the leftists are all in on the daca stuff. rachel: if you wanted a deal for daca, the deal is there the deal has been spelled out by the president. it's not hard. i actually think and i said this before on the show. i think they give them citizenship to the daca recipients if they could get the wall -- if the republican could say get the wall and chain migration and the lottery. pete: going to get resistance from conservatives. rachel: maybe, but a deal is a deal. this is a president who likes to negotiate. i think there is a deal to be made. i know there is a deal to be made. this entire government is being shut down because of daca. pete: even the media is admitting dean dean this is a big shock to me. they talk about it and the "new york times" and people say hey, this is a democratic shut down. first time i have seen that you know, you normally wouldn't see it this time the a.p. and other people are saying it's a democratic shut down. really interesting to see. maybe it won't play the way they want it to. pete: almost always flip the other way. democrats seem set to block

bill to keep government open. as you said, dean, a.p. headline senate democrats derail bill to avert shut down. and bloomberg saying u.s. shut down starts as senate democrats block g.o.p. funding plan. they are used to getting confirm from the media. no matter their actions. if there this case it's just so blindingly obvious what they're obsessed with and focused on. rachel: everything in the bill, pete, they agree with they agree with chip. they agree with the funding in there it's really just daca. so there is no way you can blame the republicans when there -- it's a fake deadline. it's a fake emergency. they have until march. and according to a judge until june. dean: they do have until march. bargaining position is now. every day it clicks by less and less. pete: do you know what in addition to daca it's about the resistance. any mistake that extended the funding deadline to january 20th, 2018. today is the one year of president trump's

time around. pete: it will look different this time around. great point he makes. we're not trying to weaponize. this minimize the impact. frankly the federal government shuts down every friday night through sunday anyway. fbi, cia, military. we know those folks are working wall-to-wall. good luck calling the agriculture department on saturday morning. they probably are not answering. thousands of federal employees will be placed on furlough meaning they won't report to work on monday morning. military members will not be paid but, of course, because they do their duty for the right reasons, they will show up for duty, they will be paid in retrospect. rachel: post office won't be affected. social security checks won't lo l. go out in the mail. most national parks will remain open and most airports will stay open. pete: war mother-in-law also stay open too. maximize those to impact the feeling people had. dean: in 2013 they wanted everybody to feel it i will

the real numbers. steven camerota director of research for the center of immigration studies and he joins us now. we hear all about the 800,000 under the daca program. but, if you look at the numbers, there are closer to almost 4 million illegal immigrants brought here as children in total. depending on what kind of deal is struck, could receive a level of amnesty. help us break down these numbers. >> look, the way the daca program worked you had to be under 16. you couldn't be over the age of 31. had you to supposedly at least have a high school or working towards a high school degree. that was about 1.3 million. about 800,000 came forward. however, there are another million children who aren't near the high school age yet, who would qualify typically for one of the dream acts. this is what the democrats are pushing. so that adds maybe a million. the other thing is the dream acts in congress don't have an age limit. so you could be 40 or 50 and get this. so, that might add 500,000 or a million people. and the way in which they

implement the high school requirement, you just have to be working towards some kind of g.e.d. or something like it. and that adds several hundred thousand people and, of course, it depends on the methodology you use to estimate these things. so it's very easy to get over 3 million, maybe 4 million people when you play with the numbers. and the dream acts in congress, the things actually that have been scored by the congressional budget office do look to have potentially 3 million, 4 million people. and that's before have you any fraud. rachel: so when i look at these numbers what i say is okay, and my heart goes out to these dreamers by the way. and the daca recipients. but what it says to me is that this is why the president wants a wall. this is why he wants to end chain migration because we can address this group of people that have been affected, but we're just going to have another group come and it's going to multiply the way you are explaining right now. >> right. so the whole points was to have a package, one was

continue to crease enforcement. so new people wouldn't come, encouraged by this amnesty. and the other thing was so that these people, once they get citizenship can't sponsor their relatives, including their parents, who are the real guilty party here. so let's get rid of those chain migration categories. that's why they wanted enforcement, an end to chain migration in exchange for some kind of daca,/dream amnesty. the stakes are very high. we are talking about a lot of folks and a lot of potential people who could come through chain migration. that's why we needed other reforms. not just the amnesty. pete: steve, we have to leave it right there. when you talk about numbers of 3 to 4 million. not 800,000 and the chain migration on top of it gives you a sense of why the democrats are basically causing a shut down on this very issue. steven, thanks for bringing the real numbers to us. we appreciate it? >> thanks for having me. pete: you got it coming up, will the wall stop illegal immigrants from stopping the border? it just stopped the u.s. special forces. i don't know what this story is. i can't wait to hear it we will explain that ahead.

pete: break it down for us. >> in terms of all previous government shut downs there have been plenty, let me just tell you. we start actually with president jimmy carter. do you remember this? there were five shut downs under the carter administration. it was 56 total days. a lot of that had to do with president carter at the time really opposing the growth of the military. in fact, it was the nuclear class them miss, aircraft carrier that he didn't want. that had to do with one of those shut downs ronald reagan. president bush one shut down, three total days. and then president barack obama one shut down, 16 total days now. if we really went back in history, we would be clicking this board for a long time. because this bill only started in 1976 they introduced this process by which the government could shut itself down and, in

mess. pete: so, speaking of mess, what is this all about? caroline shively is live in washington, d.c. to break it all down for us. caroline, good morning. >> good morning to you, pete. senators needed 60 votes to pass a continuing resolution that would have kept the federal government open for another month. they can only scrape together 50. four republicans voted against it rand paul of kentucky. lindsey graham of south carolina. mike lee of utah and jeff flake of arizona. five democrats crossed over and voted yes. joe manchin of west virginia. joe donnelly of indiana. heidi heitkamp of north dakota. clair mccaskill and doug jones of alabama. white house press secretary sarah sanders said. this senate democrats own the schumer shut down. tonight they put politics above our national security, military families, vulnerable children, and our country's ability to serve all americans. we will not negotiate the status of unlawful immigrants while democrats hold our lawful citizens hostage over their reckless demands. this is the behavior of obstructionist losers, not

legislators. now, technically, senate majority leader mitch mcconnell voted against the resolution but only because of senate rules that require you to be on the prevailing side to bring another vote. he also blames democrats but dems say the shut down blame is on the g.o.p. sings they control the house, senate, and white house. the earliest mcconnell can schedule a new vote is 1:00 a.m. on monday. the latest plan would open the government back up until february 8th. pete, rachel, and dean, back to you. pete: thanks, caroline. latest plan keeps it only for a couple more weeks ago well. both sides will try to spin it. dean: they are trying to spin it hard. pete: people are not dumb. rachel: no, we were talking earlier. my mother is spanish the saying goes. [speaking spanish] which means the aren't dumb. we saw that the diner. people aren't stupid. we saw it in the diner as soon as they asked that man who is to blame? he said the democrats. he knows this is a fake. pete: they know a fake deadline when they see it.

rachel: they threw daca in there. it has nothing to do with the budget or anything. the democrats agree with everything else in the bill. they just want to shut this down. dean: that message is getting out there this time. it's very clear. the republicans did a good job getting the message out there. it's in the headlines that the democrats are shutting it down. pete: absolutely in the headlines. as you wake up this morning realizing that your federal government is shut down. it's always shut down on saturday and sunday those days. bureaucrats don't work on those days. we asked dan bongino to cut through this for us. what's it all about? >> it's about the democrats sticking to donald trump and american taxpayer citizens that voted for him. listen, america, make absolutely no mistake, the republicans caved on every single thing the democrats wanted in this budget bill that was relevant. everything. all of a sudden, the democrats at the last minute dthrew a wrinkle in on daca. there is no deadline for daca. no deadline. but they are lying. they are telling the american people something factually incorrect.

