spent this hour with us. good night from washington, i'm shannon bream, this is fox news at night. will see you then. tucker is up ♪ . >> tucker: good evening and welcome to tucker carlson tonight. we have exclusive new reporting on a story that has turned washington upside-down and caused more intrigue than anything in the city i've seen in 25 years. of course you've heard independent counsel robert mueller's investigation has zeroed in on its first targets. former donald trump campaign manager paul manafort and his business associate rick gates were both indicted on charges of money laundering, tax fraud and failure to report lobbying arrangements. now the indictment offers tantalizing details about how foreign lobbying works at the highest levels in washington. how manafort used offshore cash

to expand his wardrobe, somehow spend $655,000 on landscaping for his house in the hamptons. it comes as no surprise for anyone who has watched manafort operate but of course the legal system will make the final call on that. paul manafort is just the first in a series of people in dc who are suddenly in deep, deep trouble. who is next? reading between the lines of the indictment and talking to a number of our own sources we think we have a pretty good idea of that. today's indictment never mentioned donald trump's presidential campaign or the 2016 election. it only mentions russia in passing even though russian meddlingly was the pretext for the investigation. manafort's efforts to lobby on behalf of pro russia groups in ukraine. it goes into great detail on the relationship between manafort and two groups described as

company a & company b in the indictment. those companies are mercury llc led by former republican congressman ben weber and the podesta group founded by tony and joan podesta who were hillary clinton's campaign manager. none will come as a shoe shock to viewers of this show. last tuesday we told you the mueller investigation is no longer a search for russian collusion in the 2016 race. it's now going into corrupt lobbying practices across dc one that is likely to en nature people close to hillary clinton. >> it's still framed as a hunt for collusion between donald trump's presidential campaign and the government of russia. our source says they're very interested in manafort's running of the trump campaign but it's bogus. the investigation has broadened to determine which people have

worked secretly on behalf of russian government and business interests. the podesta group is chiva among these. quote, they are more focused on facilitate ors of russian influence in this country than the election. the podesta group is in their crosshairs. >> tucker: that segment ran last week provoked a legal threat from tony podesta today designed to shut us up. that's not going to happen but we'll tell you more about it in just a minute. last week we described how paul manafort used a sham group to lobby on behalf of pro russian forces in ukranian. those forces sought a number of changes to the republican party and platform. some of the changes are contrary to america's interests and values. they wanted the u.s. government to support the imprisonment of the ukranian president's

political opponents. even some of the tony podesta's employees thought the whole thing was disgusted. today's indictment confirms our reporting, it is a mouthpiece for the ukranian president, yanukovych. it confirms the lock i didn't think groups including tony podesta's knew perfectly well that the center for modern ukraine was fake when they signed on to represent it. podesta's company was told they would be lock i didn't think on behalf of the ukranian president. in november 2012 manafort's business partner explicitly requested reports on lobbying activities so he could brief the president of ukraine yanukovych on what they were doing. it couldn't get dirtier. knowing they were acting as agents of a foreign government the podesta group never registered as foreign agents. failure to do that is against

the law. in april of 2012 the podesta group filed documents with congress relating to its work with the center for a modern ukraine. they falsely claimed it was just a foreign ngo. the podesta group filing contained a deck legsration that quote none of the activities of the center are directly or indirectly financed or subsidize did in whoelt or in part by a for reason political organization. that was endorsed by the ceo of the podesta group and a former jeb bush staffer, all apparently a lie. moreover according to today's indictment the podesta group must have known it was a law. under the law the firm should have immediately registered with the u.s. government. instead the podesta group waited until spring of 2017, this year, to do that and somehow applied the status retroactively.

by that point the center had effectively been out of business for three years, a little late. interestingly the podesta group filed those late papers just weeks after media outlets began reporting that people were investigating podesta's group. why would the ukranians hire tony podesta in the first place? even foreign officials in disisn't lands understood that tony podesta's brother was john podesta a key the clinton condition fit can't. it was widely known the two brothers had dinner together every sunday night. quote, they loved hearing that. even a native russian speaker said the podesta group was hired by paul manafort on behalf of for reason clients because the company was perceived to have a direct line to powerful clients. john podesta clinton's campaign

chairman, john podesta had been close to bill clinton. how the central were they to the profit mod snell the firm's billing dropped dramatically, almost immediately after hillary clinton lost the race for president. that tells you a lot. mueller's investigators apparently figured this out. today tony podesta resigned as head of his company. his excuse? us. that's right he blamed us. in his parting statement podesta said it is impossible to run a public affairs firm while under attack by fox news and the right wing media. well podesta isn't just complaining about us, though, he's threatening us. this afternoon we got a letter from a lawyer with venable ll. a big law firm here in dc. the letter demands that this show, quote, immediately crease and desist disseminating false and misleading reports about mr. podesta and the podesta

