how close congress could be to reaching a deal. and what kind of message to members of president trump's own party want to hear in his first state of the union address? iowa's senator joins us live to preview tomorrow's big address. ♪ >> shannon: hello and welcome to "fox news @ night." i'm shannon bream in washington. here tonight, republicans on the house intelligence committee voted to release a classified memo they wrote that upwardly alleges the fbi improperly used surveillance. christopher wray tonight says the removal of his second in command, andrew mccabe, was not political. nevertheless, both of these new developments signal a sharp uptake in the political temperature here in washington. continuing coverage tonight. and we begin with chief national correspondent ed henry on the

exit of the fbi's number two, andrew mccabe. >> great to see you. breaking right now, i'm told top white house lawyers who specialize in national security matters are now pouring over this republican memo after consultations with staff on the house intel panel. they are going through this memo carefully with two goals. it released the memo as early as wednesday so as not to step on the state of the union address tomorrow night. and then i'm hearing we will hear a new push from republicans on the health for a second special counsel to be named. top people at the fbi like andrew mccabe and rod rosenstein in the justice department are implicated in this republican memo. g.o.p. leaders do not think they can credibly investigate themselves. mccabe is no longer in office but tonight he's technically on the fbi payroll because he's running through his left over vacation time to reach his full pension. he was removed just hours after his boss, christopher wray, quietly made a rare sunday visit to capitol hill to get a look at that memo.

as "the daily beast" reports, mccabe is one of several officials named in the memo who engaged in what republicans are calling fisa abuse, to get a warrant to spy on former trump foreign policy advisor carter page in part with information from that trump dossier paid for by the dnc and the hillary clinton campaign. the president has been tweeting in recent months about the fact he does not believe mccabe should have been leading the probe of hillary clinton's email server for so long before he finally recused himself. remember this december 23rd tweet from the president. "how can fbi deputy director andrew mccabe, the man in charge, along with leaking james comey, of the former hillary clinton investigation including her 33,000 illegally deleted emails be given $700,000 for the whites campaign by clinton puppets during investigation? today the white house tried to insist they had nothing to do with it. the house intelligence panel voted to release that memo on

surveillance. democrats claim g.o.p. lawmakers i cherry picking key information to help the president politically. there was a democratic motion to release their own memo, but that was rejected. watch. >> i think he has done an admirable job serving the country and i think that this committee and others have done a tremendous disservice to mr. mccabe. >> it's about democracy and the constitution. it's about people being able to know if justice and democracy has been subverted. >> rod rosenstein, number two at justice, and christopher wray were spotted leaving the white house after chief of staff john kelly this afternoon shortly before the houseboat, which now starts the clock on the president getting five days to decide whether to block releasing this memo on national security grounds, or just let it be released. meanwhile, the nonpartisan justice department inspector general michael horowitz is also expected to release an explosive report looking at the handling of the clinton email matter among other issues by mccabe and other officials. "new york times" reporting tonight that he was briefed on

something in that ig report that sparked an effort to demote mccabe. the big question tonight is what else we will learn about mccabe from this report and what other top officials at the fbi and justice may soon be ousted. >> shannon: ed henry lie for us tonight. thank you. the question of the hour. now that they voted, when will the memo be released? chad, our senior capitol hill producer has been over on the health seeking answers all day. and night. good to see you. one of the concerns now about releasing this memo without all of the other materials? >> some people, especially democrats on the committee, so you need to have the background information, and that classified material. you need to have this side-by-side. committee republicans will say no, this was all something we have discussed in the committee. you can't declassify this information, shannon, because it might disclose sources and methods nav potomac maybe even put intelligence assets at risk. there's a big debate about this. mike quigley, a democrat on the committee from chicago, he indicated that this is like someone who hasn't read the

book, a teenager who was up at 11:00 at night, 1:00 in the morning, has had to cope rebels and is trying to finish the book report without winning stomach reading the book. you need that classified information. the republicans say that's not the case. >> shannon: why release it now? because the question right now, some people said they wanted to get this out before the state of the union address. trump comes to capitol hill to talk about this tomorrow. it seems like they will let this ride a little bit later in the week. there was a big debate on capitol hill about reauthorizing the fisa program, section 702, domestic surveillance. they did a temporary extension of this at the end of the year. they did it on a longer-term basis in mid-december. had they released this memo a couple of weeks ago, that very well could have tanked that roll call built because this program is so controversial. republicans will say wait a minute, this has nothing to do with section 702. some of the things which are alleged in this memo contribute to that narrative, that this was the problem with fisa overall. that could have ended the

