up next "the fox report." eric: have a good night. >> the trump administration on the cusp of its first major legislative win as members of the president's transition team level accusations of wrongdoing against special counsel robert mueller. i molly line and this is "the fox report"." trump transition officials raising a red flag over the mueller investigation. in a letter to lawmakers they accuse the special counsel transition documents from the general services administration. apparently as a workaround for issuing a subpoena. more data just a moment but first president trump heading to camp david as the g.o.p. announces it has the votes to pass tax reform. the president is celebrating what would be a much-needed

victory after his repeated failures to repeal obamacare. the president heading back against criticism that the bill would add $1.5 trillion to the debt while increasing taxes for some middle-class americans. >> if you look at the whole thing everybody's going to benefit that the greatest benefit is going to be for jobs and for the middle class. we think $4 trillion will come flowing back into the country. that's money that's overseas that has been stuck there for years and years. this is going to be one of the great gifts for the middle income people. molly: garrett tenney has more from the white house. how is the president feeling about the chances for tax reform next week? >> molly president trump is confident the congress would be able to have a bill by the end of this next weekend you can't overstate how big it would be for the administration for its first legislative victory. now today the president was talking about the economy and that has been eight and went for

him and his administration but he says tax reform will allow the u.s. to take its economy to a whole other level. >> i will say because of what we have done with regulation and other things our economy is doing fantastically well but it has another big step to go and he can't take that step unless we do the tax bill. >> in terms of what the growth would look like the president said the economy can go from the current 3% growth a year to four, five or even 6% of that would name trillions more dollars in the u.s. economy. molly: what else do we know about these new accusations against the special counsel investigation? >> today an attorney for the trump transition team a key special counsel robert mueller's team of acting inappropriately in painting some of the transitions privately-owned material data in a letter to the

congressional committee charged with government oversight. the attorney claims mueller's office went behind the transition teams back to main tens of thousands of e-mails in addition to laptops could sell funds and other materials belonging to 13 top transition team members. the letter claims instead of obtaining a subpoena going through the transition like investigators are supposed to do mueller's office sent letters to the general service of administration which provided up applies the space applies an e-mail services to the trump transition and acted as a custodian or the material and data. once mueller's team obtained those items the transition team claimed they were never informed their property had been taken. the attorney complaint any of the e-mails are protected by either attorney-client privilege and mueller's team admitted it failed to take appropriate steps to protect those clinic patients. in a letter to lawmakers at states transition teams in their members are not immune to search and seizures of that document to

records and it's vital the investigation within the parameters that preserve legitimate privileges many of which have the constitutional provenance. the transition team argues this could set a precedent or future transition and if something isn't done by congress for documents and the data and material needs transitions could be in jeopardy of being misappropriated by government agencies as well on this evening white house press secretary sarah sanders responded the report by saying the administration continues to cooperate with special counsel robert mueller's team and they expect the investigation will wrap up soon. molly: another fascinating week on capitol hill the garrett tenney thank you. more now on the push for tax reform. the. the house is set to vote on the final tax bill tuesday with the senate following suit either later that day or perhaps wednesday. the upper chambers expected to pass the legislation on a partyline vote after winning over the holdouts were mark roe

rubio and bob corker. they are plotting their members for keeping their eyes on the product. >> heaven forbid the american people be able to keep their own money in their own pockets. i think they will unanimously vote against it and applause to kevin brady and orin hatch the leaders of the two bodies. it's a compromise and i'm sure they are certain parts that people would want to change in there are certain things that i would want to change but the reality is more than a trillion dollars will be saved and put back into the american people's pockets. molly: caroline shively has the latest from washington. they were making changes right down to the wire. what's in the final till? >> 's some major cuts in some minor cuts. they had to get a few issues to get some republican senators who are still holding out. keep seven tax brackets reducing to fight to the corporate tax rate is/from 35% to 21%.

the bill also retails obamacare's individual mandates while retaining a deduction for medical expenses. the standard deduction would be nearly double and so with the child tax credit. filers who itemize to lose deductions and others are. that was going to hurt for people who use those deductions in high tax states. here's both sides take on it. >> i think the most important element that people aren't thinking about is this april 15 when you file your taxes that is the last time you will file under this monstrous broken tax bill. >> god bless wealthy people. i'm glad we have them but they don't need a tax break. people struggling to get to the middle class need those breaks. molly: the polls show it's not popular with most americans but republicans say the that will change once people see more money in their pockets. democrats say that's true if you are wealthy.

