k. files are out, some of them. what we're learning about the assassination and strippers and sex parties. that's all ahead this hour.

sarah huckabee sanders responded to questions about the president's order of lifting a gag order and in part about the obama administration approved uranium to a russian company in 2010. the top democrat says he plans to investigate president trump's involvement. adam schiff tweeted if the president personally interviewed with the d.o.j. to advance case against a political opponent, it's beyond disturbing. i intend to pursue in new probe. sarah sanders president trump has pushed for transparency and she's not aware of any specific involvement from the president. let's get to john roberts live for us at the white house. we can talk about this. remember, the big deal about this, john, when we get john roberts up, the big deal if we can get this informant and

whether the president made the order or whether the doj made the order and the president had strong influence. john? >> good afternoon to you, trace. i'm told by folks here at the white house that it unfolded this way. the process was already underway. that chairman grassley contacted the department of justice wanting to left the gag order on this informant that was involved years ago with an fbi investigation into whether or not there was some sort of bribery involved with this uranium one deal. the president was presented with the information. the president said it sounds reasonable to left the gag order. he had a conversation with chairman grassley who told him about the importance of getting information from this informant. i'm fold a call was made with the white house counsel and the department of justice to say that the president thinks this is probably a good idea and

should likely get done. so that, i'm told, was the extent of the president's involvement. this again was already underway when the president weighed in on it. the white house insists the president was within his purview to weigh-in on something like this. they're leaving it there. something else is interesting, within about 15 days or so, special counsel, robert mueller, is expected to submit his first expense report which will tell us how much the investigation is costing. the president tweeting out, it's commonly agreed that there was no collusion between russia and trump. was collusion with hillary clinton? i asked the press secretary about that and whether the president thought the investigation is a waste of money. let's listen to her response. >> is the president suggesting that the mueller special investigation is a waste of money? >> the president has been clear what his position throughout this process is. that's not the only

investigation taking place. congress has spent a great deal of time on this, a better part of a year. all of your news organizations have spent a lot of money on this as well, which we consider a pretty big waste. i think our position hasn't changed since day one. we're seeing now if there's any collusion with russian is with the dnc and not our campaign. >> there won't be a lot of details in how the monies with spent, trace. no likely give the ammunition to say how much money is being spent, trace. >> trace: thanks. president trump thanking republican leaders on twitter after the house narrowly passed a budget bill. it's a crucial step towards approving the gop tax plan.

the president tweeted congratulations to mitch mcconnell and the republican party on budget passage yesterday. now for the tax cuts. republicans looking for their first major legislative win after they failed to deliver on healthcare. let's get back to john roberts live at the white house. we got new information on what will happen on the 401(k)s, which is a big controversy. >> at the moment, what will happen with 401(k)s can be explained by this gesture. don't know just yet. the president tweeted out on monday morning that he thought that 401(k) tax-free contributions should be off limits. that prompted the feud with senator bob corker. senator brady said, 401(k) contributions should be on the table to which the president responded that afternoon from a question from me that he thinks kevin brady is a fantastic guy but he knows how important 401(k)s have. now we know what chairman brady might be looking at, the

rothification of 401(k)s. he may increase the amount of money that you can put into your 401(k). it's set at $18,500. might increase it to $20,000. the plan may be -- brady is not talking about that -- to lowter tax-free contribution of that but allow you on top of that tax-free contribution with after tax dollars add to the 401(k) so you get a tax-free contribution up front and then you can get tax-free innings on the back. so operate a 401(k) like a roth. make berman from fox business channel asked sarah huckabee sanders a short time ago if the president was still saying that he was not open to any changes to 401(k)s or if that had changed. listen here. >> does the president support taking the $18,000 or so level and potentially lowering that? >> as i said earlier this week, the president wants to continue to fight and push for protections of americans'

retirement. that's not changed. i'm not talking about does beyond that. that's the president's position and the same today as it was earlier this week. >> we don't know exactly where this is going. the details of the tax plans may start to trickle out next week. they're looking at the idea of lowering the tax-free contribution to the 401(k), bumping up the overall contribution. some of the dollars that you can contribute would be after-tax dollars, which would not be taxed on the back end. it seems to complicate a situation, but they think they need that money to pay for tax reform. trace? >> john roberts, the chief white house correspondent. thanks. let's bring in chris wallace from "fox news sunday." i want to go back to the top here. what do you make of the president's involvement in this this lifting of the gag order for the former fbi informant? >> look, i can understand why the justice department should make justice department decisions and the president should not be telling the justice department what to do.

