suspicious. pete: a lot of this has started to add up to feel suspicious. we have heard previously that james comey wrote that famous exoneration memo of hillary clinton months before she was interviewed. steve: two months. pete: before many people were interviewed. we are hearing from senator ron johnson because they have pushed to get these documents is what the original version comey draft letter looked like versus what comey actually said. that's a new development we have this morning presenting more evidence. ainsley: if you were making that statement it was going to change the election and change the course of someone's life, you are going to go through it with a fine tooth comb and do it properly. that's what i assumed he did. the question is though was he doing this to water it down because he was a fan of hers? based on other things in the fbi it just seems so shady. many people have questions including senator ron johnson. he will sent a letter to the current fbi director to chris wray. he said it looks like these i had did its appear to change the tone. for instance, the gross negligence was changed to

extremely careless. then another. steve: we have the graphic right here. ainsley: okay. steve: what comey's statement originally said about gross negligence. quote, there is evidence to support a conclusion that secretary clinton and others used the private email server in a manner that was grossly negligent. that's the criminal negligence with the respect to the handling of classified information. but, instead what he said was given that combination of factors, we assess reasonably, likely possible that hostile actors gained access to hillary clinton's private personal email account. so, in other words, they were trying to say she was probably hacked and that was reasonably likely that hostile actors, they wanted to do that instead they changed it to it's possible. pete: it's possible. it's actually a six or seven page document posted on multiple sites. look at the comparison from what was i had did ited from what was actually said. we ever talking about

reducing hillary clinton's culpability in the scandal. removing references to the intention community. because when you start talking about the intelligence community that raises suspicions about what really was the intelligence level, classified, very classified. they downgraded as you said the likelihood that spies had penetrated clinton's secret server. they took out a whole paragraph that talked about how unsecure it was. then they also deemphasized the shear volume of the emails. when you look at all those edits put together. and you know who was behind that edit and a lot of those edits peter strzok. you look how politically behind minded they were. how much they hated trump and loved hillary clinton and then you look at all those chings it, doesn't change. it doesn't feel like forensic examination. steve: two months before they interviewed hillary clinton and two months before they interviewed all the other people. newt gingrich, former speaker of the houses there is some problems here that somebody has got to get to and fix immediately.

us in five minutes to talk about how there is something going on at the fbi and at the department of justice. pete: some people are calling for a special counsel. newt gingrich is being even more aer is tia saying it shouldable our own attorney general. this justice department does not need to recuse itself from looking at what the clintons did. that's not their dirt. that's dirt of a previous administration that could have been politicized. it's time to stand up and really find out what happened. more and more of the american people feel that way as well. ainsley: yesterday there was talk that marco rubio might not support the tax bill that they are hoping the senate and house are hoping to get on the president's desk before christmas. the president is saying that's not drew. he definitely thinks rubio is going to be on his team. the reason he was possibly thinking about voting against it doesn't include the child tax credit. steve: it does but just not enough. ainsley: doesn't include enough. correct. steve: right now it's at $1,100 in the republican plan. keep in mind, it was about two weeks ago it sounded like it was going to be

$2,000 per year per family. he wants more. look, at the 11th hour, this is how they negotiate. he is saying okay, 1100 is not enough. some people behind the sceengs are saying okay, mr. florida senator, what's your snub? pete: we hear reporting now from our own chad pergram the bill has moved in rubio's directions inside conference and it is, i believe, locked. it's not close to locked, which means the house and the senate have come to a complete deal for the exact same language because that's what's required for those bills to then go back to the house and senate and vote on that exact bill. you know what i haven't heard a lot about is whether the individual mandate is included in there or not. steve: it is. ainsley: if you don't want to be a part of obamacare, you don't have to be and you are not going to be penalized. steve: one thing did i read this morning the president, when he was campaigning, he was talking about how he would like to get rid of the johnson amendment. and the johnson amendment keeps churches and religious folks from essentially

talking politics from the pulpit. there had been some suggestion they would get rid of that with this. but, at the 11th hour they have decided you know what? even though he wants it, it's going to cause much trouble. ainsley: excuse me. i have to talk. pete: you like most of america are struggling through something right now. ainsley: i don't know what it is. i feel great, it's just my voice and my throat. steve: that little passage right there we have got to pause because i got a cough. that's going to wind up on the internet. somebody is going to take a little bit of that. steve: the reason we mention that is because well, as of yesterday, the internet he coulded according to many members of the media. cnn as we know it that's just mouth it. because by a party line vote 3 to 2 the republicans in charge of the fcc essentially got rid of the obama era net neutrality standard.

