emergency alert sent to cell phones across the state warning of a ballistic missile head their way. the frightening alert to warning quote this is not a drill it wasn't until 38 minutes later that a correction was sent to cell phones saying it was all a false alarm. the reason for the mistake according to state officials? somebody pushed the wrong button. here is the governor. >> what happened today was totally unacceptable, and many in our community were deeply affected by this. and i'm sorry for that pain and confusion. i'm angry and disappointed this happened. we are doing everything we can to insure it never happens again. judge jeanine: no word on who specifically is responsible for

communication? on the surface i don't think we should believe that. i know the governor is there saying this, but -- somebody has to go in and verify that. i have a hard time believing that's what actually happened. judge jeanine: you are saying the fact it took 38 minutes for them to pull it back, something is going on. you are saying maybe something was going on and there was a reason for the alert and possibly the united states did what it had to do? >> i'm just saying it's worthy of inquiry. it affects hundreds of thousands of people. one person i know in kauai woke to this emergency and the terror these people went through. they didn't know what to do. i have a hard time believing someone bumped into a button on

the computer and this happened. if that's the case, how poorly designed was that system? judge jeanine: how do we verify it? >> i have got a lot of belief in congresswoman gabbard. somebody who is independent that can come in and look at it and say show me what you were doing. try to recreate it. and hold somebody accountable. you can't just say it's a mistake and pat them on the back and let them keep doing their job. judge jeanine: if there is a consequence yen, there should ba con question -- there should bea

justice department. >> the dossier was a bogus document. we know the deal between the dnc and hillary clinton's campaign. they hired a foreign agent which is something that's against the law. the general counsel for the dnc who had ties to the podesta group. there is a podesta tie into this that hasn't gone the much attention. you have to look at that. then you have to look at what sort of verification did they put into this document. then go and takes this as the impetus to spy on americans within i.e., the trump administration. devin anyone's, trey gowdy. it's taken months for the department of justice to provide these documents. they had to threaten a subpoena

and get the speaker involved. now supposed lire they are going to turn over -- supposedly they are going to turn over the documents. judge jeanine: let's assume the fake dossier paid for and full of absurd allegations against the president was created for the purpose of bringing in fisa surveillance. why don't we have the application for the warrant? who do we have to go to to get the application for the warrant? >> well, it was jim jordan in the house judiciary committee that asked the attorney general and rod rosenstein to provide it. judge jeanine: they said no. my viewers want to know, now, where do we go? how do we find out? enough of this stuff and going on and on about this thing. let, finds out what the

application for the fisa warrant looks like. is there anyone other than sessions and christopher wray and the fbi? >> you have to have mitch mcconnell involved with the chairman of the committee, devin nunes, and trey gowdy and senator grassley to grow a spine and do their job and hold this administration accountable. it's a republican administration, i get it. but it was the same thing in the democratic administration. there is a deep state that is we'll seated. have goats -- well seated. it's just going to play along. judge jeanine: these people shouldn't get a salary unless they are doing their job. they shouldn't get a salary until they remove the effort to

stop a candidate for president of the united states by the fbi and department of justice. these people have to go. i just go over this every week and every week i don't know any more than i did the week before. if it weren't for "the hill" and people like tom fitton and some of these organizations seeking freedom of information we wouldn't know a thing because the establishment is in bed with the rest of the establishment. am i wrong? >> subpoenas that come from congress, the department of justice doesn't pay attention to. the only way congress can enforce that subpoena is through the department of justice. that needs to change. the only thing the administration seems to be afraid of are the courts. because the courts can incarcerate and fine. there has to be an expedited way for congress to get to the courts. that's why tom fitton at judicial watch has had such

success. they go to the courts. judge jeanine: even though they have oversight over the department of justice and the fbi, then they said, we are going to give it to you. i haven't seen it yet. congressman chaffetz? >> devin nunes said they were going to supposedly get them. the key question isn't how many years we gave niece thousands of documents. the question is what percentage of the documents. as trey gowdy said, you tell me the percentage of the truth want to get. it goes from fast and furious to the irs case to the d.e.a. you go down the list and you will find they never gave congress 100%. judge jeanine: more on the false

