now. i'm rick leventhal in for shepard smith. president trump is still on vacation but fox news has learned they be preparing to make some moves with respect to healthcare. rich, tell us what you've learned at mar-a-largo. >> good afternoon, rick. the administration according to an official is looking at relaxing obamacare regulations to allow americans buy cheaper health insurance plans. that's something that the administration is doing unilater unilaterally. secondly, the president is asking republicans to work with democrats to overhaul the healthcare system. the republicans failed to do so in their repeal and replace efforts. democrats want to improve obamacare, so it's unclear if

they can get together in 2018 and figure out a replacement for obamacare, rick. >> the upcoming agenda, much more than healthcare alone. >> yeah, absolutely. the president has tasked lawmakers with immigration. on top of that, the next issue the white house is looking at revealing a plan on is infrastructure spending. the president, according to the white house, is planning on asking the top leaders in the republican party in congress, senate majority leader mitch mcconnell, paul ryan to a meeting at camp david in the first weekend in january. there they'll discuss the 2018 legislative agenda, including infrastructure. it's unclear in congressional republicans would want to sign on to hundreds of billions in additional infrastructure spending or if we ever find out where the money will come from. democrats say they're interested in working with the white house and the republican party on infrastructure spending, but it's also inclear if democrats are going to want the help the

president a chief another legislative victory in 2018. >> what do you know about rex tillerson talking to his russian counterpart yesterday? >> yeah, the secretary of state spoke yesterday with russian foreign minister sergey lavrov. that's according to a release the statement department just sent out. the state department spokesperson, the secretary was undercoring the u.s. concern with the rising violence in eastern ukraine. the secretary requested that russian return its representative to the joint center on coordination and control and lower the level of violence. the state department also says the two discussed north korea. the russian government has offered to act as a mediator between the united states and north korea. we asked the state department for a response on that offer. they refused to respond to that. the secretary of state rex tillerson has said in the past that north korea must earn its way back to the negotiating table and a start on that would be for north korea to stop launching intercontinental

missiles and halt work on nuclear weapons development. rick? >> rich edson with what looks like the best assignment in the week. >> not bad. >> thanks, rich. when congress gets back to work, lawmakers will have to figure out where to focus first. already we're hearing about potential division with some republicans aiming for entitlement reform. others looking to focus on healthcare or infrastructure. let's bring in our political panel. noel is here with have joel green. welcome to you both. >> hi, rick. >> hi. >> noel, republicans have been struggling to get work done with zero democratic support. seems like the last thing they need is a fight amongst themselves. >> you know what, rick? to solve this mystery and they can get bipartisan support, it's got to be infrastructure. i cannot stress this enough. a lot of people thought that when paul ryan came out of the bag with healthcare, it was the wrong move and he needed to come out with infrastructure. you know what?

this will not only get the ball -- get the conversation rolling, get the ball rolling but the optics will be good here. if you can see republicans and democrats and the houseworking together to come up with a really good infrastructure plan, then the optics are going to show that we can actually get along. i think people are so sick of the right and the left, not working together and the left is always complaining that they don't have a say and they're upset about the process but they're not involved in the process, this is one way to tackle it and work together. infrastructure is very popular. >> jamu, the president seems to think that that is true, that the democrats will work with the republicans. what do you say? >> i do hope that this is an issue that democrats and republicans can come together on. not from, you know, the sake of optics but because the jobs that would be involved. the boost to the economy that could be involved. it will take.

trump and republicans not fully saying that the infrastructure spending bill would be about privatizing all of these efforts. there has to be some give and take. that's what we didn't see in 2017. so i hope that's how we ring in 2018. but we all know that really as soon as the clock strikes midnight, anything that happens in the congress next year is about what the election outcome is in favor of or not in favor of from any issue, whether it's infrastructure or the dream act. i think for democrats, it would be fantastic if we could work with republicans to take care of these dream kids that hold so much promise. i know a lot of democrats and i want it to be a clean dream act, probably won't be. that probably won't be the case. if we could get infrastructure and dream act passed in this

