me, part of the trump campaign. he was so close f he's negotiating with mueller this could give mueller a behind-the-scenes look at some of the potential things you're talking about. >> at the same level is the white house concerned at all you have someone like flynn who has clear significant legal problems outside of his dealings with the trump administration, on his own. his son may have serious issues as well. is the trump administration worried he will flip and may, shall we say, over inflate what he knows to i ingracioate himsef with mueller. >> i don't want to speak for the administration. you have trump's attorney saying before this is something they expected or unexpected. i think you can say they expect it did after the charges with manaford and gates. the reporter pointed out trump

kurt is live in washington. howard, people think they're charming and a little too comfortable in those situations. al franken is accused of groping women, grabbing them by the rear end. what do you think about this apology? >> the fact it's his third apology tells you he is still under siege, politically speaking. it's an improvement on the first. two it's still in adequate. he acts like a over aggressive hugger. he has been accused of grabbing womens butts. i think he's staying in the bunker hoping this blows over. in this media environment that rarely works. we have word that senator franken will speak to the media sunday. >> we will be waiting for. that the washington post wrote an article suggesting politicians have staffers issuing statements and they keep quiet and head down hoping things blow over.

i want to ask you, what plays better for people in politics or the public domain. is it better to keep your head down and let it pass or get out in front of it? >> if it's a really serious allegation or series of allegations it's bet tore get in front of it and show yourself on camera and not hiding a statement by strategists and publicists. we this more and more. roy moore hasn't spok spoken toy journalist since the radio conversation with sean hannity. there are twice as many accusers now of the former judge. there have been wrongful settlements. i think the same with charlie rose dropped by cbs, pbs. bloomberg hasn't give any information. they give the impression they can't answer journalist questions or don't want to or

have something to hide. >> for example roy moore. president trump and kellyanne conway say don't focus on the allegations. they say focus on the policies here and what you need as constituents. do people in politics get a pass because of what constituents need from them? >> well, it depends on the politician in question and the serious of the allegations. certainly of course roy moore accused by nine women of both sexual harassment and sexual assault would like to make it about the issues. that's a common political tactic. he has chosen to run against the media, particularly the washington post, reporting many of the allegations. some of these women have talked to alabama journalists as well. a politician not wanting to talk about the allegations and

charges, what they're most vulnerable on, try to change the subject and get back to the real issues. in alabama this wouldn't be a competitive contest without these allegations. now it's a tight race. >> for constituents is there a difference are democrats and republicans with these issues? >> i don't think that's the case. we have both democrats and republicans accused of at the vesvery least. they say some of these allegations are four decades old with roy moore. al franken isn't up for another four years by the time he runs, maybe this blow over. he's under pressure now including from liberal commentators who say he should resign. a year ago it would of been a huge embarrassment. i don't know if it would reach the point of a demanding of

moving in the right direction and fare the president to take credit for it? >> we see unemployment down and stock market up. we see optimism for job creation is up, business optimism is up. i'm not quite sure what the critics want. you don't want the president of the united states talking down the economy. that wouldn't be good. you want the president of the united states to reach out to our troops at thanksgiving to tell them job well done. >> monique, let's put up the facts and get your opinion. this is the stock market since the president was elected. to say it was a massive bare market would be a understatement. unemployment in october at a near record low. the lowest since 2000 at 4.1%. how isn't this good news? >> those two things are excellent news. the question is whether the president can and should take credit for those good things.

we know where unemployment numbers are concerned they were dropping and going down long before november of last year. while we're thankful for the stock market there are many other things that americans who are not invent of vested in the stock market and invested instead in getting health insurance for their children and making sure they have food on the table, they're concerned about. this president instead of really assuring americans, assured them by offering thanks to himself. at a time when normally the mature human being choose to thank god, thank their neighbor, thank the military for being away from family members. he took a victory lap. his critics expect maturity. >> okay. so -- i'm trying to understand this. i will get amy's thought on this. your complaint is not what the policies are or how it has come to pass in the situation, but amy, it sounds like monique is

upset in terms that he took credit rather than thanking god for it. >> right putting style over substance. i think that's a problem. listen, when he called the military you had critics saying how dare he list achievements, etcetera, the military isn't interested in a literary critique of conference calls from the president of the united states. they're interested in concrete goals. the army commander in afghanistan have said we're doing a conditioned base rather than time base approach, turning afghanistan around. since donald trump has become demander in chief they are reversing the decline from the previous commander in chief in afghanistan. that's what our troops need and want. they need thanks for their service a. and sacrifice. it seems like critics want to take a shot at the president any chance they get.

