it is pretty outrageous. i love how democrats are saying if it does it doesn't mean anything. they use argument after argument. it doesn't really stand up.>> we are live in west palm beach florida near the presidents mar-a-lago estate where he is spending this weekend. hello phil. >> hello julie. house intelligence committee -- on the controversial report. the memo summarizing the viewpoints. while they want to release their own memo. a 10 page memo that they say will summarize the democrats opinion from what the committee has learned. they will renew their pledge this week to get the memo released. some republicans in d.c. this weekend say they welcome that as far as let's let the public see everything. as for the president, he has erected five hours on his trump international golf course. and now returned to his winter white house at mar-a-lago in

palm beach. as is often the case, supporters stood along the route. and one person holding a sign saying, we love trump and another says investigate the fbi. this morning, trump tweeted this. the memo totally vindicate four in probe but the witchhunt goes on and on. there was no collusion and no obstruction. the word no use because after one year of looking endlessly and finding nothing, collusion is dead. this is an american disgrace. that was then followed by this tweet from the ranking democrat, adam schiff of california. the most important fact disclosed in this otherwise shoddy memo was that the fbi investigation began july 2016 with your advisor. who was secretly discussing stolen cleansing emails with the russians. air force one landed at west palm beach international airport last night just before

7 pm. then 20 minutes later the first family was back at mar-a-lago. before him the first lady wearing a red cape and the son sporting or white. while the president was at his golf club today, they stayed home. the president left behind -- which they say shows that the fbi and justice department have used their power with surveillance warrants on trump campaign advisors. democrats in fbi content the charged memo is misleading and a distraction to the ongoing russia probe by the special prosecutor. it is super bowl weekend. today and tomorrow no public events for the president and for the first lady have been scheduled. nor are any anticipated. the president is expected to watch at least some of the super bowl at mar-a-lago before returning back to d.c. tomorrow

night. >> thank you. >> and all of this we bring in sarah westwood. she covers the white house for the washington examiner. always good to see you. phil brings up some questions in his report. what might be next and possibly the release of this democratic memo which would counter the republican memo. we know when that might happen or if it might happen? >> click because the white house and congressional republicans are not joining democrats in the release for the competing memo, there is no real resistance left to that document coming up. it has to go through the same complicated process that brought up releasing the gop offered memo that the committee has devoted declassified it. the president has to have an opportunity to block it should he want to have the white house team go over the memo just like what happened with the nunes

document. it may be a week or so away from the competing memo coming out. i think you also start to see some pressure to release underlying materials referenced in the memo. particularly some testimony from former fbi director. democrats has uses as an example of something misleading according to republicans, testified that the fbi would not have the warrant had they not had this dossier in their hands. they say mccabe did not sin it is pretty easy to verify whether or not it was sent. by releasing the transcript. >> and possibly recording that would say what mccabe actually said. it seems to be one of the key points of dispute right now. i know there are others but that really gets to the heart of it.>> right. that is one piece of the equation that is easier to verify because it is black-and-white. there are other charges like was there anti-trump buys at the time. they are more suggestive parts to go back. those are the kind of facts may not ever see verified and will have to rely on the words of

the congressional investigators and like what made up other parts that drew from this dossier or was there other people with intelligence that the fbi had? >> i wonder from the democrats memo would they be able to talk about some of the other components and they might not. because it was to be classified and we may not ever learn that. >> presumably, the democratic memo draws from the same underlying intelligence.they would have access to that same information. it is one of the reasons why the memo has to go to the same set that the freshmen did because it is drawing on highly classified information. and when we hear from the fbi that material omissions makes the memo the misleading, it leads you immediately to the question of whether the material omissions included some of the other components of the fisa application. >> and this morning they said

that this whole thing vindicates him. that was the argument. and it is kind of what the other side has been saying all along. democrats send the white house is basically using this to muddy the waters so that the mueller investigation does not go away and at least it is delegitimized in the eyes of the public or the eyes of people watching in washington. what do you make of the presidents tweet and the use of the term, vindicated? >> i don't think this will give you decide precisely what it wants. it is certainly not the case. there was a credible allegation of fisa abuse that would lead to further scrutiny and for republicans i think it was active indication that they were may be looking for in the rush investigation. it did not have a lot to do with the investigation at large with mueller. it took place a year ago long before mueller joined the fbi.

i think that maybe that is a bit of a stretch for him to use that but certainly it helps in public opinion for him to start building a foundation for that argument that maybe the mueller probe is more politicized than democrats without the public to believe. >> and of course throughout it has been that it is a witchhunt. the other side of this is that if anything, the release of the memo and all of the back-and-forth that we are talking out today and presumably, when the democratic memo comes out and adds another week or so to it. if anything it will prolong things ironically. rather than speed them up or make the investigation go away. if possible, it could make it dried out more. >> that is entirely possible. it certainly drives up the time people are talking about russia is that the presidents state of the union address this week. the healthy job numbers that came out. and except we are talking about russia which is a unintended consequence with the release of this memo right now. there are a lot of those

looking at trajectory in the investigation and saying look, the attorney general as i don't investigators, the president was preparing to submit for an interview. we could be reaching the end of the investigation with hillary clinton when she sat down with investigators, that was just days before the fbi concluded the email investigation. so, firing rosenstein, acting on his memo dramatically could prolong the investigation. >> in terms of the current deputy attorney general, the white house has been saying there have been some officials on air today saying that there have not been discussions. they say about the firing about rosenstein. it's interesting both because the president seemed not to suggest he would fire him but certainly a possibility yesterday he was not pleased with him about the whole thing. >> right. and we know that the president already was not thrilled with the behavior of rosenstein so far because he was one who