know sock is coming at us, it doesn't take 38 minutes to say this is a mistake. >> anybody who has been on hold with an i.t. department knows it can take 38 minutes. judge jeanine: thanks for the humor. let's go to immigration it appears there was an agreement on daca. daca for the wall. now there is a real problem and it looks like the democrats coming out of that bipartisan meeting want now to hold everything of. what do you say, ned? >> donald trump is exactly right. he laid out the parameters for the debate. there has to be full funding for the wall, an end to chain migration. in return, many in his base, and i have done my research, i wrote a piece on this. we are willing to strike a deal and say maybe the dreamers get the green card. they get a five-year pass to

citizenship if we get those things with full funding for the wall. but let me say this. it's amazing to me the hypocrisy on display here. there were senators who voted for turning for a wall. there is a senator by the name of dick durbin who wanted to end chain migration. in the recent past these guys were for it and now they are fighting it because of donald trump. judge jeanine: why did they change? >> let's start with the turning for the wall. i was told by 2016, mexico was going to pay for the wall. i'm not going to let you go there. the question is why were these democrats in favor of it a few years ago and now against it? it's just like my opening statement, they don't want to succeed because they hate donald

trump. >> absolutely not. there was additional funding for border security which democrats still support today in exchange for daca and a few other things and a perm nants fiction to our immigration system. judge jeanine: what is a permanent fix? judge jeanine: what does that mean. what is comprehensive immigration reform? what is that? >> acknowledge the reality that people are coming to this country for work and we deal with it with work visas to take people out of the shadows. judge jeanine: that's what comprehensive is. they all come in to work and let's bring them out of the shadows. they don't all come to work. they come for education, medication, housing and live the

american dream. when they are not allowed to be here. if that's comprehensive immigration reform, then the only reform is to eliminate and repeal all immigration laws so everyone can come in and we can have a global party. >> there are things that need to be addressed. we need e-verify. we need to talk about 40% of the illegals on this country are on overstay visas. we also have to talk about a merit based system as well. you know what else we have to talk about? voter i.d. laws. judge jeanine: are the democrats going to shut down the government next week because they are so angry with donald trump they don't want anything to succeed, whether it's daca, the wall, they can blame him. >> the republicans have complete control of government.

now back to "justice with judge jeanine." president trump: we need the wall for security, we need the wall for safety. we need the wall for stopping the drugs from pouring in. i imagine the people in the room democrat and republican, i believe they will couple with a solution to the daca problem and maybe beyond that immigration as a whole. judge jeanine: it has to include the wall. that from. president trump: this week. but this tweet this morning reads i don't believe the democrats really want to see a deal on daca. they are all act and no action.

fraudulent government document, they can't even solve that. judge jeanine: i have got to push back on that a little bit. long form was filed. let's put that one away. i want to talk about what happened today in hawaii. you had specific thoughts about what happened today. >> the only thing i'm saying, they can't solve a phoney document. so now there is something wrong with that government. judge jeanine: let's keep moving because they did solve that and i'll keep pushing back on that. what do you say to those democrats who are determined to shut down the government or stop the resolution of immigration -- the immigration issue in this country being from a state impacted by more than probably the vast majority of states? >> they ought to be thanking the president. he's the one who brought the immigration problem up front when he was running for office.

they had to talk about this illegal immigration. what's wrong with a president talking on a bipartisan situation about this problem? he's a great negotiator. i don't know why all this heat is going on because he's talking about dak and illegal immigration. everybody should be thanking him, trying to get to the bottom of this. judge jeanine: the amazing thing is he's willing to go with daca. he's willing to give them that path, but they are not willing to give him the wall. i was in arizona not that's months ago, and i have never seen anything like it. there were people coming across at night, people being arrested every day. for some reason the elite think that this is okay. yet the expense that is connected to this illegal immigration is something people don't want to discuss.
