thank you so much. that will be a fun wedding to go to. we are awaiting the white house briefing. thank you for joining us. i am dana perino, and here is shep. >> shepard: it is noon on the west coast, 3:00 at the white house, where the press secretary is set to brief reports at any moment. i just heard seconds ago. it will begin in about 15 minutes. we will hear from her then as well is a report that a lawyer from president trump's normal neck former national security advisor michael flynn met with the special counsel team. there are questions about whether or not michael flynn is in the process of cutting a deal with prosecutors or whether he may already have cut a deal with prosecutors. questions about what he may have to offer them. we are also watching from capitol hill controversy. president trump with support for the alabama candidate roy moore, despite the accusations of sexual misconduct with teenager teenagers. the top house democrat,

be talking about cutting a deal with the feds on the russian investigation or ideal may have already been reached. we do not know. fox news has called to his legal team, but we have not heard back from him. we learned last week, the former national security advisor attorney stop sharing details with present trumps lawyers on the justice department investigation. that is significant. robert mueller is looking into russia's meddling in the 2016 presidential election, and the possibility of collusion with member of president tom's campaign. the white house and the russian president, vladimir putin repeal he said, there is no collusion, fox news has confirmed that robert mueller's team is asking michael flynn for failing to register as a foreign agent. accusations that he talked about a plot to kidnap out russian cleric in pennsylvania, $15 million fee for flynn's denial. michael flynn has been worried, the special counsel will target his son, michael flynn, jr., who

served as his father's chief of staff and worked for his dad in the lobbying firm. fox news judge napolitano said the white house lawyers should be called, very concerned that michael flynn's legal team has stopped giving them information. get to the reporting kevin heritage's life. >> we are working to confirm the lawyer for mike flynn, former national security advisor met with that counsel this morning. this photo here shows the special counsel office space in downtown d.c. recently expanded to a second floor. the decision by the legal team to cut contacts could indicate, he is close to cooperating, or refusing to cut a deal. a source close to the presence of legal team tells fox news, they believe his greatest exposure is turkey, and this does not touch the president or russia. we are expecting more white house interviews as early as this week. fox news has learned that investigators on the 2016

campaign that there was no contact between the trump campaign and foreign entities. the issue is whether she was directed to make the statement by who and on what basis. investigators are focused on hick's role as a gatekeeper. >> shepard: the fbi responding to report that russian hackers targeted u.s. officials. >> that is right. in response to an investigation, they provided a warning to the service providers, and one of the biggest challenges the fbi faces is a sheer volume of hacking. that statement, the fbi notified organizations a potential information, and will continue to work closely with local partners to keep the public informed of potential threats. a leading cyber security analyst told fox news this morning, there were warnings to law enforcement and the u.s. intelligence community as early as 2015, 2300 government officials and their spouses were targeted by this espionage group.

this way. many of these officials were in some cases former ambassadors. in some cases law-enforcement national security, and they sai said, we really would've liked to have known long ago that we have been compromised. >> shepard: what you think about michael flynn, help our viewers understand, why does, no longer cooperating with the president and his team. it's an indication that something significant has chang change? >> usually when you are on the legal side, you will communicate to the white house lawyers have been in touch with michael flynn's lawyers in the pass and they share information. when you know longer do that the concern is that if he is close to cutting some sort of deal, they won't be able to share more information with the white hous

white house. it just cut to chase here, this potentially brings this investigation right into the white house. the past examples that your viewers know about, george papadopoulos, paul manafort, they were involved in the campaign, were not here at the white house. so flynn is going to cut some sort of deal, where he provides information to robert mueller steam about what happened in the white house, it could be much more damaging to the officials here. >> shepard: you do not cut a deal if you are a prosecutor someone unless that someone can provide to you information about someone higher than you in the food chain and whether that information is, do you believe is significant enough to where you would grant some level, not immunity in, but special treatment of some kind. is that right? >> that is right. it works from the outside in. what could be happening, flynn lawyers could be having off the

