accused of lying and otherwise did nothing more illegally and the president has constantly defended the general. francis is with the president said about him back in may. >> this man has served for many years. he is a general. he, in my opinion, a very good person. >> the president is now back in the white house after the fundraising trip to new york city. and garrett tenney is live at the white house. >> the president is expected to arrive any minute now back from his trip to new york city where he had some fundraising events. and he talked about the success of this senate passing taxi for me that was the win he was hanging his hat on. also between events that he tweeted i had to fire general flynn because he lied to the vice president and the fbi. he has pled guilty to those. it is a shame because his

actions during the transition were lawful. there was nothing to hide. this morning as he was leaving the white house the president said that he is not concerned about michael flynn cooperating with special counsel robert mueller's investigation. >> no, i am not. what has been shown is no collision. no collision. there has been absolutely no collision. we are very happy. we will see what happens. thank you all very much! >> while the president is not concerned, the idea of you do not know we do not know. that is particularly true because unlike the other individuals have been charged in the investigation thus far, michael flynn was heavily involved in all three phases of the trump campaign, the transition as well as the first month of the administration. from that and from the court documents were filed yesterday, they show that more people in

flynn, obviously paul manafort and george papadopoulos, as garrett tenney mentioned, michael flynn was about the many aspects of the trump scare. he was active in the campaign, active during transition and in the white house for almost a month. it will be hard for the trump white house to separate themselves from him as they try to with paul manafort and also with george papadopoulos. >> also know that michael flynn is cooperating, who else might be in robert mueller is crosshairs? >> someone mentioned during petitioner, talk obviously that case mcfarland, she was the one that helped push general michael flynn in the direction of talking to the russians. back in december with senator kislyak. i think those anesi will look at in the next couple of weeks. >> and mcfarland, the assistant if you will. so there was perhaps that perhaps there was a messenger.

as per robert mueller his mission, is collision on the back burner? and obstruction of justice on the front burner? >> i think we have to wait and see. obviously, the white house expects this to be wrapped up in the next couple of weeks. they say that the interviews by former director robert mueller, that they will be wrapping up soon. i think it will be wait and see approach right after the white house. definitely want to get what they can but you have the president out there today denying all accusations. of course he has been doing this for months. and throughout the last couple of months. i think that we will have to wait and see what happens in the next month or so. >> what you make of the presidents tweets? as he said, he is define what has come up so far in the investigation. does this help or hurt mr. trump and his top aides? >> ãit helps them. i'm also not sure that it hurts

at this point. i think one issue for the president right now is, looking at the testable days he had a big victory. tax reform. like in the senate last night to the wee hours of the night that was a big accomplishment. it hurts them in that it takes attention away from issues like this. he comes out and has a small margin of victory but they end up getting it done last night. that is really getting overshadowed by this news. i think it is something know how to deal with in the next couple of weeks. really overshadowed the one major legislative victory. >> going back to the timeline and timing of robert mueller' moves in this investigation, what does it say, the timing of everything? michael flynn is there now cooperating with him. you already have other high-level executives and aides from the campaign already having been charged and costs please. what is happening now in terms of the timeline? the timing of robert mueller's

investigation?>> obviously the white house think that this is wrapping up soon. one thing to note is that michael flynn and some made this point that michael flynn is the end all, be all for this investigation. he has been in the white house for a solid month. he has seen a lot of things. there's a lot of questions hinging on what he is seeing. what conversations was he a part of? what meetings was he and during the transition into the white house? i think those answers we want to see in the next couple of weeks and the coming months. >> as we stand right now, in what ways are things looking up for the president as it pertains to the rush approach? >> i'm not sure is looking up in many ways but one way you can look at that time of the presidents allies are making that there is no evidence of collusion yet. there -- if there will be at all. there were some attacks against immunity yesterday for saying that michael flynn maybe had some of the actions while he

was -- while trump was a candidate and transition. i think it is going to look at it. that there is no evidence of collusion yet and that is what the trump attackers keep looking at. when is this collision issue coming up? and it has not yet appeared and that is a good thing for the white house. >> washington political examiner -- thank you very much. crescent republicans give the president his first big legislative victory. as in the greatly anticipated tax reform bill. several last-minute changes. some even handwritten on the margins of the bill that russia was criticized by some democrats and the bill passed without one democratic vote. senate majority leader, mitch mcconnell, touted the results last night. >> i am totally convinced this is a revenue neutral bill.