this is not did b. daca. this and sticking to donald trump. pete: by the way they will probably try to do it again. even if they reach a funding bill funding deadline before the daca deadline. left wing activists obsessed with illegal immigration and future electoral implications of it driving this for chuck schumer and nancy pelosi. rachel: democrats really playing with the daca recipients in a really, i think, disingenuous way. if they really wanted a permanent solution, certainty for these dreamers who don't know what's going to happen to them after march, possibly june, when the deadline comes, there was a deal to be made. the president made it very clear. i want to make a deal of love. he had said from the beginning, i want to find a solution for the daca recipients. give me my wall so we don't have this again, give me an end to chain migration so we don't see the multi-multiplication of the dealers and daca recipients as we saw in last segment and let the visa lottery -- suspend visa lottery because

it's dangerous. by the way, one of the ways that we know how to gauge where the american people are with this shut down are phone calls to their congressional leaders, to their representatives u talk to my husband congressman sean duffy from the district in wisconsin, seventh district, he says we are not getting a lot of calls like we did in 2013 about the shut down. we are getting calls about releasing the memos which we will talk about later. that's a way to gauge that we don't have a lot of problems. pete: so much news today we can't even get to it. memo who he and house intel committee showing that fisa warrants were abused. we will get to that in this program pointing to the fact that our intelligence services were weaponized. dean: i was going to say something about go back to 2013 the shut down. i remember hearing so much when the shut down happened and how awful and terrible and armageddon again it was going to be. it's interesting to see what they say this year. let's take a look. >> i call them ledge layive arsonists. they are there to burn down

what we should be building up in terms of investments in education and scientific research and all that it is that make our country great and competitive. >> it's sort of like this. someone goes into your house, takes your wife and children hostage and then says let's negotiate over the price of your house. you know, we could do the same thing on immigration. pete: so we are arsonists, hostage-takers, nancy pelosi talks about armageddon. the only thing they haven't useside donte's ninth ring of hell. level of hyperbole is out of control. you can't up that ante without looking ridiculous. dean doesn't it sound the same right now. pete: now they are saying no we need a shut down they are trying to say trump not a big deal. yet they are to blame for it i don't know how think win this n. this equation. rachel: mick mulvaney say the way the shut down was handled in 2013, he said we republicans are not going to handle it the same way. we are not going to be

affected quite as much as 2000 13. actually he said that the democrats weaponized government against the people on the last shut down. dean: yeah, made it very difficult u. rachel: here is what is going to be affected. thousands of federal employees will be placed on furlough, meaning they won't report to work on monday. the military won't be paid, but they will report for duty. what's not affected? post offices won't be affected. you are still going to get your social security check in the mail and most national parks will remain open as well as the airport. pete: do you know who else is going to keep working bob mueller and special counsel. they are essential employees as well. it speaks to what your intent is if your inner tent is to make it hurt. under the obama administration 2013, they wanted people to feel it they closed down monuments. national parks. remember the signs that were hanging closed, out of business. if that's your intent, look, reremember that it was clear of war memorials, in this case they are saying listen, this is not about a shut down. we don't want people to hurt. we want to fix, gets our

budget under control and make a separate deal about immigration, which is clearly dysfunctional. those are two separate things. the democrats are trying to conflate them and they're losing that argument because, as you pointed out, people are not dumb. as a regular person sitting at home, you want things to get done. you don't want to see this kind of stagnation. it just doesn't make any sense. we don't at this point in time closed down. rachel: well, dean, you are one of the most real celebrities i have ever met. i mean, you are so down to earth. you are so rationale. other celebrities are tweeting in. dean: oh, are they really? no, say it isn't so. pete: from your friends. dean: yes, these are my friends. this is a tweet from john legend. i don't know john, but he is very active on twitter. here is what he says, the reason the government shift down is that trump and his team have an ideological commitment to allowing fewer black and brown people in to the country, #trump shut down, #trump is a racist.

dean: a fox news alert. the government shut down. so what does that mean for the economy that has been surging under trump? pete: white house press secretarsarah sanders tweeting before the vote. democrats can't shut down the booming trump economy. are they now so desperate they will shut down the government instead schumer shutdown. so we have got this economy taking off like gang bussters how does a shutdown, partial, lengthy, short, how could that affect that? >> the press secretary is correct, actually, because if you look at this government and its policies it's actually letting the free market do all the action. if you go back to 2016, we had an average g.d.p. of 1.6%.

that's because the obama administration government was the one really fueling the economy, actually repressing it. if you look now, private enterprise and companies are actually fueling the economy. so, government shut down is going to have a diminius effect on the economy. >> just a little effect. dean: which is nice. past shutdowns has it affected the economy a lot? >> yeah, so if you go back to october of 2013, you saw actually the market go down 5% off of that yesterday, if you look at what happened in the market it was up. that was when mick mulvaney said there was a 50/50 shot. if two hurricanes can't impact the trump economy and it's still growing at over 3%, a temporary government shut down won't really do it because private enterprises are still spending money. they were spending money even before the tax plan coming. in now -- that was because of deregulation. so deregulation has pushed the economy further. now that you have the tax

plan, in effect now, that's going to fuel it even further. so, any government spending will be delayed into the next quarter. so it will just -- the output will be pushed into future quarters. pete: sometimes it's important to take stock and round numbers are helpful. today is january 20th. i couldn't know year since the president's inauguration. break down for us if you will. we have a full screen of some of the numbers. president trump's first year and what it really means. >> i think what you need to do is actually look. markets are forward-looking, right? so if we go back to november 9th and we see the performance of the dow jones industrial average since then up 40%. that's really telling, because we were told during the entire election cycle oh, we're so far into the recovery, anybody is going to have a hard time boosting the economy. it's going to be difficult. guess what he did? he just did deregulation. we got 3%. now we have other fiscal policies actually putting money into people's pockets.

he has shown that, guess what? companies and people know how to spend their money better and puts it to higher and better uses than the government. and it's playing out into the g.d.p. and so you are seeing it happen. if you just look from when he was inaugurated until now, 32%. companies and people are doing better. you can with consumer confidence is numbers, business confidence and actual hard economic data. pete: a "wall street journal" poll just out this morning to your point. what's happening on wall street is translating to main street which is the sort of political, if you will, mount everest. 69% satisfied with the economy. 30% dissatisfied. that's a huge number. >> what's nice that's a poll. most polls are actually distorted by a lot of liberal bias. one thing that i want to focus on is on wednesday, the federal reserve, which has 12 district banks throughout the entire nation, came out with what's called the beige book. takes a temperature of the health of the nation and economy. they said tightening labor

markets are leading to rising wages and companies are spending more. economy is going to be doing even better. look at the start of the year, after taxes were passed and signed, the market went up because once again, it's a forward-looking indicator. it is showing that this year is going to be a phenomenal year. that's why this whole, you know, government shut down is just a ruse. that's why you are seeing the hyperbole really sad coming out of the left side, because the 2018 elections are going to get disseminated because of the policies coming out of this administration. pete: look at that 70% number that's a dangerous number for democrats. dean: it's about the economy, stupid. pete: it sure is. kevin, thanks for breaking it down for us. we appreciate it this illegal immigrant deported twice showing no signs of remorse for killing two police officers in cold blood telling a court, quote: i wish i had killed more. the aunts of one of those fallen officers here to react next. dean: plus alan dershowitz on the politics of the government shut down just

in sacramento and the suspect then, after shooting deputy oliver, he shot at his partner. then he shot a citizen in the head, carjacked him, took his car. and fled northbound interstate 80 or west -- eastbound, i'm sorry, interstate 80 toward playser county. they were put on alert and michael responded to help try and appear preel head the suspect. up in the auburn area. he was cornered and that's where he shot and killed my nephew. rachel: how did it make you feel when he said that in court? every time i hear it i'm so angry, my blood is boiling. i can't even start to explain how it makes a person feel to know he is illegal. rachel: we will get to that there is a lot of positive stories about daca

recipient, about dreamers. are you frustrated that there aren't more talk about stories like yours, that the media is not embracing a story like this? >> absolutely. that's why i'm so thankful for fox that they're talking about this. they are keeping this alive. these are the people, the first line people who are here to help us are the officers. and our politicians our lawmakers are doing nothing but protecting the folks that they're supposed to be keeping out of our country. and when you have stories like, this where officers are killed, all of a sudden, they are ignoring it completely. it's just horrible. it's really heart breaking. rachel: talking about in this morning he tweeted, let me tell you what he tweeted here. democrats are far more concerned with illegal immigrants than they are with the great military or safety at our dangerous southern border. they could have easily made a deal but decided to play shut down politics instead