congress, especially since in 2017. trump and the republicans in control of every single branch of the government were only able to pass one piece of major legislation. hopefully 2018 is more productive. it will be about the election. >> my question is do democrats have any leverage in 2018? noelle, we can start with you. >> absolutely we have leverage when it comes to the debt ceiling, making sure we can keep the government running. we have to be smart about how we use the leverage. >> and noelle, you agree with that? >> i think i the republicans will have to come to the table. they have to participate. i think we're getting very tired of hearing how they're complaining about the republicans. the republicans, they are getting busy with it. they are busy. they passed tax reform. they're actively doing things. but they're doing it alone. if we have any hopes of seeing

anything on infrastructure, which i think is our best plan or, you know, health care, anything going forward, we have to do it together. this will force the issue, especially when it comes to infrastructure. not only that, we'll see private companies get involved like the trucking association, transportation companies. this will be a cumbaya moment for government in general. >> repealing and replacing obamacare department work out as planned. i'm going to guess, jehmu, you think that would be a mistake. >> it goes to about leverage that the democrats have. the other leverage are the people that have been pushing back from a resistance standpoint. i know that there are a lot of the audience that are not in favor of the resistance, but you have to give them actual credit for being responsible for not stopping or not allowing the

republicans to repeal and replace obamacare. certainly there are about 13 million americans that will lose health insurance after the tax bill that just passed. but when people took to the streets and called their senators, called their congressmen, they stopped the obamacare repeal. we've seen senator mitch mcconnell. he said its time to move on. we have a situation in the senate where it's going to be harder for republicans to pass their agenda, not easier. when it was easier, when it was a two-vote margin, they still couldn't get it passed. we see that paul ryan wants to focus on cutting entitlements, even though the president said that is something that he doesn't want to do during the campaign. so mitch mcconnell and paul ryan will have to find a way to come together. really there is leverage that democrats have that comes from the streets as well as to be able to move anything in the

>> this year is one of the worst on record for diplomatic relations between the u.s. and north korea. that's according to a report for the center of international and strategic studies. the regime of kim jong-un carried out more than 20 missile launches, including this latest one from last month. lucas tomlinson is live with more. lucas? >> rick, 2017 was a record-setting year for north korea. recalling in his new year's day message last year, leader kim jong-un predicted his nation would launch its first intercontinental ballistic missile and that became a reality with july 4th with americans celebrating

independence day. drawing this warning from president trump's national security adviser about the possibility of war. >> it's increasing every day. we're in a race to solve this problem. he's getting closer and closer. and there's not much time left. >> north korea's long range missile test last month flew 2800 miles in space. the longest and highest to date. north korea conducted three icbm tests this year, which experts say could hit the united states if they remaster entry technology for a warhead. north korea has not successfully tested a warhead to survive the intense pressures of returning from the atmosphere from outer space. south korea says there will be talks between north korea and the united states, but all eyes are on north korea with kim jong-un's new year's day message coming up monday and so far all his predictions have been accurate, rick. >> something to look forward to.

what other milestones have the north koreans marked this year, lucas? >> in addition to their missile test, they tested the largest nuclear weapon to date. a blast 17 times bigger than the atomic bomb the united states dropped on japan in 1945. but that's not the only threat from north korea according to experts. >> we spent really, you know, months and years talking about north korea's nuclear weapons. we don't talk about north korea's other weapons of mass destruction. the north koreans have as much as 500 tons of chemical weapons. >> north korean leader kim jong-un killed his older brother using a chemical weapon. >> thanks, lucas. police departments around the country ramping up security ahead of big new year's eve celebrations. comes here in new york are promising the tighter security ever for the ball drop.

will beef up security after two recent terror attacks on the still. bryan llenas is there. tell us what the nypd plans to do this year. >> hi, rick. hundreds of thousands of people will be standing out here in just a few days. the nypd promises this will be the most secure celebration in the city's history. following the two terror attacks in as many months, remember, there was a vehicular truck attack on halloween and then just two weeks ago, a failed suicide bombing by a man that used a pipe bomb in the times square subway system. both of those terrorists were inspired by isis. the nypd, we expect them to do a few things. one, we expect them to look at -- really put more scrutiny on rental car and truck rental places in and around the city to prevent a vehicular terrorist attack. we expect truck restrictions in an around times square to be more strict than ever before. barring them from the times square area earlier in the day. we expect parking garages, more

