post," judge roy moore facing sexual assault allegations from three women when they were teens. now the alabama senate candidate is facing growing opposition and responding as our republican leaders. we're waiting to hear from the head of the air force against the gunman in the texas church massacre. the military admitting they didn't tell the feds against the killer's conviction for attacking his wife and breaking her baby's skull. that could have kept him from buying guns that murdered 25. we'll have the briefing live. president trump in beijing giving great credit to china. the country he once accused of raping the united states. the president now says he blames americans, not the chinese. and there's word airport screeners failed to find more than 70% of guns, knives and explosives in an undercover operation. the weapons were fake, luckily.

so what are they doing to try to catch the real ones? news is breaking news. let's get to it. wow! what a day. we begin with a bomb shell report involving a republican nominee for alabama senate's seat. accusations today that roy moore initiated a sexual encounter with a then 14-year-old girl and relationships with three other teenagers. now the senate majority leader mitch mcconnell says if the allegations with true, roy moore should take himself out of the race for the senate. according to the reporting of "the washington post" newspaper in the last hour, this all happened while roy moore was in his 30s. the incident with the 14-year-old in 1979. the woman tells "the washington post" that moore struck out a conversation, offered to watch the girl while her mom went in for a custody hearing. when they were alone, she reports that moore asked her for

her phone number. days later, she said he picked her up near her house and "drove her about 30 minutes to his home in the woods, told her how pretty she was and kissed her." then on a second visit, she says he took off her shirt and pants and removed his own clothing. the report goes on, he touched her over her bra and her underpants, she says and guided her hand to touch him over his underwear. the report says i wanted it over with, she thought. please get it over with it. just get it over, she said. the woman said she asked roy moore to take her home and he did. the post also reports three other women have now come forward in recent weeks to say that roy moore pursued them. each says moore was in his 30s and the women between 16 and 18 years old. roy moore's campaign officials says the allegations are not true. they're accusing "the washington

post" of playing politics. in a statement, judge roy moore has endured the most outlandish attacks as any modern candidate. today's story alleging sexual impropriety takes the cake. national liberal organizations know that doug jones is in a death spiral and this is their last ditch hail mary. the "washington post" is already endorsed the judge's opponent and for months the post has been engaged in a systematic campaign to distort the truth about the judge's record, career around derail his campaign. as i reported, the senate majority leader, mitch mcconnell now says that roy moore should quit the senate race if the accusations are true. john mccain wants moore gone now. quoting allegations against roy moore are deeply disturbing and disqualifying. he should immediately step aside and allow the people of alabama to elect a candidate they can be

proud of. news is breaking now and peter doocy has more. >> the accuser is named leigh korfman. she said that moore undressed her and started to inappropriately touch her. she accused him of kissing her but said there was no sexual intercourse. the moore campaign which is calling this story from the late 70s false and they suggest it's only coming out now to help the democrat in this race, doug jones. part of the statement says this. this garbage is the very definition of fake news and intentional defamation. we have called a few phone numbers. we have not been able to get in touch with leigh korfman yet. >> shepard: what else are we hearing this afternoon? >> nobody is defending roy moore in the republican party. we have brand new sound a few minutes old from alabama's other

senator, richard shelby as well as jeff flake. they're saying that he should stop running if any part of this is true. >> i don't know. it's a devastating nasty story. if the revelations -- if it's true, i don't believe that there would be a place for him in the u.s. senate. >> no, if there's any shed of truth, he ought to step aside immediately. >> there's more than a dozen republican senators that say that moore should step aside if the allegations are true. seems like the list is getting longer by the minute. mitch mcconnell is among them. but remember, moore ran his race in the primary and won on anti-mcconnell platform. moore still is likely going to be on the ballot even if he was to step aside because state law says no new ballots in 76 days of the election. if they were printed, luther

strange's name can't go open it. he could be written in. it's early to tell if that will happen, shep. >> shepard: just beginning, peter doocy. thank you. breaking news now on fox news channel. five women have told "the new york times" newspaper that the comedian louis cecay crossed the line in sexual misconduct. the "new york times" reports the encounters happened a decade ago. when asked for comment, ck's publicist said there's no quote. louis ck also cancelled an appearance on the late show with stephen colbert on cbs. that news breaking now. more detail as they come. also breaking, the leader of the united states air force speaking from the pentagon now. they're talking about the suspect in the texas church shooting. he was able to buy guns because the air force failed to report his violent history.