pete: then when does anything get done? it seems like crucible moments are when deals get made or someone blinks. if it just continues, where does it stop? >> there is a big difference about making a deal about something particular. and either party using the blame game to try to get this done. obviously, congress needs a prod. this is one prod that has to be taken away from them. the idea, now, look, we did it already. you can't stop social security. you can't stop the military. we already have a partial ban on shutdowns. let's go all the way. rachel: what do you think about the democrats using daca in this instance? we have been talking to people in america this morning. they are saying we don't believe this. this is a fake deadline. they have until march. >> well, but, they want to use this deadline to make a point. both parties want to use it to make a point. pete: you said they shouldn't make that point. >> they shouldn't make that point and they shouldn't be

able to use that tactic as a way of making that point. the people who suffer are the american people. we don't know how many people, even if this continues, doesn't matter so much over the weekend, but it continues monday, tuesday, wednesday, people will be affected. they are victims and congress shouldn't have the power to make victims out of americans so as to help them play their political games. it's the schumer shutdown. it's the trump shutdown. the american people don't care what you label it. it's a shutdown. it's the american people's shutdown. rachel: it's a dysfunction. >> right. pete: today is january 20th. rewind one year and it was the inauguration of this president. the president tweeting this morning about that. this is the one year an verse varanniversary of my presidency. democrat shutdown. you wrote the book trumped up. you have been involved in the debates surrounding his presidency. one year in, what is your take? >> first of all, i think we have learned the legislative that the appointment of a special counsel was a big mistake. we have learned nothing either because there is

of this year's march for life theme and that theme is love saves lice. pete: so, how was the president's message to the pro-life community received? joining us now to discuss is the president of the march for life, jeanne mancini. jeany, thanks for joining us this morning. i was in d.c. on thursday. ran into a couple folks headed to the march. first of all, how many years

have you been doing this? and what does this mean this year the sitting president addressed the group? >> i personally have been helping with the march for life for six years although i attended many others. more important importantly this is the 45th annual march for life. it's hard to believe. the 45th annual march for life and, i mean, honestly the enthusiasm was incredible. you could just seat support of the marchers to have the leader of the free world there and to hear his really moving, very moving speech yesterday was just really unreal. and we asked the marchers, you know, please give a big cheer so the president was less than a mile away from us. we were at 12th street. of course, he was in the rose garden at the white house. i understand they could hear the marchers cheer for the president. so it was a pretty special moment. rachel: jeany, i have taken my family to the march. my niece and nephew were there yesterday. i'm always amazed. like the one place where i really feel old. i'm amazed how young everyone is my question to you is, what is attracting young people to the

movement? is it technology and 4 d ultrasound and the fact we can now see inside out womb? it's a pro-science movement? or is it the human rights? what is attracting so many young people? >> i think it's all of the above. i absolutely do think it's the ultrasounds and advances in science and technology that, of course, are very much on the side of life. but, young people are attracted to, you know, the gravest human rights issues. they know that that's what this is. and they believe that their generation will be the one to change things, to build a cull purr of live life. and they have got this unmatched enthusiasm. no cynicism some of us been around longer some of these things. it's contagious to be around them. pete: if you were to give the president a grade. >> an a. he has been really good in terms of protecting the unborn this year. he ran with some campaign promises and he has delivered whatever he could. i would say there is a

rachel: so what's this all about? garrett tenney is live in washington to break it down. garrett? >> well, good morning to you all. can you see the lights are still on here at the white house despite the partial government shutdown. we are told that today the president will continue making phone calls to try to reach some sort of a deal before the end of the weekend. and we are told that progress is being made on those negotiations. witbut last night it was clear they still have a ways to go when the senate failed to pass short-term spending billingbills to keep the governt open. they needed 60 votes for this bill to pass. four g.o.p. senators voted against it south carolina's lindsey graham, kentucky's rand paul utah's mike lee and arizona's jeff flake. but five vulnerable democrats from states that president trump won supported the bill. now, today, majority leader mitch mcconnell will continue negotiations on a revised spending bill, one that will keep the government funded through february 8th, and that's something that democrats have seemed more willing to support. if that passes the senate, the house would then need to revote on the bill before

the president can sign it and the hope is that they are able to do that before the end of the weekend so they can avoid the bigger impact of a partial government shutdown when offices are supposed to be open on monday. pete: important to point out the government shuts down on weekends anyway. bureaucrats don't work on saturday and sunday. but the military does. dean: bureaucrats are working this saturday, right? rachel: my husband was supposed to be home yesterday, all child care arranged until that moment. and i called him last night. he said i'm staying over. we had a -- i called him this morning before the show weighs what's going on for the weekend so i can help make plans and call the sitter. he said i don't know. so really we don't know what's going to happen. pete: your husband is not a bureaucrat. rachel: is he not a bureaucrat. a member of congress from wisconsin. they are having a meeting in a couple hours at 10:00 a.m. eastern to discuss thousand they will move forward. pete: the president coming out saying this is not about funding. we could fund it if we want.

this is about democrats making this about illegal immigrants. dean: political game of chicken. who will blink first. it's not about the funding bill. everybody knows that the thick that's interesting about it this time that message is getting out there. for the first time you look at the headlines today it is saying things like senate democrats are being obstructionists. pete: that's exactly right. even the so-called mainstream media is having to point out who is blocking progress here. first we will start with the statement from the white house. what the white house is saying when the senate was unable to come to a vote and pass a ujt budget. they say, this sarah sanders, senate democrats own the schumer shutdown. tonight they put politics above our national security. military families, vulnerable children and our country's ability to serve all americans. we will not negotiate the status of unlawful immigrants while democrats hold our lawful citizens hostage over their reckless demands. this is behavior of obstructionist losers, not legislators. so some clear and strong language from the white house. rachel: clearly coming from the white house when you hear losers. pete: one place the president can't control is the headlines that come from

what he calls the fake news media. dean, as you pointed out even the "new york times" headline had to point out who is to blame this morning. dean: not something you see all the time. not at all. pete: "new york times" says democrats seem set to block bill to keep government open. a.p. senate democrats derail bill to avert shutdown and bloomberg u.s. shutdown starts as senate democrats block g.o.p. funding plan. do the best they can to conflate it calling it shutdown begins as budget talks falter. democrats weren't talking about the budget. if they were they would have reached the deal. the republicans gave them everything they wanted. they were talking about illegal immigration. rachel: they agreed on everything. let me tell you the democrats aren't used to this. they are used to shutting down the government or whatever their strategy is and the media sort of going along. this is so darn obvious. that this is about daca. that they threw something in here that has nothing to do with the budget. and that they are trying to force this issue and create a fake emergency deadline when we know they don't have

to do anything until march, maybe even june, plenty of time to negotiate. and by the way, if they wanted a deal, you wouldn't have had dick durbin blow it up by repeating whatever the president did or didn't say in that meeting. and you wouldn't have the shutdown. because the deal is set. he said give me the wall, end chain migration, end the lottery system, which is dangerous. and you can have a solution for the dreamers. i actually think, because is he a negotiator. i actually think he would give them citizenship. pete: he might. a lookout of conservatives. dean: he probably would have. rachel: he wants the wall. pete: you said democrats are surprised. do you know who is surprised this morning, too? conservatives. because republicans rarely fight like this. they are finally taking a cue from a counter puncher and this president willing to stare down and not give in. which republicans are so good at giving in. rachel: dean, you said it exactly right. you know, it's a game of chicken. dean: it is. rachel: they are gauging who is going to blink but also how the public is going to break on this. and i think the democrats

miscalculated on this one. dean: i think they might blink first. alan dershowitz on the couch earlier. he had very interesting things to say. maybe they shouldn't have that power at all to shut down the government. let's hear what he had to say. >> these members of congress should not be given this tool to play with. it has proved too dangerous to them. it's like giving children matches. we have to figure out a way of taking this shutdown away from congress. either by law or even by constitutional amendment. this is one constitutional amendment that would pass immediately. the people don't want congress to have the power to shut down their government. pete: interesting take. i mean, ultimately, congress does appropriate as it currently stands, if they don't fund the government the government shuts down. it's not a complete shutdown. essential services are happening. people are going to work. the military may not get paid but they will get paid eventually. bobble mueller is still working today. in case you were wondering about that. dean: i'm sure they were august wondering about that. pete: the trump administration, as opposed

to what obama did in 2013 is trying to make the shutdown as easy as possible on people. because, if you remember, the obama administration weaponized the shutdown in 2013. rachel: they did. let's see what mick mulvaney has to say about the difference shutdown in 2013 and the one we are experiencing now. >> the military will still go to work. they will not get paid. okay. the border will still be patrolled, this will not get paid. fire -- folk also still be fights the fires out west. they will not get paid. you want to make folks understand it will look very different than it did under the previous administration. one of the things that i have learned since i have been in this office is that there is no other way to describe it but the obama administration weaponized the shutdown in 2013. the only conclusion i can draw is they did so for political purposes. so, we'll look different this time around. pete: looking different this time around means this. so here's a couple of data points we pointed out in previous hours as well.

