welcome to "america's news hq" life or my nation's capitol today. i am gillian turner. leland: great to be with you, gillian and u.s. home. i am leland vittert. a fox news alert senate majority leader mitch mcconnell has promised a 1:00 a.m. vote to put an end to this government shut down. a boat no guarantee that it will pass. a stalemate has left a lot of uncertainty about when it will reopen. >> there is a chance this thing get done before 9:00 on monday morning when folks come to work and if not it could go several days because they look at the state of the union during the shutdown. leland: a lot of options. mike emanuel if congress is working, so is mike.

>> this is the deal. there is a plan for the senate to vote in 12 hours to see if enough lawmakers would support a three-week government funding extension. the senate is now dabbling back into session for the day. the same senate floor where senate democrats and some republicans blocked a four-week funding passage late finding -- sunday night. chris wallace pressed a key democrat on what he would be willing to expect. >> i voted against a 30 day cr. on friday assistant to the secretary mattis put out a statement saying we shouldn't have another 30 day cr. that is why there were republicans and democrats who voted on friday can a 30 day period it depends what is on the table, what we'll move forward on. >> republicans were quick to labor the schumer shutdown tying it to the leader. gop leaders know that there is nothing controversial in the bill democrats rejected, the

cost to continue in a variety of other important issues we have been discussing here for a couple of. together, democrats and republicans have enough votes to pass it. five democrats crossed over and voted against shutting down the government. keep the government open while we do our work. the house saturday passed a. the president was ready to sign it. we were poised to send him this compromise solution and he raised the threat of a shutdown. but unfortunately, my friend, the democratic leader had other ideas. now, we all know in the senate, the minority has the power to filibuster. i support that right from an

institutional point of view, but the question is when do you use it? on friday the democratic leader made the extraordinary and destructive choice to filibuster our bipartisan bill and guarantee the american people a shut down of their federal government. now it's the second day of the senate democrats filibuster in the senate democrat shut down of the federal government. because the president wouldn't resolve months of ongoing negotiations over massive issues in one brief meeting and give the democratic leader everything he wants, my friend across the aisle has shut down the government for hundreds of millions of americans. because he didn't get everything he wanted in one meeting friday with the president.

sulu pays the price for that? health care for needy children. training and resources for men and women in uniform. care for veterans who came home and survivor benefits for families of heroes who did not. full funding for the cdc nih and safety inspections of food and medicine. you know, to most americans, those sound like fundamental responsibilities. to the democratic leader, currently they sound like hostage rates for the taking. all of this was totally unnecessary. there is a broad consensus on both sides of the isle that daca another issues relate to illegal

immigration require a compromise aleutian. almost everybody here, democrats and republicans believe we need to get to a solution on the side can related matters. bipartisan bicameral negotiations have been underway for months, but they can go nowhere until senate democrats realize the extreme pass their leader has charted leads them nowhere. a filibuster of health care for nine children. a filibuster of training that our war fighters need to keep us safe. a filibuster funding for the federal government for hundreds of millions of americans, all over a tangential issue related to illegal immigration that does not even ripen until march.

all of these other things re: mergers. the one nonemergency issue that our friends on the other side are trying to shoehorn into this discussion doesn't reach that status of emergency until mark. this is pure folly. the american people know so. that is why in a recent survey, the majority said keeping the government open is a higher priority than shutting down the government over the issue of illegal immigration. that is why headlines all across america are laying the blame for this government shut down right at the feet of senate democrats and their coasters. now, the democratic leader could end this today. we can get past this manufactured crisis and get onto a host of serious issues before

us but require thoughtful, bipartisan negotiations. the shutdown will get a lot worse tomorrow. a lot worse. today would be a good day to end it. all we have to do is pass the commonsense legislation the senate is currently considering, ending the a government shutdown ensuring health care continues for vulnerable children. there is nothing in this measure that my democratic friends cannot support. so here's the situation. if nothing changes, the cloture vote will be no sooner than 1:00 a.m. tonight. we can resolve this much earlier if the democratic leader withdraws his procedural objection and allows the senate to proceed the votes.