molly: do they have the votes to pass a? >> it looks like it. the houses and salad. the senate had a bit question mark but they may have republicans voting for it to two senate republicans flipped slate this week marco rubio who wanted concessions on the child tax credit and bob corker has said he wouldn't vote for anything that adds to the deficit that this bill is forecast to add $1.5 trillion in a decade that in the end corker says it's better off without them. the senate should give thad cochran and john mccain a day to recover. both are in the hospital. they said they will vote for vote for it and in there are still a few republicans while cars in the senate susan collins and jeff flake are still reviewing it this weekend. vice versa might tens pushed back just in case they need a breaking tie. molly: caroline shively thank you very much. chris wallace will be sitting down with treasury secretary dave nugent. check your local listings. a massive wild fire raging in

southern california is getting bigger. authorities say high winds are feeding the thomas fire helping it grow. as a consumes just about everything in its path. it's now the third-largest wild higher on record in california. the thomas fires linked to two deaths including a firefighter. new evacuation orders going into effect as these flames bear down on coastal communities. >> it's pretty crazy. last night about midnight i woke up to the roar of this fire coming through about 3:00 a.m.. i got most of my stuff packed. >> an hour ago was blowing really hard. i think the worst of it may have already passed us. molly: will carr has more from california. >> molly the winds beverly picked up a lot over the past couple of hours and we have fire

crews racing through the neighborhoods in montecito. that's because we have the fire coming across the ridge right behind us. that is bad news because we have a number of homes in the fire's path to the santa ana winds have really picked up and pushing in this direction and the direction of santa barbara. we been walking along with firefighters and they are doing everything they can to put out hot spots. take a look at what we have been seeing. fire crews are doing everything they can to put out any hotspots. the winds beverly picked up this afternoon pushing embers through the air starting small fires. firefighters have to come in and put them down. it's a dangerous game of whack-a-mole because once they put out once the flames another one can pop-up down the road to the data the road. with that in mind we can see fire engines in the distance. they are surrounding all the homes in the neighborhood doing structure protection trying to do everything they can to make sure the neighborhood is as safe as possible. you have an eerie light orange

molly: renewed concerns with putting its nuclear -- choose the test. the launch would come just two days after a u.n. meeting which rex tillerson backed off earlier offers for unconditional talks with a rogue nation. instead he re-iterate the white house's position that north korea must suspend its nuclear missile tests. >> a pressure campaign must and will continue until

denuclearization is achieved. we will in the meantime keep our channels of communication open. molly: bryan llenas joining me now. where does the north korea crisis stand? >> look molly u.n. security council described the situation this way to "fox news." he said bluntly there will either be a war we collectively have to extend a nuclear north korea within a year. it's a grim outlook and yesterday tillerson told the u.n. security council that north korea is going to have to change is threatening behavior that is at the least refrain from shooting missiles for a sustained period of time or the u.s. and north korea can begin negotiations. he said communication lines are open and that the ball is in north korea's court. >> the international community condemns north korea's pursuit of a nuclear arsenal and we will never except a nuclear north korea.

democratic congressman joins a growing list of lawmakers to resign or not seek re-election in the wake of sexual harassment claims. congressman ruben kihuen of nevada announcing he will not run next year. the decision coming amid accusations from two women of inappropriate behavior. kihuen has denied those claims. meanwhile a democratic candidate from kansas and her campaign for house seat. and ray ramsey dropping out of the race after accusations of sexual harassment from a 2005 lawsuit that resurface. she too is denying the allegations. caroline shively is in washington. congressman kihuen came out with the student -- a statement. >> he denied the allegations and he said he wants to clear his name but he said he still won't run for re-election. if here's a statement quote allegations that have surfaced came from a fair and thorough discussion of the re-election campaign therefore it's in the

best interests of my family and my constituents to complete my term in congress and not seek re-election. a former campaign finance aide said she quit last year after kihuen asked her for a date and sex in touch or an appropriate with another woman a lobbyist has a similar story. the house ethics committee is reviewing the cases. house speaker nancy pelosi has called on him to resign. >> i have spoken on the subject. he wants to go through the ethics process it's his right to do. >> the ethics committee only investigates current members. because kihuen will be in congress until january 2019 that investigation is still underway. molly: then there's this case out of kansas and this time it's a woman that stands accused. >> she is dropping out of her race in the third congressional. a man filed a complaint with the eeoc alleging he was fired after

house and senate where they now appear to be on the verge of passing tax reform. let's bring in alex bolden a senior staff writer on the bill. thanks for joining me and i appreciated on the saturday this saturday night. >> good evening, thanks. molly: let's kick off attacks or form because that's the big thing on capitol hill that is expected next week. the ink has yet to hit the paper and yet to dry. will we see the historic tax reform that they've been crowing about orchid something get in the way before the christmas breadline -- deadline to president trump's talks much about? >> i don't think so. there's going to be voted in the house on tuesday likely and a vote in the senate tuesday night or wednesday. looks like maybe all senate republicans will vote for this. the senate has a higher hurdle and because there's an exception made for allowing property in state and local income taxes to be deducted up to $10,000 that should bring people on board in