record sessions with robert mueller's people to find out what his team has on flynn, and with the flynn return can do a proper, where they would say, this is the information that we could offer you the might implicate us. >> one more matter before we go to this, his people say, although he is clearly supporting roy moore or the efforts of the republican in the state of alabama, the president's people are now tell us, he will not be actively campaigning in alabama. >> that is right. white house officials tell us, he is not expected to campaign for roy moore in alabama before the december 12th special election. i think this is a safe space for the president. he can express his views on twitter, perhaps in quick back back-and-forth with reporters, but he does not run the risk of

going back to alabama, campaigning for him, and being burned. if he does go down there and campaign in person, if roy moore wins, he's campaign for somebody who in all likelihood, could be prevented from seated by members of the republican party. if you go zones there and campaign for them and loses, it will be a second time in a matter of six months that this president has gone down the campaign for somebody in alabama and has lost. >> shepard: ken thomas is the white house reporter for the associated press. thank you, ken. now if this matter at the white house, i have described to you as best i could a minute ago come over the president was hosting world war ii code talkers. american heroes themselves, native americans, who were native american code talkers. they did a fairly lengthy introduction. it seems to me about 10 minutes just by monitoring the feed.

will raise taxes to the sky. jones would be a disaster. the white house said roy moore should quit the senate race if the accusations are true. they called on him to step aside immediately. roy moore of course, denies the accusations, the president said, you have to listen to him also come and that is a quote. today, white house official told the associated press, the president will not campaign for roy moore as we said earlier. the president last week suggested he might. he would let us know this week. please, let us know. the white house confirmed to fox news, there is nothing on his schedule at this time. that is a quote. the election is two weeks from tomorrow. kristin fisher is live at the white house briefing room. she is awaiting for sarah sanders along with all of us. alabama undermined. hello, kristin. >> alabama's on everybody's mind. that is cap locating the white house's top priority before christmas. which is of course, tax reform.

president trump promising tax cuts by christmas, but this race in alabama really complicating that, before president trump left on thanks giving break, he left the door open to possibly campaigning for the republican senate candidate roy moore today, there has been multiple reports that the white house said, he will not be doing that. he will not be campaigning for him and i headed this december 12th election, and our sources here at the white house tell us, there is simply nothing on his schedule at this time. i could change, but it certainly appears likely that president trump is going to continue to do what he was doing over the weekend, which is not actively campaigning for roy moore, but instead, really pushing borders in alabama to vote against his opponent doug jones, calling him weak on crime, leak on immigration, even though a lot of the members of the house and senate would like him to be a bit more forceful in his condemnation of roy moore

after being accused of molesting young girls down there. so many years ago. >> shepard: another subject, tells more about this fight over the job at the consumer financial protection bureau. that is quite a dustup. >> shep, it is quite a dustup, quite a story. it is fascinating everybody here in washington. here you have two people essentially that could have been showing up for work for the same job at the very same time. you have president trump appointing his budget director, mick mulvaney to this job on friday, but the outgoing director of the cfpb, he appointed his own person to the post, and this outgoing director was appointed to the job by president obama. give a president obama going against president trump appointee, and now, that obama era holdover, his replacement is suing the trump administration and at this hour, right now, you have senator elizabeth warren, who was instrumental in the

creation of the cfpb after the 2008 financial crisis. she will be sitting down with the person that she believes should be the acting director. at the same time that mick mulvaney is going to be holding his own press conference just across the street. really a battle of directors here, it will be a lot of questions about that here at the briefing today. again, when it starts, will take you back to life. meanwhile, as it so happens, seconds after we got the playback of the president making those comments about senator elizabeth warren, she was the guest on msnbc. at the end of a fairly lengthy conversation i am told, she was asked about this and she said, senator warren said the following. this was supposed to be an event on our heroes, people who put it all on the line for our country. and people who because of their incredible work saved the lives of countless americans and our allies. it is deeply unfortunate that