our constituents want us to end this. secretary mattis, military leaders and governors want us to end this and we can. today is the right day to do it. then a democrats only need to withdraw their filibuster and allow bipartisan majority to move america forward. if they really care about the big issues, increase defense spending, daca and other important matters that we've been negotiating and i would like to bring to the floor, then they will stop their filibuster and their shut down and let the negotiators get back to work. everyone has figured this out.

majority leader in a couple minutes. we'll take both live and come back as news warrants. thank you. gillian: things come only when away in his ways and means committee mike kelly. thank you for being with us. you just heard the senate majority leader on the senate floor has some very harsh scathing words for senator schumer. this is the first time in american history said the federal government shut down when one party come in one party, your party is in both chambers of congress and the presidency. remind me again how we can blame all this on democrats. >> it's really not too hard to figure out what you just heard that her mcconnell say. senator schumer brought this about because he has the ability to filibuster this legislation, the spending bill. there's nothing in the spending bill that democrats don't agree with. protecting our children, paying our troops and a lot of other issues. the argument is over immigration, which is not

included in the funding bill. or you are going to point fingers at it very clear to me that if you tell your party in the senate that she can vote on this, this is a procedural issue. this doesn't come down to the facts. the different between fact and fiction. the american people don't understand senator schumer in the minority has the ability to shut down the government. he just did it and he continues. >> there was a path forward for republicans on this. i want to pull up the latest quinnipiac poll. you know what, we are actually going to go live. we are going to hold on. they were deciding when to cut in on senator schumer. here is the latest quinnipiac poll that tells us 73% of americans nationwide supported fix for undocumented immigrants brought to the united states as children. they want them here in the country. why not included in the spending bill? >> this is in a spending issue. this is an immigration issue.

when you try to cross over and again we can't confuse facts with fiction. our bill is about keeping the government open, making sure children hummus insurance and making sure our military gets paid. it has nothing to do with immigration. if you're on the side of it that you can explain yourself, and the best thing to do so from then out there. this is something they keep relying on, and that the american people will not understand the issue. the issue here is in the senate the minority can shut down legislation from going forward by doing what they are doing. gillian: they can, sir but it's also the majority job to keep the government operational, running and healthy. it is incumbent upon your party commissar to make sure this goes forward even in times of challenge like this. cannot they understand that. something about the majority were you set policy and when you do the right thing for the right reasons, good things supposed to happen. when you do the right things for

the right reasons and someone says they have a legislative maneuver i can do to shut this down, the moment of truth is right here in our voting cards. you can talk the talk, but you better be able to walk the walk. when you tell people you're concerned about chip, the military, all these other issues but then you say and that is all in that piece of pending legislation but i've got to find something wrong with it. i've got to find a way to politicize and not look at the direct policy of the american people need to understand the wall were in the majority, week to work to set an agenda that's out there. it's not my job in the majority to do something the minority says that i can shut it down. why would you shut down a government over an immigration issue that has nothing to do with funding. this is not funding. this is an immigration issue or they can polarize the american people. i'm fine with working on daca, but there's a term out there called deadlines. the deadline was the 19th of

have failed. for democracy was designed to run a compromise. the senate was designed to run on compromise. we are no dictatorship subject to the whims of an executive just as we are not a one-party system or the winner of an election gets to decide everything in the minority not name. we are a government that can only operate if the majority party, the governing party expects and exceeds compromise. the majority however has forgotten the lessons of the founding fathers. they have shown that they do not know how to compromise. not only do they not consult us, they can even get on the same page with their president, president and their own party. the congressional leaders coming to negotiate with president trump. president trump tells me to figure it out with the congressional leaders. this political catch-22, never seen before has driven our government to dysfunction.