pete: obamacare moved in 2015 to basically treat the internet as a utility. the government says that opens the deal up to a great deal of regulation. they have done a nice job calling it net neutrality. there is points on both sides. both sides in his administration did did on jimmy kimmel had though this to say about net neutrality. >> fcc did something an absolutely despicable today. voted to put an end to net neutrality. this is the rule that says everyone gets equal access to the internet. a big company or somebody selling crocheted owls from their house in the midwest. as long as they are telling us they are doing it now. internet providers will be able to slow down or block web traffic to any website or streaming service they like which benefits of the big tell con companies and does the opposite for all of us. thank you president trump. thanks to you and this jack

hole you appointed to run the fcc. big corporations are about to take full control of the internet. merry christmas, everybody. ainsley: explain all this for you and your family. steve: it's a little complicated. all you have to do is before net neutrality, the internet working fine. this deregulates it and returns essentially big parts of it to the free marketplace. ainsley: what it would do. democrats are up in arms about this because it prevents someone like a comcast or someone like a big internet company from charging different prices gengsding on the market. they might charge an area that makes a lot of money than they would. steve: charge netflix more if you are going to stream more. this ultimately helped google and netflix. now essentially they are saying the big internet companies charge more. ainsley: this takes the government out of it less

government. less government for the free market. >> i wonder if jimmy kimmel got his talking points from chuck schumer. steve: did he? pete: become an organ for the democrats. goal to the "wall street journal." did a nice job laying out why this changes all about freedom as you talk about. deregulation, opening up a space. it opens up for innovation and things that trump administration have been -- believe have been stifled under so-called net neutrality. so, a lot of debate will continual. we get to ask the man himself who jimmy kimmel called an ajack hole. you always win an argument when you call people names. steve: i had to look that up just saying. it's 6:11 in new york city. jillian: happy friday. we made it get you caught up on headlines this morning. this is a sad story. we now know the name of the first firefighter killed while battling the wildfires raging through southern california. he leaves behind a pregnant wife and 2-year-old daughter evey.

director james comey email probe was watered down. next guest says it wasn't just a simple edit but all part of a deep state plot to keep president trump out of the white house and get hillary clinton elected. here to explain former chief counsel for the senate intel committee and the attorney for that fbi informant in the uranium one probe victoria tony'sing. >> good morning. good to be here. steve: who is behind this? >> well, let me just tell you that these events that we have been seeing over the last year but now recently are just terrifying because it's really threatening the integrity of our justice system. we now have facts that show us it's very clear that top officials at the comey fbi and the obama justice department are r. harbored such animus towards donald trump they hachesd a blazen plot to do two things. one to corruptly clear clinton of crimes. steve: before the election. >> before the election and they did that in july 2016.

ainsley: quick headlines this morning starting with a fox news alert. isis making another christmas threat. the terrorists now calling to set washington, d.c.'s national cathedral on fire. isis propaganda like this might have inspired terrorist suspect akayed ullah. is he accused of setting off pipe bomb in new york city subway system on monday. and a new york woman is accused of donating to isis, sending $60,000 in bit coins. the feds say that she bought the online currency using stolen credit cards.

officials saying in total she sent $150,000 to isis. she was arrested while trying to join the terror army in syria. steve: look at that with light saber in hand the most anticipated move of the year blasting theaters today. "star wars" the last jedi. the latest installment of the stars saga has fans of the franchise excited. but is it out of this world? here with his review is fox news contributor kevin mccarthy who apparently not in line to watch the movie because have you already seen it. what are you wearing? recent ones the force awakens by j.j. abrams. this particular version is directed by ryan johnson. this is now episode 8 the last jedi. i'm going to break this review down in positive and negative. i will say to the audience there will be absolutely no spoirms in this review. this is a spoiler-free review. on the positive side, the action seens are absolutely amazing. this movie contains one of the greatest "star wars" themes i have ever seen in the franchise. so much so that i was in the theater with grown adults and we were all cheering and geeing out beyond belief. this scene is a fight scene. it will blow your mind. the performances incredible. i love adam driver as kylo dresden. i love kelly wawrn. the cinematography. he makes classical effects and cgi masterfully. those are the positives for the last jedi. now we have to get to the