shear what is affected by a shutdown. thousands of federal employees will be placed on furlough, meaning they won't report to work on monday. military will not be paid but they will report for duty. dean: as they always do. pete: well said. here is what is not affected. post offices, you can still mail stuff. social security collect also still arrive in the mail. parks will remain open and airports will stay open. the last shut in 2013 even war memorials were shut down by the obama administration to make people feel it. dean: put signs up we're closed for business. people won't feel this shutdown in the same way. rachel: which might be why when i talked to my husband this morning, one of the ways that congressman gauge where the people are at. not where the media is at. but where the people are at is by phone calls to the office. people really do call in and congressman want to know how do my constituents feel. in 2013. i think the obama and the democrats were pretty effective in blaming the republicans and getting people mad at them. sean was getting a lot of calls saying, you know, people were mad. guest the government open.

this time not so many calls. pete: interesting. rachel: people not -- either they are becoming immune and desensitized to these shutdowns or maybe they are just like, look, and maybe because they're not feeling it like mulvaney said or maybe they are mad at the democrats and maybe not calling republican congressman, maybe they are calling the democrats. pete: or see politics when it's politics. dean: as a person sitting at home hear phone calls pour. in you wonder does it actually really do anything? do the emails to your congressman. rachel: absolutely. dean: do they really mean something? rachel: every member of congress wants to know what are the phones saying? how are the phone calls breaking down? what are the emails saying? they absolutely pay attention to that because their job depends on it that's why all politics is local. dean: good to know. pete: let's bring in a guy who received some of those phone calls in 2013. fox news contributor and former g.o.p. congressman jason chaffetz. congressman, you were there for the 2013 shutdown. you are in touch with what's going on in washington today. break down the difference between the two, as you see

it. >> well, i got to tell you, as a member of congress who actually slept in his office and there were a lot of them, there weren't necessarily clean towels in the house gym in the morning. and i can tell you members start to feel that and there is nobody to answer the phones. it just rings and rings and rings unless you answer it yourself. so members do feel the impact. look, republicans are going to blame democrats. democrats are going to blame republicans. jeff flake is going to blame joseph stalin. [laughter] and then the true independents, i think, when they look at this, the true independents will say democrats way overreached. because there is nothing in the bill that the democrats actually oppose. and they are trying to say that we should be voting on a bill that they haven't even introduced. so there is not actually a bill to actually insert. and i think the logic of that will ultimately resonate with the true independents and people out there. and i do believe, if i had to guess, by the end of the weekend, government is back

in business. pete: congressman, i don't think people are sad about dirty towels in the house gym. rachel: it's not about the dirty towels. i will tell you a dirty little secret, speaking of that that is spouses who are back home. they want their husbands and their wives to come back and get the schedule. there is also pressure not just from the constituents but the families. >> i got to tell threw are some spouses. rachel: they are going get it done. >> take care of business. rachel: pete brought up a good point earlier that this president is really teaching republicans how to fight, how to negotiate. and in this case, the republicans did message well. and they are sticking to their guns because they really do feel like they are in the right on this one. >> yeah. and i thought mick mulvaney and mark short, when they came to the podium, i think they drew some real strong comparisons. i thought mick mulvaney, who was in the house as a member

from south carolina in particular could draw the contrast of how this would be different than other shutdowns. remember, most of these departments and agencies are hoarding tons of cash. most people -- you know, people don't realize that and this cash they can use to parlay this difficult part. and as the mick mulvaney pointed out, they are not going to weaponize. this they are not going to take the department of interior and actually go to greater expense by trying to put barricades, say, around world war ii memorial on the national mall. rachel: outrageous. pete: even the compromise bill on the budget says it would go until february 8th. we get to go through this whole rigamarole again in two and a half weeks which is above the daca deadline. if the president wins this stare down how do you win the future negotiations and deliver on what he wants which is a wall and end to chain migration, the visa lottery system. where does it go?

>> well, right now, members are getting ready. they are clipping on their ties, the house republican also get together at 9:00 a.m. 10:00 a.m. the house democrats get together. kevin mccarthy, paul ryan, patrick mchenry who is the deputy whip, they are going to gather together. and then they are going to actually listen to members for probably an hour and a half or so. there is not much else to do. and the core question will be are they going to bring up the goodlatte mccall bill in the house? there s. there a different version of this that they can also debate and talk about? but i do think there will be some sort of short-term continuing resolution. nobody likes that and then the other thing is the house -- you've got to remember the appropriations passed, multiple of them, something like six months ago. so, the senate has three vehicles, three shells, if you will, that they can use to put forward a continuing resolution to put the goflt back in business. dean: speaking of timing, today happens to be the one year anniversary of the

president's inauguration. he tweeted something about the democrats giving him a nice present on this day. do you think the timing has anything to do with that? >> absolutely. i think the core of the democratic base is the resistance movement. and it didn't really matter necessarily what the republicans were going to do. the democrats wanted to shut this government down. they wanted to, quote, resist. they will wanted to go back to their constituencies and say we are putting it in donald trump's face. we arist resisting. the fundamental problem is they don't have a proactive message. what are they for? they just took away the opportunity to fund children's healthcare for a number of years in states that really matter. so i think. pete: they do have a proactive message. and it's we're for illegal immigrants and amnesty. is that what you go to the voters with in 2018? >> yeah. they care more about that than they do about americans. this is -- as we have talked about multiple times, a if i can dishes deadline. i do think if they do get the government back up and

running, this weekend, they will have a date certain where they will start to have some daca votes. i do think it's wrong when congress doesn't vote on things. they usually just, you know, hey, this is where we think, everybody. put some bills up for a vote. let's see where america is and see who votes for america or for illegal aliens, that's the core of it. rachel: congressman, right now trending on twitter is #release the memo. g.o.p. lawmakers are demanding that the house intelligence committee declassify those memos and let the public see it. is it going to happen? and what will happen when that happens? >> what i'm told is it's a four-page memo, led by devin nunes, trey gowdy mike conway out of texas and tom rooney out of florida. my understanding is it's classified. i do think it's telling that nearly 200 members have gone down and read that. but only one democrat. there are a few things that they can do. there can be a criminal referral from the committee

to the attorney general. that wouldn't be public but my guess is that having been through this myself. that they have already done that. they will also notify the inspector general who has been working for nearly a year on a report. that report is almost done. i think it will be the most explosive and conclusive report that the public will see. when michael horowitz and his 450 inspectors general at the department of justice come and testify, hopefully i believe it will be before the oversight committee. and then they can vote as a committee to release. this but given the classified nature, it's going to be more difficult than not to actually release it. pete: so you don't think it will be released soon, given the classified nature? >> i would like to see it i have called for that. i think they should take a nonclassified version and put it out there. i do think they should name names. but given its current status, what happens is down in the boughs of the capital, literally below the dome, members can go into a room and read. this somebody will probably

it's incredible year. pete: they finished it on a perfect note. all that russian noise russian collusion progress. president promised to make america great again. wages going um. the stock market sum. businesses are returning. bonuses are being given out. i talked to a lady who works at wal-mart in ohio. she says don't tell me the $1,000 bonus i got is bread crumbs. that's meaningful to me. policies effect people's lives. this president has courageously gone after what he said he was going to do which is rare in washington as you know and he is getting things done. dean: it's the economy stupid. so simple, so straightforward. it's doing well. we're doing well. pete: absolutely. rachel: we haven't heard about the american worker this much. i mean, this is just an incredible refocus on to the people who really build this country. pete: what a turn about for democrats who ran as the parties of the worker for years. and now they say we're going to run on the economy. we're going to run on jobs. wait, does that mean you are going to run on trump's agenda? it's working and people are feeling it that's why they are lost in the woods.