americans know why the dysfunction is current. a dysfunctional president, hence we are in a trump shut down. and party leaders warn act without it. it is created the chaos and the gridlock we find ourselves in today. it all really stems from the president whose inability to finish a deal has created a trump shut down. i agree with majority leader mcconnell are the trump shut down was totally avoidable. president trump walked away from not one but two bipartisan deals and that is after he walked away from an agreement in principle on daca we reached way back in the fall of last year. if he had been willing to accept any one of these deals, we wouldn't be where we are today. on friday, in the oval office, i made what i thought was a very generous offer to the president,

the most generous offer yet. the president demanded for months but if you want a 10 included the wall. most of all democrats don't think it was the fact day. we think it's expensive and a waste of money. we are offer tough border security, but every x herbal tell you that drones and sensory devices and personnel are far more effect is on the wall. but because the president campaigned on the wall, even though by mexico demands a wall, for the sake of compromise, for the sake of coming together, i offered it, despite what some people are saying on tv and mind you these are folks not in the room during discussion, that is exactly what happened. the president picked a number for a wall, i accepted it.

it wasn't my number. wasn't the number and the bills here. he picked it. it would be hard to imagine such a more reasonable compromise. all along the president saying i will do daca and dreamers and returned to the wall. he's got it. can't take yes for an answer. that is why we are here. and we don't have anyone in the white house are here in the senate come in the house, republicans and the president's own party to tell him he's got to straighten this whole thing out. he can't say yes one minute and know the next. three, four, five times. the bottom line is this. it would be hard to imagine a much more reasonable compromise. i was in principle agreed to help the president to get a signature campaign promise, something democrats and republicans on the hill staunchly opposed in exchange for daca. a group of people the president said he has great love for.

i essentially agree to give the president something he said he wants in exchange for something we both want, but only after hours of seeming very open, very eager about the generous tentative agreement and it was only tentative, no handshakes, he backed away from the last best chance to avoid a shut down. that's why from one corner of america, this is being called the trump shut down. it is trending all over. people from one end of the country to the other know if the trump shut down and they know why. they've seen what the president has done. it's a direct result of the president who's proved unwilling to compromise and is thus unable to govern. the deal was in everything the president wanted. it certainly wasn't everything we wanted. what it was was compromise.

something nobody loved but everyone could live with. something good for the country. it would've staved off a government shutdown on friday and could reopen the government today. mr. president i am willing to sit and work right now with anyone he designates. let's get it done. right now the republican leader would have them think we forced the shutdown. he forgets several members of his own party voted against the cr. are they holding the government hostage over illegal immigration? doesn't seem that way. republican leader accuses democrats opposing to pay for our troops. house speaker ryan blamed the senate on tv but yesterday senator mccaskill offered a motion to make sure our military

gets paid the majority leader himself objects. in the troops are getting paid because this would've passed in a minute. speaker ryan should talk to leader mcconnell, the only person in the u.s. senate candidate in the way of paying our troops. not anybody here. we don't want to use the troops as hostages. unfortunately, some on the other side may be doing just that. we could make sure our troops get paid right now with the majority leader would only consent or if there's pride of authorship, let them offer the resolution. we won't block it. we will applaud it. i hope it can happen as soon as possible. the republican leader also accuses democrats of blocking chp when you fall amounts every democrat here supports extending chp. it is four-month lapse. who let that happen?

the republican majority. the democratic majority would never have allowed chip to expire. not just because it was placed on the cr was a bad idea for so many reasons, republicans want to pretend that their advocate of chip. quite the contrary. they were using the 10 million kids on chip, holding them as hostage for the 800,000 kids who are dreamers. kids against kids, innocent kids against innocent kids. it is no way to operate in this country. so again, a party that controls the house, and the senate and the presidency would rather sit back and point angers and lame then roll up their sleeves and governor. the way out of this is simple. our parties are very close on all of the issues we've been

debating for months now, so close we might have a deal twice only for the president to change his mind and walk away. the president must take yes for an answer. until he does, it's the trump shut down. he said he has love for the dreamers, let them show it. he said he needs a wall and border security? accept our offer to do both of those things because we democrats while we think the wall will not accomplish much, we strongly believe in border security and fully support the president's offer for budget proposal and border security for this year. so, this is the trump shut down. only president trump in and day. we democrats are at the table ready to negotiate. the president needs to pull up a chair and ended the shutdown. i yield the floor.