program and forced it to go dark right there. >> shannon: a very interesting intersection of viewpoints there. >> some gaming of the system. >> shannon: that happens from time to time. thank you very much. >> any time. >> shannon: democrats claim republicans are tarnishing a special counsel's probe with partisan politics. the minority party is preparing a memo of its own this evening. unclear if it's going to the same classification vetting the g.o.p. is now doing with their memo. the former chief counsel for the senate select committee on intelligence and former deputy assistant attorney general, represents the members of the president's campaign in the mueller investigation, great at it with us tonight. >> great to be here. >> shannon: there so much to unpack air. we we have a tweet from former presidential contender evan mcmullen saying this. fbi directors and their teams are expected to serve long terms to ensure independence from the politicians they hold accountable. firing comey, forcing out mccabe and reassigning others is a purge of independent law enforcement readers in an effort to place trump about the law. your reaction?

>> president trump should have fired james comey on day one. just for his behavior in the hillary clinton so-called investigation. who can help it if there are corrupt people they are trying to purge? mccabe is too little too late. his wife paid over $700,000 from hillary's top democratic fund-raisers to run for office. any law enforcement officials should be sensitive to the fact that they should recuse themselves because of the appearance of a conflict of interest. and what did he do? he stated and he conducted. he was director stomach directing the so-called investigation of hillary and the exoneration. and then he started the investigation of the trump campaign with the russians. he did not even recuse himself conveniently until one week before the election. >> shannon: what you say to those who say the money to his wife did not come at the same time that he was investigating hillary, that they didn't

overlap? >> it doesn't matter. they took place. she was running for office, he was helping her campaign. i was there at the justice department, i know what it's like to say i can't do this because it might not look right. if that's what he was supposed to do. now we see with all these texts that he was just involved with peter strzok and lisa page, setting out insurance plans deciding what to do. >> shannon: you are referencing a tweet that talked about a meeting in andy's office and a lot of people think that andy was andrew mccabe. we have this memo now. at the democrats say it's full of misleading information. they are offering their own memo to separate fact from fiction. here's what the top democrat, adam schiff, on the house intelligence committee had to say today. >> we had boats today to politicize the intelligence process, to prohibit the fbi and the department of justice from expressing their concerns to our committee and to the house and to selectively released to the public only the majorities

distorted memo without the full facts. a very sad day i think in the history of this committee. >> shannon: both sides are adamant about where they stand. where is the truth in all of this do you think? >> we we will go into the docut comes out. i don't think that schiff is shedding real tears there. i think that's bit of trauma for the media. >> shannon: i want to ask you before we let you go because you had some advice for the president. he said you didn't think it was especially smart for him to agree to sit down with special counsel. noting that everybody has pretty much got in trouble so far, it has not been about the underlying conduct, which may have been legal in these cases. it's the lying about it. axioms wrote this. he says one source who knows trump as well as anyone told me he believes the president would be incapable of avoiding perjuring himself. trump doesn't deal in reality, the source that, he creates his own reality and he actually believes it. you know the fact is that if you get anything wrong if you are

sitting there in a conversation with a federal investigator, you could get yourself in a lot of trouble. >> there's any crime at the basis of this investigation. that's the frightening thing to me. they're supposed to only be a special counsel appointed if there's criminal activity, and rod rosenstein directed bob mueller to look at any links of coordination between the russian government and the trump campaign. there is no criminal conduct stated in his directive to bob mueller. that is scary in and of itself. the second thing is you don't have to have lied. scooter libby didn't lie. he said what he thought was the truth, another witness said what she thought was the truth and the special counsel in that matter, in which scooter libby was indicted, indicted scooter libby without one other minutia of evidence. two years later that first witness recanted because she found other evidence.

it's frightening, because you don't have to lie. if a prosecutor thinks you can be indicted just because you disagreed with another witness. >> shannon: it's a very delicate dance. and we will see what the president ultimately, now consulting with his lawyers, tries to do. thank you so much, good to see you. at the white house as it had no part of the decision-making process that led to the departure of fbi director andrew mccabe. there sarah sanders answering a question on the point asked by our own john roberts. >> would you say that the white house was not involved in the decision, but clearly the president seem to be involved in a public relations campaign against mccabe? >> the president stands by his previous comments, but in terms of the situation today, as i just said, we've seen reports just as all as you have, we don't have any specific comments and i would refer you to the fbi for any specifics. >> shannon: let's bring in politics editor and author of the half time report,

chris stirewalt. tomorrow night is the state of the union. let me ask you this, do you think this comes up in a speech at all or do you think he does not touch the situation? >> to a certain degree he might be obliged to stick up for his own justice department because now we come to the point where the attacks are so constant on the justice department. these are the president's appointees. we know he doesn't like jeff sessions. he doesn't like the way jeff sessions has done his job. >> shannon: he didn't like the recusal. >> it stuck with him. i don't know how much longer jeff sessions really can stay on as attorney general given the way in which republicans in congress and the president basically say the justice department is a mess, the fbi is a mess, everything is a garbage fire disaster. the president could go a long way towards getting past this part of it by saying christopher wray, our team at the justice department, our team at the fbi, great people, doing a a great b independent and strong. if you were to say that that would probably help them a great deal.