on the other hand, let's look at what adam schiff, the top democrat on the house intelligence committee is objecting to. he saying that he's upset at the idea that an fbi informant who would be allowed to talk to congress will be allowed to talk to congress. that's a very out position for a member of congress to take that he doesn't want to talk to an fbi informant to find out what happened. but it seems to be part and parcel of this real kind of pull-back on the part of a lot of democrats that were hell-bent on wanting to investigate donald trump and his possible collusion with the russians feeling that somehow when the subject has turned to possible collusion between hillary clinton and the democrats and the russians and that's what this informant might be able to speak to, they don't want to follow that so intently. so it's kind of a curious thing. >> trace: yeah, you have a lot of news organizations saying look, fox brought up this

uranium one thing. which is not true. it was the hill. the democrats are now backing off this saying well, this is a different issue. the president should not be involved in matters the doj should be presiding over. we look that the doj pulled the trigger on this, not the president. >> again, all the doj is doing is saying this fellow under a gag order and couldn't talk to congress can now talk to congress. may turn out he has a story to tell or may not. why on earth would any member of congress not want to hear what they has to say unless they're worried about what the person has to say. >> yeah. i want to move on to tax reform now. the time line in this seems to be speeding up. now they're talking about thanksgiving, which a lot of people be difficult. you think we're three, four weeks away from thanksgiving. we don't even know -- john roberts asked the question about the 401(k). i don't know. we're not quite sure what we're going to do with the 401(k).

not sure what we're going to do with the salt thing, the state and local tax initiative. a lot of questions and it's fast-tracked to nowhere. >> i don't know that it's fast-tracked to nowhere. but you said we don't know much about this. we don't know anything about this. we're going to find out november 1 when kevin brady, the chairman of the house ways and means committee, the tax-writing committee in the house reveals it. that's the first time we get a plan that indicates how the rates will be cut, what income levels the various rates will kick in what will happen on state and local taxes what will happen on 401(k). they haven't told us anything about this among other reasons because there's a huge scramble right now by all the lobbyists, all the special interests to talk to the house ways and means staff, all the other republicans in power in washington to try to say hey, don't hurt my interests if you're going to have to get some money to pay for these tax cuts, take it out of somebody else's interest. so we're talking about between

november 1, which is next wednesday, i think, and thanksgiving, which is three weeks from the day after that, we're talking about passing a bill in the house and the senate that nobody has seen yet. part of the reason, part of the strategy behind this, trace, the feeling is the longer it takes, whether more opposition builds up, whether it's congress about constituents losing tax deductions or lobbyists losing tax advantage. so let's do this at warp speed before any opposition can form. my guess is this is going to take longer than that and be messier than that. we'll probably be declaring tax reform alive or dead and back and forth a lot of times before this time story is written and the final bill is written. >> this is vital to the gop. you look at the repeal and replace, nowhere. even infrastructure never got

off the ground. if tax reform doesn't happen, you have the gop going 0 for 3. can you emphasize how important this is to the republicans? >> oh, it's -- in terms of their political future, could be life or death. here it is. the republicans were saying for years, give us a republican house and we'll stop obamacare. they got a house, didn't stop it. give us a republican senate. again, now they said finally, we can't do it because there's a democrat in the white house. give us a republican president. they got the keys to the car and still can't get anything done with repeal and replace. if there's one issue the republicans have stood for for decades now, it's the idea of tax cuts. if they would have control of all three arms of the government, are unable to pass tax reform, boy, i sure wouldn't want to be a republican running for re-election in 2018. the most recent polls show 15% approval of republicans in congress. you know, people are holding

them accountable. they should. they put them in power. they need to put up. >> trace: i have to go, chris. i want five seconds from you on the j.f.k. thing. we'll talk about it later. the president not releasing or agreeing with the cia and not to release some files. surprised by that? >> a little bit. just because of the fact we're talking about this terrible assassination in the 60s. the review and the deadlines set in the 1990s. why did it take till day before it was -- the day of it was going to be released for suddenly the fbi and the intelligence community to say there's still secrets here, we haven't scrubbed the documents. give us six more months. it's curious. you can only get the conspiracy theorists out there have got more fuel for the fire as a result of the last delay. >> trace: they may. and the question is what are you going to do in six months that you haven't done in 25 years? chris, thanks. great to see you. >> thanks, trace.