the house. there are some folks who aren't going to vote for it like darrell issa the republicans from california. this is seen as a major victory for president trump republicans are hungry for a win after the failure on obamacare earlier this year. molly: let's take a quick look at a couple ulla points. these are a couple of highlights that are expected of tax reform goes through. the highest bracket of 37% for individuals and the corporate tax rate this was one of the big highlights it got so much attention. the rate was reduced from 35 to 21% and also the repeal of obamacare individual mandate. that was something they wanted to see happen and republicans feel like they have managed to accomplish that as well. one of the questions is that it benefits the wealthy more than the middle class. when will the average american see money in their pockets and will that be the standard going forward as to whether or not people support ultimately

support this historic tax reform. >> rob portman the senator from ohio republican negotiator one of the guys tracking this bill he told me people are going to begin seeing benefits as soon as january because the withholding of paychecks are going to be adjusted. when you get your paycheck in january the federal withholding will be a little less than your paycheck will be bumped up a little. there will be an immediate benefit but now the question is how much of a benefit? really the question is as we go forward in years does the income disparities from the wealthy and the middle class continue to grow? if it does even though the middle class will see a tax cut next year and i think it they will be happy about will they be happy to re-bury years from now? who'll be the verdict of this bill down the road? strongest argument republicans have is to bring money back into the country. president trump said $4 trillion

or more per season that's optimistic that it is does generate economic growth 3% or 4% americans will be happy. molly: three or 4%, is not incredible? how amazing that would be. one of the criticisms of this is there's an expectation some of the analysis is that a web to the deficit. we have to decide on the 22 midterms. adding to the deficit over the course of 10 years they won't be able to quantify that certainly in time for this next election so what will matter is if people are seeing those gains. mentioned the rich get richer and the middle class c. greater disparity in what may matter is it those corporations get these benefits if they pass them on. if they hire. is that what we are looking at? if there is at boost in jobs not lose as much as they have might

otherwise? >> the biggest job creators in america are small businesses so there's a new tax rate. it's a top tax rate for pastor businesses will be a 29.6% rate. there are surveys that have been done asking small-business owners if they have extra money what would they do. they would hire more people. there's less evidence by cutting the corporate tax rate that would generate more jobs. it's more likely to go into share buybacks or dividends. there's historic low evidence that it doesn't really create jobs but there is evidence they will hire more people and that will make the economy stronger. molly: another shift now counsel for the trump transition team trump for america have written a letter to congressional committees. they argue that mueller's team inappropriately received e-mails from the general services administration, the agency

unlawfully produced private materials including privileged communications and tens of thousands of e-mails and attributed -- as this goes forward what does this actually mean? >> well i guess some people right now are trying to lay the groundwork for mueller being fired. i think there are some people who would like to see that. mark levin the conservative talkshow host, he is beating the drum for mueller to be firebird republicans on the hell aren't hill are going to get so the question is how inappropriate would this be? the trump transition team is arcing he should at gotten a subpoena for mueller team should have given a subpoena to get the documents a set of circumventing them by going to the general services administration obtaining e-mail communications that have attorney-client privilege. i'm not sure whether that is such a accusation. investigators job is to get his hands on the documents.

if it goes around the transition team it is what a good investor investor -- investigator tries to do. i'm not sure that's good enough for republicans to rally for mueller's ouster. he is worried about what he calls partisan team. very players on the team who gave to the hillary clinton for america campaign. molly: only talk about who is digging in our mueller's team if the accusation of eyes against mueller's team mueller's team. the theme on capitol hill could be investigating the investigators. their number veaux that are going to be on capitol hill and the fbi director will face the house intelligence committee next week. the demoted deputy attorney general is expected to testify on monday behind closed doors. the senate intelligence committee. when you see all of the folks that have been involved in the hillary clinton investigation of

e-mails and auma trump investigation regarding the possibility of russian meddling in the election going before investigators and talking about feelings regarding this president and of course about secretary clinton as well. what can we expect as we go into this week on capitol hill? >> now that the tax bill is going to pass the focus will turn to the mueller investigation and already you have those sides jockeying to frame the investigation and characterize it. john cornyn as i mentioned is talking about it being partisan. ted lu a democrat from colorado colorado -- california shot back and said christopher wray the fbi director has given nearly $40,000 exclusively to republicans so if you are going to attack molars team it will make the app via a more. there will be a lot of jockeying and i think another point to make jackie speier a democrat on the house intelligence committee

she is now raising the red flag warning in saying there rumors swirling that mueller will be fired before christmas and her justification is the house intelligence committee run by the publicans doesn't have any interviews set up in the new year so looks like they are ready to wrap up their investigation which could be timed with mueller getting kicked out of fire. that is pretty speculative then i think she has certainly an agenda and pushing that story where she is trying to get the ahead of the argument on the weekend. molly: we can't help but wonder about so many of the agendas being on ball then subtly different size in washington. alex thank you so much for joining us tonight. >> thanks for inviting me. molly: representative -- joined "justice with judge jeanine" to weigh in on that letter at 9:00 p.m. eastern right here on the fox juice -- the "fox news"