i don't know if you will. >> shannon: this is what he's up against. tweet from former fbi director james comey singh special agent andrew mccabe stood tall over the last eight months. at one small people were trying to steer it on the institution we all depend on he served with distinction for two decades. i wish them well and i wish for continued strength for the rest of the fbi. america needs you. these encouraging law enforcement agency that could use a little bit of that possibly from the president. >> the president, he is both the malefactor -- he's the guy that's doing it to them but he also has to be the guy that box them up and here's what happens. a justice department that can't work. an fbi that can't work. things start to fall apart. i understand why republicans have continued to bring the fight against law enforcement and continue to dig in. there are obviously legitimate concerns about the way that hillary clinton investigation was handled. that's a separate different piece, that's where we are having an inspector general report, on all of that. it will probably be seeing that

before too much longer. >> shannon: it sound sooner rather than later. >> that's a very legitimate inquiry. at the other stuff now has just added up to republicans saying the fbi -- the president has to take up for his own people and say this is my justice department. these are my people and when you are attacking them that's a strike against my administratio administration. >> shannon: today our own white house correspondent john roberts of these other things -- jobs in the economy. infrastructure, immigration, trade, national security. >> it that's pretty much all of them. [laughs] >> shannon: a couple more things. >> most state of the unions don't matter. it's lordly and unrepublican. i don't care for it. however, this one really matters because which trump shows up, and if we do get the trump that we are being promised, the guy

be one less than 24 hours from the state of the union and senators are discussing immigration and daca. first time that lawmakers have been in washington since the trump administration laid out its plan for immigration reform and daca last week. the conservative group federation for american immigration reform calling the plan a bust. they say it betrays the president's campaign promises. lindsey graham always a key part of these negotiations joins me. good to see you tonight. i understand you are part of the group of 22. meeting tonight. where are you getting to? is there a compromise coming? >> i think the president's proposal was very helpful. he laid out a strong security border plan. the president spends 25. he gives 1.8 million dream act kids a pathway forward to citizenship. they've got no other place to go and he does some things on chain migration i think there's a market for. we are talking about the

president's plan, is there somewhere in the middle? and i think we can get there. >> shannon: this is what smith, other side of the hill, here's how we describe it. >> mst today, it doesn't have workforce verification, and also it's really an invitation -- they will allow a lot of adult illegal immigrants to apply under the daca program to get amnesty. >> shannon: let's talk about that workforce verification. a lot of people think why not have that because if you're holding employers responsible they will cut down on the magnet for people who shouldn't be here illegally. >> there are about 11 million illegal immigrants and they didn't sneak up on us. if they are in south carolina working in my backyard. if they are doing a lot of jobs americans -- i live in south carolina where it's hard to find workers. to give the daca adults, and

some of them are in their 40s, late 30s, the chance to live in a country, if you told them go home they wouldn't know where to go because they've been there since they were six. in return, get strong border security. moved to an american based immigration -- have told mike why you have 11 million people here illegally, employers cheat. i want to increase legal immigration so employers don't have to cheat. put them in jail and have a national verify system that comes at the end. >> shannon: that will get some attention. a lot of folks a look at 1986 and say the amnesty or legalization came up front. the enforcement never really kicked in. when you talk about different parts in different phases -- i want to get to another big boat. >> it we did exactly the opposite in 1986. what we do to say there will not be a pathway to citizenship for 11 million people who are nonfelons. you have to pass a criminal background check, until we had the border security.