>> new information on the investigation no russian interference and the 2016 election. attorneys for former white house national security adviser michael flynn ending communication with president trump's legal team. there are allegations he could be cutting a deal with robert mueller. let's bring in our panel. former prosecutors. fred, i want to start with you. often times you see the defense teams cooperate and share information, data, until they get to a point they're no longer willing too or able to under the law. what do you read into this? >> there is a bunch of different things to read into it. there is the obvious answer that flynn is taking to the prosecutors about making a deal. under those circumstance there's are a thousand reasons why you want to cut off communication. you don't want a question whether information that flynn obtained came from after

starting with prosecutors. prosecutors can't call up to talk to people in the white house. they're represented by council there. is that issue. i could spin it there is information the white house found out that flynn has real problems and they chose to terminate the relationship. we can read it a lot of ways, it's all speculation. >> a member of trump's legal team said no one should draw the conclusion that general flynn is cooperating against the president. i want to talk with you, richard, this is pretty much expected at this point. >> as i mentioned earlier flynn has a number of issues and his son is being investigated. this maybe a situation where a father wants to save his son. when you look at flynn's charges, potential charges he failed to register as a fail agent. he didn't claim money receives s from russian entities he certainly has issues. it's in his best interest to

cooperate if there is a offer to cooperate. >> we have seen general flynn regarding lobbying work if he laundered money. we have seen indictments with paul manafort and his deputy. when you look at the indictments they don't have to do with the trump campaign, but other crimes. how far can mueller's team go using evidence from other crimes to get information about the trump campaign? >> well, that's a interesting question what constitutional scholars would argue back and forth all day. ultimately they can only go as far as the mandate they were given allows them too. so, to try to prosecute general flynn if they had evidence he robbed a bank and use that as evidence to turn and cooperate against the president would be far a field. given the potential charges against flynn including false statements his credibility is suspect. i'm not trying to run down a guy

serving his country for years. if you have to look at this as a prosecutor to put him on the witness stand they need cooberating evidence if he agreed to cooperate. >> let's not forget general flynn resigned after it was found he mislead the vice president about his communication with the russian ambassador. his kred. >> has been called into question, specifically by the white house. how much damage would he potentially do given that lack of credibility? >> well, look there is no doubt general flynn wasn't involved in the trump campaign early on. if he decides to cooperate with the special prosecutor he can give insight no what was taking place, the meetings with the trump campaign. which is what the special prosecutor is looking at. what there co lyings with russian officials and the trump campaign.

when you make a plea agreement with the feds you must tell them about every crime that you know about or else you will face another potential charge against you. there is full cooperation when you enter no a plea deal. >> while i have you both i want to hit another topic. when they return to the bench there will be questions about a cellphone is searchable with a warrant. this centers on timothy carpenter. he says his fourth amendment rights were violated. the government used cellphone information to convict him for a stripping of robberies in michigan and ohio. your thoughts on this? >> there is a reason i was a prosecutor for years. all kudos to richard, i don't do criminal defense work. i think the argument is garbage. a legal term. he has no expectation of privacy

or where he was. they could have asked people if they saw him. the second is the third party issue. he waved his rights to claim privacy and information getting to the cellphone carrier. the notion from the aclu and other people, lawyers hate slippery slopes, from this decision they will get his google searches to heart rate and anything else you can get from a cellphone. i don't think it holds a lot of water, not with me. >> richard, the government says they're using a 1986 law for this and go further that he gave up his rights to privacy with the cell service. what do you think about this? >> there is a 1986 law before the internet and the cellphones. the storage communication act of 1986. i disagree with fred. the supreme court have said the police need a warrant to search someone's cellphone after anna

rest. this is going down the same line and they probably took the case. it's important to weight in on stuff not contemplated in the storage communication act. i think there is a fourth amendment violation. you didn't wave your privacy signing up for services. when a police officer pulls you over you he has to ask to search your vehicle. here there is no chance or opportunity to say anything. the standard of proof under this act is much lower. i think the supreme court will find it's a violation of fourth amendment. >> with new technology there are more ways to collect evidence. we will see where this goes. thank you, richard and fred. >> thank you. >> tufplt. >> congress returning to capitol hill next week. the focus is on tax reform. how the president plans to raleigh his party to deliver the