the military convicted the suspect of assaulting his wife and cracking his stepson's skull. he spent a year in prison and got a bad conduct discharge. under pentagon rules, the air force should have told the fbi so he would be disallowed to buy a gun. it would have prevented the suspect from legally purchasing guns and ammunition before he murder 25 including a pregnant woman. officials say they planned his state of the air force news conference before that shooting in southerland springs, texas. let's listen in. >> a few of the things that we intended to share with you when we planned this press availability. after we to that, we'll open it up to any questions you may have. with respect to the priorities for the air force, our biggest need right now is for a higher and stable budget to provide security and solvency for the nation. the fiscal year 18 continuing

resolution is actually delaying our efforts to increase the readiness of the force and risk accumulates over time. you just don't know exactly when things will break. we are stretching -- >> shepard: they moved on to another topic. in just a moment our producers say they will take questions about the suspect in this case. jennifer griffin has been following this for us. she's live at the pentagon. jennifer? >> shepard, the pentagon has known that they had a problem two decades with not reporting military crimes to the fbi. there was a department of defense inspector general report going all the way back to 1997 that dealt with this very issue and found that military crimes were not being reported by the various military services to the fbi's national criminal background check database. as recently as two years ago, the fingerprints of hundreds of convicted offenders had not been submitted by the various

services. the fbi database had one entry from the pentagon for a domestic violence conviction as of december 31 according to u.s. officials and had none from other federal agencies. secretary of defense jim mattis has ordered the inspector general to define what the problem is, but i think they did so in 1997. now congress is getting involved and senator john cornyn of texas is crafting legislation to require the pentagon to swiftly report criminal history to the fbi database. the shooter had seven incidents of domestic violence in texas between 2011 and 2012. five were withdrawn as part of a plea agreement with the air force, shep. >> shepard: jennifer, you have more info about high widespread this problem is throughout the military? >> in fact, that 1997 pentagon inspector general report found "widespread lapses among all of the military services." we now know in more than 80% of

criminal cases involving the army and navy, fingerprint cards were not submitted to the data bait. the navy failed to report their criminal cases 94% of the time to the fbi. the army 79% of the time and the air force 50% of the time putting it ahead of the other services. the lack of reporting to the fbi files prevent civilian law enforcement agencies from having significant information on military offenders that is from 20 years ago from the i.g. report. expect hard questions of the air force chief general david goldstein and heather wilson moments from now. that press conference has just started. >> shepard: jennifer, thank you. when we go to do question and answer period, we'll go there live. the feds might have lost valuable time trying to get information from the texas shooter's phone. simply because they haven't been able to unlock the thing. apple executives told fox news

this morning that the fbi has not reached out to the company for assistance in unlocking an iphone belonging to the killer. in fact, the authorities haven't even confirmed publicly that it is an iphone. matt finn is in texas. what are you hearing about this phone? >> shepard, apple tells fox news that they reached out to the fbi to see if the dead shooter's phone was an iphone. that the fbi tells apple that it is an iphone. apple goes on to say that the fbi did not ask apple for help in unlocking it and that there's a critical 48-hour window in which apple says they can assist authorities to unlock a dead person's iphone. now the 48-hour window has passed. one way to do that is holding a dead person's finger to the phone to unlock it. that window has passed. in an unrelated event, an fbi director said this is a growing problem with authorities trying to unlock dead people's cell

tell fox news senior judicial analyst judge andrew napolitano. he says that indicates that prosecutors believe that politics motivated the attack. that's what would make it federal. a senior adviser to the kentucky senator says he had not talked to the suspect in years before the man "vigorously assaulted him." he also disputed reports that the senator was in a longstanding dispute with the neighbor saying the first conversation with the attacker came after senator paul's ribs were broken. this was not a fight. it was a blindside. violent attack by a disturbed person. the suspect is rene boucher. he pleaded not guilty in court today. prosecutors there say that they may charge -- may change the misdemeanor charges because of how severe rand paul's injuries are. so far, no charges. the senator says he had six

