after sailing through the icy waters of the cyclone. ♪ hello and welcome to "fox news @ night," i am shannon bream in washington. we are hearing at this late hour that the president is reportedly making a flurry called a friends to get their reaction to the firestorm. what some are calling the s storm over the s-hole comment is now in the white house reportedly defending his remarks in those calls about haiti, el salvador, and african nation saying he is expressing what many people think but will not say publicly about troubled countries with high emigration to the u.s. saying president trump is not apologetic. he denies that he is a racist. he is blaming the media for distorting what he said. with that, let's bring in a scared penny with more good

morning. >> president trump continues to say that he made disparaging remarks about the oval office yesterday. he has become a major distraction for the administration in the midst of delicate negotiations trying to find a way to avoid a government shutdown. that was clear throughout the day as world leaders reacted to the president bulking at a proposed plan for the u.s. to allow more immigrants from haiti, el salvador and african nations calling them s-hole countries. and after signing a proclamation from martin luther king day. president trump ignored questions from the press about his statements. >> mr. president, are you a racist? >> we hope that he did not say those things. if he did, let's just apologize. >> these are shocking and shameful comments from the president of the united states. i'm sorry, but there is no word that one can use but racist. >> all of this believed any

>> shannon: do you want to weigh in on where we are in this conversation? >> i think that it is very interesting that we are getting mixed messages of what took place in the meeting. i think that that is very interesting. for one thing, then the second thing that the democrats are already preparing a motion resolution of center to go with the impeachment that they already had to go with the russian investigation that they wanted and now it has gone against them. all the way back to the day that he was elected they have been wanting to delegitimize this president. i do not think that this really helps the president or the democrats. the only people who believe anymore are the own base. >> shannon: al green, the one that brought the impeachment article before, racist bigotry is not enough. in congress talk is cheap, it is how we get two accounts. next week i will bring a resolution to impeach real donald trump right i will put my vote where my mouth is. repeal and replace trump. they have done this before about

58 democrats who voted to move forward. many in the party are saying, this is not a good look for us. we do not want to be running on the idea of impeachment. do you think that he will continue to bring this up for a vote and we will keep watching it not proceed, but to get enough votes to get some attention? >> i think so. this is what they are trying to do. and it will backfire on them. what we are seeing is it is where the republicans deliver with president trump and the economy and things that are going that way, it tells you all that you have is the racist card and delegitimizing president trump you are not going win over the independent said one to president trump's way and carried him to victory last year. it does not make sense to me. but that is where they are. >> shannon: you have written a piece, we talk about the substance of getting a deal done. government funding runs out a week from tonight at midnight. and of course the democrats are saying that daca has to be tied to that. you have written a piece since i basically until the wall is funded, started, and finished we should not be talking about any

kind of legal status for anybody who is here illegally. are you going to be able to hold that line? it sounds like the president is pushing for it. something will have to get done in one form or fashion. >> i will hold the line for sure, that's what i promised my voters and that's when my voters want and they expect. i received messages today about that op-ed supporting that position. and quite frankly, we've danced to this stance before 1986 we had an amnesty. what happened, we were promised all kinds of border security and internal enforcement. it did not have impaired it happened again when we wanted to build a wall. we built a wall, provided funding. and then the funding dried up. these are some real problems that we have seen before. so i am so mistrustful that i think that we keep our promise first and then not give up our leverage until we have built the wall. >> shannon: here's what the president said about the deal that he was presented with. he said the so-called bipartisan daca deal presented yesterday to myself and a group of republican

senators and congressmen was a big step backward. while was not funded, chain and lottery were made worse and usa would be forced to take large numbers of people from high crime countries. at the white house insider who told me that they do not consider the proposal serious at all. it sounds like if anything, it upset the president and may be, who knows provoke some of the rough language. but it does not seem like he provide linac believed that the leaders came in with a legitimate deal. >> i agree with that. when i read the aspects of the proposal that were released it was like a token for the fence. they get everything that they want to. is like that old gang of eight bill that we heard so much about derogatorily, by the way. and i think that this and to the durbin report. i hope that it is instructed to the president and maybe some of these people that are negotiating from the other side are not really they are in good faith. i think that they are there trying to make their political point. and they do not want daca, they want the dream act.

to me. now we hear from martin luther king the third after the comments saying in the new york daily news. when you make a statement like you did yesterday, the question is do you understand why we have a martin luther king holiday? >> well, it is hard to take the sting out of it. but you just tried to -- you know, when i heard vince say play the race card and that his opponents delight in this but i do think that the president brought a lot of this on himself with the comments. so when you make comments in the oval office, guess what, it is going to leak. the idea is that when the white house was presented with the opportunity to say, the president did not say this yesterday, they did not say that. in fact, it looked like he was saying, listen, this is the way that people talk. he thought that it will play well with his base. i do not know how it is playing. >> shannon: i don't know if he thought that particular comment which he denies saying that exact word. he admits that there was coarse language in there.

