day three of government shutdown that we are talking about. rob: that's right, a live look at capitol hill where in hours s from now senators senator from s of the aisle will huddle in terms of getting 60 votes in order to pass a spending bill to reopen the government. carley: that's right, doug live from washington, d.c. with what we can expect. >> we can expect a vote in the senate where republicans will try to end a democratic filibuster today. >> let's step back from the brink, let's stop victimizing the american people and get back to work on their behalf. >> democrats, most of whom are holding out for protections for illegal immigrants who came to the country as children sought to blame the president. >> this is the trump shutdown, only president trump can end it, we democrats are at the table ready to negotiate.

the president needs to pull up a chair and end this shutdown. >> the president has been relatively quiet over the weekend but he did tweet this out yesterday, great to see how hard republicans are fighting for our military and safety at the border. the dems just want illegal immigrants to pour into border unchecked. no cr's or continuing resolutions, you have the president advocating for the "nuclear option". getting rid of the senate filibuster in essence to try to bring the impasse to an end that seems unlikely to happen. we think we will hear more from the president later today at an event at the white house. rob and carley, i can tell you here in washington, this is a much different shutdown than we saw in 2013, closed world war ii memorial. i was at the mall yesterday, it's open. the administration is clearly trying to soften the impact of

some of the closures. carley: that's right. rob: president trump taking to twitter over the weekend to express frustration about the shutdown and the fact that it fell right on his one-year anniversary as president. carley: media taking advantage of the timing using it to make the president look bad. usa today with headline, trump's one-year anniversary marked by shutdown instead of celebration. cbs news out with this, trump marks one-year anniversary with shutdown and abc writing bad timing, shutdown spoil trump's one year festivities. rob: mick mulvaney say democrats we wanted to cast a shadow over the accomplishments that the president has had over the past year. >> i really do believe that part here that was an interest by some folks in the democrat party to deny the president sort of the victory lap of the anniversary of inauguration, the chance to talk about success of the tax bill, success of the economy and jobs, it can go

several days because i think the other democrats want to hear the president give state of the union during shutdown. the president wants to resolve daca, he could have taken it away entirely but chose to give congress six months to fix it. congress is waiting till the last day to do that but we are interested in getting daca worked out. rob: again, the senate will vote at noon today on whether or not to end the government shutdown, that would be a procedural vote and we will see how that works and we will go from there. carley: that's right. as more antitrump texts are turned over, others are apparently missing. kelly wright live in washington, d.c. with the latest details on the mystery, kelly, what's going on? kelly: carley, good morning to you, new batch of text messages with stunning revelations regarding the fbi's handling of the investigation of hillary clinton's e-mail server, the disturbing texts are part of a

new file of nearly 400 pages released from the fbi on friday. some of the texts show that fbi agent peter strzok and lisa page knew then hillary clinton would not face any charges even before she was interviewed by then fbi director james comey. another text exchange, page reveals to strzok knew in advance about then former fbi director james comey to exonerate hillary clinton, the two texting this to each other in july 1st, 2016 stating this u timing looks like hell, yeah, that is awful timing, it's a real profile encourage since she knows no charges will be brought. and then four days later on july 5th, 2016 comey made stunning announcement about clinton. >> although there is evidence of potential violations of the statutes regarding the handling of classified information u our

judgment is that no reasonable prosecutor would bring such a case. we are expressing to justice our view that no charges are appropriated in this case. kelly: other texts of pages between strzo and page, calling him idiot and when president trump emerged as candidate, they texted this about a trump versus clinton race. check this out. they we wanted to say, now the pressure really starts to finish nye referring to the mid-year exam, the clinton investigation, it sure does, we need to talk about follow-up, call tomorrow. we still never have. so a source on congressional committees investigating the fbi texts, carley, say it's outrageous the fbi did not preserve due to technical

problems. the fbi must show now that missing texts are not obstruction of congressional oversight or destruction of evidence. carley: just keeps getting messier and messier. rob: we will analyze this all week i'm sure. the parents accused of torturing and imprisoning 13 children may have had more victims, detectives in california bringing cadaver dogs. david and louis turpin have pleaded not guilty to all charges, they could face up to 94 years in prison. the kids ages 2 to 29 were found malnourished, some chained to furniture in the house. given one meal a day and one shower per year.

carley: senate voting at noon today to end the shutdown as the military is one of the hardest being hit. rob: yeah, here to react the indiana congressman todd, todd, thanks for joining us this morning. i want to ask you, a lot of people don't understand what all happens when we have a government shut down but this has in fact, in military when we need them more than i can remember in my lifetime. >> that's right, a lot of our lives will go by and we won't notice most of this, our protectors, starting with our military will be impacted. thank the, lord, guys, that they are serving for us but they are

doing it without pay and won't get paid until all of this is resolved and that's putting tremendous stress on families and it's unfair. what this is about chuck schumer and liberal democrats putting amnesty and illegal immigrants above funding our government, above military and it's just wrong. carley: we have another week and a half before members and military are supposed to get paid again, but some military members are supposed to begin training over the weekend and were sent home, could the government shutdown potentially put those people in a dangerous situation down the road? >> yeah, of course, they are not getting trained and that makes them less able to protect us, so some danger by this, military families won't get payments if we happen to have a member die during shutdown, that's impact, mobility is impacted, getting

military personel around the globe and where they need to be and that's impacted. the military taking the brunt of this and they are the last people that should are have to take the brunt. again, this is chuck schumer and liberals putting amnesty above government and that's wrong. rob: i have to be fair here, i think both sides are pointing fingers on each other, on friday you had the big oval office meeting between schumer and trump and photos that came out that were close to something there and seemed that they were close to something there and it all fell apart. democrats say that they bent quite a bit to get this deal done and the republicans say they are holding them hostage, everybody has an opinion. >> fingers may be pointed but let's look at the facts. this was a spending bill that had everything in it that they want. they are opposing this bill on things that are not opposed to. the chip was funded, health care for children was funded for six years, other things were funded

