>> sandra: not that well, don't start rumors here. >> bill: nice to see you while. it's a great day, i'm very excited for tonight. i'll keep my powder dry and tell you why. >> harris: let's get to the news paid republicans on the house intelligence committee are voting to release a classified memo they say reveals major concerns about abuses of government surveillance powers in the russian investigation. now president trump has five days to review that memo. the white house says he will meet with his national security team and counsel to talk about it in the coming days. if he wants, he can object to the release of that memo. the congressman jim jordan believes the president will approve it. >> i think we'll go thumbs up, but every journalist in the country see and let every american see this memo. if he goes thumbs up and in five days of public and the american people can see it which i think it will speak for itself. it's about transparency, it's about the truth. >> harris: all about a memo and now another one. democrats have their own memo,

but it will not be released just yet. house intelligence committee ranking member adam schiff confirmed the members on his committee have opened an investigation to the fbi and the justice department and he's blasting the decision to release the g.o.p. memo. >> sadly, we can fully expect that the that the president of the united states went up for the national interest over his own personal interest. but it is a sad day indeed when that is also true of our own committee. this is an effort to circle the wagons around the white house and distract from the russia probe. >> harris: bill hemmer, the memo. as they took the vote and house republicans said what's in it to the president. we agree it should come out. of the president said he likes transparency. what happens down? >> bill: my guess is we see it. my guess is he makes the public. i don't know exactly when but the clock with the clock works, they would at 6:00 monday night so you got five days coming up up until saturday. my hunch as it comes out on thursday of this week. the state of the union tonight, going to get a lot of track

tomorrow with coverage that comes after that. which should knock it to thursday. >> sandra: that want to. on friday. a speaker probably not. the question is what does the other side have? what story are they cooking up, what sort of a leak as they're getting ready in the hopper to be flushed out perhaps later today or tomorrow morning? that we don't know. it will be made public, i think will see the democrats memo a lot sooner than we think. but as for all the other. >> harris: even though it has to go for the same panel. >> bill: eventually we're going to see and i think we should see it. as for all of those pages that they used to draft this memo, i don't think that will go out. i think sources and methods should and will be protected. this is going to contribute a lot. i will say one thing. republican from ohio is on this house committee. he was in them committee yesterday. he voted yes. the question was will this put the russian matter to rest? his answer was no.

>> harris: the russian matter to rest doesn't bring bob mueller's investigation to the end or the several others that are going on. but the democrat memo, the way that i understand it melissa is something that has to go through these other channels. we know from our own reporting that sunday night, the fbi director christopher wray took a look at the republican memo dated democrats i would assume would want that same pattern to be followed so that memo has the same sort of clout they hope. >> melissa: it's become battle of the memos and battle of the narratives pending who we are watching. we are listening to. i think that they don't have to be mutually exclusive and that's what a lot of people are missing. you can ask two questions simultaneously that are both very important. one is where anyone's civil liberties violated? that's a really important question of matter who you are by anybody in the question is, we know that rush is a bad actor. did any american help then? goes on the bottom of both sides in what they're looking at. they're both really valid questions. i want to know the answer to both, and it doesn't have to be

republicans versus democrats. one narrative versus the other. i want to know what was anyone's civil liberties violated and did anyone help the russians? >> sandra: that was the point that paul ryan made during the g.o.p. news conference this morning. point taken, but within response where we're going to see the democrats memo, we have to see the same process play out there. and by the way, i don't hear a lot of republicans saying pushing back on releasing that memo. rhonda sanders for 2 minutes ago but it has intel should've released the memo and goes into detail why won't really change things. >> lisa: we arty know that civil rights were already abuses in terms of spying and the use of surveillance under the obama administration. we know that the fisa court condemned the obama administration for for the moment abuses. they also spied on reporters, they spied on senators, various agencies. so we already know those things happen. in regard to your question, release the memos. i would add an estimate. when i see both of them and if