>> people are also making a delineation that he is talking about the countries from which these people come from. and we will keep people in the united states that have protective status or had it until recently that come from countries who have such miserable conditions. that is an in elegant way of referencing that. >> the problem that i had was as i understand it he was talking about the lottery. and he really is an opponent of the lottery. he would like to do away with it. >> shannon: he has made that clear. >> in the discussion about the lottery you have the democrats coming in and saying, let's cut it in half but have special protections from people from especially or particularly distressed countries such as these. and the response was why do we need people coming from the s-hole countries? the people part of it is so offensive. >> those people specifically are the people who had protective status in the united states. they were looking to extend the slots from these diversity visa lottery's already in the united states. so these would not be people emigrating from these countries, they are already here. he does not want to see the

slots go to that people. >> shannon: we can continue the conversation for a while. it is good to see both of you on the friday night. >> happy friday, shannon. >> shannon: just last week the justice department and the fbi barely beat a deadline set by the house intelligence committee to hand over documents and witness lists related to the russian investigation. in it so dirty dossier. we have breaking news concerning the contents of those documents. courtesy of her own ed henry who has been doing digging for us. >> good to see a paid fox has learned that in two closed door meetings devin nunes told republican colleagues there is evidence that shows clear abuse. of surveillance programs by fbi and justice department officials. that is according to three sources familiar with the conversations. this is raising more questions about whether that anti-trump dossier was used by the obama administration to authorize surveillance of advisors to president trump. the california republican made these comments as you try to round up votes in favor of

renewing a key section of the foreign surveillance act known as 702 that eventually passed in the house on thursday. that part of the law gives power to the calls of foreigners who may be plotting terror. and there has not been an abuse of that section of the law. other sections have been misused by government officials with surveillance of americans. clear reference to allegations at the end of obama's administration in that top officials at the james comey lead fbi and loretta lynch led justice department authorized surveillance of trump officials. the comments came after he and other members of congress were given access last week to sensitive documents in a secure room of the justice department. raising questions about whether those documents show that the dossier paid in part by the dnc and the clinton camp was used to grant permission to trump officials. nunes is now pushing to get these documents in the hands of all 435 members of the house.

but the top democrat on the intel committee adam schiff will try to block that. he has said that nunes is acting as a proxy for the white house and this is an effort to shift the focus to the dossier and away from allegations of russian collusion in the 2016 campaign. meanwhile, tonight the group judicial watch has won another lawsuit. a federal judge ruling that by january 18th, the fbi has to give up the james comey memos. the ones that he wrote about one of his meetings with the president before he was fired. he has admitted that he gave those memos to a professor and a friend so that he could leak them to the media. allies of the president said that that was improper resulted in special counsel robert mueller being named in the first place. this is not the last that we have heard. >> shannon: great and interesting new insight. thank you very much. despite the tough week politically for the president, the economy is showing more increased strength. the dow jones industrial average is nearing 26,000. strategist say that there are numerous reasons for the

what is happening if the president decides to pull out? do you think that he will? >> i talked to a high government official today, who is clearly in the know. and he said, if the president is trying to get congress to make some changes to the deal. and here is what they are really focused on. number one, the so-called sunset clause, which permits iran to have a nuclear threshold capability short of a weapon in ten years and in 15 years and actual nuclear weapon. the deal permits that. stop that from happening, hold them in place right now i make that hold in place permanent. second, permit a very tough inspection of regime that's now currently denies us from the sophisticated military basis which nuclear research is going on. it makes no sense whatsoever, but that is why the obama administration gave into. if we just get those two things to fix the deal, then i think that president trump will go along with her. now we have something that makes some sense. if we do not get that, he will