leland: senate minority reader chuck schumer with many of the same talking point the democrats used yesterday. we heard from schumer on the floor and in a press conference as well. didn't quite have the same rancor. less name-calling perhaps. we didn't hear him say working with the president was like negotiating with jell-o. perhaps an olive branch, perhaps can use different talking points. in the meantime, come monday morning, everybody wakes up in the government to shut down. what does that mean? the statue of liberty was going to be closed and there is new york governor cuomo announcing that state funds are going to be used to keep the statue of liberty open. you can see lady liberty there off of the shoulder on a chilly morning in new york city. the debate will continue not only around the country in terms of the effects of this.

short-term budget. for some of us this is enough. we cannot continue to fund the government for a few weeks at a time. the budget they are referring to when we would go through the same exercise again for me. i can't speak for all my colleagues, but for me what i hope from the standoff is an agreement that will fund the government for the rest of the year. >> that's what every american hopes. it's a little ludicrous, sir at the risk of offending you, is it not congress' job writ large to fund the federal government? that their primary responsibility in you and your colleagues are falling short month after month, week after week after week. >> this is where there is plenty of blame to go around. what we vowed on, what goes to the florida house and house and the senate, and along the

about independents who voted hard-core for trump in michigan. what are they doing to enough folks back? do you think falling on your sword is the way to do that? >> they were sometimes when they we can't think about electoral politics and that's why this obsession about polling to me gets in the way of our ability to govern and i heard congressman kelly on earlier saying we should just do the right thing. we'll have different views of what the right thing is, but what we ought not do is govern day-to-day, week to week based on what the latest poll says. there's a chance for democrats and republicans to come together. as i said, we can't be in the position of the most extreme voices, and will not accept any daca deal. gillian: and sorry to interrupt you. we are going to heartbreak here. thank you for your time. we will have you back your thank you for the positive message. leland: great interview there.

leland: fox news alert is there's a lot of activity on capitol hill. house minority leader nancy pelosi now speaking to the press about what house democrats can do during the shutdown. >> to champion the values of the american people. hundreds of thousands of people here in different cities across the country. tens of thousands throughout in different venues. the anniversary of the women's march in day one of the trump shut down, americans march to call in our government to honor the priorities and values of the american people. i am proud to stand here today with the house democratic women who are leading leaving for those priorities than five years in the congress. yesterday on the floor of the house i said there is a path in here today we want to talk more about that pass. and it talked about a letter to

the president and what are the priorities we were fighting for in all of this? i just want to say something to her and then implanted into uniform. we in congress take an oath to protect and defend the constitution and the american people. we value the service and courage and leadership of our men and women in uniform and we are here for them. we want them to ignore anything that they are hearing from the other side that they're not going to get paid and we are not here for them. they are going to get paid and we want them to have the resources they need to keep america safe and to keep america safe. we know from listening to general mattis and other leaders in the department of defense that the best way to keep them safe is for us to happen on the best until the end of the fiscal year incentive once again see our after cr after cr.

of political blame, but this time around president trump attempting to point the finger at democrat this morning via twitter. gary tenney joining us live at the white house this hour. he's got all the details. >> a lot of folks to member this is not the first time they enact the "nuclear option." last year in the midst of that tough debate, but here is what they treated this morning. they fight for military at the border. they just want and they should go to 51% "nuclear option." white house officials to explain that the "nuclear option" is just one of many options that congress has too be able to get the government shut down wrapped up and over with. that is his top priority.

in a "nuclear option." with his inability to enact his agenda unilaterally without congress in those frustrations could get a lot worse come november if republicans lose majority in the house and senate in the midterm elections and that is why the white house in part is waging an aggressive pr campaign to place the blame for the shutdown squarely on the democrats. on the forefront of the campaign is accusing democrats of politics with our national security and military. vice president mike pence visited soldiers of the u.s. military base and he took the unusual step of sharing that message directly with our troops who are risking their lives without pay during the shutdown and told them they deserve better. >> just as each of you will do whatever it takes to defend our country come another president trump and i will do whatever it takes to defend you and your families. that said, you can be confident