if everybody works together here. if you don't get what you want is a democrat until we get what we want is republicans. we do it together. >> shannon: i want to talk about this other bill that you all voted on tonight, the 20 week bill based on essentially that the belief that there shouldn't be abortions after 20 weeks. there are some exceptions to that, based on the idea that at that stage of unborn fetuses, how far people want to address them, can feel pain. i will read you a couple of things and give you a chance to respond. in testimony to the house committee, the american college of obstetricians and gynecologists say the organization knows no legitimate scientific data or information that supports the statement that a fetus supports pain at 20 weeks gestation. it goes against the constitution, medical aspects and the rights of women across the country. >> standard medical practice is to provide anesthesia to a baby

who was operated on at 20 weeks. why would a doctor do that? they are trying to save the baby's life. at the fifth month of pregnancy. the reason they provide anesthesia, they know the baby feels pain. with that actual people born at 20 weeks to survive. everything is intact in terms of pain, so that group that you talk about doesn't know what they're talking about. name one doctor that would operate on a 20-week-old baby in the womb, five months during the pregnancy, that would operate on that baby without anesthesia? find one and bring them on the show. >> shannon: the door is open. if there's one out there. >> if you're a doctor out there and you want to operate on a 20-week-old baby, five months in the pregnancy, without anesthesia, this is your chance to be famous. there are seven countries in the entire world that allow abortion on demand in the fifth month of pregnancy. what good comes from having a country where you can abort a baby in the fifth month of pregnancy with out -- we exceptions for the life of the

>> shannon: actually to become more popular following their unsuccessful run for the oval office. that is not the case for hillary clinton, whose favorable ratings have dropped since november of 2016. last month gallup had her approval at 36%, but the left seems more enamored with her than ever. trace gallagher joins us now with details. >> the left -- the new clinton controversy continues to unfold. during her 2008 campaign, her face advisor sending her scripture every day. he was then accused by young campaign worker of repeated sexual harassment. at the woman's complaint eventually got the attention of campaign manager patty. watch. >> i interviewed all the parties involved. i looked at the evidence, and looked at the emails that he had sent, i had a look at other documents. came to the conclusion that there was sexual harassment

involved, that the young woman was very credible. >> she then recommended burns strider p fired but hillary clinton refused. nine years later clinton tweeted this response. "i was dismayed when it occurred but was heartened that young woman came forward, was hurt, and had her concerns taken seriously and address." except that can't with a campaign addressed was letting him continue in his role and reassigning the young woman. the #metoo movement compelled several former clinton staffers to speak with "the new york times," ironic considering the 2016 campaign has been cited as an inspiration for #metoo even though harvey weinstein was a longtime friend and donor to the clintons. still, clinton continues touting female activist groups, though she did raise a few eyebrows by using one of the groups literal name. watch this. >> thanks for your feminism, for your activism and all i can hope

delegate elizabeth guzman. congresswoman maxine waters is giving an address on bet, and the official party response from congressman joe kennedy. right now, at least 11 other democratic members of congress say they are just going to skip president trump's joint address to congress tomorrow night. that's about one-sixth as many democrats decided to skip president trump's inauguration and that is because some of thee presidents critics in congress planned a protest in the chamber silently. some are going to do it with her clothing. expect to see all black attire for lawmakers trying to show sympathy with victims of the #metoo and #turnsup movement. more than two dozen democrats if invited so-called dreamers were in this country illegally. and have been since they were kids, into the chamber with the president and all of congressional leadership and most of the supreme court. not ruth bader ginsburg. she is going to be 400 miles

>> shannon: senator joni ernst said days to go the president's rhetoric and complicate efforts trying to get real policy change in washington. what does he think about it chances for his immigration proposal and what did he say to america? joining me now, joni ernst. godaddy with us. >> it's great to be here. >> shannon: i know that something you while they're working on around the clock. there's controversy from the left and the right for the president's plans. what you think are the odds that it moves forward? >> certainly this is a great starting point. what the president has provided is his road map. it's up to congress to make those final decisions on where we go. whether it's the number of dreamers that are included, the 1.8 million that he has proposed or whether it's a smaller number, those are all things that congress will need to make a decision on.

it's a great starting point but there are still a lot of questions that we have for his proposal in immigration and daca. we will have to work through that. >> shannon: at least the proposals we initially saw were so different. do think that the lawmakers can buy can really together? >> i'm very helpful in this regard. daca is not an issue that is owned by one side or the other. we all agree that we need to find a solution for our dreamers. it's really important that we help that population move forward. but all of the other items that they president included, we have to come to a consensus. border security is really important to so many of us. with that, i think we can work through this issue and find a resolution. >> shannon: i want to read the quote that i referenced a little bit earlier about what you have to say about the president. he said i don't appreciate the rhetoric. what i can say is that i do support some of the policies that we are working on.