actually a revenue producer that will get american moving again. >> more about what we can expect, caroline shively in washington. >> questions tonight, what is in it and what is next? what is in it, the basis of what we've been talking about. the gop held the permanent reduction of the corporate tax rate from 35 to 20 percent. they also pointed to allotted tenure customer individuals. this would add more than $1 trillion to the deficit of republican leaders say does not take into account the massive growth that it would unlace. but there are plenty of surprises in there that were added late last night. they had to shove them in there at the last minute to win over some republican holdouts. in the end, the measure passed without a single democrat. >> i would be delighted to gut and destroy this legislation. >> how high the stench is rising in this chamber as we debate the bill tonight. in my long career in politics,

i have not seen a more aggressive piece of legislation. >> not to the other question, what is next? a conference committee. with members of both chambers to try and blend the two bills together. the house is coming back a day early to get the process moving. >> my goal is to pick the best of the best ideas from the house and senate and in some ways find the third way.but work together starting next week as you know, the house is coming back early on monday. >> there are substantial differences to the senate version has seven tax brackets. and this job seductive for. and the mandate for insurance. plus as we pick apart the bill some of those surprises will likely get checked. >> they looking for the christmas deadline to get it all done. >> a crisis in disguise. many american airlines and flights will not be canceled after all.

any comfort from this at all. us officials as you know say the ballistic missile test by the regime of kim jung one last week. you have the potential to reach washington dc. but a senior us official now tells fox news that the missile was not able to safely reenter the earths atmosphere. another remains a major hurdle for the regime to apparently pull off any possible nuclear strikes so far so that could be good news. we have more on this from the london bureau. >> fox news has learned that a missile launched by north korea last tuesday may in fact have broken up on reentry to the earths atmosphere. the long-range missile was launched last tuesday and it appeared to demonstrate capability of hitting targets over 8000 miles away putting the us within range. the new information is significant because it indicates that despite the distance the missile travel, it may not be able to strike a long distance target if it cannot survive reentry. us allies in the region are now

searching for the wreckage to try and learn more about what happened. meanwhile, north korea has been holding mass celebrations to mark what it is claiming to be a successful missile launch. he says that the test was proven that could hit targets in the us but the latest information would question that. in hawaii, they are taking no chances though. it cold war era warning siren has been reactivated to prepare people there for a possible nuclear attack from north korea. hawaii is one of the closest us states north korea and has a large military presence which could make it a potential target. these fears come at a time when the north korean regime has continued its aggressive rhetoric in addition to the latest test launch claiming the us is begging for war. but the us ambassador to the un, nikki haley, says it is the regime in pyongyang which is pushing for a military confrontation which she says the world does not want.and the un security council is due

to meet on december 15 to discuss north korea's weapons program and to help to find a peaceful solution to the ongoing crisis. eric? >> the greatest immediate threat to the united states and the world is the threat posed by the rogue regime in north korea and his continued efforts to develop a long-range nuclear capability. and so, it is immensely important that we work together with all of our allies, partners and everyone internationally to convince kim jong-un that the continued pursuit of these capabilities is a dead-end for him and his regime. >> that of course is national security advisor, hr mcmaster. in the last hour the national security forum in california. with his warning about the threat to kim jong-un. he echoes the emergency united nations security council meeting that was held here in new york a few days ago.

that is where the us ambassador to the un, nikki haley, also made it clear to the world diplomats who bears responsibility for this continuing crisis. >> it never sought war with north korea and still today, we do not seek it. if ward does come, it will be because of continued acts of aggression like we witnessed yesterday. and if war comes, make no mistake, the north korean regime will be utterly destroyed. >> can kim jong-un be tamed? joining us we have jim watch, senior research associate at the mit security studies program in cambridge. jim, welcome. as you discern, nikki haley, but the blame bluntly and directly on kim jong-un.and she also called on nations around the globe to cut ties with north korea. is it even feasible or possible and you think china would go with it? >> it is a plea that we have heard many times before.

