ed: there has been talk about a senate ethics committee review of senator al franken, the democrat, who called for it himself. many senators including franken saying that's how they want this to be handled after last week he was accused of forcibly kissing a woman and appeared to grope her while she slepght based on that photo that was infamously spread around. pete: would an ethics investigation be worth it or a waste of money and time. rachel: gregg jarrett joins us now with this. ed: pete went through the stats yesterday. the ethics committee has had dozens and dozens of investigations in the last decade and no one got hit with anything. maybe a couple slaps on the wrist. >> right. ed: nothing. >> bob packwood was exsped from the u.s. senate raufly 20, 25 years ago. that was related to sexual assault in the workplace while he was a u.s. senator. historically the committee won't even take up a case if it involves misconduct

before somebody became a u.s. senator, which is this case. brock adams was accused of sexual misconduct before he became a senator, ethics committee wouldn't even take it that was 25 years ago. ed, you know, the ebb environment was changed dramatically in recent years yes with sexual assault, sexual harassment, i do think they will take up the case of al franken. rachel: isn't this investigation also probably going to look into his senatsensenatorial office have e been reports we have been hearing about sexual harassment that happened and covered up through secret fund that pays people to make these problems go away. is the investigation just about the photograph or is it about looking into his senate office to see if there is a pattern? >> the committee has broad latitude and discretion. only with respect to matters in the u.s. senate, there is a comparable committee in

the house and given the revelations of jackie spear that there have been payoffs that have been kept secret over sexual harassment, the house needs to investigate as well. you know, we're changing increasingly and for the better, our attitudes for this kind of misconduct. and i read over the weekend the senate rules of conduct. they are complete and utter joke. almost as if they were written in the 19th century. don't spit tobacco juice or something like that. >> they need to update this. rachel: keep your gun in the holster. >> please explain what the proper code of conduct is with respect to sexual harassment, sex all-assault and other relevant matters. pete: i have been beat ago drum but so-called ethics committee has a batting average of zero over the last decade as far as bringing sanctions against senators. do you have any belief on the franken case or anything like it that they will actually step up and censure or sanction a senator who

has done something? >> if i had to make a guess i would say it's either a public admonition or censure as opposed to expulsion there souse chance there will be expulsion. >> how does it apply to roy moore. >> it's alleged and to your point about al franken his conduct happened on a uso tour when he was a comedian. doesn't excuse it. but he was not a u.s. senator. roy moore 30, 40 years ago obviously was not -- obviously not in the senate today. or would the senate ethics committee be likely to look at what he did 30 to 40 years? >> if moore wins i think it's a sure bet can you place your money on it the ethics committee will take up the case of roy moore. i would urge mitch mcconnell to not seat roy moore until the completion of an ethics committee review. which means luther strange would continue to fill the vacancy. and let's see. i mean, if the committee says this man is not fit to

maria bartiromo and who better to talk to when you've got the crown jewel of the trump agenda basically in tax cuts. >> pete: love it. >> ed: stuart varney was on a little while ago saying he think s there's a 90% chance they get something done and frankly as a reporter i'm not there yet because there's too many republican holdouts right now. what do you think? >> maria: well there really are. hopefully it doesn't die in the senate like what happened to healthcare. that's really the worry, but we know that the crown jewel of this plan is the corporate tax cut and the biggest cut. talking about a $1.5 trillion tax cut plan $900 billion of that is the business cuts, and so yes, you are going to see some peoples taxes go higher when you eliminate that state and local deduction as a way partly to pay for the business cuts and the idea is that when you lower corporate taxes, when you lower the passthrough, you'll create an environment for business and encourage businesses to invest in their businesses and create jobs. that's the hope.

we've already seen some new york congressman, california congressman say no so today i'm talking with congressman darryl isa, he's a no in the house for that reason 6 million california ns use that deduction so they may see their taxes go up and peter king from new york said the same thing. i didn't go to washington to raise taxes so that's the stick ing point. we'll see if there's any change on this so-called salt, state and local tax deduction elimination out of the senate and whether you can get these senators who really don't like president trump to vote yes on this. >> pete: what about the idea of passing it in the senate a version that may not be perfect and every senator may not love every aspect but it's different from the house bill so it has to go to conference. there you work out those differences and it goes back to the full body so why couldn't a republican whether they like trump or not or whether it's a perfect bill vote for it to say let's proceed in the process and see what we can get in the end. >> maria: you're right and the senate doesn't have the problem that the house congressman do in terms of hack an election year. the senators aren't going to see

necessarily their seat get replaced next year in 18 when all the congressman are up for reelection. you make make a good point but it's always the democrats targeting any republicans and saying you voted for higher taxes and that's what they're doing to peter king right now. the democrats say look we're targeting your seat in new york in 2018 so he's got to go to the matt for his constituents even if he's playing a little poker i think he would like to see some kind of movement on salt maybe put a cap in the air, $400,000 in income, you can still deduct it or lower, but he's got to go and say no i want it completely overturned because his constituents are going to be voting next year. >> rachel: so maria there's so much misinformation out there about the house bill about what is going to come out of the senate. you heard the democrats had the fight between orrin hatch on the senate floor where the democrats are using their old playbook just saying these are tax cuts for the rich, so tell our viewer out there who isn't, you know, in business like you just tell us how is this tax

plan going to help every day family? >> maria: for example, you're doubling the standard deduction, so you're getting an enormous amount of income tax-free, so right there-- >> pete: everybody. >> maria: so right there you get that standard deduction. you're also looking at lower rates. they are lowering rates both plans whether it's seven or four brackets you're seeing lower individual rates and i can't stress enough the impact of the corporate tax cut because this is trickle down economics. we've learned this over the years over and over again. when you create an environment where businesses do have a more attractive environment they will reinvest their money. the money that is expected to come from overseas because of this very low repatriation is going to be enormous. you'll see trillions of dollars come back to america so i do think there are a lot of positive things but i can't not say that some people will see their taxes go up. we'll talk about that this morning we've got peter rosscam on a subcommittee on taxes and-- >> ed: eric trump is coming on. don't miss sunday morning
