the december 12 general election for the senate seat is likely to become a referendum on which side we trust most. roy moore or his accusers. eric: thank you. arthel: a big week on capitol hill with senate and republicans working on separate tax reform plans. the recently times analysis says the health bill will raise taxes on millions of middle-class families. the house ways and means committee chairman kevin brady is wrong. >> here is where i strongly disagree. i believe there is tax relief all up and down the income level for families regardless of what they earn. the joint committee on taxation confirms every income bracket sees a tax relief. was first new york times analysis, they are describing in america that doesn't exist. arthel: allison barber has more from washington. reporter: and optimistic outlook from kevin brady who says not only do they have a

good tax reform plan in the house, they will pass their version by thanksgiving. >> republicans in the house know that it is time to deliver on this economy and grow these paychecks by getting rid of this current tax code. >> peter king lays out some of his concerns. >> this is like a quest. >> right now there are two republican tax plans. one of the senate and one in the house. there are seven brackets in the senate plan, for in-house plan. the senate lets homeowners deduct mortgage interest payments up to $1 million for the house cut in half. both cut the corporate tax rate for 20% but the senate plans to delay cuts by a year. the senate bill will completely eliminate the federal deduction for state and local taxes. the house bill allows deduction for property taxes up to $10000. that last difference is a big deal for lawmakers from high

the idea of tax reforms which is a good news but the house and senate are operating on some different rules. you have the house that while they just need to pass through , they also have to worry about some votes from members from california, new jersey and new york who are from high tax areas which is why the state and local tax deduction is a difficult thing to part with in the house where they need republican votes from the state so moving those tax deductions would be bad and how. >> if you flip over to the senate. >> those states, california new york and new jersey, they're all represented by democrats. those democratic votes are going to be needed in the senate so the senate is more willing to buck that deduction. the other problem will come up with here, that the house doesn't have to deal with, is that at the end of the day, they are using a different type of wall.

they're using reconciliation which allows them to pass it through without any democratic vote, but they still need to abide by certain rules with making sure doesn't expand the deficit. that's why you're actually going to see some tax language in the senate bill that in order to keep things below the deficits, the house doesn't have to worry about that either. >> he wants to close this deal by christmas. republicans want to deliver. how much is riding on the. >> a lot. both for republicans who want tax reform and believe they wanted for their legacy and their constituents, but also for 2018. you have the republican party who, so far has swung and missed on healthcare. if they were to also come into 2018 without having another signature item, you will see a problem because you have republican voters who want lawmakers to enact this agenda. you're the president who wants

the republican congress to enact the agenda he was voted for and then you have republican donors who have expects concerned about continuing to donate if this doesn't go through. if you look at that on the right combined with increased enthusiasm on the left with democrats, obviously every midterm, we see an increasing influence from clinical party who is not on the white house. when you have that on the left and the republicans who are going to want to have something they can point to. >> if republicans get tax reform done, how long will it take for small businesses and american taxpayers to feel the results, good or bad. >> is going to depend on the language on the bill, if you get a pass by the end of this year or perhaps some things have to get taken into next year but it will also depend on whether or not things get phased out or whether or not they have delayed implementation. at the end of the day, maybe

while it will be easier for republicans to point to and say look what's on the way if they have something pass than it is to say we tried and were still working it out. arthel: democrats are mobilizing. do they have a comprehensive tax plan that is beneficial to small businesses and corporations in the middle class. >> they argue they do but they don't have control the house of the senate so it doesn't really practically matter. they are beastly have their positions and they have things they believe would work better and you might see some of that in the amendment process depending on how it moves forward, but if you look up senator using a reconciliation deal that won't require any democratic votes either. right now this is the republican show and its positive for them in the sense that they can put their own bill forward and if they agree they can pass it but it's a negative in the sense that they have to own political consequences if they do pass something or if they don't

some sad news this in the evening. liz smith, the famed columnist and staple of new york city society has died. she became a legend after moving to new york city from texas in 1950. she was known for her irreverent way of calling on society. she broke the story and chronicled his divorce from ivana. she had been a guest at his resort and also had a second calling is one of the big apples most influential charity fundraisers. she wanted daytime emmy for her reporting in 1985. her column appeared in more than 70 newspapers. we are told she suffered a minor stroke in january of this year. a journalistic legend in new york, she was 94 years old.