broken records and water on the lungs. it's been back and forth between the two parties today. the suspect's lawyer says this was about lawn maintenance. his neighbors, many neighbors, say that is ridiculous. rand paul has been out with some interesting tweets today suggesting that was not the case at all. now word from his office that they should expect federal charges against the accused attacker. trace gallagher with the rest of the story live for us. trace? >> we know dr. rene boucher is a retired anesthesiologist that has lived next to rand paul for years. the arrest warrant said that boucher admitted to going on to paul's property and tackling him. at the time that rand paul was doing yard work and wearing ear plugs. the "new york times" reported the dispute was over lawn clippings being blown on to boucher's property. senator rand paul has not issued any comment though he did tweet

two articles, one from breitbart and said that the landscaping news is fake news. the washington examiner spoke with several neighbors and said that the stories that a landscaping dispute or a dispute of any sort between rand paul and rene boucher are erroneous. the attack is known only to him. several other neighbors back that up. on the flip side, the developer of the neighborhood says boucher says he has been a perfect neighbor. rand paul is a different story. >> shepard: sounds like there's a different story popping up. >> yeah, even though boucher's attorney says there's a political agenda, turns out that boucher is a democrat and was anti-trump and anti-gop on his social media. even calling for the impeachment

of trump and urger robert mueller to fry trump's private parts. the doctor was a fan of the never trump movement. neighbors say this should not be called an altercation considering that rand paul was ambushed by his neighbor. he said there could be federal charges for attacking a politician. >> shepard: i've gone back and looked. it appears the only one making this lawn narrative, this landscaping narrative alive was the lawyer for the suspect. we haven't officially heard that from anyone in rand paul's team, never. >> nobody. the developer brought that up. the neighbors are saying that is not the case at all. we have not heard that from rand paul's team or anybody else except for the lawyer for boucher. >> shepard: we have reached out from rand paul and have not had calls.

there's breaking news in the air force secretary and chief of staff are answering questions from reporters regarding the gunman and the texas church shooting. let's listen in. >> there's no final vote. but we haven't gone through the whole bill. i think it's like 1,500 pages total. so i'm -- i think we're hoping that we don't get it before the three-day weekend entirely. we'll have a lot of people spending their weekend reading. everyone agrees that space needs to be integrated, normalized as part of a joint war-fighting effort. this year's budget increases the fy-18 budget proposal, increase what's the air force is proposing to spend on space by 20%. we're shifting to a spaces fighting demain. in six months that i've been on the job, i went to colorado

after i was confirmed and i was there last week and advances are significant. >> secretary mattis has been very clear in his guidance to all of the services. we are to go look at how do we increase lethality and readiness. when i opened with saying, talking about owning the out my high ground, the nation expects its air force to own the high ground, the ultimate high ground and achieve space superiority, which is like air superiority, freedom from attack and freedom to maneuver. so as we transition from a benign domain, from which we monitor and report, to a war-fighting domain, this is a significant shift that we're leading as we go forward. as a service, we organize, train and equip ready forces to combatant commanders. as the secretary said, normalizing space is a war-fighting domain means we integrate all of those capabilities and tried and true

principles of joint fighting as we go forward. the secretary and i spent an entire day with the three four and three-star leadership doing a full day of table top exercise on war-fighting in space. so we're moving forward. >> would it take away from the air force, the pdsa and the a-11 and the war-fighting con-ops under strap. are you concerned about that? >> there's a lot of things in that language that is conditional and a lot of caveats in there. i think we want to look at the language really carefully. >> shepard: they have moved on to other topics. the headline from this briefing is they have come together to say that leaders at the pentagon in washington did not have any idea of the shooter in texas' background. because of the error that was made in the chain.

the moment they became aware at the pentagon according to their reporting, they put that word out to the public. further, they went on to apologize to the victims and the victims relatives and loved ones for what has happened and they're vowing to get to the bottom of it. look brings in michael farcas. this seems extremely serious and horrifying. >> it is, shep. i wish i could say this is an isolated occurrence. in a very large bureaucracy where there's many steps and many people involved. unfortunately errors do happen. i think the air force secretariry agrees more has to happen. >> more on the breaking news on the attack on rand paul. sources inside the senator's office tell judge andrew napolitano that senator rand paul says to expect federal charges against the suspect. judge napolitano in a