your democrat you got harry reid formally, you got maxine waters call saying that james comey had no credibility at one point, criticizing the fbi, i do think that they also would want to get to the bottom of political bias in the fbi for potential corruption. >> harris: except for yesterday when air quota was tweeting about how everybody was aboveboard paraphrasing him and, comes up in that tree. so let's we look forward to this whole process and you talk about does is put russia to bed, their investigation. >> bill: does it affect bob mueller. >> harris: we don't know what he has paid. maybe you've already seen within the four pages. >> bill: how far down the line are we in this matter and we don't have a resolution on it yet? paul ryan made four points, very important, you're going to hear a lot of this from republicans in the days and weeks, maybe in months to come. number one, were civil liberties violated was his first question. it is a separate matter from the bob mueller investigation, very important to to to hang onto as

malfeasance. number four, the institution of the department of justice is important to keep intact. he specifically came out and said i wrote four things down today. number four is critical now as we go through this debate in this area. >> sandra: let me ask this question as you're putting a forecast out there when this will be made to the public. we are talking almost four pages. this is the summary, what i'm saying is will it make sense to the average american who wants to run through that for what they need grand context and was that evidence? >> melissa: that the problem and they kept aspersions, they say it like a book report and they say they don't does the research behind this. >> harris: others have said it will be pretty much self-explanatory and he do not want to see any portion of it redacted.

that tells you if the redacted conversations have come up, they must be some interesting things in it. >> sandra: they asked christopher wray, the fbi director on sunday. does this make sense? you set out to get back to my table. >> harris: they ask him about inaccuracies but will it make sense of the american public without their notes leading up? is kind of like a legal brief the way it's been explained to me. it better because it's her closing argument speaking. >> lisa: would you would hope that every american that reza would understand the context of it. that would be important. i guess we're going to see republicans have also made some pretty stark characterizations of the memo, so we'll see if it lives through to that as well. were all going to be reading this four-page memo. >> sandra: it's trending. >> harris: is a like tomatoes with an es? space as i was going to make another appointment i completely forgot. is going to want to talk about your list because i often take notes when bill hemmer speaks. we all do actually.

let's go to number three. you talked about fbi malfeasance. can we talk a little bit? >> bill: that was paul ryan's words. >> harris: but you said it. >> bill: i did. >> harris: can we talk about reputational harm to the fbi right now and what rights the ship? >> bill: that's what got to get it right and if it takes a little longer, then so be it. i for one want to get past the stuff and i want to figure out what's true and what's not. i want to know what was going on. i went to know though whether or not you plan on bad information to go ahead. doing what is the economy look like to you. were any of these criminals? >> bill: was a little bit of that yesterday. andrew mccabe now admits his resignation occurred 24 hours after his boss went up to capitol hill. and i think that's the accountability. >> lisa: was and that also in to the inspector general saying it's in response to what horwitz

had found in the doj, special counsel? spector general . i am just on my game today. but that's also another thing that is really important to look at here and what we are going to be looking for in the coming months as well because he has really not been afraid to take on leadership at various agencies in regard to corruption within rates the atf with fast and furious over the dea as well, both of his investigations have led to the resignation or firing of people in leadership. so that's going to be something really to watch here as well. >> harris: i know that this want, but the state of the union, but as the story, to think the president because he talked about timing. >> bill: i don't know if he makes a reference to it that sort of oblique. perhaps. >> harris: he was asked about yesterday. >> bill: i don't think it's written into the script at all. you would be stunned. >> harris: will move on.

this will be my last word on this, you talk about whether the bill be a counter point for democrats on point with the economy, lord trump told me yesterday as the trombone, that's what they're calling it within the family of the next time around, the midterms 2020, whatever. and i don't know what the hashtag backing democrats with a quick but that's what they're calling this economy. meanwhile, there will be no shortage of democratic responses in case you like that sort of thing in the president's address, so many of them. the democrats are planning five lawmaker rebuttals to the state of the union including one from independent senator bernie sanders because he votes usually democrat fueling speculation he may make another run at the white house in 2020. democratic leaders are turning to a famous name to be there official rebuttal in chief. congressman joe kennedy the third, those committees. he may be a little known outside of his native massachusetts but the rising democratic star stirring up a lot of excitement among his parties face.