arthel: a new twist in the special investigation of russia's involvement. they're looking at whether flynn had a role in a plan to kidnap a muslim cleric in exchange for millions of dollars from the turkish government. what we know about this alleged plot? >> we know michael flynn did more than a half million dollars worth of lobbying and consulting work on behalf of the turkish government. that included lobbing the u.s. government to extradite a modern muslim player who lives in pennsylvania back to turkey. they've viewed this as a political rival and claims he was behind a failed coup to overthrow the government last year. investigators are now looking into two meetings flynn had with turkish officials that

called for flynn and his son to kidnap him and deliver him back to turkey in exchange for $15 million. this latest investigation comes as part of the special counsel and fbi investigation into michael flynn's contacts in business dealings with foreign governments including whether he violated the registration act by failing to disclose his work for turkey until march of this year. >> what is michael flynn thing about these allegations. >> his legal team made it a rule not comment on reports that come out in relationship to the special investigations report. but they did say in a statement, today's news cycle has brought allegations from general flynn that are so outrageous and prejudicial that we are making exception to our usual rule. they are false. the turkish embassy in d.c. is also refuting the allegation

security and there's good reason for that. there's lots of bad stories and other countries about militaries or intelligence agencies having undue influence. americans have worked hard keep that space appropriate. the intelligence committe community do operations and analysis but they don't to policy recommendations. there americans and entitled to voice her opinion but like a lot of thoughtful generals, i've encouraged them to think about how far they are pushing this because what can happen is a pluralization -- i agree with much of the criticism but i really think they need to think carefully about what the role is in about the legacy and for them to be as cautious outside of government as they were inside government. >> you know about the

>> why was she allowed. >> but everything is put out in the open with jury selection. jurors were tell you, i have a planned vacation in the judge and the attorneys will make a decision and say it's not going to last eight weeks, it will last six weeks but here it lasted eight weeks. you had the alternate so is no problem. >> that's why they have the alternates, for situations like the. >> so she's no longer on the panel. that's all legal too. >> there's no order of the court that they can speak with reporters but there is something to say to the reporters, don't talk about this case or watch the news so you are hoping they are paying attention to that and if they are paying attention to the judge's orders, they are not hearing what she is saying. >> while they are saving as serving as a juror, they can't even deliberate amongst themselves. they can't say anything about the case, but when she released you can speak to reporters coming you can speak to attorneys. many times attorneys spok speak to alternates or jurors that are released. you can always go by the juror that's released.

many time that juror may say not guilty but it turns out it turns into a guilty vote. >> they are predicting there will be a mistrial due to a hung jury. she was leaning toward not guilty. she said if i was rich and i had a lot of money and wanted to take my friend somewhere, why can't type. she said she feels like the senator did nothing wrong, the prosecutors are trying to railroad him. she is not a politician. the senator is, but in the case of senator menendez, does this make it criminal? >> no. i don't think it does. there is a case called mcconnell where the supreme court came down in june and said 8 - 0. they said no, it needs to be a specific act for a specific favor. here i think they will have a hard time proving that.

>> i don't think so because in the mcconnell case, it dealt with setting up meetings. if you're merely setting up meetings and you're getting all these gifts, that wasn't enough. however, in this case, menendez is accused of setting up more the meetings. he is, he was a lobbyist. he was advocating, he attended the meetings and he's receiving all these gifts on behalf of the doctors. >> they were friends for decades before the. >> friendship means nothing. >> but it also means they could be doing these things as they would normally be true do. they made it very clear that the government is not permitted to run roughshod with this whole charge and they need to be very careful because otherwise you will have the government indicting people left and right when they don't like things that otherwise would be perfectly permissible. >> but a elected officials can abuse. it violates every ethical conduct to accept vacations worth hundreds of thousands of dollars. he's accepting all this.

that's totally unethical. the question becomes, is it criminal. if you have a quid pro quo and a timeline that connects these gifts, you do have bribery. >> they don't have that. there's no receipt proving that or anything that will connect it to make it clear for the jurors. >> so then what if there is a mistrial. what happens next? do they impanel a new jury? do they use alternates? would there have to be a change of venue? do they select from a brand-new jury pool. >> no. the government has to take stock and said we want to retry this case. in this candid case i would think they would want to retry it, and you'll just have a new trial. >> and if they don't, what happens to the senator. >> that will be dismissed and there won't be any charges against him. a lot of times, in cases like this, the prosecution looks at this and says let's cut our losses and they don't retry it. they knew the writing was on