>> trace: vice president pence speaking at minot air force base in north dakota after he toured the nuclear launch facility there. we're expected to hear him talk about the north korea threat. minot is home of the b-2 bombers and the intercontinental ballistic missile silos. if something happens, that will be key to this entire conflict. if he says something critical, we will dip back in. this comes as tensions over north korea's nuclear program hit an all-time high. americans say rogue nations are a bigger threat than terrorists.

33% of registered voters say rogue nations pose an immediate threat. a jump of 20 points since january. james mattis visited the dmz zone today. secretary mattis stood at the border and said, "our goal is not war." he stressed using diplomacy to resolve the nuclear standoff with pyongyang. president trump set to travel to asia next week and make a stop in south korea. he's threatened to totally destroy north korea if necessary. let's go to jennifer griffin live at the pentagon. jen? >> trace, defense secretary mattis wanted to warn north korea not to carry out any more provocative tests while tamping down a sense that a nuclear war is inevitable. it was a carefully calibrated statement by the defense secretary on his first visit to the dmz. >> we're doing everything we can to solve this diplomatically.

everything we can. ultimately our diplomats have to be backed up by strong soldiers, sailors, airmen and marines. >> there was a report in the south korean media ahead of mattis' visit that its defense secretary asked him to don his old marine corps uniform. the pentagon shot that down and mattis was wearing a suit. >> trace: jennifer, thank you. republicans are trying to pass their tax plan with the same strategy that didn't work for healthcare. we'll talk to analysts about the chances the gop and its leaders will get it done. and what happens if they don't? that's next. >> tech: so you think this chip is nothing to worry about?

>> trace: well, republicans trying to score their first big legislative win since president trump took office by rewriting the tax code. analysts warn it could cost the gop its majority in the senate if they don't get it done. former republican senate majority leader trent lott told the "wall street journal," if they go this whole year without achieved anything major other than supreme court justice, that horse is going to be out of the barn. let's bring in our panel. evan, i mean, i know you say in your talking points, this isn't repeal and replace. they're closer to getting tax reform done than the healthcare. close isn't going to cut it. they have to get it done or it could be game, set, match. >> yes. a lot of republicans recognize if we don't get this done, we're going to have nothing to hang our hats on in 2018, which is

why we're being so deliberate about how we're going about tax reform and tax relief for the american worker. i think republicans are being very careful and they are considering things that are small sticking points like the 401(k) aspect. president trump has led and stood up on twitter and said he wouldn't allow us to tax the pretax amount on the 401(k) contributions by americans. why should we make it harder for americans to save for retirement? at the same time, bigger states are throwing up their hands in new york and new jersey over eliminating the salt deduction, which would allow americans to be quadruple taxed. in america, it would be a $72 billion tax increase. they're trying to find a solution. republicans are working together. this isn't like obamacare repeal and replace where there was a faction saying we have to do it this way and another faction saying we shouldn't repeal. we should repair. a more gop orthodoxy

undertaking. >> trace: just for clarity, he says salt. that means state and local taxes. when you talk about new york and california and illinois, new jersey, very high tax states, that would hurt a lot of people. you have people on your side of the aisle saying listen, if you're against this whole salt thing, you have to stand up and say so. if you're a congressman in these states a senator in california, new jersey, illinois, maybe you shouldn't vote for this. >> exactly. i couldn't have said it better. i want to point out, i'm getting action alerts daily from the national association of realtors and the national home builders association coming out strongly against this bill. they say that if this passes, we will lose about a little more than 10% of the value of our homes. consider the median home value is just about $189,000. so that means the average