of them to be shut down than ever before as well. also, vapor wake dogs will be in place. they're trained to sniff out bombs on people and in the air. those will be in place. given what happened in las vegas in the worst mass shooting in u.s. history, there will be extra scrutiny on office towers and hoteling overlooking times square as hundreds of thousands of people stand out here. all of this on top of what will already be extraordinary security measures, including checking every single person that comes to times square. there will be 7,000 police officers and all the trash cans and manhole covers will be taken away or sealed in a 25-block radius. >> and they start planning for security the day after the last new year's for the next new year's. obviously new york is the biggest celebration but there's parties across america coming up. what about securing the other locations? >> rich: well, las vegas has america's party. the biggest celebration outside

of new york city. after this shooting on october 1 there, the officials there thought they might have to cancel the party but they will continue with the party. 330,000 people expected there. the sheriff's department tripling the security budget from 120,000 to up to $350,000 will be spent on security in the las vegas strip and downtown. some 360 national guardsmen will be on the strip and dune town. that's double last year. just to give you an idea of the security measures being taken, new security measures in las vegas, they used to have spotters on the strip and downtown. the spotters will be accompanied by snipers who will be equipped to be able to take down an attack or attacker as soon as they can in the event of an attack. >> rich: brian, i know you'll be there new year's eve. i picked a good night to take on the night off based on the weather. >> finally a night off. i know.

>> rich: if you listen to forecasters, they're warning an arctic blast will hit new york just in time for the ball drop. temperatures could be about 10 degrees. the coldest new year's eve in new york in two decades. rick reichmuth is tracking this. windchill below zero i heard? >> yes. listen to your forecasters. >> i am. >> listen to what i'm going to say that is don't do it. i know people want to do it. man, new year's eve is going to be awful. right now it's awful out there and will get colder. windchill advisories in effect. you can see the purple. much of the northeast, across parts of the appalachian, it's cold. the cold air that we normally see bottled up across the arctic or maybe in towards northern canada, is spilling down across parts of the u.s. it's minus 3, is what it feels like right now in fairbanks.

it feels like minus 4 in cleveland. feels colder in the lower 38 than alaska. the cold settled down. 29 is what it feels like in dallas. 38 in atlanta. till warm in south florida. so that is maybe the one good spot. in fact, temperatures there are above average. the only spot. minus 4 in minot. feels like minus 19. here's the deal. the cold air isn't going anywhere. it's going to continue to move across the great lakes, which will still relatively warm. that's where we've seen the snow pile up. 63 degrees in erie, pennsylvania. breaking a record. that's fallen just since christmas eve. all of the snow will fall. the wind moves across the great lakes. by the way, we're talking 63 inches, up to about here. it's everywhere. so you can't move it out of the way. there's just snow every where you turn. doesn't go anywhere. temperatures across the north, a little break on thursday.

special guest slot editing the flagship news program open the bbc. this is the first time that harry has produced the broadcast and he invited president obama to record his first interview since leaving office. the first two have met before. they were seen at the invictus games in toronto organized by prince harry. the interview was recorded in canada around that time. prince harry asked president obama about a range of topics. one was internet. the president warned of the dangers of the overuse of social media. >> the question i think has to do with how do we harness this technology in a way that allows the multiplicity of voices, the diversity of views but doesn't lead to a vulcanization of our society but rather continues to promote ways of finding common

ground. >> now, they talked about a white range of issues. president obama also had the opportunity to speak about his life since leaving office. he said that although he missed the job, he was liberating to have more time, especially to spend with his wife, mitchell. prince harry is said to get along well with president obama. the warmth came through with this interview, rick. >> rich: what else did they discuss? >> prince harry asked president obama how he felt at the time when he was leaving office. >> the sense that there was a completion and that we had done the work in a way that preserved our integrity and left us whole and that we hadn't fundamentally changed i think was a satisfying feeling. now, that was mixed with all the work that was still undone and concerns about how the country moves forward. but you know, overall, there was