group. it ghndz we stop reporting on the podesta group and he said mr. podesta may pursue legal action to protect his rights. the letter warns us that we will face legal action under the copyright act merely for quoting from this letter publicly as we just did. the most amusing line is this one, paul manafort did not work with the podesta group in its representation of the european center for a modern ukraine. that's what the lawer's letter told us. apparently he hasn't read the manafort indictment yet. at the direction of manafort and gates companies a and b engaged in extensive lobbying on ukraine. the indictment says the podesta group and mercury were selected personally by paul manafort to lobby on we half of ukranian interests. so if john podesta's legal team has a complain it's not with us it's with the department of

justice and the mueller investigation. podesta's lawyer wasn't trying to inform us of anything but to threaten us, to shut down our reporting on his clients. one lawyer said the podesta have used this tactic with people before, it's to use fear. we're not -- to paint a pretty clear picture of exactly what the podesta group was doing for years here in washington. let the facts speak for themselves. we're confident the mueller investigation will be revealing a lot more about tony podesta's lobbying practices in the near future. for a summary of all this, here is the one sentence cliff note to the whole affair. the chairman of one major presidential campaign colluded with the chairman of the other presidential campaign to secretly enrich a foreign adversary. that the happened, that's the swamp they told you needs to be

drained. jonathan turley teaches law right in the middle of the swam, mr. turley thanks for coming on. >> thank you. >> tucker: you don't often hear people prosecuted for violating the fera act, the legal requirement to register as a foreign lobbyist. a lot of people do it, very few register. why is that unenforced? >> there's only been a handful of are prosecution's. to have it in this mix is odd. it's not exactly a fears charge to face. but it was brought nick. i think it sends a signal to others, like flynn, like tony podesta, that these are charges that could be brought. i think this indictment is saying the special counsel is prepared to indict anyone for anything within his mandate. but he's clearly focussing on these types of financial transactions and register violations. fera violations are deadly, some

are registration violations. jurors tend to treat those as basically cut and dried if they're convinced you had to file, then you're guilty. you can secure these types of convictions. they're in a mix with very serious crimes. >> tucker: look, this whole investigation appears to be focused on the question of foreign influence. how do foreign governments affect american policy, the decisions our government makes? there's a law that says if you're doing the bidding of a foreign power you have to tell us about it. why is that considered a small violation? when you violate it the response like the podesta group was to retroactively file. the department of justice has allowed that. clearly mueller is not following that pattern. he is taking the view if you violated fera we can charge you criminally, we will. it would be hard not to see that charge brought against flynn. you could white out manafort's

b bigly. what will be the effect of the recent ref lathsdz about russia and the investigation into its influence. scott congrats on the book. what do you think the take away? you're always arguing that things will happen but people perceive them differently from intended, often. what is the take away from the russia investigation so far? >> well, i think the big guest factor is there's so much russian stuff that people are overwhelmed, have lost track. are there six scandals? seven scandals? russia is like the harvey weinstein of countries. you think it's done but there's always one more horrible thing coming at you. the net effect of that is people can't follow the complexity of it. they're just sort of lost in it so they're going to default the taking the side they were going to take any way.

>> tucker: we're sort of where we started out which is if you don't like trump you think he had something bad to do with putin and if you did, he had something to do with it? >> yeah, if you look at the totality of the russian drama and the players, you've got in a sense the lowest rated popular president ever but he's in a drama with lawyers and putin and hillary clinton. the only drama where he's the most pop lash person in it. i don't know what were the odds of him being the most popular player. but somehow we've found a set of players less popular than he is. i think he's going to come out okay. you can't get your hands on what seems to be the problem? he doesn't seem to be indicted for anything. we're just confused. >> tucker: things occur to you that do not occur to smaller brains than mine. your book is about persuasion in this weird internet infused

world we're living in. if you could give one piece of advice about persuasion, what would it be? >> keep it visual. visual persuasion is the best. other than -- scaring people is the best. i don't like to give that advice, go scare people. >> tucker: that is true. it works. >> if you're going to try to sell a border solution don't say i think i would like to put together a patchwork of different border security depending on the terrain. you want to the say it's a wall, a big beautiful wall. if you want to the say we've got to do something about isis, don't say they have an ideology that could be dangerous to us, you want to say they're chopping off heads and putting people in cages and drowning them. that's the president trump method. it is very powerful, visual persuasion is always the best. >> tucker: you can kind of stick, i mean you could use it for deception but you could also tell the truth with images if you wanted. >> well yeah. we've gotten to a weird point in