american stands to lose about $19,000 of value in their homes. that's not going to help if that $1,000 a year tax savings for middle class america is not going to help when you're talking about losing on average $19,000 of your home value. >> trace: evan, robin has a good point. because we don't know what is in this bill, he's bringing up, you guys are talking about salt and the audience is salt? what about salt? what about the home deduction. a lot of things in this bill we don't know what is in it because quite frankly it hasn't been laid out very well, evan. so if they're going to get it through in the next three or four weeks before thanksgiving, somebody has to give us some clarity. >> first of all, robin raises an interesting points. he says he's getting alerts from lobbyists. the bill hasn't been written yet. it's being worked out by republicans. we're trying to hammer out the differences. they're talking about going out and saying, how can we make this

fair for the american worker and small businesses? make sure it keeps the economy growing. i would say let's hold our horses. we're not going to get it by thanksgiving, maybe christmas. >> trace: you can hold your horses all you want. at some point you have to put up. when you talk about the homeowners deduction and you start talking about state and local taxes not being deductible, you're going to get dramatic push-back as soon as everybody realizes what is in this bill. very quickly. >> everybody doesn't like this because you see how the sausage is made. at the end of the day, you'll have people very happy with the contents and a lot of lobbyists pushing action alerts to robin saying we don't want this because they're going to use the scare tactics because they're not getting what they want. >> trace: robin, those people pushing the alerts, some of those are powerful.

fox say they have arrested a college freshman for killing two people on grambling state university's campus. investigators say he shot and killed another student and his friend when a fight in a dorm room spilled out into a court yard. the spanish government moving to take control of catalonia after lawmakers voted to breakaway from the rest of the country. supporters chanted "freedom" in barcelona. and we're hearing harrowing stories from two sailors stranded on the ocean for five months with their two dogs. they were apparently headed from hawaii to tahiti when their engine broke down and they drifted thousands of miles off court. luckily they had more than a year's worth of food on board. they said their dogs keep their spirits up. the news with trace gallagher continues after this. only eggland's best.

assassination of john f. kennedy, director of the fbi j. edgar hoover wanted to steer people away from conspiracy theories. hoover said "the thing i'm concerned about and so is deputy attorney general, having something issued so we can convince the public that oswald is the real assassin." he was referring to lee harvey oswald, the shooter. the records reveal that hoover reported "last night we received a call from the dallas office from a man talking in a calm voice and saying he was a member of a committee organized to called oswald." according to the records, hoover said police assured him they would protect oswald. the next day, dallas nightclub owner jack ruby shot and killed him inside police headquarters on live television. there's more than 2,800 newly

released records but president trump did not let hundreds of files under a six-month review. kristin fisher is live with more. >> trace, in many ways the files raised more questions than answers. take this document from a deposition by the deputy cia director under kennedy. he was asked by an attorney, is there any information involved with the assassination of president kennedy which in any way shows that lee harvey oswald was a cia agent? it's a fascinating question but we don't get an answer. another cliff-hanger, an anonymous call made to a reporter in london 25 minutes before j.f.k. was shot. the reporter said the cambridge news reporter should call the embassy in london for big news and hung up. again, 25 minutes before j.f.k. was shot. then there's also some more

salacious tidbits in these documents involving trippers and alleged sex parties. one fbi files has information on the bureau's attempt to locate a stripper named kitty that is reported by another dallas dallas stripper that is known to be associated with jack ruby. and agents asked a high priced hollywood call girl about her participation in sex parties involving then senator john kennedy, his brother-in-law, peter lawford, frank sinatra and sammy davis jr. she told them that she had no knowledge of such activities. so bottom line, some of these details were known, some are new. they're all very interesting. trace, there's nothing in them that will put these conspiracy theorys to rest once and for all. >> trace: they're not. the other big news is that they held back some documents. kristin, what are you hearing about the rest getting released

in several months? >> president trump is saying that he wants to release as many of them as possible. he said in a statement last night, i have no choice today but to accept those redactions rather than allow potentially irreversible harm to our nation's security. you know, as much as he may want to release them, the cia and the fbi now have six more months to make a persuasive enough case to keep them under wraps for good. so it remains very much unknown if we will ever see all of the complete files once and for all, trace. >> trace: yeah, true enough. thanks, kristin. doug weave is the presidential historian and author of "all the presidents children." it's amazing to me, doug, when you go back to what kristin was talking about there and i don't know what they're planning to accomplish in the next six months that they have not done in 25 years about these