conversation a few minutes ago said this points to one thing. this was politically motivated. do you agree? >> if they're considering federal charges, that obviously goes way beyond a simple assault charge. he's currently charged with a low level assault. >> misdemeanor 4 assault. >> if it remains at the state level with broken ribs and water in the lungs, may very well be elevated to a felony and go to the county attorney. if they're looking at federal charges, it sounds like this was politically motivated. >> shepard: we had the initial police report indicated that there was a delayed reporting. meaning the assault happened, he went inside, called police. the police came and he reported i have this pain. but he didn't know he had broken ribs at the time. that's why they put a misdemeanor assault 4 on him, which is a low level, $7,500 bond. if it turns out the injuries are worse, we'll change the charges. nothing happened. this is -- makes of that make sense in a way that it didn't

before. >> it does. it's obviously being vigorously investigated. you can read into it a little bit about what comments are coming out of senator paul's office. he's really not going along with this is a no big deal story. >> shepard: no. he said indeed what they're saying isn't true. this is not about lawn maintenance. the lawn narrative shattered. >> right. so if there is some kind of connection, if it was -- i think the official language of the statute is account of the performance of his official duties that can mean a host of things. this person could be looking at a 20-year count. >> shepard: we'll wait for it to play out. we would love to hear from senator paul on this matter. he's not spoken to anyone as far as we know and this news is new on fox news in this hour. expect more throughout the day. the breaking news in the white house ways and means committee has just approved the republican tax plan. ways and means says yes, and we

>> i'm lea gabrielle with the fox report. more of today's headlines. a dramatic takedown with a rubber bullet caught on camera. according to cops in long beach, california, the suspect led them on a chase after he fought with an officer and stole his gun during a traffic stop. he then stole a woman's car. and a man hunt underway in tennessee where investigators say they're looking for an armed and dangerous murder suspect who broke out of jail with two other inmates. happened about 60 miles north and east of nashville. investigators say the inmate escaped by removing a speaker in a wall and crawling through the

it turned out, a lot of people fell short, of even the average length of retirement. we have to think about not when we expect to live to, but when we could live to. let's plan for income that lasts all our years in retirement. prudential. bring your challenges. >> shepard: there's breaking news now on fox news channel. the house ways and means panel has voted the republican tax bill out of committee. this measure is set to go to the house rules committee next week. if things go according to their plan, the bill would head to the house floor after that. a senate committee has also released some details about its version of this tax bill and there's a big shift in the house bill now. it would delay the corporate tax cut to 20% until the year 2019. that is breaking and they're speaking about it now. let's listen. >> it's forward-leaning. this is a tax proposal that is aspirational.

this is a tax proposal that invites americans to say, you know what? i'm ready for prosperity. i'm ready for opportunity. i'm ready for a bright future. this is an important step today. our next steps will be to fully engage other members of the house of representatives, but there is a spring in our step as we think about this great debate because we have one of two choices. we can either defend the status quo and you heard some defense of the status quo -- >> shepard: what we would like to hear is the details. since we're not getting them from this cheering squad, let's go to the chief congressional correspondent mike emanuel. there's changes and notable ones. >> that's right. they did a 29-page amendment that kevin brady offered this often. it would do some things that were popular with republicans to make sure that they got the 24-16 vote to pass it out of the ways and means. for example, preserving the

adoption tax credit and lowter rate for small businesses from 15% to 9%. chairman brady talked about the changes. >> we've had numerous discussions on the same priorities. these are areas where members on both sides of the aisle said we need to take a second look. we did. i'm offering this amendment to put them in the bill. >> it had enough support along party lines. next step, it should go to the house floor. a lot of wrestling to go through before that. should go to the house floor by the end of next week. >> shepard: what do you know about the senate's plan? >> the senate plan is being rolled out this hour. it's different from the house proposal. let's take a look at the key points. the senate would maintain seven tax brackets ranging from 10% to 38.5%. it would scrap local and state tax deductions which are popular any high tax states. it would permitted mortgage deductions up to $1 million and would reduce the corporate rate to 20% but hold off and wait

until 2019. senators are still reviewing it. the house's top democrat is accusing the gop of rushing. >> why don't we do it where there's the least opportunity for people to review it? it's very fast. very fast. speed of light, the dark of night. back rooms. >> there's plenty more argument up here on capitol hill with two tax reform plans being unveiled and shown to the public, shep. >> shepard: mike emanuel on the hill. thanks. for more on the gop plan and how it can affect you, let's bring in gerri willis. what do you see? >> a lot going on. the senate version. i wanted to get some numbers first in here and how this impacts middle class folks. there's more information on that you should know. the republicans have been saying all along that family of four earning $59,000 would get a tax deduction of $1,182. we heard that a number of times. guess what? when you work that out over the