but they are bringing in a third argument that's not part of a spending bill into this and that's what's wrong. it's an important issue, don't get me wrong, solving immigration, daca done. that's going on a separate track and they are hijacking the spending bill for that issue and that's why they are putting amnesty above us and that's wrong. carley: some people are pointing out that even though government is shutdown, lawmakers are getting paid but you're donating your salary, is that right? >> that's right, i'm donating to families of law enforcement, ice officials, border patrol agents who have been killed by illegal immigrants. frankly, i've been vote to go keep the government open so i'm not sure that i have to, i call on chuck schumer and others to do the same thing. you know what, president has been doing a great job and general mattis have been doing everything they can to keep the government open and give them a lot of credit. rob: we have a chance at three-week continuing resolution and maybe a daca deal coming up. we will see if that turns out

carley: democratic new york governor cuomo using state money to reopen popular tourist site, the state will pay $65,000 a day to pay federal employees to operate the site. rob: 65 grand a day. all right, day three of the government shutdown officially entering its first full workday now so it's going to feel a lot more real today. here is a live look at capitol hill where in just a few hours congress will return to try and get everything back open. the senate rejecting an opportunity to reopen the government overnight so what can we expect today? are we going to see any progress in this? here to weigh in republican strategists john jordan and george washington university professor wendy. guys, thank you so much for coming on this morning. we do appreciate it. john, i want to start with you, according to democrats at this point, they say that on friday chuck schumer went into the oval

office and offered the president the wall, paid for, $20 billion, a dream come true to this administration if it is true and yet somehow there wasn't a deal, do you believe that that actually occurred? >> no, there's no reason to believe. the democrats have a big obstacle problem here. now they -- the noisy majority inside democratic party is holding them hostage. they are siding with illegal immigrants and opposing funding chip which republicans offered, military people not being paid, even the new york times washington post la times have all come out and are blaming democrats in the senate for this. you look at realclearpolitics.com ballet preference and it's democrats plus five. because of distribution problems that democrats have concentrated in larger cities, they need to be north of ten and the number

is falling. this is not going to be helpful for them in promulgating the new blue wave that they like to talk about so much. rob: chuck schumer has vote today secure border and do you believe that he went into the oval office on friday and offered in exchange a deal on daca to protect the 800,000 immigrants brought here as kids, do you think he offered the president full funding for his border wall, do you think that happened? >> rob, i don't think that he offered him full funding but i believe that he offer him a substantial amount and by all accounts what is being said by chuck schumer is that the president actually gave out a number and said this is the number in which i would like to fund the wall and schumer said it's a done here, what we are having here, people are being held for ransom and that's not good, daca, children's health insurance for ransom.

it's not really about the democrats or the republicans, it's about how do we move forward as the strongest government in the world and we are on day three of a shutdown. that is a big issue. rob: okay, the magic number will be 60 in the senate. we have to get to that number. there's going to be an attempt today at least procedural vote to try and get there and it's going to be a deal basically on a three-week cr which is a continuing resolution that we will put a date on a daca vote and we will vote and figure this out in three weeks, john, do you think that that plan makes sense, does that get to the magic number to reopen the government? >> i think it has to because the optics are going badly for the democrats on this specially in the state that is they really need to be competitive in. but more to the point, this has no business being a spending bill at all. they are already in negotiations over daca and immigration, why are we holding soldiers, why are we holding soldiers, families hostage and the childhood health insurance hostage, why is it in the spending bill at all in rob:

office, if we are going to build a barrier and spend money on barrier, we need to test it, they had u.s. special forces test it and turned out perfect. what we are going to see is see something that's going to completely and totally stop illegal immigrants from crossing over the barriers. rob: certainly is the hope. i do think -- as we have seen democrats have always supported at least some kind of border fencing and security at the border and keeping illegal immigrants out of the country only in the last year or two, certainly flipped on that. méxico is a nation with a lot of problems right now. let's put up homicide numbers here. this is from 2017, a country about third of the population of the united states, around 127 million people live there and they've had almost 30,000 murderers last year, 27% increase from 2016, i think there's five states right now that there's a travel warning from the u.s. government not to go there, warning that's equivalent to the warnings of going to syria right now. it's a very dangerous place, there's a need for security.

>> well, and the crime is spilling over to this side of the border, into the united states. if you look at the criminal cartels, this is a multibillion dollar industry, drug smuggling and human smuggling into the united states generates huge amounts of revenue and they will fight to keep revenue open, they will not let it go away. when you look at what the democrats and the republicans have said, the secured border fence act, they supported that, but now all of a sudden they are saying, well, we don't need a wall or fences or anything like that and down make any sense, in fact, what they are doing is they are playing politics with the security of the united states. carley: president trump does say that méxico will pay for the wall whether directly or indirectly. we will see if that happens. there is a report that says out illegal immigrants are being relocated throughout the u.s. on commercial flights, is that true? >> that is true and what we are looking at again is we are looking at you had on

rob: welcome back, california could soon allow illegal immigrants to automatically register to vote. new rules going into effect in april will automatically register anyone with a driver license to vote and illegal immigrants are allowed to get driver's licenses in california. the rules require dmv to forward records to eligible applicants, records of eligible apolitic cants to the secretary of state's office unless they choose otherwise. we will see how that goes. carley: german city bans all refugees after a surge in violence, about 3,000 asylum seekers but is saying no more after teen was allegedly slashed in the face by two syrians, before that another group of syrian teens was arrested after they attacked a couple outside a