happening all year long, right? gerri willis with more. >> that's right. let's start with those prop temperature taxes. you're right. there's a rush on to prepare property taxes, especially in the blue states with high tax levels. let's give you an example here. in new jersey, the average annual property tax, 21,720. imagine that the deduction allowed on the tax return, $10,000. so you see a lot of folks out there out of pocket. nervous. worried. asking for help. now expecting the new jersey governor to issue an executive order that would allow them to prepare ahead of time the taxes before the year ends. also happening in new york stay as well. so lots of concerns about that. >> rich: what about the santa claus rally. is it going to happen? >> let me tell you what the santa claus rally is. it's 76% of the time there's a

rally in stocks between christmas and new year's. it's not huge. but we've seen the dow go up. stocks have been back and forth across the positive and negative. right now the nasdaq and s&p 500 lower. that could change before the end of the trading day as we continue to watch this market. i have to tell you, hope the rally will happen. a little tough at the end of the year because of volumes. typically low here. >> maybe 25 k, right? >> fingers crossed. i just asked somebody about it. they said we're trying. giving it our best shot. >> thanks. >> attorney for three u.s. cities are suing the pentagon after officials say they failed to comply with reporting standards against federal background checks. this all because of a gunman that killed 26 people at a church in texas. the air force kicked out the shooter in 2012 for assaulting his wife and child.

officials are supposed to have reported that to the fbi's database for buying guns and the system would have blocked him from buying any weapons. they never reported it. the three cities are new york, philadelphia and san francisco. let's bring in gabby, white house reporter for the washington examiner. thanks for being with us this afternoon. a horribly sad case. appears to be no debate that the military dropped the ball here. >> absolutely. i mean, this was a clear error on the military's part. they should have made enforcement authorities aware that this man was dishonorably discharged for bad conduct. they failed to do that. there was a question whether he would have legally obtained a firearm if they had been aware of this. this is an important lawsuit, but there's still a lot of questions surrounding the cities suing the defense department and

why they're the ones lodging this complaint when the shooting didn't occur in either of those cities. >> i want to get to that in just a second. there's no guarantee that think guy couldn't have bought a record even if he was on the list, right? >> yeah. that's the biggest question here. a lot of gun rights proponents including this president have been quick to point out that in many cases, when mentally deranged individuals like this shooter haven't been able to legally acquire a firearm through the proper channels, they will then do so illegally. so databases like the ones that the pentagon is being encouraged to do a better job of maintaining, background checks, things like that, further gun restrictions, may not always prevent individuals who are dead set on committing these evil acts of getting a firearm. >> yeah. the military track record is poor on this issue. failing to record at least a quarter of service members with serious offenses in 2015 and 2016. >> it's not good. i think that's one of the

reasons why this complaint is being lodged about a recurring pattern. there's certainly many instances where all three of these filers can point to and say, you know, there could have been lives saved if this individual had been prevented from acquiring a weapon. and so i do think that it's important for this lawsuit to move its way through the courts. at the same time, there's a lot of backlash from conservatives because if you notice, all three of the filers here, san francisco, philadelphia and new york, they're claiming the pentagon failed to enforce federal law here. that they filed to properly maintain the database. all three of these cities are sanctuary jurisdictions, which ironically have refused to comply with federal law in terms of immigration enforcement. a lot of conservatives are wondering why these three cities in deep blue states, pennsylvania being the exception, are lodging this complaint and why it isn't coming from the state of texas where the shooting occurred. >> rich: it's a pretty dramatic contrast that you point out.

what about jurisdiction? can they bring suit and why are they able to bring suit since it happened in texas? >> it's a question they have to answer in court. why they have the legal authority to bring this forward when the shooting occurred in southernland springs and nowhere near any of thinks metropolitan areas. they're not asking for any monetary damages. they're just asking for an injunction meaning that they want to ensure that the defense department, the air force and that the military is in fact maintaining these proper databases to ensure that other individuals who have been dishonorably discharged or who have been reported for bad conduct or assault are no longer able to pass the background check. but it is a question that is likely to come up as this proceeds. >> the pentagon says there is really no excuse for this. we'll see how this plays out. thanks, gabby, for being with us today. >> thanks for having me. >> picture this. you take off from california on

fight. chrissy teigen and john legend took to twitter about it frustrating. she called it a flight to nowhere. like we're having a great time in the sky here. she later tweeted she was on a new flight and was hoping for a different menu. william la jeunesse in the newsroom with more. how did this person get on the wrong plane? >> well, we don't know. government officials tell us two brothers, one with a ticket on the a and a flight and the other on a united flight, both scheduled to leave to l.a. and tokyo and the same time wound up on the same flight. to complicate matters, the two companies are partners in business. airlines are supposed to have system and people in place to prevent this but it doesn't.