negatives; unfortunately we have to get to the negatives here. in my opinion the first act of this movie is way too slow. did i not like the direction they took luke sky walker. in my opinion at the end of episode 7 we see this scene when ray walks up to leukemileukemia luke skywalk up. hes did not need to be a grumpy, unnecessarily comedic character. that was a really, really poor direction in my opinion to go with that particular scene. also, it just didn't feel at the end of the movie i wanted to see another episode. at the end of episode 7 i couldn't wait for 8. steve: how many stars. ainsley: you really like it. how many stars? >> i gave it a 3.5 out of 5. it's a stylish "star wars" film not a great "star wars"

film. it's 2 and a half hours. you will enjoy yourself. i just didn't love it as much as the force awakens. i will say empire strikes back. new hope. return of the jedi, force awakens and then this movie. steve: buzz feed list. pete: seen all of them. steve: kerry fisher did. >> she did complete all her production on this film, steve. i don't know what's going to happen with episode 9. i will say she was supposed to be a part of episode 9 but she did not obviously shoot those scenes. episode 8 she did complete before the release date. steve: okay. r 2. thank you very much for joining us live today. ainsley: thank you, kevin. these directors need to hire him to come and say watch the movie and tell me what you like and don't like and we will change it because he is such an expert. pete: he does do a nice expert. ainsley: he married a movie critic, too. pete: he married the perfect person. she was the get away driver

this point. rates will be lower. pete: rates will be lower. >> but still seven brackets. pete: income brackets different? are they just lowered at every bracket or could you be moved into a different bracket? >> no. they have shifted as well. with the point of trying to bring everybody down just a little bit. pete: got it. steve: what's the final verdict with the state and local tax deductions, larry emailed us. >> well, all of us have had our fingers crossed on this one, all right? steve: salt states. >> what it looks like the final plan is going to be, $10,000 of salt deduction. however, it's not going to be limited just to real estate taxes. that's what the talk was. now they're going to allow that deduction 10,000. it could include real estate taxes, income taxes, sales taxes. so a little bit of flexibility there. steve: you had a suggestion we were talking earlier before we started the program and you suggested if you could prepay next year's property taxes, do because then you can deduct them

this year at the full amount. >> that is a possibility. so what we were talking about is individuals are cash basis taxpayers. which means if you pay for something in a certain year, you would get the deduction in that year. so, with real estate taxes being limited or knocked out, depending, you could potentially prepay 2018. however, that's a gray area because the irs could turn around down the road and say that's tax avoidance. steve: of course. >> because the motivation there is not to pay the tax. steve: the moat ration is to help the federal government. pete: get that money in there. all in how you spin it what does the tax bill do for seniors? all she hears about is middle class. >> so seniors per se are not cankd out anywhere right here. what it really comes down to is income levels. so, if you're a high income earner, and you're a senior,

your age is not relevant here. so, it really is based upon your income levels, not your age. ainsley: but if you are on a lot of medications and a lot of seniors are, aren't there some tax breaks for that? >> there was talk that the medical deduction was going away, which would have really hurt a lot of people, particularly seniors. however, that deduction is back as far as we know right now. so that's a good thing. steve: you know, i was watching one of the other channels yesterday, and the wrap on the tax plan for the republicans is that it's just a great big give away for the wealthy. is that true? >> no. it's really not true. it's particularly not true if you are a high income earner and a high tax state. it's definitely not true. i know the president was talking about this is going to be a big fat christmas presence. a lot of people are getting caught particularly high income earners. ainsley: do you mind sticking around because a lot of people have questions.

it's been in place for the last two years. protected consumers against bad behavior from internet providers. for instance have you comcast. largest internet provider. have you verizon. and 30% of everyone who has the internet. they just have those companies might have a monopoly on it. 30% of people who had the internet don't have a choice. there is only one company that they can choose from. they are scared they are going to raise rates. steve: right. you know, if you looked at cnn.com yesterday. you saw that what they did was the end of the internet as we know it. ainsley: hogan, what's senator lee's beef with this? why doesn't he want to support it. >> i'm not sure. the negotiations are ongoing. obviously, we are trying to get this through before christmas, as you just mentioned. we want tax cuts for christmas here at the white house. we want the american people to be able to keep more of their own money. this tax bill does that obviously the president's three main areas of concern were the tax code was just too big. it was too bulky, it was too confusing. that's been addressed in this bill. we wanted tax cuts for the middle class, the president demanded that he has got that and also bringing down the corporate tax rate. something else the president has demanded. all those things are in the bill and we hope to get the bill to the president's desk as soon as possible. pete: a lot of expectations on that, no doubt. we have got to get your comments on a second topic as has well. new documents showing that then fbi director james comey and others including potentially peter strzok watered down his remarks. you recall there was the early will i draft that james comey put together that exonerated hillary clinton before she was even interviewed. now we are getting more evidence out from senator

