and this is "americas news headquarters". >> the president tweeting again about michael flynn and the former fbi director. that he fights and that quote - i never asked james comey to stop investigating michael flynn. just fake news covering another james comey line. senator dianne feinstein, top democrat on the judiciary committee, says the presidents legal problems may be getting worse. >> i think what we were beginning to see is the putting together of a case of obstruction of justice. >> garrett tenney live at the white house. >> the president has had a lot to say about michael flynn and the fbi over the last 48 hours really. but one of the tweets has landed him in hot water with congressional investigators. yesterday he posted this tweet in which he said, he fired general flynn because he lied to the vice president and the fbi. to some that look to be an

admission that the president lied to the fbi and then still then asked the then director of the fbi, james comey, to go easy on michael flynn. we now know that that treatment was written by the personal attorney wrote a long flowing social media director to post it on the presidents account. he told fox news he was simply paraphrasing and adding a statement i am out of the tweeting business. i do not mean to have fakeness. that is entirely correct but it is said i do not know why he lied. he did not need to. and while the white house is trying to downplay the significance of michael flynn cooperating with robert miller's investigation, today, lindsey graham said that michael flynn also that she has a key role in this investigation and bring it to a close. >> there is no evidence of collusion, no one has been charged with it. we found the one person who would know if it did exist.

so it won't be long before we understand one way or the other whether trauma people collude with russia because i can imagine it happening and michael flynn not know about it. >> we also learn more today about the fbi agent who was fired from special counsel robert mueller this summary of dissenting anti-trump messages to a colleague. the agent is a former deputy director of the fbi working on a number of highly political investigations including that of hillary clinton's private email server. fox news learned that the justice department's office of inspector general is now reviewing the cleansing investigation, the gentle rush investigation, the dossier and the justice department not contacted house investigators in congress to set a date for - to meet with them. >> thank you very much. eric? >> not to tax reform. after the senate passed the bill in the hours of yesterday

that we would be in this position when i started in may. i wanted to make sure people had a voice that had not had a voice in a while. alabama is at a crossroads. the contrast between me and roy moore could not be greater. >> brian is following this race from our new york bureau. >> you know, two weeks ago a fox news poll had democrat, doug jones, at eight points over the republican, roy moore. in a teenage sexual assault allegation. this week a brand-new washington post poll shows the two candidates are neck and neck. the survey shows doug jones has a slightly, 50 ã47 percent over judge roy moore. this is closed and within the margin of error of 4 and a half points. the poll also shows alabama voters are divided over whether or not they believe the sexual abuse allegations against roy moore while 35 percent believe the allegations, 37 percent say they are unsure, have no

opinion 28 percent said that they do not believe the women's allegations. meantime, today, roy moore attended the guiding light church outside of birmingham and an african-american church with a pastor that made it clear he is pro-life and anti-gay marriage. roy moore spoke for a few minutes but nothing campaign related and avoided questions from reporters after. the elections on december 12. just four days before election day, the president is hosting a rally in pensacola, florida. less than an hour right away from mobile, alabama and in the same media market as the race. the white house has been walking a tight rope with supporting roy moore committees allegations to the white house as the president would not campaign in alabama for roy moore. take a listen. >> hi, this is just six i am excited to invite you to an event in your area. a rally featuring president

powerful. meanwhile media movie personalities were probably fired after accusations of lewd behavior. as we know, not so with these guys, the accused politicians in washington. top democrats still calling on this man, michigan congressman, john conyers, to step down over mounting sexual harassment allegations against him.but he remains defiant. and now there's a bipartisan effort on capitol hill to try and make lawmakers accountable for their actions. ellison barber explains. >> so far, none of the lawmakers accused of sexual harassment or misconduct have lost their jobs on capitol hill. in the case of republican candidate, roy moore, the chance at a future job on capitol hill. majority leader, mitch mcconnell previously called on roy moore to drop out of the race today. he says alabama voters will decide. >> there has been a lot of discussion about it. they will make a decision a week from tuesday. the ethics committee will have

to consider the matters that have been litigated and the campaign. should that particular candidate win. >> would allegations of sexual misconduct came out against some of the private sector, many lost their jobs. the same cannot be said for the lawmakers. but all are accused of some form of sexual harassment. and making unwanted advances on a campaign staffer. and franklin corbin woman, conyers harassing former staffers, and forming a claim with taxpayer dollars. and in one case money came from the fund managed by the office of compliance. >> another all totals as his 1995, there have been 268 claims paid. we know the total is $17 million. how that breaks out with different types of complaints and settlements, we do not know. >> that is not the focus of the bipartisan legislation with the goal to end it and name people.