senator warren, the president of the united states cannot even make it to a ceremony honoring heroes without having to throw out a racial slur. she finished by saying, donald trump does this over and over, thinking somehow he will shut me up. has not worked in the past, and will not work in the future. that is from elizabeth warren, the senator and what appears to be a bit of a dustup with the white house in the last 30 minutes. over an event honoring native american heroes. the house minority leader, she changed her tune on her colleagues, john conyers and the most awkward way you could ever imagine. even democrats has said, this is politically disastrous. she initially defended him after accusations that he sexually harassed staffers, calling him an icon in the rest. after catching some criticism and after he came forward to saying he is stepping down from his chair, she is backing down, and fox news has talked a woman

financial protection bureau today or is there still a back-and-forth between. >> director mulvaney has taken charge of that agency, and he has the full cooperation of the staff and appear there this morning and things look very well. for his first day over at the cfpb. >> reporter: how did he handle that power struggle? >> i think the legal outline was very clear, who is in charge of that agency, and both him and the white house as well as the general counsel for cfpb, who was appointed by robert condrey, that he has the legal standing to be there and serve as the director, we agree with that with congress moving forward. >> reporter: why not just fire leandre english?

>> secretary sanders: she is still the director and has a legal part, but not as a director. >> reporter: does the white house agree with mick mulvaney when he called this agency a joke? >> secretary sanders: we think a lot of the past practices under the previous director and under the previous administration were used more to advance political ambitions and not about protecting american consumers, which is what that supposed to be, and our goal is to make sure we get back to that. matthew. does the president still accept the authenticity of the axis highwood tape? >> secretary sanders: at the present address this. this was litigated and answered during the election. by the overwhelming support for the president, the fact that he is sitting here in the oval office today. he has made his position on that clear at that time as had the american people.

his authenticity has changed to make >> secretary sanders: the president has not changed his position. i think if anything, the president questions, is the media's reporting on that accuracy. >> reporter: two questions on the cfpb. it has to do with whether or not you want us to clear up any confusion as to who is in control of the cfpb? the lawsuit has been filed. we want that case to be a ruling decided very quickly. >> secretary sanders: we are aware that a lawsuit has been filed, we also aware that the law is clear and director mulvaney is the acting director here as that has been outlined by the counsel's office, department of justice, and as i said before, cfpb's own counsel appointed by richard cordray. i think everybody is in full agreement that he is the director of this office.

online asking whether the president lacked decency. was your response to the notion? >> i think the president certainly finds an extreme amount of value and respect for these individuals, which is why he brought them and invited them to come to the white house to spend time with him, recognizing them and honoring them today. i think he is constantly showing ways to honor those individuals, and he invited them here at the white house today to meet with them and to also remind everybody about what the historic roles that they played many years ago. >> reporter: why is it appropriate for him to use that in any context? >> secretary sanders: it is not appropriate for him or anybody else. reporter mike wise appropriate for him >> secretary sanders: like i said, i don't think it is. i don't think it was his intent. like i said, i think the most offensive thing -- i'm sorry?

reporter mike to see see value in calling people out racially? >> secretary sanders: i think senator warren was very offensive when she lied about something specifically to advance her career. i do not understand why nobody is asking about that question, why that is not constantly covered >> reporter: with erdogan and turkey, the kurds with isis, u.s. is backing away from its previous support? >> secretary sanders: once we started to win the campaign against why that is not constantly? isis, the plan a part of the process was to always wind down support for certain groups. now that we are continuing to crush the physical caliphate that we are in a petite position to stop giving money. it does not mean stopping all

talking about. >> reporter: was the official policy on this position? should be stay or go? >> secretary sanders: like i said, we have no changes it to past payments we've already made on that front. >> reporter: on the cfpb, the white house believes that leandre english is qualified for that position? >> secretary sanders: we think mick mulvaney is the right person at this time to leave that agency, and that is why he is over there. >> reporter: he's the right person, but the follow-up is, what if the white house what does the president have against leandre english? >> secretary sanders: i'm not saying that we do have anything against her. i am saying, we want director mulvaney to lead this agency, and as the decision that the president is allowed to make and one that he has made and has legal authority to do. >> reporter: to questions about personality. governor brownback about the ambassador remark. with religious liberty be installed in the senate have not