was that guy one of ours? >> that's right. if a blogger out in tulsa said was oswald ever in the cia, people would have laughed him to scorn and ridiculed them. this is the director of the cia. then we don't get the answer. and then there's the testimony, the story of lyndon b. johnson's theory. this is in the document. this is the president of the united states, not some conspiracy theorists, not a taxi cab driver. l.b.j. is saying the reason that j.f.k. was assassinated is because he ordered the assassination of president diem in south vietnam, our ally. a fellow catholic believer with john kennedy. amazing. >> trace: yeah, it is. you talk about the big one and kristin talked about this, the information going to the british newspaper. the guy says here's the deal. we got a tip on this.

how many minutes ahead of time? 25 minutes before the assassination? >> yeah. that's -- >> trace: what do you make of that? >> yeah, the only thing to keep in mind is remember, you've seen all these movies tinker tailor soldier spy and books and best sellers about a mole in the british secret service. turns out, there wasn't a mole. this were five. we now know it's not a conspiracy theory. it's reality. we know that five soviet agents were at the top of the british secret service. so that brings in to question this advanced warning that oswald is going to be killed. was this a disinformation plot of the soviets? never ends. >> we were hoping doug, we were doing to get information about lee harvey oswald's trip to mexico a couple of months before the assassination. he went to mexico city. we know he visited the cuban embassy and the soviet embassy there.

they say they found him unconscious parked on the side of the road. a toxicology report showed traces of sleeping pills and marijuana in his system. the golfer said he was dealing with pain after his fourth back surgery in april. woods has not played in a tournament since february and it has been nine years since he won a major. phil keating is outside palm beach gardens, florida. phil? >> trace, tiger woods walked in and out of the courthouse without answering any reporters shouted questions. as part of his play deal which goes into effect immediately this afternoon, the dui he was charged with now gets shelved for one year, 12 months. as long as woods meets all the requirements imposed by the judge, the dui charge goes away forever. woods arrived here at the courthouse in his black s.u.v. with his attorney as well as a couple of security guards. woods was not driving.

his sentencing hearing lasted ten minutes. the judge outlined the conditions he has to meet. a year's probation, $500 in fines and court costs, attend a dui school and do 50 hours of community service. all of this from the arrest after sheriff deputies found him on the side of the road sleeping at 3:00 a.m. woods failed the sobriety test and clearly out of it. the breathalyzer test showed no alcohol in his system at all. blowing a 0.0. today in court, woods just answered yes or no questions from the judge politely. >> there's no other matters? anything else? >> no. thank you. >> that concludes the hearing. thank you. >> on monday, woods tweeted out this video of him nailing a line drive shot down the fairway appearing not to have any pain. wednesday night he tweeted out this pick which from dodger stadium enjoying game two of the world series.

weekend, super storm sandy slammed the east coast devastating parts of new york and new jersey wiping out thousands of homes, causing an estimated $65 billion in damage making it one of the costliest storms in u.s. history. today some folks that lost everything are still struggling to rebuild their lives. rick leventhal has more from jersey shore. he was there five years ago after that storm struck. hey, rick. >> tray, super storm sandy damaged 350,000 homes here in new jersey alone. most have been repaired or rebuild. there's still plenty of houses boarded up like these two across the street. the governor's office says one in five homeowners still have not moved back in five years after the storm. we were hear in point pleasant during sandy and hear on ocean aafter the storm hit. the scene here on ocean avenue was researchable.

this entire ocean front highway was buried under two to three feet of sand. ten miles down the beach, you might remember the jetstar roller coaster was dumped into the atlantic. today the pier and the boardwalk have been rebuild. now rides there. new dunes have been added to try to protect against future storms. >> we're mother attune to storms and storm warnings than even. we're more prepared. we have a strategic plan. not just evacuations, what to do and where to go and so forth. >> new york city and long island got hit hard. you probably remember the scenes where more than 100 homes burned to the ground. that neighborhood has been rebuilt. the insurance industry says 98% of sandy claims have been paid out. a lot of people didn't have understand. that's a lesson that a lot of people wish they didn't have to