and mick mulvaney coined a great phrase with the schumer shutdown. who is to blame and why is the government shut down right now? >> this is just a disgusting and despicable display by the democrats. i will be brutally honest about in this morning. there is no reason that our government is shut down except the democrat party, the democrat leadership wants to create more trouble for president trump. they -- he has extended olive branch after olive branch to them. trying to make deals. trying to make deals with chuck schumer who is somebody you can't trust to make a deal with. now the president is unfortunately recognizing the democratic party will do nothing to move america forward. that's one of the reasons he won. dean: do you feel like the democrats may have overplayed their hand on this one? >> i certainly hope that the american people are recognizing that the democratic party is putting illegals, people here illegally ahead of the american people. that ask what the rub of this is. that's the exact down to the

nub of it they are putting illegals people from foreign lands who are not here legally ahead of american citizens and our military. and, quite frankly, all of our government and our government operations. so, it is so irresponsible for them to be doing. this and it is at a time when everybody has been saying that it's not necessary. these deadlines are fake deadlines. the democrats are voting -- are saying we need to vote on something that's not necessary. but it's the principle. they have to be against this president. why? because they don't stand for anything except for things that the american people are against. they voted against the tax cuts the american people are for them. they are voting against keeping the government open, and the american would like their government open. although i will say four years later after the last shutdown nobody remembers it. it is not going to be the end all for the democrats. and they are just playing politics. rachel: fox news has been at

diners this morning -- a diner this morning in florida talking to people. and overwhelmingly they are very concerned about what this shutdown is doing and what it says about the military. we have had, what, 80 people, 80 of our heroes dying in training. our equipment is not you have to snuff. the good stuff going to the field and not so great stuff going to the training exercises. and people are dying over it. what do you say about that? >> well, this -- that's so vital to what the american people need to keep in mind. when you say a government shutdown. it's not just the national archives building is not going to be open for business today. it is that everything stops, right? so for the military, specifically, whether it's troop deployments or moving men and equipment or missions, you know, things get effected in the training, in how they are able to be housed, this is

not a small problem. i think that the american people are going to wake up to the fact that the democrats are playing politics. this schumer shutdown as it's now being coined and so appropriate, is going to fail on the democrats because they're dealing with somebody in the president who is a great negotiator. and he's -- what he is also going to do i hope in the next day or two is explain to the american people and tell them exactly that he gave them everything they wanted. he -- they wanted daca. he said yes, i will do a deal on daca in return for things that i stand for. the border wall. ending chain migration. ending this disastrous, dangerous lottery system. those are simple things. and he said i will give you on your end if you give me on mine. rachel: david -- >> -- they are saying no. rachel: david, i actually agree with you. i'm hispanic. i want a solution for the daca recipients. i really hope that the president goes out and gives

a message to the american people about the shutdown and his willing flz to find a solution for daca. but i hope he goes directly to hispanics and tells them who is really fighting to keep the daca recipients here and who is not. because he had a very fair deal. he said i'm going to give them a solution. i will let them stay. even give them citizenship. i want a wall. i want the end to chain migration and end to lottery system so we don't have another generation of daca recipients here and with no certitude nowhere know where they are going. i feel bad for them. in march, june, we don't know what's going to happen to them. >> look, i am concerned about them. but i'm more concerned about the american people and the american military. and i will just say that the president cares about them. and the president has said, look, i don't believe in amnesty and i am not going to support amnesty but i am going to give daca

recipients something that they can understand and know. so, supporting the goodlatte bill in the house as an example is a good way for -- to get this done. it gives daca -- those here under daca a three-year ability to stay here. and get themselves in order. at the same time as giving the president the border security, the security for all americans that we so desperately need. and so he is standing firm for america. and that's what is being lost here, is this president only cares about america first. and that whole making america great again, it comes down to the principles of supporting and securing america as a country and the american citizens as a whole. that's what he is all about. and that's what he has been doing. his entire campaign and entire first year. this great first year as the president.

dean: one year today. pete: to that point people may have thought america make great again or slogan are campaign slogans but they are a philosophy. 69%, basically 70% of americans are satisfied with the state of the economy. which is a huge number. david, did you anticipate a year in that the economy would respond, even you, did you anticipate it would be this good? >> i'm blown away and so is my 401(k). that is -- and that's what every american. that's why these numbers are so good for the president. and bill clinton and you guys were talking about this earlier. the democratic party used to be a party of the american worker. and they are -- they have just thrown that out the window 20-plus years ago now. and this president has picked up that mantel and has run with it during the campaign and in his first year. you look at the economic principles that he has put forth in lower taxes, bringing jobs back.

the largest military locations in the country with multiple navy bases, a submarine base, and, you know, on top of that, this day, today, we have over 180,000 soldiers just from the army deployed overseas. that's larger than the british, canadian and australian armies combined. what do they get for that? if you look at the language from dod's guidance, it says that military personnel will not be paid until such time as congress makes appropriated funds available to compensate them for this period of service. so, they're out there on the wall for our freedom and we can't do our job back in washington to get them a paycheck. the last thing they need to be worried about is their benefits and their families while they're out there defending us. i think it's egregious. dean: it goes further than that though, doesn't it in the planning and readiness in the future. a little shutdown, you know, 2, 3, 5, 10 days really has

an effect later down the road, doesn't it? >> so, essential what the dod or the defense department calls essential military operations will continue, the wars in afghanistan, the wars in syria and iraq, but what is not continuing is our maintenance operations, our intelligence operations. the entire civilian apparatus that supports all of those soldiers. all of that is going to be furloughed or is furloughed as of monday. so, for example, the three aircraft carriers that we just had sitting off the north korean coast, in order to staff those aircraft carriers with a full complement of planes, the navy had to essentially gut its fleet back here at home. these budget issues are hallowing out our military when we have threats all over the world. i guarantee you the russians and the chinese and others are fully staffing their militaries as they grow and they are fully investing in technology. we have to do our jobs here. guys, i think this is a systemic problem in washington.

i was looking at a statistic yesterday. right now in congress, there is only 18% in terms of veterans, in terms of members that have served. and i think, you know, one thing about veterans in the fox hole, whether you are black, white, or brown, whether you are rich or poor, no matter where you come from, republican or democrat, you know how to get stuff done for america and we need that ethos back in washington. pete: certainly we need it as pertains to our military and veterans as sure. lieutenant michael waltz thank you for your time. >> i have one more thing for you go jaguars, baby. pete: you are in the tank. a lot of americans are with you, i think. good stuff, colonel. appreciate it. well done. what is the white house saying this morning as washington wakes up to a government shut down. hogan gidley joins us at the top of the hour. dean: plus, todd piro is still having breakfast live near jacksonville, florida having breakfast with friends. how are you? todd: having a great time. talking issues. how was the president's

♪ rachel: today marks exactly one year since president trump's inauguration. dean: so what do the voters think so far? todd piro is talking to them down there live at the beach diner restaurant florida. what's going on down there, todd? todd: this place is packed, guys. people having a good time, but they really do want to get into the issues of the day. we will get right to it start with ann. ann used to work in real estate like the president. anne, how do you think the president did in year one? >> i think he has done great. even with all the resistance he has had, he has done

great. todd: what issues, specifically do you think he is doing great on? >> well, the economy, the -- he is going to help our military. i have a husband that's retired military, a son that was retired military. and a great grandson that's in the navy. so, jobs, the tax, right? todd: all good stuff. >> all good stuff and he has a great family. todd: get to that husband, retired u.s. air force, ernie, thank you for your service, sir. let's talk about the shut down. you stayed up to watch the shutdown? >> i did, yes. todd: what do you make of it. >> it's a democratic ploy to do anything to harass trump that they can do. it's going to come back and bite them i'm sure. todd: you have a specific label you would like to refer to this shutdown as. >> mr. schumer shutdown. todd: understood. let's go to richard now. is he in wealth management business. he looks at 401(k)s from all of his clients. how do you think the president is doing? >> i think he is doing fantastic. all americans, whether you are republicans or democrats

you should be thrilled to know that he has done such a great job spurring on the economy. the corporate tax reduction has helped a lot. the average american is going to pay less taxes no matter what the other side is saying. everybody is going to benefit. it's just a matter of time before people realize it. todd: did you expect this year one? >> actually, i did. because we had to make a dramatic change and trump has done that. todd: quickly, on government shutdown, what did you think? >> well, i think it's just another ploy that ernie just mentioned. the fact that they just want to do anything to obstruct whatever trump does, whatever he does that's good, and he has done a lot good. so it is going to come back to haunt them ultimately. todd: thank you. quickly, before we toss it back to new york. give a shout out to josh stan the man's grandson in the national guard to pay for school. want to give a shutout to him. thank you for your time, sir. >> hope it's not his drill