probably walk away. >> shannon: we talked about the leak report from the pentagon looking at the nuclear capabilities and what we would like to add to the arsenal with the flexibility. it talked about a couple of new things that would armed subs with different nuclear actions as far as missiles. we had a reaction from a former obama administration official who works with president obama. john wolf saul, here's what he said about the report. >> i think that the document goes off the rails by calling for the development of not one, but two new types of nuclear weapons that would be deployed to both on submarines and on surface ships. >> shannon: quick reaction? >> first of all we have permitted their nuclear weapons to atrophy except for what we have on the submarines. this is bombers and particularly an account of the ballistic missile. the chinese and the russians have been upgrading us for years. we have been unwilling to put the money on that. as we have been unwilling to put the money on a lot of things in

scott pruitt is a controversial administrator of the epa. seen it 13 times before he was deleted by president trump. and finds himself at the center of more agency drama. trace gallagher has that story. >> shannon, as a current head of the environmental protection agency and oklahoma general, scott pruitt has built his career by challenging what he calls the epa's activist agenda. he has made no bones about wanting to cut regulations, but he has made some enemies. and critics now say that his level of personal security is unprecedented. they also bemoan the fact that while president trump is threatening to slash a epa funding and jobs, the bill for the round security could run into the millions and that agents protecting permits are being pulled away from investigating other environmental crimes. the reason that scott pruitt is getting more security is because he is getting more threats. according to the epa system

inspector general, scott pruitt is getting four as many times as threats as his predecessors. through social media and letters and packages delivered to his home. scott pruitt himself told bloomberg the quantity and the volume as well as the type of threats are different. it is really disappointing to me as it is not just me, but my family as well. and the free beacon is reporting that one of these death threats came from a man who was drinking and got riled up watching the rado maddow -- rachel maddow show. the unidentified individual reportedly admitted sending threatening tweets to scott pruitt and senate majority leader mitch mcconnell part of the threats were serious enough to get the tulsa police department, fbi, and the joint terrorism task force involved. they are finding the u.s. attorney's office in arkansas which jay declined to prosecute. epa inspector general is looking into the cost of scott pruitt's

firm that ultimately compiled the dossier that became a test of sorts. republicans who looked at the same said the timeline fits with this dossier having been used to jump-start the russian investigation at the fbi. and liberals who looked at this and said, look how credible the fbi sounds and the allegations in the dossier. there's a reason that it was used. cooperated by george papadopoulos at the time. and it was clearly evidence of potentially something going on with russia. so we still do not know how large the dossier factored into the fbi's decision-making. but it is certainly a good question. because remember that the dossier was at the end of the day funded by democrats and the hillary clinton campaign. >> shannon: sydney, as the entire investigation continues, on capitol hill and robert miller, there is somebody that polk should know about. his name is michael horwitz, who is he? >> he is the inspector general of the department of justice. he has been investigating the

tonight, but not after what passengers are calling a trip to hell. it began last week when they decided to return to new york from the bahamas right through the path of the winter storm that barreled up the east coast. but very difficult to get through. >> shannon: this is what we heard from weather.com, the meteorologist said that forecast detected that a powerful and large pressure system would go many days in advance of january 3rd-4th. given the forecast intensity of that low powerful winds and high were given in the waters of the east coast. so what kind of obligation did the cruise company have? >> obviously this is an unfortunate situation, but also obviously, when you are traveling by ship on the ocean you may encounter bad weather. part of the guest ticket contract, a contract that binds the passenger on norwegian cruise states that you acknowledge that there may be conditions that are outside of the captain's control, outside of the ships management control. for any cruise line, there is continuous legal precedent that states. no implied warranty of states passage. they are not guaranteeing safe passage.

>> shannon: wow, i do not think that people realize that when they get on a cruise ship. >> that is not the case in the event that they know that there is going to be extreme weather. if they know that there is going to be extreme and very unusually extreme weather, which is the case here and it could possibly endanger the passengers if not to make the voyage miserable, they have an obligation to do the right thing which is delay the cruise or tell people about the extreme weather. to this was not something that was not under their control. they knew that it was coming. and notice a difference. if they had no idea, i would agree with her. but they knew that it was, and they went ahead and did the cruise anyway. we learned later that the reason that they did this is because they had to make it back for another 14 day cruise on the return trip. >> shannon: final word to you. >> we do not know that pressure. of course the captain of norwegian cruise is not going to want to put passengers in danger. there is no positive side or way to spend that. but there were conflicting weather reports prior to the