>> i think the fact that in his factual base for the plea, he sets out that he was not acting as a rogue agent. in fact, he was acting with the knowledge another direction in the transition team. i think probably all of which ultimately ended up in the administration is very significant. >> what does this mean? where is correspondent jeff mason joins us now. jeff, in a report, saying that the general plan was drafted by jared petitioner, to contact them why would this be significant? >> would be significant if it turns out to meet you because jared petitioner of course, is not someone that you can say that he left the administration after 24 days. he is his son-in-law also. so a very important figure in the white house.

also a very important figure in the campaign. >> others are saying of course, that this is the transition. that it is appropriate and responsible for members of the transition like michael flynn, two do this as a try and start to prepare the administration. have been covering the white house a long time.what is your view on that? >> i do not have a view on that. i think it will come down to what robert mueller determines was legal or not. as he said in the intro to this, part of that against flynn, that he pled guilty to suggest that he is being useful to the special counsel and he may have information to use against others either in the white house or who were part of the campaign. that is a question that we don't know. only robert mueller knows this. >> it could be the tip of the iceberg. that he pled guilty to this legend, low-level type action.

the others are saying that no, that is all i got, he doesn't have anything else. >> a lot of people are reading the tea leaves but all we can do is look at what has been done and look at the fact that others within the presidents orbit have spoken to the special counsel. and no doubt, may continue to do that. so there is more coming, no doubt. the white house has said that it is confident that this investigation will be wrapped up soon. i'm not sure where the confidence comes from but we certainly i think, can expect to see more coming up from the special counsel. >> it does not seem that it will be wrapping up soon at all. the president tweeted dated that he did not ask james comey to stop investigating michael flynn. it can get down to he said he said. do we know where this angle of the investigation is going and when it collides, what will happen? >> that is one of the open

questions. at what point does everyone move beyond what happened in the campaign to what happened in the white house and that includes with when michael flynn left. inquiry includes when he fired the then fbi director, james comey. what went into the decision and all of those things. i think what also seems to suggest investigation is not about to wrap up, but there is no way of knowing. but we do know is what they have done so far. and what that indicates about what robert mueller will perhaps do in the future. >> apparently something that may be part of this is that a resolution that the obama initiation abstained on by michael flynn recording mueller to get russia to vote no or delete the book. this morning, jared petitioner was at the transacts event.

did that. again, as we were saying earlier, he is a very important figure in the white house. though his portfolio has shrunk, he is deleting some very important pieces of the presidents policy. not the least of which is outreach to the middle east in an effort to reach some middle east peace deal. he remains an important figure in the white house and what happens with him, it will have a big impact on the white house in the presidents presidency going forward. >> he did express optimism that they will be able to get a peace deal. he talked about the team working on that and he also said d.c. is a different place. >> it certainly is! >> he is from new york and sees it that way. >> thank you. good to see you. >> my pleasure, thank you. >> knew legal action in a sexual assault case. this made national headlines way before the current wave of washington, hollywood and media allegations.