pete: the federal government is now shutdown. >> what we have just witness on the floor was a decision by senate democrats to shove aside millions of americans. >> the white house is finally officially weighed in. senate democrats own the schumer shutdown. >> the core of the democratic base is the resistance movement, but the fundamental problem is they font have a proactive message. what are they for? >> these democrat parties will do nothing to move america forward. >> shocking and alarming memo detailing government surveillance is sending shockwaves through washington. >> it sounds pretty troubling to me. obviously this has been a witch hunt probably the greatest since the salem witch trial. president trump: the march for life is a movement born out of

dean: super woman. pete: superman and super mom. dean: i've learned a lot in the last few hours about this young lady and she is a super mom. you said excuse me, eight kids? i thought i heard wrong. wow. that's just wow. pete: and a husband in congress whose still in congress because they're trying to figure out what's going on because the government as of right now is shutdown. the senate was unable to reach a deal overnight and that's why the white house and republicans are pointing to you see it right there? the schumer shutdown because while negotiations may continued to and thomas you mentioned, your husband a congressman is there still having discussions in the republican caucuses and democratic caucuses but still no end in sight. rachel: no we don't know how it's going to end and i called about what do we have to do about the sitter back home because he's supposed to be the sitter and he's not there and has a meeting in about an hour. the democrats are meeting too and look, this shutdown was totally avoidable. pete: yes. rachel: this is a manufactured

emergency. democrats saying that it's the republican's fault but if you look at the headlines, which usually break in favor of the democrats especially when it comes to a shutdown i think that the democrats maybe miss calculated. dean: this is just so egregious that even the new york times. pete: i did some art work. every single morning. dean: but shutdown begins as budget talks fault urine the senate. the democrats weren't talking budget they were talking daca and illegal immigrants and that's what held up a budget. because daca and illegal immigrants reporter: part " budget. pete: president up and tweeting earlier this morning pointing out what dean just said. democrats are far more concerned with illegal immigrants than they are with our great military or safety at our dangerous southern border. they could have easily made a deal but decided to play shutdown politics instead, hashtag we need more republicans in 18 in order to power through

the mess. you know you pointed out rachel multiple times a deal was on the table. rachel: usually i like the president's tweet. this says they care more about illegal immigrants or daca recipients. i would say the democrats don't care about you because there was a deal to be made. you were going to stay here, you were going to get certainty maybe even citizenship but the democrats had to give the president what he wanted which was a wall, which was an end of chain migration and end to the visa lottery system and i believe that the democrats don't want that to happen because they want to keep this issue alive and it fits their identity politics narrative and frankly i think they're afraid if you resolve the daca issue as the president said in the meeting which seems like eons ago but in that 55 meeting, he said we get this done, maybe we'll move on to comprehensive and if comprehensive is off is resolved and immigration is off the table , hispanics with a lot like republicans. i really think that's it.

pete: there is an electoral angle for democrats they need these voters and want them. we've revealed on the programmed to it's not 800,000 daca recipients it's closer to 4 million illegal immigrants who could get amnesty under any sort of a deal so if you even talk about that without getting a wall without ending chain migration without ending the visa lottery system you're perpetuating not just the fact that we have open borders and the rule of law doesn't mean anything but potential electoral disaster but it also comes down to the democrats can't resist the resistance. they just can't. making a deal with this president would like make their skin crawl and their activists so much if they do that it's a big part of it too. dean: in this game of chicken they may have overplayed their hand really this time and it might hurt them coming up in the midterms 2018. pete: we will find out so let's bring in hogan gidley a white house deputy press secretary talking about this this morning. before we get your reaction, sir we want to read the statement the democrats have put out about this and get the white house's

official reaction. the democrats putting this statement out about the shutdown they say what a massive failure of leadership, donald trump, paul ryan, mitch mcconnell and republican lawmakers pulled out all the stops to give a massive tax break to their wealthy donor s but now it's time to take care of the rest of america they can't get their act together. the american people clearly want congress to take care of veterans, combat the opioid crisis and ensure children have long term access to healthcare and protect dreamers instead republican leaders pushed our government into a need less shutdown and this is trump's republican party. chaotic, destructive and driven by greed so hogan ultimately they say this is all about greed where are they going with this? >> give me a break. that's so ridiculous. nobody is buying that. look you guys are sitting with a former tv superman in dean cain. i'm working for a real life superman over my shoulder in donald trump. he stood up to the american people last night. he did not bend.

he did not break. he fought to make sure that the military received paychecks. he fought to make sure that 8.9 million american children vulnerable american children who receive health insurance get the money they need to have healthcare. he did that. the democrats did not. instead, i'm disgusted that the democrats played politics with people's lives. they're holding the military hostage, they're holding the american people hostage and these tired old tricks about trying to blame the republicans we needed their vote it's a budget bill and they know procedure, we needed their votes to get this done and they didn't come to the table and they didn't want to come to the table because they want the political issue. they don't want a solution for daca. they don't want a solution for anything. the only thing they want to do is run against this president and quite frankly the american people because from the first time in 30 years, the forgotten men and women of this country have a voice in donald trump and that terry fridays the democrats pete: you know this morning, you've got both caucuses the rep s and the democrats strategizing where do we go

forward. what is the white house's position on separating the budget from a deal on immigration? is there any room for those to be coupled together or do you remain in the future committed to keeping those two separate? >> absolutely not. you have to make them separate because there are two different issues this is a budget deal. the president wants a two year budget deal absolutely to give some security and safety to the american people, so make sure that what they know to be true is actually going to occur that we have a budget in place. the problem with what the democrats are doing is they're taking this down roads that they themselves were against before. they didn't want anything tacked on to the budget. you'll remember we called it the schumer rule. we're dealing with the schumer shutdown now but back before it was the schumer rule which is don't attach anything non-budget related to the budget. he called republicans arsonists for doing so, called republicans terrorists for doing so and now they are trying to attach something that has nothing to do with the budget and daca to the

budget. that is absolutely ridiculous but as it relates to the shutdown i do have to make this point. i'm reading some of the quotes that senator schumer said about the politics surrounding a shutdown. he called it the politics of idi ocy. senator feinstein last night talking about this particular bill said shutting down the government is a very serious thing and people die. she didn't vote for it so what does that say about senator schumer and senator feinstein. rachel: we're seeing house back in session. are you hearing any talks about a continuing resolution? >> look we are in constant negotiation to try to get something done for the american people. the president has been clear in standing up for what he believes in which is providing those men and women in the military the pep who lay down their lives for us every day, providing them with funding, protecting the military families, protecting children. first responders, they have to fight the wildfires or they won't get paid. that's something he's standing for. i don't know why the democrats won't come to the table with something reasonable and rational but it is the schumer shutdown the democrats own it so any negotiation going forward

here any pain felt across this country by the decision from the democrats is on them. pete: hogan as rachel said we're looking live at a shot of the house floor as members of congress do well there's a lot of talking we'll see if there's any doing that happens today but you know the president sat down with chuck schumer yesterday, one on one and it was reported on both sides that they got closer to a deal on daca orem it graze. what can you reveal as far as where the sides may be closer today? >> look the president wants a deal on daca. the american public was open and got to see a 55 minute meeting in the cabinet room that was by camera and bipartisan and the president said i want a deal on daca. i want both sides to come together but not as it relates to the budget. its got to be done separately. we have to put the american people first, the interest of the american people first, something our immigration system hasn't done for the better part of 40 years. the president wants long term lasting solutions to these problems but he's got to have democrats do it and right now,

they just refuse to come to the table. rachel: the president used to tweet a few months ago even about changing the rules in the senate so we can have a simple majority and we have the house, the senate, the executive branch , the republicans do. why don't they change that rule so we can get things done. i really think the people want to, they're tired of this kind of grid lock. >> absolutely and that's what they elected this president to do and so far he's been able to do that. here is what's so interesting and people need to understand this. the republicans have 51 votes in the senate. any budget deal by law requires 60 votes which means you've got to have nine democrats to put politics aside just for a moment and focus on the american people the stop holding our military hostage just for a moment and focus on the american people. the problem is they're focused on politics. pete: is it the white house's position, will they change the senate rules from 60 to 51? i'm not sure if we're there yet, but the president's position has been clear. he's not going to bend or back