confirmed him or a vote on it? at the same time, the national security council staff has a vacant slot that deals with the same issue, religious liberty. it does not require senate confirmation. is he going to fill that slot? >> secretary sanders: i'm not aware of any announcement for that position at this time. if one happens, we will certainly make sure you're aware of it. >> reporter: another question, the appointment of director mulvaney simultaneous, presidential appointments. it seems a little odd, because this is not been done according to many accounts since before world war i. at >> secretary sanders: we are in an administration would like to. >> reporter: the last one was before world war i when the chairman of the fed -- did the president decide to give the

dual position to director mulvaney? >> secretary sanders: i think the president thought he was the right person to lead the agency and he made that decision. there's no more to it than that. >> reporter: as far as reform, the house there is no action, does administration view this as an opportunity to try to push congressional reform? >> secretary sanders: this is director mulvaney's first day. we will let him get settled in before we start announcing new policies. when we do, we will keep you posted. i'm going to jump around to same time. were reaching the end of year, and i'm wondering what the president said he will do what congress, what does the president propose to do, and seen that happen in the next few

weeks? the stand-alone bill? >> secretary sanders: use been specific to the dreamers? we hope that the democrats are not going to put our service members are broad at risk by trying to hold the government hostage over partisan politics, and attaching that. today, we have laid out what our principles on immigration appeared we want to see responsible immigration reform that would include doctor, but i would also include the priorities that we have already laid out. like i just said, we hope that the democrats are willing to actually make responsible immigration reform. we have laid out what we want, and with the president a meeting. with various members tomorrow, and i would imagine that that will come up at the time. reporter mike while you say to consumers that was called the agency that he is leading it is -- well you say to consumers who are concerned about somebody like that leading this agency

trying to protect him. >> i think consumers should be glad that there's someone who wants to fight for consumers and not fight for their own political ambitions, which we have seen in the previous leadership, and which will be a different change under director mulvaney. at this point, senator al franken has said there may be more women coming forward. he does not know if there are, there might be more women coming. i won't point is the president condemned them? how many women does it take or accusations as a take before the president says, al franken should resign, and is he holding back from some accusations against himself? >> secretary sanders: the president is not going to wait and on every single matter. every single day, with people from the media, hollywood, members of congress that have allegations brought against them, and we think that this should go through a due process and that is something that al franken should be the first to

address and after the president to weigh in on every single time the quantities accusations comes up. there should be a process that we go through, we want to make sure that that is completed. >> reporter: you had said that that has been litigated. do you think -- >> secretary sanders: the president has addressed it at the time. >> reporter: do think because he's elected, that is the question of sexual misconduct, it is wrong? speed to the present has been clear that he denies anything taking place. >> reporter: can you point to some cases of where the cfpb did not actively investigate consumers? >> secretary sanders: we have a list of those that will provide after the briefing today. i do not have it right in front of me, but i have read multiple things they'll be happy to provide for you after the briefing. reporter mike after the weekend, today, he called out cnn and

netsuite. the conversation that the president has had with rupert murdoch, has he ever brought up cnn or talked about at&t? >> secretary sanders: not that i am aware of. one last question. veronica? >> reporter: he met with congressional leaders and surprise a lot of people, making a deal, if you will, with chuck and nancy. taking republicans by surprise. should be expected something like this out of tomorrow? should republicans feel anxiety or concern leading into tomorrow's meeting that he may throw them under the bus leading into tomorrow's meeting? >> secretary sanders: i don't think the president to anybody under the bus. if the president -- i'm not going to get ahead of that meeting. if the president can make a deal in any of those democrats would like to come by i board, that is my guess, since republican

senators will be excited about everything so much, guys pit have a good afternoon. >> shepard: i thought was interesting that none of them asking questions about the tax plan. associate editor for "the wall street journal" and fox news channel, factors property or corporate cousins. this tax plan, all to the other stuff, pocahontas, the tax plan has about 25, 27% approval among the people. 50% disapproval and largely the reason is because over the term of it, it raises taxes on many middle-class people. it lowers taxes on corporate interest. and makes those lower taxes on corporate interests permanent in addition, it lowers taxes largely speaking on the wealthiest americans. that is probably the reason is not so popular. just a guess. >> is still being hammered out.