this is a top democratic official in texas of the kennedy appearance in the lone star state, he gave a powerful speech that was about us. i've never been in a room with democrats where no one left, no one moved, no one talked. it was quiet. but the young kennedy has his detractors. who say democrats are making a big blunder with their choice of him saying the "washington examiner" quote making can be the prime time face of the party is a clear mistake. none of the experience of the massachusetts liberal will resonate with an electorate outside of the cape cod bay area. somehow democrats still cannot understand this ahead of the midterm elections suggesting they still have not grasped the lessons of 2016. bill hemmer, what happened to max the three i get it. >> harris: the book. >> bill: i think it's a great opportunity for the congressman. as a great moment. i just don't think it really matters because the whole world

is wrapped around the home trump right now. what he says and what he does and what he decides. it's his world at the moment. he wanted think like that. push it back and say maybe it's good to have some young blood, new phase to be seen for the democratic party. >> harris: if you look at the picture, one of them is not youngblood. at least. >> lisa: i think it matters because what is the underlying message from the democratic party, who knows because there are five different messages or whatever that message allegedly is. so i think it demonstrates the divide of the democratic party bill reeling from losing something like 1,000 seats whether it's from the state wide local elections as well, congressional et cetera, et cetera. they suffered great losses especially the loss of hillary clinton in 2016. still trying to figure out what they represent when the biggest problem for the democratic party if you got nancy pelosi trying

to say the tax reform law is crumbs. they wanted to make this election about the economy, but now it's very difficult. >> melissa: there all the spaghetti at the wall and see what sticks. two people are talking about the next day. >> harris: he said technically, there are six. five politically and he says celebrities on the west coast will also kind of be doing their own rebuttal whether it's in an article or whatever they do. >> melissa: it gets traction the next day. whenever you get the buzz. we know in this day and age it is not necessarily about what slides the moment, it's what goes viral the next day. so somebody says something afterwards tonight, see where it goes and see what gets traction. >> bill: whether you love this president or hate this president, nobody's going to be talking about anyone but the president tomorrow. >> harris: that's what sarah sanders said at the lectern at the white house press briefing. space is i don't know what you're talking about. he doesn't get any coverage.

just kidding. >> harris: one thing is for sure, the five rebuttals if you look at them, that messaging is difficult and again, at least with the trump camp that i've been told is the trombone for the economy so what is your back for that? what would that look like? >> melissa: their own this is obama's economy. obama himself has stepped up. >> harris: why didn't he give a rebuttal? >> lisa: i think that's very difficult to do if you look at survey, doesn't matter what the industry is. we've seen such a boost of confidence among businesses and among different industries since president trump became president. and it's clearly had an impact in businesses wanting to invest in the economy wanting to create job and move the economy. >> sandra: is tough and you've got the ceos of these major corporations, exxonmobil today coming out and saying like them or not, we are doing this because of this president's policies. how do you stand up and fight back against that? we are up in the hundreds now of

so again, there has been concerned about the political interference when it comes to mccabe, that obviously was a decision made by the fbi. >> sandra: some democrats still lashing out at the president following the announcement. >> if, in fact, the president of the united states can pressure law enforcement and as well try to pressure the courts and the justice department to skew the law, to undermine the proper administration of the law, then america is less safe. >> sandra: this is new reports say fbi director christopher wray pressured mccabe to resign amid concerns about an ongoing investigation into the agency that is expected to address whether mccabe should have recused himself from the hillary clinton email investigation. it's amazing how crucial the timing is all of these events, what happened when they seem to be learning more and more. >> bill: think ultimately were

going to find ourselves in the same position that paul ryan was mentioning in a program two hours ago and that is the integrity of the department of justice and the integrity of the fbi to long-standing american institutions. as americans can trust the work they do. a large part of these people as paul ryan was saying today, they are respectable and they are honorable. but it appears near the top there's some confusion as to whether or not there were people in it for their own agenda. we need to figure it out. >> melissa: it felt very solid and also talking about transparency, these institutions cannot be dismantled if we lose them. you lose everything. this is really the idea that there is law and order, the people's civil liberties are respected, you can trust law enforcement. this is what separates modern society from the dark ages.