i think most countries have pretty much ended their relations with north korea. not entirely, but mostly. in part because of aggressive south korean diplomacy going out and visiting countries and trying to persuade them not to do trade with north korea. but 90 percent of north korea's trade is with china. and so that, you do not solve the problem without china and without south korea and the us all being on the same page. i do not know why this statement will be any different than any other statements that we have had for more than a decade. i do not expect that. >> you point to try to purely keep on talking about china. 90 percent of the oil in them not that off. they say they are supposed to cut up some banking, the corporations began north korean workers and tried to cut off the money. but at the meeting, ms. nikki haley also pointed to the oil and pointed out that in 2003, when china cut off the spigot of oil, that brought the north

koreans to the negotiating table. why don't they do that now? and do you think that would work? >> you are right eric. there was the incident where oil was cut off. there was some confusion. was it on purpose? was it because allegedly a break in a pipeline? we do not know. but the result was the same which was that they suffered a loss. there was in a spring, a spike in gasoline prices in pyongyang. it was reported and there was at least rumors that north korea or china had sort of tie and the spigot as it were to send a signal to north korea. but are they going to cut off all of the oil? no, they are not. if you cut off all supply of oil, to north korea, first of all the people are going to suffer the most. they are the poor citizens, the poor north koreans who are living at the margins. women and children who have food insecurity. they are the ones that will take it on the chin.

that could be a very ugly scene. china does not want that. so as you and i have discussed so many times before, it is trying to squeeze north korea enough to change behavior without squeezing it so much that it collapses and that balance has not been found. >> even the north koreans refuse to entertain one of china's envoys and then the envoy from china brought gifts to north korea and they were touting that. let me tell you something else about ambassador and what she said and get your reaction. let's listen. >> we are once again, at a time of reckoning. we have some options. first, we should continue to treat north korea's international pariah that it has become by taking it un rights and privileges away. including, the voting powers. second, we know the main driver of the nuclear production is oil. for sanctions, we have cut 90

percent of the trade and 30 percent of the oil. but the crude oil remains. >> there it is. kick north korea out of the un. do something with the oil and the third part is, enable blocking cargo ships and the un sanctions committee, they targeted for such ships and the investors as their 20 nations on this effort trying to do this. cannot try and strangle them? >> eric, the two of those introductions is perhaps more likely. there's just no way you know, i don't know that it has ever been done the un kicks out a country. i mean we had world war ii, we had a lot of awful things happen and no one has been kicked out of the un. i think it is highly unlikely. as an introduction, i think it is more likely. carson kressley predict and someone pulls out a gun and starts shooting. is that an incident that then

begins the escalation, some little thing happening that gets very serious very quickly that no one actually wants to have happen. because no one was to have an accidental war. there are some trade-offs here. they have to ask yourself, how much bang you get for the buck. if you stuck 20 more ships will that change things? there is no simple answer here. every choice that you have, has potential benefits. but i think we are pretty sensitive because in a case that involves nuclear weapons. >> i will point out that on behalf of red china, taiwan. they were dumped. the problem is the un is that they let anyone in.no matter who you are. dictatorship or certainly an enemy of your own people, you are still a member. >> and i do not think that will change. >> okay jim. it does not seem that this

crisis with north korea will change anytime soon. thank you. >> thank you. >> national security advisor, hr mcmaster talking at the reagan national defense form. you heard moments ago on north korea. mcmaster had a lot more to say about potential threats our nation faces. and an arrest warrant issued for the undocumented immigrants found not guilty of killing us citizen, kate steinle in the case that sparked the same tri-cities debate. what can happen to him now? >> i'm glad the jeff sessions is issued a warrant. they will get this right. the feds do a better job with prosecuting. that is why i do not like any of these cases like this in the state courts.

concern here at the defense form. the u.s. navy is short 41 warships and 90,000 sailors than it had on september 11, 2001 when the major focus right now is readiness of the us military. my colleagues are hosting a panel as we speak. earlier they spoke with the air force secretary who said, the us air force was to go to war with another country you should expect a lot of casualties. as 70 percent of the marine corps hornets cannot fly, after the air force bombers cannot fly. half of the air force jets overall cannot fly. the air force is also short 2000 pilots. the navy is short 50 percent of the f-18 hornets cannot fire an apparatus 542 jets that cannot fly. so jennifer griffin's panel is wrapping up and we will report the latest.

new warrant for the rest of jose garcia zarate. will carr is live in los angeles with more on this very disturbing case. >> the doj announced the twist in the case on friday issuing an arrest warrant for jose garcia zarate who had been deported five times for he fatally shot kate steinle in 2015. this week entering san francisco acquitted jose garcia zarate of the most serious charges he was facing. he was convicted for possessing a firearm and remains behind bars. his attorneys argued during the trial that shooting kate steinle was a freak accident. the president immediately criticized the verdict tweeting a disgraceful verdict in a case. no wonder people in our country are so angry with illegal immigration. and then the attorney general jeff sessions. >> it is time for this country to get its head on straight. these cities should not be protected criminal aliens. >> you may remember that jose garcia zarate was released from
