said they're going to hold another vote to reopen the government by funding the government. the house has already passed it. the senate would need to. the question is will democrats blink. dean: everybody seems to have their heels dug in. white house saying they won't negotiate, won't negotiate immigration while this funding bill is going on and democrats say we're not going to do anything because we need to protect these illegal immigrants if you will, over our own military. where's it going to end? rachel: he talked about senate rules. there's another senate rule that's the president has just tweeted about. he wants to see this one blown up. he's saying, "great to see how hard republicans are fighting for our military and safety at the border. the dems just want illegal immigrants to poor into our nation unchecked. the stalemate continues. republicans should go to 51%, the newark option, and vote on real long-term budget, no crs. what do you think about that?

antebecause the last thing the democrats want is a nuclear option because essentially the expire trump agenda goes forwar. pete: of course tax reform happened on the backs of only republican votes. the democrats are invested in resisting and if you want to get something done you got to push past that resistance. he's suggesting that. we'll see where the news cycle goes on whether it's actually considered in the senate but it would be a huge move if it was. speaking of the agenda, so you're talking about spending and keeping the government open. republicans insisting you got to separate the wall and daca and chain migration from this debate and we heard from the deputy -- principal deputy white house press secretary that they're going to separate those two. well, a democrat, as we've pointed out this more, luis gutierrez out of illinois has acknowledged on another network that he may be willing to actually build the wall in exchange for the daca deal. it's a suggestion the deal could be there. take a listen. >> if that's what it's going to take to take 800,000 young men and women and give them a chance to live freely and openly in

mcconnell to get rid of the filibuster rule since the republicans took over the senate and the house and the presidency we could have gotten the whole trump agenda through trump supporters would have really liked that. i think this is a fascinating new development because it gives something for mitch mcconnell to chew on, possibly break the stalemate and in the process, get the rewards of having them to get the rest of the agenda out. pete: absolutely. dean: earlier on the show we had raj shah, a principal deputy white house press secretary and he says that the dems shutdown are holding troops hostage. he talked with us this morning, here is the sound. >> this is the democrats and chuck schumer shutdown. they've been in the senate for years. they had eight years under president obama and a president that was more willing to sign immigration legislation that they preferred. they never shutdown the government over that issue. they're doing it now to try to blame this president. it's wrong. it's completely out of line with

how legislators need to operate in compromise and frankly they're holding our troops, holding our first responders, holding our border patrol agents all hostage over unrelated legislation and i think the american people understand what's going on. we have had more nominees for senate confirmation filibustered in this administration one year alone than the rest of history in recorded time in this country the level of obstruction is unprecedented and i think the response needs to be unprecedented when dealing with the filibuster. pete: republicans had a couple key themes, either you're for illegal immigration or american citizens on this vote about democrats are voting against something that has everything in it that they want. the only thing that's not in it is a non-budgetary issue which could be handled later based on a fake deadline and i do think democrats there's concern that they're losing this messaging and it's going to hurt them that chuck schumer has led them into a proverbial political ambush.

rachel: you're absolutely right. if you're a democrat and especially if you're from a red state who voted for trump or was in the middle there you're not happy with chuck schumer right now. he put you out there. you're in the line of fire that looks like it's going to break in the way of the republicans in terms of who gets blamed for the shutdown, and you know, this is a big test for chuck schumer. this is him as the leader of the party. dean: but some of the democratic senators want to be in the line of fire because they may have plans beyond right now. they may be looking at 2020 and maybe run out there. pete: wait this isn't just about policy? politics? dean: what a surprise. pete: so a bunch so these are five potential 2020 presidential nominees on the democratic side, corey booker, elizabeth warren who the president calls poke a on the as and bernie sanders until it was the front runner and they're all positioning

themselves with a hard line on the democratic party and they don't want the shutdown to end because they want the base to love them because they stood up to republicans but what's so interesting as you mentioned dean is the democrat in states that trump won who are up for election in 2018 that voted for the budget because they want the good idea so you've got the pragmatics who realize this is a bad shutdown for democrats versus running for president in 2020 and if you're chuck schumer who do you side with and how does it end and i don't see those folks we put on screen backing down because it's not in their political incentive to do that. rachel: if you're an honest broker who really does have a heart for those daca recipients and you want a solution this is not the way it gets resolved and it looks like from what we hard from raj shah and everything else from the republicans they're standing strong saying we're going to deal with the government shutdown and only this bill for government shutdown. we are not going to deal with daca. you want to deal with daca we'll deal with that later. pete: not to use a phrase but there is a crack in the wall for

>> thank you. dean: she's a lois lane. i had to say it there. >> oh, thank you. oh, it's dean on the show of course. dean: you've been all over this, so where do we stand now? >> well, this is pretty incredible. all of the members that i've spoken with who have had an opportunity to look at this memo , remember the memo was put together by not just the recent information that was given to the house intelligence committee but information that they've been compiling for months now, so over the past year. everyone whose seen it says they are shocked and stunned at how the fisa warrants were packaged and used. now, there are people named inside this memo. this is a highly classified memo and i think that's why a lot of members of congress have kept a very tight lip on this. they don't want to leak names but they want the american public to understand that there was extensive fisa abuse and this is huge because this means that the foundation that the special council built their case

on in order to investigate trump and members of his team right now and even the investigation going back way last year, they saw the dossier and some other information was built on a very shoddy foundation according to the people that were looking at this. pete: absolutely. as you look at this what's the process by which this memo would get declassified so that the public could see it? >> okay so this is what needs to happen. the house intelligence committee is basically going to hold another vote. this vote will then be made for the public. they will say okay and they're sure it's going to pass because the republicans are going to pass on the party line to make this available for the public. then the memo will go to the president where the president will have five days to decide whether or not to declassify the memo and from what i'm being told from my sources, he will declassify that memo for the public. they're actually hoping that the memo gets declassified very soon the latest i've heard is the end of the month but the soonest could be any time this week.

pete: wow. rachel: so if there was fisa abuse, is that on the people who are presenting the information to the judge or is it that the judge was willing to agree to this with shoddy information and maybe knew it was shoddy whose to blame here i don't really quite understand. >> okay it appears that it would be the people bringing the information to the judge. now remember it's not that difficult to obtain a fisa warrant because overall, everybody brings like as much as they can to the judges, to the court that's the foreign intelligence surveillance court so you want to have all your ducks in a row. you want to present these documents and you want them to be solid so many times the court just approves them. apparently the first fisa warrants were denied by the court and that's very interesting. they don't usually deny them and then something else was brought to the court where it was approved. now, what's really interesting is that they kept re authorizationing this fisa surveillance, so we know that it wasn't just the first time but that the courts were then

signing off on continuous fisa surveillance and i just want to go back rachel really quick. remember last year, we were breaking stories regarding the fisa courts and they were chidin g the obama administration from 2011 until now there was a threefold increase in unmasking americans and towards the end of the year they were going, they were unmasking everyone they could, samantha power we saw 300 and susan rice and others so this is very interesting. dean: sarah carter aka loise lane. rachel: she loves it.