ten-year span of this bill, at the end of that period, that same family would get a tax increase on today's tax policy of $500. so there's actually baked into this tax increases as a back end for middle class folks. i have to tell you, i just want to show you a list of the deductions going away or being just reduced dramatically. mortgage interest, student loan tuition, medical expense is the big thing for people that have huge medical problems. you can write off medical expenses up to 7.5% of the income. it's a big deal. yesterday we talked about student loan interests, tuition expect. a lot of stuff is out, out of the house version. of course, the senate upping the ante today on the salt state and local income tax. saying you can't deduct that under their plan. >> shepard: so what you're saying for middle class americans, a lot of people will see a tax increase from this. >> depends on who you are, what your deductions are, where you

live in particular. are you in a blue state? new jersey, new york, california, anybody with high local taxes, you know, you're likely to see some kind of tax increase here. >> shepard: but there's lots of tax breaks for the rich. >> well, lots after tax breaks for the rich. it's unclear. i think right now you'll see some tax increases for wealthy people. i have to tell you, we've been told it's a huge middle class tax break. i think that's true. but only to a point. for a lot of people certainly if this went into law, at the end of that ten-year period, which this law goes for, increases for some people. >> shepard: the dow and nasdaq are off today. is this about taxes? >> yes. the treasury secretary said they cannot sign on to immediately reducing the corporate taxes to 20%.

may not happen for a year. that raises all kinds of questions. will it ever happen if the republicans were to lose control of one house or both houses. could that even get it through? so you saw the big sell-off. it was 180 points down from the level at the open. this was a big change. we've rallied back some. you can tell the markets really focus on the taxes, the corporate taxes in particular. some of this was baked in. a lot of people were buying stocks in part because they thought they would get a corporate tax benefit. but, you know, when they got the news today from mnuchin, maybe not. you saw what happened. >> gerri, thank you. michael flynn is said to be worried that the special counsel, robert mueller, could target flynn's son in the russia investigation. that's what catherine herridge is reporting. michael flynn jr. worked for his dad's lobbying firm. flynn jr. traveled with his for to moscow in december of 2015.

that's when flynn sr. sat next to the russian president at a black tie dinner for the rt television network. nbc news reported that mueller had enough evidence to file charges in the flynn investigation and his son. fox news confirms mueller's team is looking at flynn sr. for failing to register as a foreign agent when he was lobbying for turkey. also accusations that he talked about a plot to kidnap a turkish cleric living in pennsylvania. flynn has denied that. flynn jr. commented about the ongoing federal investigation tweeting that he does not think he will go to jail. josh gerstein is here from politco. what do they have on michael flynn jr.? >> well, i think that the idea, shep, that it comes from the same involvement of him being side by side with his father in a lot of activities. there's questions i think about statements that were given either as part of background checks because remember there

was a story at one point that the father had thought that some kind of security clearance or requested a security clearance for his son. and then the question will be whether they were entirely candid in their dealings with the justice department about this question of whether they should be registered as foreign agents. >> michael flynn led the lock her up chants at the convention and otherwise. what are the report of that chance might happening to him? >> it's possible. definitely something that the mueller team is looking at. i'd be very surprised if we saw any kind of charges that involved simply failing to register as a foreign agent. if you look at the manafort and gates cases that were brought a little over a week ago, prosecutors have said explicitly that there isn't really a history of bringing cases for failing to register as a foreign agent except if you do something else like you misrepresent yourself or if you are involved in some conspiracy to present

peninsu peninsula. the strike force will meet up in the sea of japan to do combat drills, surveillance and other training. tsa workers did not find the majority of weapons hidden in luggage during an undercover homeland security operation. that's according to cbs news. it reports that investigators were able to sneak fake knives, fake guns and even fake bombs past the tsa security more than 2/3s of the time. the chairman of the house homeland security committee, michael mccall of texas said he found that disturbing. the homeland security department's inspector general made recommendations to the tsa following the investigation. the tsa administrator says we take the findings very seriously and implementing measures that will improve screening effectiveness at check points. we're focused on staying ahead of the dynamic threat to aviation, which is what they said about a year ago when they had another test and they failed
