and the president playing a key role leading up to the boat. vote and let's bring in fox news sr. good evening to you, what's happening on the floor right now? >> they go through vote after vote after vote and this is kind of the precursor and this might happen sometime at one or 2:00. this is a question of when and not if. they will pass this bill sometime later. and not expected to be needed is vice president pence. there is nothing democrats can do to stop this and they are not pleased. >> this will mark today as one of the darkest black letter days in the long history of the senate. this unfortunately is the

metaphor for this bill. and how high the stench is rising in this chamber. as we debate stilts night. my long career career in politics, i'm not seeing a more aggressive piece of legislation so devoid of rationale. >> what we are thinking here is there won't be any democrats here to vote on this bill. one of those democrats in a swing state told me they wanted some democrats to vote yes but mitch mcconnell made the bill so bad there's no way they would vote and say yes. >> what happens at this point? >> of the key is getting the votes.

general denies a false of treason. and he's agreed to cooperate with a special counsel in the russian interference in the 2016 election. and he's here to tell us what this means and the bigger picture. legal he >> he was once the topl and tonight he is under investigation. and he admitted lying to the fbi agent during an interview in january. he claimed he never asked russian ambassador to escalate the diplomatic dispute. any claimed not to remember the phone call. any said he falsely claimed a separate call to try and make a deal with russia. flynn also claimed and special

counselor mueller got him to admit making false statements on federal disclosure forms. his prosecutors don't know if these admissions can be used against him if they placed him on the witness stand. the false statements involved near the false statements white house officials which resulted in his resignation in february. nothing about the guilty plea or charge implicates anyone else other than flynn. jared kushner the president's son-in-law has been identified as the senior transition official who directed flynn to contact russian officials about the u.n. vote. and encourage the entire team to enforce the issue. and this shows that the trump

administration was associating with the russians before trump got involved. and it's critical that we determine whether flynn spoke with the russians on these issues. the logan act prohibits conducting foreign policy without authorization. the last prosecution was a hundred and 65 years ago. >> shannon: so it's been a while is what you're saying. we will see if this case has merit. thank you. let's bring in our fair panel. and litigator in these cases. any national security attorney. thank you for being here. i want to start, a big announcement on what this does. we are talking about one charge of lying in all kinds of things.

kidnapping plots, not registering as a federal agent. is it just the tip of the iceberg? >> it has to be all they have. this is the package. this is what they present to the court today. the thing that everybody needs to understand is it's very serious criminal offense to make a false statement to any federal agent. if they had other criminal offenses which include -- those would have been included today and they weren't. so this is it for michael flynn. while regrettable i think it does underscore that frankly if this is all there is in this took place with the interview with the fbi before robert mueller was named special

prosecutor in a carryover from the obama administration, i think it raises a lot of questions about the whole investigation. >> shannon: is it that there was a lot more? what because they got him giving other information about ongoing investigations in the trump campaign and russia, that there was much more. and that's why we are only seeing this charge in the plea deal. >> this may be all that they had on him. as far as i'm concerned is the tip of the iceberg. what they're getting from him as material investigation. it doesn't mean flynn himself was engaged but because he wasn't part of the inner circle. but he saw everything on the campaign with the transition, he had significant information that

can provide to investigators. and provide mueller the ability with initial contact with members of the circle as jared kushner or donald from jr. this is not the end of the investigation. >> >> shannon: one person says f there was evidence of conclusion conclusion. we would be looking at a major conspiracy indictment and flynn would see far more serious charges. that sounds like that's closer to your read on this. >> other high-profile cases where individuals -- let's talk about scooter libby. he ended up pleading guilty to a charge of making a false statement to be fbi.

as we know no the entire thing was a media incited phenomenon. so i think what this does remind me and everyone, and the fbi up at your door, don't ever talk to any federal agent without an attorney present. you can inadvertently say something that can end up being a felony charge. i don't know the circumstances of the interviews but i do know the fbi has faith of the conversations with the russian ambassador with flynn. so the question arises of why they need to interview him. it is what it is and it's a serious thing. and i do think it raises a question that there is not all there.

to create division and a program of mass deportation. it was used as a catapult for presidency. and along that philosophy of hates. >> shannon: i will let you take the first ring of that. >> and we need to address issues that need to be solved in our community. and san francisco disregards the law and doesn't have the capacity to convict. they can't even find him guilty of involuntary manslaughter. which is by definition is what occurred here. they charge him with possession of weapon. what more do you need to do to prove that. this is a miscarriage of justic justice. >> shannon: we had the attorney general jeff sessions talk about that.

>> we are confident that we will do everything possible to ensure that happens. there are some potential other charges and before being deported and released we think he should face every charge against him. you can be sure our department of justice is working right now for other charges that are there. >> shannon: so not building the wall and democrats want to negotiate over government spending, it changes the immigration debate. >> i think this is more of a criminal justice issue. the defense's argument for when i read has some holes in it potentially. and some federal charges they can sort out.

the question here is, he was held and released on a drug charge and he wasn't a violent offender up until that point. this is somebody who is a criminal. he was a criminal absolutely. the predicate to this is immigration policy specifically is the reason he's in the country and he murdered an american woman. >> that's exactly the problem. why the cities haven't set the national immigration. that should be the responsibility of the city. they failed to pass immigration reform and were pushing the duty on the city.

>> shannon: when they decide they won't cooperate with federal requests when they know the sky has been reported five times and they got a request and they just let him go. >> that's the problem. people are missing the background. government gets frustrated with washington. we pay federal taxes for us to set a effective immigration policy. and they failed to do that. and we pay them to enforce immigration policy. they are passing the buck to witness appellees municipalities and we will let law enforcement analysts. and if you get pulled over for a ticket or marijuana cigarette,

hold them in your jail and use your resources. >> there are known murderers and in prison. >> and if they were letting him go, the feds asked him to be held. he can potentially commit other felonies. how can they just let him go? >> that's part of it. the problem is in practice these state prisons and jails are left on for weeks or months waiting for these prisoners. the states are not setting the laws, the federal government is. >> hand him over to state authorities and prosecute them. >> shannon: i think we all can