it's transparent. speaker you go to third world areas of the world and the reason why they can't get off their back is because they're just system doesn't work. there isn't rule of law. they can trust the system, there's money under the table. as long as that, we cannot as a country allow for afford these institutions to be under question. their own reputation in the future. we think they have to give a reason to trust them and over the years, these various agencies have looked given. it's distressed. what i take issue with is eric holder weighing in on this and criticizing republicans for their attack for the doj yesterday. considering the fact that he is a liar. he lied about fast and furious. he obstructed the investigation into it. so he is the one that brought part of the reason brought to stress to doj. so shame on him and having the audacity to weigh in on this.

>> harris: his punishment came via congress itself with the fast and furious. it was that high up and swift. two senior fbi officials now have been confirmed from the bureau's counterintelligence division to have looked at this republican memo at this point. we're just learning this from catherine herridge by the way has been fantastic reporting on this. so this also says that the two bureau officials are following up after that initial review of the memo. remember, the president is looking at this right now and so more eyeballs on it to see if there were any inaccuracies because that was the big question on that rare meeting on sunday for fbi director christopher wray in a couple of other fbi officials were with him to take a look at this memo. finally inaccuracies of there's anything in there that factually needs to be taken in hand or if there's something that gets to the point out there in the bloodstream of the public should know about our enemies should know about. >> sandra: the reporting these

two fbi officials that found even more inaccuracies. that being said, going back to the timing of all this, and the 1:00 hour yesterday to get that shot of christopher wray and rod rosenstein, the doj and fbi leaving the white house, no explanation when we talk to the white house this morning as to why they were there at that time. >> bill: from what i understand, they met with the chief of staff. and with the conversation was we don't know. but people like bob goodlatte, the chairman from virginia republican, the only way to ensure the fbi remains the premier law enforcement agency in the world is to ensure that leadership at the bureau holds the trust of the american people. we talked about the change of leadership with mccabe resigning yesterday. this is happening right now. and where it stops we do not know. >> sandra: the latest in the russian meddling investigation now newly revealed documents could keep one probe from wrapping up anytime soon. all the details on that and more, "outnumbered" after the break.

the press, what you think? >> harris: i'm with bill on this. i think that full transparency is always good. i think we've actually gotten into the zone where the american people can kind of look at this and say whether or not they care. and they can say what they believe and what they don't. so i'm actually all for just put it all out there and if you have the evidence because is not what we are looking for now? >> sandra: apparently they have new evidence. >> harris: if you have the evidence, we definitely want to see at this many months and this many million of tax pillars dollars and, what is it? >> melissa: to your point, here's what sarah sanders said about how the american people feel about all this. >> the only thing the president has applied pressure to is to make sure we get this resolved so that you guys and everyone else and focus on the things that americans actually care about. and that is making sure everybody gets the russia fever out of their system once and for all, that you're all reminded once again there was no collusion, and we can move forward to focus on things like national security, the economy, and solving the immigration crisis that we have here in our

country. >> sandra: is that possible for the supreme court to move past russia? i don't know. >> bill: is like the year 2025. what new information is just now coming to light? is it reflecting more on some of these house committees looking at? i'd like to know. what are the new documents? >> harris: let's see it, bring it on. >> lisa: i think ever since we found out that the dnc and hillary clinton paid for the dossier, the russian investigation took a massive below and so did the credibility of it in underlying concerns. i really don't think in the absence of any sort of irrefutable evidence, i don't think most americans care about this right now because we have had the former dni director james clapper previously said that in his work, he hadn't seen any russian connections. we have people like senator dianne feinstein safe there's no collusion there, any evidence of collusion specifically that she has found. we have peter strzok and his text messages saying he didn't want to work on this investigation because he didn't