down. he will stand up for the american people. pete: hogan before we let you go it is the one-year anniversary of the inauguration. you know for folks out there, it feels like you're watching four years in one year when you watch that highlight. what's the biggest takeaway folks should have about the first year of the trump presidency? >> effectiveness, getting something done for the american people again the forgotten voices out there who have been trying out for help for so long this president comes into office record setting accomplishments in record setting time passing a tax cut that no one saw coming and in fact after the obamacare failure everyone said he can't do anything and he will get through his first two years and not accomplish a thing. he has proven the critics wrong time and time again and the best part about it is the beneficiar ies are the american people. pete: hogan gidley thank you very much, sir now get back to work. dean: get back to work. rachel: [laughter] pete: democrats digging in shutting down the government over the so-called dreamers and immigration. geraldo rivera says what the democrats are doing is despicable and avoidable as well

pete: fox news alert government shutdown overnight due to the democrats daca demands let's bring in geraldo rivera to react to developments overnight. geraldo thanks for joining us the fox news correspondent at large. what do you make of the shutdown geraldo: i think first of all pete you're the only one on the show right now that hasn't had a reality show. you should get it together, man. >> [laughter] pete: i'm working on it. geraldo: four against one. i think that i don't care if you call it the schumer shutdown on the trump shutdown, you know, to borrow from shakespeare a pile of crap smells just as stinky by any other name. i think it's very very unfortunate and maybe the cynical shutdown, i feel worse for the dreamers because now, they're going to be blamed for this absolutely unnecessary act by the legislator, legislation.

i just think that it's pathetic. why did we get here, how did we get here? whose purposes are served by this? are the american people served, are the park rangers who are going to be laid off, are their interests served? the members of the military who are not going to get paid right now, that relationships with foreign governments when they look at us and we seem so disfunctional? i think that it is really really pathetic and i'm mad at both sides and i also think though, you know, the president and i say is a friend of mine and i have no doubt but that the democrats were less inclined to make a deal because they understood that this is his first anniversary. this is the culmination of his first year in office when he should have been celebrating his achievements, and there's nothing either side does to help bring the american people together. rachel: geraldo the president wants to divorce the daca solution or whatever he's going to come up with that idea from

the budget and from the cr. what do you think about that and who is really on the side of these daca recipients? who really wants to make a deal? geraldo: i think first of all in terms of divorcing daca, daca has nothing to do with the continuing resolution or the budget negotiations. just as in 2013, the de funding of obamacare had nothing to do directly with the continuing resolution in the budget negotiations. every once in a while, one party because you need 60 votes to get these budget items passed, one party gets the minority party gets the leverage where they could really really put the screws to the majority party and that's what the democrats are doing here. i think that yes of course he wants to divorce it. president obama wanted to divorce the defunding of obamacare in 2013 but these are politicians. these are cynical people and these are self-serving people. these are people whose business

is not the business of the american people. their business is to get re- elected and ultimately how the american people have judged this will be reflected in the midterms. pete: but to rachel's question though geraldo and you talk a lot about immigration illegal and legal as far as who are the real advocates for dreamers and we've learned it may not be 800,000 it could be as many as 4 million illegals. that's the constituency the democrats say they're concerned about and president trump says it's the american citizens i'm focused on but he ultimately he's willing to make a deal so whose falling short here? geraldo: see pete you're bringing me into the trap, where i have to negotiate the substantive issue that has nothing to do with the budget resolution. i feel and have made no mistake and have written two books that i feel that we need comprehensive immigration reform i also believe as a person profoundly interested in the national security of this country that of all of the

immigrants that we let into this country over decades, these 800,000 are probably the most vetted, the most investigated, the most scrutinized, the most impressive admirable group of immigrants ever. they go to college. they're in the military. they're nice people. they have good families. if quality is what we care about , if a merit-based immigration system is what we care about, these kids qualify. rachel: but geraldo let's get to the point though. if the democrats wanted to do something for these daca recipients, why did they blow up the deal and why are they attaching it to a budget negotiation that they know is going to go nowhere when the president already made clear what the framework is. he says he has to have border security in exchange for a solution for them. geraldo: i think that what you'll have eventually, rachel is in the next few days you'll have a continuing resolution. a lot of bitterness, a lot of

fingerpointing and then you'll have three weeks of the most absolutely reprehensible, you know, bitter debate over immigrants. pete: we've got to cut you off right there. geraldo: have a great week. rachel: you too geraldo.

pete: we are back with a fox news alert. the house back in session amid the overnight government shutdown due to democrats demands. rachel: even the headlines this morning say that democrats de railed the plans. dean: so how should we expect them to cover it from here on out, brea payton joins us right now. how are you? >> i'm doing great, thanks so much for having me. dean: what do we have to look forward from the press? are they going to be fair about this, unfair? we have fake news or real news

what's going to happen with this >> since donald trump has risen to prominens several years ago, every single day has been filled with fake fake fake news. at this point you'd think that the media would figure out how to cover donald trump in a way that's nuanced and in a way that is without being completely off the rails and sounding completely dilution all but they've not decided to do that but there's an expression that if you keep repeating the same things over and over and expect ing different results you're insane. i think that that's clearly what we are seeing from so many members of the media who are just running totally with fake news stories based on a single unnamed source, not verifying it it at all because it confirms the preconceived notions they have about the president. rachel: but some of it is not just that they're reporting fake news. i think some of it is just omission that there's been a lot of success. >> right. rachel: and those aren't being reported we saw talking about isis and the economy. dean: the high right reel.

rachel: that's right and you'll see that here but you're not see ing it in the other media outlets. >> yeah, i think you're totally right that they are choosing to ignore that and they are choosing to focus on stories that are really really dumb. i mean, you know the coi pond controversy where donald trump supposedly overfed fish and when you just watch 10 more seconds of the fish it was very clear he didn't do that. it's just a perfect clear-cut example of the media running with really really dumb things and honestly there are so many thins you could criticize this president about. donald trump promised he would respect religious liberty and protect the little sisters of the poor and yet the department of justice has not dropped their lawsuit against the little sisters of the poor and they're still fighting for the right and order to adhere to the religious beliefs as they serve the poor and elderly who can't afford healthcare. so that's a perfect example of a way that someone could legitimately criticize the president and say here is an exam el of how he hasn't fulfilled his promise yet they

decide to spend an entire day talking about how he overfeeds fish? pete: yeah. >> for weeks if i had a dollar for every time i heard an arm chair psychiatrist say he was totally insane despite the fact they never even met him once in their lives i would be super rich and so would the rest of the country, you know? and then when presented with the white house doctor who evaluated president obama and trump and saying he's totally fine, nothings wrong, you know they're doubling down. the washington post called the doctor himself dilution all. pete: of course. too much nuance let's listen to them. dean: straightforward. >> there's no question by all standards by all met ribs and any way a doctor or cardiologist will look at it the president does have heart disease. >> i said 239 pounds? >> whatever. >> but the white house press seemed stunned that the president who cannot button the button on his suit coat isn't much heavier. pete: will they ever see

themselves in the mirror? >> yeah, i mean that's a great point and whenever trump's approval ratings slips a little bit or there's a fluctuation in that they cover it for an entire day and double it down and pairity with stories like these that are just so dumb and yet, you know approval ratings for the media is in the single-digit s and they never like to talk about that and never like to ask themselves questions about why that might be and you know the footage that we just watched is the perfect example of why their approval rating is in the single-digits. this the reason why americans completely distrust the media because they're going on and speculating about his health and his weight when here we have a professional whose saying he's totally fine, everything is fine , stop worrying about it. he doesn't have a problem and yet they're going full truth around this. rachel: and hypocritical. i thought that was out of bounds dean: making fun of looks. >> when you're republican all of those rules completely go out the door. we see this with melania and

held hostage over illegals? >> yes. i mean, it's quite apparent. you know, i was watching earlier this week, secretary of defense general mattis said that china and russia has replaced terrorism as our number one threat. he went on to say that whatever military fighting competitive edge america once had, it has eroded and so now to be faced with really a manufacture crisis , there is no need for the democrats, chuck schumer and the democrats to make this such an imminent threat to our national security at all and yes, they did but you know i was coming into, i was coming in here this morning and i was just talking randomly to this gentleman and talking about the shutdown and what did he think and he said in the midst of the conversation i only have $17 in my bank account and i was shocked when he said it, but it resonated with me because it goes to the casper asian i believe many americans are feeling right now that while our elected officials who have

