page. they were never told the democrats put together the dossier christopher wray. -- christopher steele. he admitted the justice department official was desperate that donald trump not get elected. ohr was demoted over his contacts with steele. fusion gps directed the trump project. bank record obtained show he worked for fusion gps and began investigating trump as early as 2016. republican investigators said the court was never told about the dossier's political roots. quote:

according to the memo, deputy director andrew mccabe testified in december last year they would have never gone for a surveillance warrant had it not been for the dossier. >> one question. speaker ryan and the white house said they encouraged the democrats to release their version of the memo. do you have any idea what the timing of that might be? >> well, thanks have to go through a number of processes in terms of classification. one of the distinctions with the republican staff memo it was deliberately drafted that it could be made public quickly. they eliminated a lot of national security information. the democrat's version is 10 pages long and would be subject to an inter-agency review. it could take some days. >> thank you. >> president trump shared his thought on the memo from the oval office moments before it was released. >> i think it's terrible. if you want to know the truth, i

think it's a disgrace. what is going on in this country, i think it's a disgrace. a lot of people should be ashamed of themselves and much worse than that. let's see what happens. a lot of people should be ashamed. thank you very much. >> around the table. kimberly, who knows about the fbi process and getting a fisa warrant. >> a few things jumped out to me right away that are the exclamation points. what was interesting is they excluded the political origins on the sealed dossier that were known to the senior doj and fbi officials. they were excluded from the fisa application. i feel that is glaring. it shows the motive and the intention and intent to deceive and duplicity on their part. that's inappropriate for what they were supposed to be transparent about. they knew about the political origins of it, that should have

cast doubt on the credibility. they purposely with held that information. that's a significant factor. number 1 on my list. >> juan, the media helped played a role in this. apparently, steele leaked information about the dossier to yahoo news and they write the article. the fbi when applying for the warrant said there was corroboration because it was in yahoo news. but steele used his own information to get it there. what do you think of that? >> i don't think much of it. it doesn't matter. clearly the fbi cut off contact with steele once they suspected he was leaking information. this whole thing is comical. i said to greg in the greenroom, this is zero. this is comical.

i thought this would be somebody here to cause people to take a second look. kimberly is talking about steele having a political dislike for president trump. that doesn't speak to the information in the memo. secondly, it did not even prompt the investigation. the investigation started before with the news that the fbi uncovered george papadopoulos's connection with russian agents. >> that's included in the memos. >> so i don't understand. and carter page was under fbi scrutiny since 2013. this is not even pertinent. i don't get it. i am struck by the number of republicans who have said today -- john mccain -- hes that nunes and the republicans here are doing putin's work. one said it was an attack on

american institutions. another we have to get past this. president trump said ashamed. he should be ashamed of using nunes and the congress in this way. >> jesse, you think differently? juan thinks it's comical. but you are not laughing. >> i am laughing at juan's speech. it's a kill shot and juan knows it. the reason juan can't admit it, he would have to admit he's been wrong for a year. they were caught red handed. the left. it involved the media and hillary clinton operatives in foreign countries and the department of justice and the fbi under barack obama. the person whose wife was working through fusion gps was demoted. you say this did not prompt the

with a library card. >> you have ever tried that? >> i am curious about this. we don't know this from the memo. if carter page is under a fisa warrant in 2013. you have to go to the fisa court every 90 days to keep up that warrant. we don't know if there was a lapse in the warrant between 2013 and 2015. we don't know if this is a new warrant about carter page. >> the problem is the chronology issue here. when did they get it? at what time? it goes to the larger issue of veracity in terms of the content and the facts that are alleged there. if you have a question about that, you have to verify it to make sure that it was substantiated and there was initial proof or evidence to support any of this. >> one other thing on this legal point. ept if you are a fisa judge and

you are presented information that you think was based on faulty information, how mad would you be? what are the consequences of that? >> furious! be held in contempt of court. lying to the court. false affidavits. this goes to the integrity of the whole judicial process. it should be truthful and be relied on by an officer of the court. >> imagine if you are presenting to the judge. you don't say one. my pieces of evidence is an article from yahoo news. that's what they are saying is one of the pieces. i don't know all of the details. we will find out if the democrats will come out with their memo. but we will talk about this more. memo fallout ahead and a programming note. devin nunes will join bret baier tonight at 6 p.m. eastern for a

fisa memo fire storm. what fallout will this have on the fbi and the department of justice. former fbi director james comey took to twitter to give his reaction. he writes: jesse, how do you respond to comey? >> that was too long. >> [laughing]. >> it's terrible. >> he needs to take lessons from trump on being not as verbose. comey since he was fired looked worse and worse and worse from the leaking of the memo and the

leaking of the comments. the twitter page is all about the book release. a fine point on what kimberly said. i think she is right. the crux of the issue: when nay they applied for these warrants they knew it was paid for by hillary clinton and they didn't disclose that on the judge. they purposely with held that steele hated trump and was connected to fusion gps. something else. remember for a year, the clinton campaign denied they had anything to do with the dossier. eventually it came out they did. again, they used fake news to get the warrant. they shopped the stories around. the yahoo deal. everything the left accused republicans of, they themselves are guilty of. >> kimberly, back to the comey

memo. he said it damaged the relationship between the intelligence community and the congress. if you are in the congressional committee at this point, you are thinking to yourself: gee, i don't know if the intelligence community will share information with us because people will use it for political attacks like this nunes memo. >> you are thinking perhaps we would like to make sure we could rely on the veracity and truthfulness of information provided to us that we are previewing. that it isn't we are not being used as pawns in political chess. that's a problem too. they are basing their reputation on the information they are provided. if the information is suspect and lacks veracity that's a huge problem. that's the bigger picture issue.

that's a collateral issue of the problem. >> the question becomes whether or not it's trustworthy information, right? does it matter if somebody doesn't like or likes hillary clinton but is doing their job. christopher steele must respected former british intelligence agent. wasn't there additional material not disclosed in this memo. the average fisa warrant is 50 pages. the nunes memo 4 pages. this is much missing. >> so, yes, of course. this is not the full story. that's why i think the white house put out a statement. sarah sanders said the white house stands ready to help the democrats with the release of their memo as long as it doesn't affect national security. should we see the underlying

documents? the source documents? the fisa applications? should we always see the fisa applications from 2013? i don't know if america needs to see all of that. i think the justice department need to have the integrity of investigations. if you start doing this, it will be a slippery slope for other things. i think comey is taunting people. it's one thing to walk away, to write a book. you will have your say when you write your book. you will have a chance probably to talk to bob mueller who might be called up to congress. it wasn'ting on twitter on either side, if you are under investigation is a really, really bad idea. >> talking about trump or comey? >> anybody. one thing that happens in washington or anywhere you want to protected yourself. these are people's careers. i would not be surprised if you