a security alert that was sent out yesterday. ana is releasing a statement saying they're researching the situation to determine how this happened. why pilots decided to return to l.a. is still a mystery because ana says the move was solved in flight. they figured it out. according to security protocols, the pilots said let's go back to l.a., so they turned around. now there's now and fbi investigation to how this happened. rick? >> we know grand or the -- torino is an amazing film. we don't know if it's chrissy tiegen is the one that complained about it. here's the video. >> thank you so much for taking me on this awesome vacation. >> welcome to los angeles. >> in her tweet he said why did we get punished?

likes to see. box office revenue down 2.5% to just over $11 billion. fewer people buying ticks as you just mentioned. blame it on bad original movies, lackluster sequels and stiff competition from streaming services like amazon, hulu and netflix. >> you have more content on more platforms available than at any other time in history. while the movie theater experience is singular and essential, it's not the only game in town. >> and adding to the pressure of facing film makers, movie goers have more tools to see how they spend their time and money. they're relying less on critic reviews and social media. sites like rotten tomatoes with film scores. people know before a movie it's good or not and whether they would be better off staying home binge watching on the small screen. >> which is why it's not just the movies that attract

audiences, right? >> well, not anymore. today movie goers are looking for a compelling, exciting experience that's better than if they watched a movie at home. i max ceo greg foster says a lot of this has to do with the theater. >> premium, premium. that's the tenet. you have to have the fancy seats. when you're in a complex that is old and cruddy and the seats aren't so hot and gum on the floor, you notice that, especially if you're paying $15. >> or more. one movie that people are wanting to see in the theater is what you're looking at here, star wars, the last jedi. it's set to eventually pass beauty and the beast as the biggest grossing movie of the year. rick? >> rich: i go for the popcorn. salt, no butter. claudia? >> me too. >> all right.

>> rich: it can take up to ten months to remove unsafe food products from grocery store shelves in the u.s. that's according to a new report the department of health and human services inspector general has released. the report examined 30 recalls that companies reported to the fda between 2012 and 2015 and found serious delays getting that news to shoppers. hillary vaughn has the story from the west coast news hub. hillary, what does the report say about the fda? >> well, that they're not doing their job. the new inspector general report says eight times out of ten, the

fda is failing to make sure that food that gets recalled doesn't end up in grocery stores. companies making the contaminated products are sometimes operating negligently and putting all of us at risk. the inspector general reviewed the fda misses their audit period 80% of the time and sometimes skipped it completely. it can take up to ten months for stores to stop selling recalled food. in one case, listeria was found in cheese products almost three months passed before the products were pulled from shelves. one infant died and two pregnant women recalled their unborn children. one of the supplements was not safe and the company continued to give out free samples for eight months. >> is the fda counting on

companies to recall their own products? >> yeah, they are. for the most part. the fda is relying on them to self-report contaminations and voluntarily initiate recalls. it's kind of based on the honor system. here's the catch. the report says some firms have been uncooperative and hesitant to take their products off the shelf. they have to build a case against them with strong evidence in order to mandate a recall. reforms are in the works following the report. safety advocates want the fda to release the names of stores selling recalled items. that's something the department of agriculture already does. the fda has not so far. rick? >> rich: thanks, hillary vaughn in los angeles. thanks very much. we'll be right back.

>> rich: at least ten people hurt after an explosion after a supermarket in russia. it happened in st. petersburg. investigators say a device with seven ounces:explosives went off in customer's bags. no one has claimed responsibility for the attack. earlier this month, vladimir putin called president trump to thank him for a cia tip that helped prevent a series of bombings in st. petersburg. officials say they arrested seven suspects with links to isis in connection to that reported plot. recreational pot officially legal in california on monday.