university swimmer convicted of sexual assault last year once a new trial. brock turned his attorneys have filed an appeal. they say this was a detailed plan for allies. he was accused of assaulting a

woman. >> you remember brock turner case sparked outrage across the country and really put a spotlight on sexual assault on college campuses. the former stanford student and champions of was found guilty in march 2016. his attorneys are now arguing that his trial was quote - fundamentally unfair. most one third of their appeal focusing on just how drunk the victim was the night of the assault. two graduate students were on but the pattern is it is taking place. he was on top of the woman and they chased him down and held him until police arrived. turner face 14 years in prison but was only sentenced to six months in the county jail on probation. a decision that many found to be far too lenient. then the da releasing statement that doctor received a fair

against his religious beliefs. jack phillips name says that forcing him to bake the cake would violate his freedom of expression and religion under the first amendment. but the couple that he turned down, david and charlie say refusing to serve them is simply illegal discrimination. the dispute has worked its way up to the supreme court which will hear arguments on tuesday and one of the most closely watched cases of its turn let's bring in our legal panel after former prosecutor robert check her now a defense attorney and rachel, a trial attorney. and robert, first on this one. is this case about religious freedom or civil rights? >> is more whether or not it is civil rights. because phillips is saying that his civil rights are being infringed by colorado's antidiscrimination laws and says that he wants to have a -- which is you cannot is going about someone's creed or sexual

orientation, etc. for the problem he is running into is that he never found out what the cake wanted to say. he told them within 20 seconds of meeting with them, i will not make a cake for you. i think that is where it is going to be an issue for him and being successful there. >> rachel, is this religious remorse civil rights? >> i think we need to look at this as a religious exception to civil rights. what they are trying to do is process and violate their civil rights by saying that this is against my religion. unfortunately i do not think that he has a leg to stand on here. because a market transaction has never been covered by free speech. and so, when he's not even find out what they wanted to put on the cake and within 20 seconds of meeting and said, i do not believe in what that is, i think that it runs afoul of the antidiscrimination laws in

requiring me to adhere to the state law. however, the law is clear that says, if the law on the books apply equally to everyone at the same time and across the board, and individuals first amendment rights will not check for having that loft or not. so send this infringes on my freedom of speech, first amendment rights, my rights religion is not going to cause the entire legislation to be thrown out in colorado. >> rachel, talk about the president that can be set. >> hopefully the president will be that it is discrimination to not serve people based on sexual orientation. because then what that does is it sends it down a different path. if they rule in favor of the baker, what you potentially have is also a bigger who could decide that they think catholicism is wrong and is of the devil and that it is

sacrilegious to perform any type of catholic rights so they will not bake a first communion case. it leads you down a dangerous path of discrimination for the wrong reasons and while free speech is absolutely protected here, market transaction has never been considered to be free speech. we are not forcing this guy to bake a cake and write something on it that he does not believe in. we do not force that. we do not force t-shirt manufacturers to print t-shirts with messages they do not believe in. we have here is a man that within 20 seconds of meeting a couple, decided he was not going to serve them.that was based on their sexual orientation. which has been made in this country, and under colorado law, wrong. >> robert, what is the likely outcome? let's i do not think that mr. phillips will be successful here. i think it will be close. probably you look at the breakdown of the way the courts are situated right now in regards to everyone reading the tea leaves and who will go

tensions because they want what kim jong-un wants. they want us to stop the joint military exercises with south korea as well as stop deploying the thaad missiles. >> is the way pyongyang interprets the extreme military action which takes the form of large-scale maneuvers and exercises by the united states and allies including sending strategic bombers, naval taskforces and carriers to the region. additional destabilizing factor in the region is wrapping up the territory of the republic of korea. elements of the american antimissile system, thaad. >> you just heard it. what is the chance of us not conducting these military exercises and there are some starting this coming week. they want us to curb them back. >> there is zero chance that we will give in to such outrageous

threats. there is no sane person, including in moscow or beijing, who believe that we have any intention of attacking north korea to conquer the place. the only reason we would use military force is to get north korea to stop its nuclear program. and we will move closer and closer to that of china, in particular, but also russia which has a border with north korea, does not act to cut back oil and other strategic materials that are keeping north korea "war machine" going. >> did not show any signs of doing that. nikki haley indicated at the meeting that 90 percent of the trade has been cut off with north korea. she's a 30 percent of the oil. one third, there still get into thirds and she also pointed out that in 2003, china did cut off the oil. an important victory to the negotiating table. so your predictions ambassador? do you think that china will shut off the spigot and will north korea go to the negotiating table or will they have a nuclear weapon?
