franklin announcing plans to resign from the senate after mounting sexual misconduct allegations but he also took some jabs at the president. garrett tenney with the latest. you said he is going to resign but not quite yet. >> no exact date but it will be in the coming weeks. several key votes on the senate floor the democrats don't want to lose him 4. more than a half-dozen women have come forward with allegations of sexual misconduct by our franken, he is an advocated champion suggesting he is only stepping down now because he wouldn't be able to effectively represent minnesota going through a senate ethics investigation. >> i know in my heart nothing i have done as a senator, nothing has brought dishonor on this institution.

immunity? >> spousal immunity is there, as far as a parent and child there is no recognizable privilege that prevents a parent from giving information about a child. heather: there are spousal privileges. >> and patient doctor privilege. lifted in the evidence rules, specific what they are. they have to comply. and continue to refuse to do that, that could put the case in jeopardy. >> the judge was a female, they came from a different country they refuse to testify with a female judge, ordered them in jail for 6 months, they still refused to comply, after a year, i am going to have to release them from jail but it won't get
