30 hours. we thought there might be a deadlocked jury. shortly after handling the gun that was used. they reached a verdict. a shocking verdict. not guilty of murder, not guilty of involuntary manslaughter. a big win for the public defender matt gonzalez. he came out to address the throng of reporters who were waiting for a verdict to come down. he almost immediately took aim at president trump saying he is bracing for the tweets. just wait. listen to what he said. >> those who might criticize this verdict, there are a number of people that commented on this case in the last couple of years. the attorney general of the united states. the president and vice-president of the united states. let me just remind them that they are themselves under investigation by a special

prosecutor in washington, d.c. they may themselves soon avail themselves of a presumption of innocence and beyond a reasonable doubt standard. reflect on that before they comment or disparage the results in this case. >> matt gonzalez came directly over to talk to me as soon as he left the hall of justice. he said this is not a night for celebrating. he feels this jury reached the right verdict. given the circumstantial evidence that was brought into the trial. there was no testimony about the defendant's criminal history or a multiple felon on track for his 6th deportation from the united states. the jury was not allowed to consider any of that. the defense really painted the case this was an unintentional discharge of a loaded weapon that happened to be on a popular

confession to police. mr. zarate gave statements that were proven to be wrong or false. for instance, he told police he went over to kate steinle. surveillance video shows that did not happen. there were also issues with the police translations. matt gonzalez raised reasonable doubt for in jury. the gun only fired once. after it fired, mr. zarate kicked the gun into the water. the prosecution said that showed evidence of guilt. but the defense said no. he kicked it into the water because it fired on its own and he was scared and panic. so he kicked it in the water. two different threos. -- threos. -- theories. >> tucker: the gun was stolen

out of a vehicle and mr. zarate said he found it. >> mr. zarate was never charged with stealing that gun from the parked car of a ranger 4 days earlier not far from the pier. yes, zarate's defense was that he was sitting on a bench. he looked down under the bench. and there was a bundle, a rag, a t-shirt. he bent down to pick it up, the gun fired. again part of the defense was the trigger pull on the 40 caliber pistol was so light, the barest amount of pressure would cause it to fire. >> tucker: that's ridiculous. with reaction to the verdict, mark stein joins us. this remind you of a verdict 20 years ago in a case that was

equally politicized. the o.j. simpson murder case. i want to read a quote from one of the lawyers representing this man who is a murderer who was just acquitted. he said: this case is used to foment hate, decision and a program of mass deportation." it sounds like this whole thing was recast as a political statement rather than a murder trial. that's the end of justice, isn't it? it trials can be subverted by national politics, there is no hope for justice, right? >> i think it's a miscarriage of justice in the profoundest sense. kate steinle is dead because she went for a walk in a popular destination in her own city. her parents will never see anybody convicted for that crime. there is no dispute -- this is slightly different from the o.j.

case. at least he pretended to be looking for the real killers for the last 20 years. there is no dispute that this guy actually fired the shot or picked up the gun that shot itself, and that this gunshot killed kate steinle. there is no dispute either that this man should not have been in the country. , in fact he had been deported 6 times. to go back to the old line about the jobs americans won't do. every society has a proportion of murderers. murder is a job that americans will do just as dutchmen will do. you don't need to import foreigners to add to your murder population. this guy had a grade-2 education. the reason he got off is because he is too stupid to understand what the cops were saying to him. he gave conflicting answers about finding the gun.

just treating illegal immigrants as you would american citizens but giving them better treatment. special privileges because they are here illegally. it's hard to imagine a american citizen in zarate's position would have been acquitted on all of these charges? >> no, this is a life language career criminal. the justification to let him go is there no evidence of violent crime. just non-violent crime. the term sanctuary cities is designed to shutdown the argument. who do you give sanctuary to? you give it to refugees. to those fleeing injustice. how can there be something called the sanctuary cities if they were a place for criminals to hold up. the term is designed to shutdown the debate.
