jillian: welcome back, the debate between privacy and security coming to a head, the house rejected changes to the controversial spy program. what is the 5 act and how does it impact you? joining me to explain is daniel hoffman. thank you for joining us, appreciate it very much. we are dealing with section 702 which was set to expire on january 19th. explain what is the section that is in question? >> this section is authorized in 2008 and one disclosed in 2013 by ann snowden, allows for the

collection of correspondence, communication. when a foreigner is involved, the sender or receiver must be a foreigner, the us persons cannot be targeted if there's inadvertent collection, that information must be destroyed unless there is evidence of a crime. there is significant oversight of this program. there is a courts which provides oversight and the perspective of retired intelligence officer i can tell you i felt the debate is a good thing to have but i also believe that this is really important for national security. heather: the question is how much information is shared in terms of what they collected with americans who may be caught in the crossfire. >> some of the challenge we face was rectified last spring when the nsa on their own foolish and

made some changes and rather than target the body of an email which was about collection, if there is a foreign target mentioned in an email we could target that email for collection, they eliminated that so there has to be a foreigner on one end the other receiving or sending and that they eliminate lawful collection but it also played to the concerns that many have including rand paul about the privacy of american citizens and it is a fair debate to have but we all need to remember we are under great threat and we don't want to turn off what could be valuable intelligence collection to protect our citizens. >> it is a fine line when you talk about individual rights and rights to privacy and at the same time you want to keep our citizens safe from terrorism, the terrorism threat is very

very real in america as we have seen. in terms of the crime you mentioned, crime elements, is it going to be potentially any crime and who is determining if a crime is involved. >> a very rigorous process when it comes to managing the us collection. i have been on the other end where the names have not been revealed and there is a vigorous process in order to know who the person is, there has to be a real reason to know that. goes through a serious process but i would highlight us persons who are members of al qaeda who were themselves targets of threats and there have been us persons family members in contact with terrorists so there are legitimate reasons the fbi might need to know that information but it goes to the law enforcement channel and there is tremendous oversight and respect for the law when they do that. heather: thank you for joining

jeff sessions, where do you see it moving forward? >> a big step in the right direction. the key is going to be whether they have the authority to conduct prosecution not only in the us but outside the us. it is not just a us problem but a global issue, when it comes to organizations like the dea or the fbi they are the right size to head of these activities because they have a significant amount of information on hezbollah. law enforcement has been working for years on these activities and were told to stand down, primarily for political reasons. this is a step in the right direction. hopefully we see the stopping of the flow of money in these activities stemming from years of investigation that have taken place in the us. heather: we can look at the number of airstrikes in yemen in 2017, 120 strikes against al qaeda and isis militants according to the foundation for

the defense of democracy and the department of defense report that came out, several key al qaeda leaders were killed in recent us airstrikes in yemen. what do you think of that news? >> they have to step up the tasks to help the yemeni government but in the endory, that is from irani and backed militias, for years they established a foothold here. they can't go out and strike against irani and regime targets but there is a significant issue that might be greater than al qaeda, iran has been able to take a stake in it. that is where the focus should be in making sure these activities are curbed. heather: thank you for joining

bad news for walmart, the nation's world retailer closing sam's clubs nationwide land off thousands of workers, just hours after the retail giant announced an increase to their hourly minimum wage. >> reporter: both of those announcements came almost in the same breath. we heard the good news from walmart and the bad news that 63 sam's club locations across the country would be cleansing, laying off thousands of employees. many claimed they were not given any advance notice. we are hearing of locations closing in texas, new york, virginia and arizona. we haven't gotten a full list. some of them will be turned into e-commerce distribution centers. employees can apply to those locations or other locations. if you have a sam's club membership you can get a refund
