answers to the questions that you asked the congress about and the attorney general? >> no. i asked did the fbi pay christopher steele. he said he couldn't answer that. we know who our staff are and how much they are getting paid. did the fbi pay the guy who wrote the dossier and at the same time that we know the clinton campaign and the democrat national committee were paying fusion gps. we believe that they did it's been reported that the fbi did. more importantly, if the dossier became the basis, if they turned an opo research into an intelligence document and took it to a fisa court and persuaded him it was real intelligence and that became the basis for spying on people associated with the

trump campaign, that's not supposed to happen in this country. judge jeanine: we have the clinton campaign, the dnc sending money to perkins cok who sends money to fusion gps, then sends money to christopher steele. not only did the fbi pay $50,000 to steele according to reports. but he worked with fusion gps previously. if this is true we have a kangaroo court and a primary on the democratic side that was rigged and an investigation that was rigged. how can we find out whether that fusion report in christopher steele's dossier was the basis of a fisa warrant. >> we need to ask the president

to declassify the applications. once we have that information, then we can know whether it was from the dossier or not. congress has been trying to get this from the fbi for months now. they have fought us tooth and nail on that. you have to ask yourself why. it's clearly something congress and the american people are concerned about. you can provide it in a classified setting. but they fought us tooth and nail. judge jeanine: is someone going to make a request to the president to declassify and it's solely within his power? >> we want to find a committee who is willing to get members on board and send a letter from the committee to the president. i think it will work. judge jeanine: on the one hand you have jim comey, the head of the fbi saying hillary clinton, i'm investigating her today and i'm closing this investigation. i'm starting a new investigation, i'm closing that

one, she is not guilty. and all of a sudden they can't tell us whether they paid $50,000 to an individual we know about? it we learned they were buying for the dossier and fusion gps. they weren't going to tell us that. but we were going to seen a bank records and they find the lord and give us the documents. judge jeanine: if it did take place, then we have a false narrative created to not only destroy donald trump, but we have got the fbi and the democratic national committee in cahoots so that they can destroy a republican candidate for president. that's the kind of headline that this country has never seen. >> you have to ask yourself why

would the fbi have paid steele if he was come pie -- if he was compiling it for the democrats. they wanted to provide the fisa court with a cloak of respectability. >> think about what comey did january 6, 2017 when they went to the trump tower and briefed him on the intelligence situation and mr. comey talks to him about the dossier. that gave the dossier legitimacy as well. all the press had this document. no one would print it. but now, to ron's point, the fbi director took the time to have a special meeting with the president-elect to brief him on this dossier and suddenly it gets leaked real quick after that meeting. someone leaked it and not has respectability because it was important enough to talk to the president-elect. that's a concern.

it fits in with the theory congressman desantis just talked about. judge jeanine: james comey is such an important player in all of this. he admitted top leaking things to a friend to go to the "new york times" to seek a special counsel. then we find out the attorney general has the 27 active investigations into leakers. after the hearing, i'll start with you congressman desantis, did you get a straight answer as to whether or not the attorney general has recused himself regarding uranium one? >> we didn't. no, we did not. i always assumed that he was recused because when he was confirmed by the senate, his confirmation hearing. i told senator grassley the clinton matters, there hasn't been an official recusal. so i'm not clear whether he's recused. if he doesn't think he needs to be recused, then you don't

necessarily need a special counsel. judge jeanine: this is a statement on his recusal. he says, i have decided to recuse myself from any existing or future investigations of any matters related in any way to campaign for president of the united states. i have taken no actions regarding any such matters to the extent necessity exist. that has nothing to do with uranium one, it has everything to do with the campaign. and congressman jordan when he was asked by you and congressman gates, it seemed that he didn't know whether he was or wasn't. did you get a straight answer? >> congressman gates ask him twice early in the question, the attorney general indicate he would nod recuse him from related to uranium one. later in the questioning he said he wasn't sure. i'm not sure if he understands

the parameters of the recusal. on previous testimony in front of the united states senate he said with the clinton foundation he felt he was recused from. all this underscores the fact -- judge jeanine: do you guys have the authority to call in all those members of cfius who according to my investigation, 7 of the 9 of them had connection to the clinton foundation to find out, put them under oath and find out what exactly their connection were to the foundation, whether they made any money off that foundation. >> we have seen a power. but we need to get all the documents from the informant. we need to subject him to a snroft questioning. a lot of that will be done outside public view. it will be with congressman jordan and myself, and staff members. based on that, figuring out who else we need to talk to.