been, who have the responsibility of protecting us are playing footsie. pete: i'm going to you rick on that because it does feel like doesn't it feel like democrats are a bit out of touch where people are saying i've got $17 in my bank act but this party is worried about protecting the illegals? >> this will all depend one of the things we're doing is reacting to the shutdown last night but there's a very good chance this will end up being the so what shutdown by monday. there's i'd say better than 50/ 50. pete: who blinks? >> i think everybody does because everybody has played a role in getting us here. by monday morning very good chance the government opens that they will have extended this another three weeks and we go on , so let's wait and see. democrats will take some heat over the things that you're talking about if it continues. i don't think it will. pete: interesting and headlines seem to get in a concession like that from you rick means the headlines this morning acknowledge that and say democrats are holding it up. let's go with rick's theory that the government doesn't shutdown

and then it becomes a debate about immigration and daca as a conservative where would you feel comfortable with that deal ultimately? >> well i want to say this before we get to even that deal. let's look at the calendar. it's january 20, daca expires on march 5. that means this was a construct of the democrats and about politics not about actual solutions. anybody can read a calendar can really see that for what it is. they could have put this aside; however when you go to the politics of this and you push it down the road, cr is nothing. that's continuing the bad behavior. what are they going to fix so while people argued over what should be done about daca, the real important issue here is the more millions of americans and hundreds of millions that will be affected if government doesn't work correctly. it doesn't affect a large amount of people relative to the population. the military let me tell you something and you know this pete our military and military families are a lot stronger. they aren't weak all of a sudden because there's a shut done but they will show up for work on monday without pay and they will

stay in organizations that you work with, that i work with, that i sit on the boards of. if a family needs help you go to wwfs.org, call us and we'll get you the help you need if you're one of the privates who doesn't make much money. so when i say ton, they make more money than the military let's put it that way. the pressure has to be put on them and one of the pressures i'd like to see put on you're not going to get your backpay for your furlough. pete: sure there's pressure that could be applied. dean: let's talk about the politics. i think they overplayed their hand because going back to the man who has $17 in his bank account, i mean people are barely being able to survive, robbing peter to pay paul, keeping their head barely above water. pete: so what does this mean in the ballot box? when they go into the ballot box , well for one i think that the sympathy because right now, daca had bipartisan interest in

moving it into some kind of resolution but i believe that because of what the democrats are doing they've overplayed their hand and people are going to begin to recent the whole contact. >> should it play out that way rick? i think in real life even if this goes on you're always going to have the situation if you are a republican or a trump support er. you're going to blame chuck schumer and blame the democrats. if you're a democrat you're going to blame probably the president. you get to the ballot box and i question if it will even be an end. >> i think people don't care. you don't care. >> but i really do want to -- >> but it's a low pressure in the face as well. >> mitch mcconnell did promise for the last cr that he would deal with this daca thing in january. he broke that promise. >> but who cares? pete: they also said they would shut the government down over daca and they have and now we'll see what happens. >> they sudden we should never take for anything if you go back a couple years and look at what she said the obamas were doing

it? >> [multiple speakers speaking ] >> it's about hipocracy and the democrats have done nothing about illegal immigration. >> i'm sorry. it's nothing but electoral. pete: rick, david and kathy we'll have you back again to continue to debate this. rachel regain control. rachel: turning now to your headlines the government shutdown not stopping the cdc from tracking one of the worst flu seasons in u.s. in recent history. the agency collecting data on flew activity, hospitalizations, pediatric deaths and the effectiveness of the vaccine as health officials warn the virus is only getting worse. 32 states and puerto rico experiencing high activity last week. the department of justice announcing plans to retry democratic new jersey senator robert menendez as soon as possible after a federal judge declared a mistrial in his high profile corruption case.

pete: we are back with a fox news alert. the government shut down overnight so what does that mean for the economy that has been surging under president trump? well joining us now from washington d.c. this morning host of the brand new show

cavuto live which kicks off for the first time in about 15 minutes. neil thanks for being here first congrats on the new show and as a guy who looks at the political and the economic side of this break down this shutdown for us? neil: do you know what's remarkable pete and i was hearing you discussing it, it's almost how people are in the face of this maybe because its happened so often. you know the markets have been steadily climbing through all of this, as if they either expected or make no big deal about it once it happens. the fact of the matter is the markets like the economy itself kind of look at things that are bigger than the u.s. government if you can fathom that and they've been enjoying this ride. its been an incredible ride and stops just over the past year of this trump administration, a dow surged second only to fdr, and remember in his opening year he was coming off a very very depressed level in the market. they had been beaten down after the crash and the fact of the matter is these markets were relative strong levels and he's taken them up to 31% so i think

that this is a market's way of saying yeah, we prefer everything being open but it's not the end of the world they're not. rachel: so the president is in d.c. because he has to deal with the shutdown. he was originally going to florida to celebrate. he's had a lot of success, a lot of reason to celebrate. i was on my twitter and people were saying he should go ahead and celebrate. he deserves it. what do you make of what he's done so far and you know better than anybody about the record breaking numbers. neil: well the numbers are startling when you think as i said they came from already pretty high levels and then he got the tax cut through but remember the tax cut through just came around the came of a holiday so there was a run up in anticipation of that and then of course the run up with the president dramatically cutting back regulations the kind of things a lot of ceo's were telling me some of whom we'll be hearing from later today that is the wind at their back just taking that monkey off their back because that has been a problem and if you were to ask

them a year ago what their more pressing need would be just get the government off our back. now there are people who agree or disagree with that sentiment but the fact of the matter is that paved the way for this run up before the tax cuts even happened. dean: but the tax cut that did hit the tax cuts that nancy pelosi called crumbs, have we even seen the effects of the tax cut on the market itself or is it going to continue to keep pushing it? neil: well you know dean it's interesting. i think a lot of things that happen with the tax cuts were what you found out when you dug through them. one of the things i think that's remarkable is what corporations are doing because not only did their rate go down dramatically from 35% to 21% but here is what's remarkable that they also had another critics will say too much but they had a one-time rate of 50.6% to take trillions that are held abroad and bring it back home. apple indicating that it's going

to be paying $35 billion to the united states government and it's going to invest 350 billion over the next 10 years, whether you want to credit that all to the tax cuts, you know, it's very clear without it, it wouldn't be as aggressive or as generous. and i think what's remarkable is all these bonuses these companies are giving out. in other words they're free to spend that money any way they want dean but they've been plow ing it back to their workers , to their customers to take the utilities cutting their rates 5% for customers. i mean i don't think this was appreciated or absorbed by many in the media, myself included about how this reverberate way beyond the market because these are individuals who are getting these long before, weeks, months before they're going to see it pop up in their paychecks. dean: and they were told that the companies would hang on to it and not give it out. pete: so neil you have your newt show so whose on live today? neil: is that today? rachel: [laughter] dean: i think it's in about 10

minutes. neil: oh, all right i didn't know that thank you for updating me there superman. no we are looking at just where this falls out. not only for the market, the economy. i had an opportunity for two hours to do what i love during the week, what's happening on wall street, on main streator k street if you will and this intersection between taxes and money, stocks that's something we're going to be following a good deal. we've got senator tim scott joining us, just a short time ago. south carolina senator, very pivotal if we can get the government doors to reopen he will be joining us on what the dilemma is here and how this mit not necessarily be falling under republicans that has typically been the case in the past but it could go a different way. we're also going to talk to the va secretary david shulken, this at a time of course when the president remember he had that physical and a lot of people are saying wait a minute is he up to the task? what i marveled at that report

todd: the economy is booming. we'll go here to jill. jill schlesinger a leader of the republican club locally. what do you make of the whole shutdown? >> the schumer shutdown? you're referring to? todd: that shutdown? >> oh, i think it was predicted and it's the resistance. but we're going to keep on keeping on. todd: i love that. we have to keep on keeping on. and finally mike former leader of the county republicans what do you make of the whole shutdown? >> well dreamers is just too big of an issue for the deputies to hold it hostage to hijack it and hold a temporary spending bill hostage for temporary political gain and i just think it's despicable. todd: thank you guys, now the championship weekend by ignoring the elephant in the room. mike, no you're not an elephant but you have something you want to say to america on be half of all americans and against pats fans. >> go jags.