thank you for joining us on this friday. >> good morning. it's good to be here. ainsley: it's great to have you, god bless you. amen. so why do you say that this is great for families? tax reform? why are you a big supporter of the president? >> oh, this is so simple. i call it the win, win, win principle. it's going to win for my family. we are going to get a refund of about $3,000 or more, which will allow us to pay our bills off. i got two kids in college. pay that off. and even invest some in our investments and as entrepreneur, you know, we can expand even our business. it's going to win for my church because we pray for the president every tuesday. we have a prayer ministry called united to pray. we can do more of giving and as opposed to going to make a living. and then thirdly, work for our community because now more jobs can come in with this tax cuts as entrepreneurs. we can hire more, expand. it's just a win, win, win. that's three wins. that makes a win for the

president. a win for the congress. and the win for america. ainsley: bishop, how did you meet the president? what did he say to you on wednesday when you were at the white house? >> he was first and foremost he is just a down to earth person. he was glad to see us. i met him before on the campaign trail as a surrogate. opened up in the campaign for him. good to see him but he was so inviting. he talked to my children. he talked to my wife. it was just so good to be there. it was an honor and definitely an extreme pleasure just to have my whole family there. ainsley: you told our producers yesterday that you have had some negative outcry from people in the black community. tell us more about that. what is your message to them because you clearly support the president. >> yeah. you know, there always is going to be some cynical people. we got called some names, you know, uncle tom, coon, those names are not needed. my thing is. this we need to pay

comey on the election as the election is approaching. all of these allegations that president trump then candidate trump made sense to his campaign about hillary clinton and the e-mails and so forth. on the fbi was in the rare position of almost determining the outcome of the election and what was their first impression. their first impression was that she was grossly negligent. why is that important? because gross negligence. steve: that's what they wrote. >> it is the entry-level criminal copability. in other words, if you're grossly negligent, it's possible that you're guilty of a misdemeanor in terms of handling the server and the e-mails and so forth. but as he approached his public proclamations about it, it was reduced from gross negligence to extreme carelessness, which is not a crime. so it was a very, very significant move. a deescalation of the fbi very critical appraisal of hillary clinton and handling her e-mail. it exonerated her and

propelled her candidacy until he got involved again until later on when he found another computer and more e-mails and had to investigate it just a week or so before the election. >> peter stroke and others had shown to be partisans. everyone is allowed to have their own political allegiance but were involved in that writing. ultimately it lands on the desk of james comey. but is it worth going back investigating the investigators? >> that's the most part of the question, pete. that if it isn't bias, it is at least extreme inclination to favor clinton over trump. which is distressing when you figure these are the same people investigating president trump with russia gate and so forth. to me, though, this is what we should be concentrating on.

despite the expenditure of $8 million and all of these smart people, what have they come up with? people point to the indictment of paul manafort. sure. but that was about business dealings that predated president trump's candidate. he had nothing to do with president trump. they pointed general flynn. michael flynn and his plea to lying to federal investigators. again, that is about general flynn. that's not about president trump. so where do we sit this morning? we sit in a place where despite all of this effort and all of this bias with absolutely nothing with the collusion with so-called russia's -- steve: geraldo, there is collusion. it looks like there's collusion between equilibrium's department of justice and the clinton campaign. >> whether or not it is, steve. whether or not it is specific cooperation or.

>> newt gingrich is saying it's time to investigate that. that's where the real collusion is. >> do we care about the 45th president of the united states being a success or not? are we going to continue to look backwards and all of this crap? we can now encourage this president to get his tax plan passed. ainsley: you also want to hold people accountable if they do things wrong and shady. >> i care much more about shouting from the rooftops. there's no more there. at what point do decent people say enough? the problem with special prosecutors period, and that's why i absolutely oppose the appointing of another special prosecutors to renew these controversies that we've been talking about this morning. they are self perpetuating. they are funded, they are empowered, and they tend not to know when to stop. when to quit. at what point do you say. okay. i did it. here's paul manafort. he was a crook. and now let the president be the president. >> but to ainsley's point, if

you really want to restore faith in the fbi and the justice department. then you have to strip out that bias. and say trump's innocent, and we're going to sweep the rest of the stuff because we want to move on. it doesn't restore faith to anyone who used the justice department as a weapon. >> when was the last time -- when was the last time in anyone watching now. when was the last time you saw our special prosecutor say okay. i've done it. this is the job. we're finished. i found what i found. i didn't find what i find. let's go on. goodbye. it never happened. just like a city job. nobody ever creates a city job because you get paid, you get a pension, you get taken care of, you get dental, eye care. no one ever quits a special prosecutor. >> speaking of a city right over here port authority beginning of the week we had a guy try to blow up a bunch of people on the subway. thankfully, he was not successful. he got into our country by