how tough is the rhetoric part of what he does make your job? >> it is hard because he may be talking about other issues. we've mentioned the five top issues that the president wants to focus on for the state of the union, those of the things that we need to focus on because that's what the american people expect us to do. they want to know that we are going to come forward with an infrastructure package. they want to know that we are going to work on immigration. jobs and the economy, the wonderful tax cuts and jobs act that we just passed last month is providing wonderful opportunity across the united states. those of the things that the american people are really interested in and they want us to work on. >> shannon: what kind of message do you think he should have to run a? what kind of words are concepts or themes would you like to see from him? >> again, going back to those main points that i just mentioned. it will be important to communicate that to the american people. the president, i know, will speak from the heart. he's very good at that.

and when he does it and stick to those topics that the american people want to hear about, they are caught up in his speech and in his language. i hope it's a message of optimism, keeping america safe, keeping a strong, and of course making us all proud to be americans. that's what i hope to hear from the president and that's what i truly expect. >> shannon: i will ask you, there was a vote tonight on something you help the sponsor, this bill that would ban abortions, with exceptions, after 20 weeks based on the concept that unborn fetuses or children at 20 weeks are developed enough that they feel pain. it didn't proceed. you did bring three democrats, but two republicans held out. i got reaction from a group, strong pro-life group, a young group, they said pro-life americans would finally have a groundbreaking victory for life in the u.s. senate if the vote passed for majority rules as it should. if you had to get 60, you got 51. it's time for overall change. what you think about ending the

legislative filibuster? >> i think it's something we need to come together in a bipartisan manner and we need to have a very hard discussion about the rules that exist in the senate today. i think there is room to make improvements, because we see that anytime we are working on legislation, whether we are working on actual policy bills or appropriation, there's always a filibuster. if you don't like something, you filibuster it. and you don't ever see results. it's time to have those discussions and i do think that we can do better for the american people. >> shannon: quickly want to ask you, would you worry if the republicans ended up in the minority, you would lose that goal to hold up legislation you didn't think is good? >> those are absolutely things that we need to talk about. what happens when you are no longer that majority party. but in a bill today, this very important pain-capable unborn child protection act, it had 51 votes, the majority in the senate agreed that this was a

>> shannon: iran dialing back harassment of vessels and north korea scaling back exercises. are the signs that diplomacy is working and what can we expect to hear from president tomorrow night about all of this? let's talk with fox news contributor ambassador john bolton. great at it with us. i want to talk about this report that reuters has out that russia is actually helping north korea by excepting coal shipments, taking them through their ports, sending them back to south korea and japan. today, the state department spokesperson saying this. we've warned russia of its parts.

it russia says it will follow all of these u.n. security council resolutions, but it fails to enforce them and rewards illegal behavior by north korea. there is no more time for excuses, so what we do? >> that's true. i think what this shows is that sanctions are not stopping north korea from engaging in trade with russia, with china, with iran, with plenty of other countries. nor are they slowing down its nuclear or ballistic missiles programs. in fact, i think is a fatal flaw in the sanctions approach to both north korea and iran by using targeted sanctions rather than naming this north korean company or these north korean individuals. the only sanctions that have a chance of working on the kind we imposed on iraq after it invaded kuwait in 1990. if sweeping, very broad sanctions covering whole sectors of the economy and enforcing them with military force where necessary. we are not doing that and the result is the sanctions don't work. >> shannon: what does sanctions get about from a russia or china?

>> they have absolutely no problem voting for tougher sanctions and completely ignoring it. this is something americans have a hard time understanding. these people are hypocrites. they are happy to bask in international praise for coming together against the threat of north korea and iran and then ignoring them once our attention is averted. >> shannon: let's talk about iran because we mentioned how the harassment of u.s. vessels has really backed off and people are trying to figure out what's going on there. new york post editorial said this, to be fair, iran might have backed off in the golf if hillary clinton had won in 2016. it's facing president trump and said. a leader who has enforced redline in syria and -- preserving the nuclear agreement at all costs. is it about that or is iran scheming to do something else? >> i think it's mostly about the nuclear agreement. i think they can see that the president has essentially put it on a deathwatch. i think they are doing whatever they can to avoid that happening

in the europeans are helping them out. that's why today's attention on sanctions for the iranian violations of the prohibitions on engaging in missile transfers i think is really a diversion. the fact is the europeans have been wretched on iran's ballistic missiles program even though it's part of revolution 2231, which endorse the nuclear agreement. the reason iran and north korea have ballistic missile programs is to deliver nuclear weapons. that's the ultimate purpose. i think you've got to focus on the nuclear issue. i think that's what iran is focused on, because they know there's a new reality out there and it's not good for them if we ever get this deal. >> shannon: a little bit better behavior by then. what you make of five the better behavior by north korea? >> i think there on a propaganda roll right now? if they are going to march with the south korean team as if that makes a difference on nuclear weapons. they've done this before the summer games in 2000, 2004.