chain migration. so if your family had 17 kids, all of them can come in, all of the grandparents can come in. what do you think about it? >> well, first of all, i was absolutely agonizing over not being in new york on monday. i was in cleveland, our new home. and i felt so much for time square a block away, and it was awful what happened. and thank god he was an absolute bumble bum that he blew hideous own belly. i want them all to end that way. on the issue of immigration, i think the visa lottery has outlived its usefulness. i think that when you compare the visa diversity lottery recipients, winners with the dream act students, for example. talking about groups of immigrants. one is absolutely unvetted or only vetted after the fact.

law-abiding. it's a crazy violent place. but chain migration, i think you have to be reasonable about it. if a dad comes, he should be able to take his wife. but a guy comes. i mean, his auntie, uncle, nephew. steve: where do you draw the line? is it four people or 40? >> it's the core family, you define it in a reasonable way without getting stupid. i think the uncle and the nephew and cousin and so forth, it absolutely the concept. i'm a very, very fierce pro immigration advocate. i think the country is strengthened by it. i think our diversity is our strength. but we also want to bring people that add to the pot. you want to bring in the people that have -- they're going to make the google. they're going to make the factory, invent a new gadget.

worry. what is jimmy kimmel wrong about this? >> he's getting everything wrong about it. the free and open internet we had prior to 2015 is the one we're going to have going forward. and that kind of name-calling and hysteria is disappointing, but it's not surprised. those who have said the internet as we know it is about the end as people send e-mails, check on their twitter accounts, post on facebook, and the like. we have a free and open internet going forward and the fcc and the ftc going forward are going to make sure that happens. >> boil this down for us because it feels complicated because one says net neutrality looks fair and equal. yet, what you have done has opened it up to a free and open intent. simply put, what are people missing. what does this boil down to? >> what it boils down to is should the government micromanage how the internet works? for 20 years before 2015 starting with president clinton, we decided "no." we wanted to have a free-market approach in which innovators could innovate and consumers could benefit. and the results speak for themselves. companies like facebook and amazon and netflix and google

became global giants precisely because the government wasn't involved. that is the light-touch framework to which we are returning, and that's part of the reason why i think so much of this hysteria is simply misplaced. as we will see going forward, getting this regulatory system right means better, faster, cheaper internet access to all americans across the country. ainsley: so i heard earlier that 30% of america only has one choice when it comes to their internet choices. so does this mean that those companies -- they're not going to start raising rates on those families, are they? >> two different points. number one to the extent that lack of competition is an issue, and i've seen that for myself in parts of the country. the solution is more competition. not heavier government regulation that makes it even harder. number two, the fcc and federal trade commission are going to continue to be cops. so if there's any company or internet service provider that enacts competitive way, we will take action accordingly.

steve: okay. here's what i want to know. is my internet going to slow down? my internet is okay. it's a little high. is it going to slow down? what's it for me? the average consumer. >> and here's been a lot of misinformation. think about how far we have come the starting years until these rules were adopted in 2015. we went from 28k modems to gigabit fiber. so going forward, the internet is going to speed up, we're going to see better and faster and cheaper services all across the board, and that's exactly what these rules, which were after all the clinton-era rules that served us so well are calibrated to do. >> if we stayed with president neutrality and there was a president clinton, what type of regulation could we see? >> there's no question that that kind of fcc would have heavily regulated the internet even further. they would have ban, for example, free data offerings by wireless companies where

the wireless company will say you can stream data, your music, video and the like exempt from any data limits. they would have banned that and probably got into price regulation, which is essentially the government deciding how these businesses are going to operate. so there's no telling how far they would have gone. it would have been limited only by their own imagination. ainsley: you're a smart guy. you went to harvard. you're a general council for verizon. you have jimmy kimmel calling you names. what did you think of that? >> i think it's unbecoming of the seriousness of this debate but, again, it's not surprising. those on the other side have literally nothing other to pedal than hysteria and misinformation and fear than the light-touch approach that we would have for the internet'san existence. given what has transpired over the last several weeks, i'm not surprised at all. steve: before you go, the headline over at cnn, end of the internet as we know it. is that accurate? . >> it's not accurate at all but, again, that's part of having a free country.