wanted sessions to recuse himself and appointed robert mueller in the first place. and allow this entire controversy to stretch into the second year of the presidency in the way that might not have. so this memo would by name have rosenstein is on the had a role in the fisa application process. give the president another opening to criticize rosenstein or maybe he would not have had one before. i think the house recognizes it would be disasters. especially because this might end organically in weeks or months anyway. >> sarah covers a definition by definition means she works 24/7. thank you for joining us on a saturday. good to see you! >> thank you. >> republican lawmakers working on another short-term spending bill to avoid a government shutdown. current federal funding runs out on thursday but the daca issue, that caused the three day shutdown last month, still has yet to be resolved.

what will happen? ellison barber is live in washington with the latest. >> that's right. immigration and protection for dreamers.immigrants that were brought to the us illegally as children is still a very big issue this time around. some republicans cannot and democrats from the fact that they probably will pass 1/5 short-term spending bill of this year. democrats say yes, immigration is an issue but far from the only one. >> at their never wear one dream in the world and thank god, there are many. we still have a problem. this is about, george increased defense spending into an object into that, we have to have an increase on the domestic side. you cannot increased defense and lead the domestic budget and think we will be a strong nation. >> republican congressional leaders at shutdown will not happen but lawmakers have not reached an agreement yet.

even in the republican party there are disagreements. they are pushing to bolster defense spending and they tell fox news that could oppose a short-term bill. it's we will have to see what the situation is when it arrives. no one wants a government shutdown but we also cannot continue to inflict damage that crs inflict on the military. we cannot keep doing that. >> forces tell fox news republicans looking at a short-term bill that funds the government through march 23. this is house speaker paul ryan. >> i think we are making progress on an agreement. even if we get everything figured out by tuesday, we still will have to have a cr if only to write an appropriations bill. >> chuck schumer took the floor last week and accused the president of backing away from deals they started to make that quote - the first sign of pressure. perhaps some optimism on thursday he reportedly told the

washington post that discussions on the different budgetary caps are going well. >> thank you. >> the man who sold ammunition to the las vegas gunman, he is charge of manufacturing and selling armored piercing ammunition. and by doing so without a proper license. he's accused of selling it to the man that killed 58 and ended more than 500 on the strip in vegas last october. will carr is in los angeles for us. is this man already speaking out? >> yes, he says he had no idea what stephen paddock planned to do. he is an aerospace engineer who sells ammo as a full-time hobby. he was arrested on friday and is now facing charges for conspiracy and manufacturing armor piercing ammunition. he admits that in september he sold stephen paddock 720 rounds of what is called tracer ammunition. it creates a flame after the

bullet was fired that allows the student to follow the bullets path. stephen paddock went to commit the worst mass shooting in modern united states history las vegas last october. he says when stephen paddock purchased the annalisa quote, he was going to put on a light show. along with numerous guns and bump stops at 30 say they found a box of unused ammunition in stephen paddock room with his name on it. in at least two bullets that had his fingerprints on them as well. >> none of the ammunition that doug sold to stephen paddock was used at all in the tragedy that occurred in las vegas. >> very thankful that he did not use any of the ammunition that i sold him. i feel terrible about what happened. again, keep thinking, what did i miss? but there were no outward signs. he appeared as normal as anyone in this room. very well spoken. very clean-cut, very well dressed.

buying him and sent him to jail. larry nassar will spend life in prison. >> and north korea again -- what good are sanctions? lieutenant colonel -- joining us. i feel like a broken record because we talk about sanctions and weapons fired after they had been told not to. that they were supposed to abide by shutting down their regime. what is the point of sanctions? if they clearly do not work when it comes to north korea? >> actually, there is a bit of good news, a silver lining to this situation because number one, they were taught is the first thing but when you look at the, in 2015 before sanctions were applied alterative $3.5 billion worth of experts. so 200 million is considerably

weapons stockpile. the chemical weapons that he uses to kill his own people and that comes after the president called on russia, also allies of syria to help north korea recover. so it all comes down to russia and china. and again, china and us working together to put further pressure on north korea. but what about putting pressure on north korea and russia? because of russia is aiding, what do we do about russia to make them stop? >> that is a good point. everyone always talks about china. the president dimensions that we are getting some cooperation with china. the rush is trending that they've not talk much but if there is constant between years and occurred the biggest winner is russia. >> sure! >> want to make sure we don't fall into traps for them to instigate things because they are trying to work against this all over the place.

again, let's shut down any kind of holes that we find in any dissensions and anytime russia is not doing something they have agreed to, we need to not do that publicly. >> the president has called out russia and that is a good thing. but it does not seem to be enough. what do we do aside from calling out russia in order to get russia to cooperate? is russia ever going to cooperate?it seems that they do what they want. vladimir putin does not take orders from anyone else. >> true enough. russia follows their own self interest and we need to do that. and our president has said america first. we have to do what we can with our assets but we have to mention our interest is taking care of. i think there are a number of things we can do. we do not want to antagonize russia because we can cooperate words possible and where it is in our interest but we have to make it clear that when they operate against all interest it is not --

>> this is a fox news alert. in syria, they reportedly shutdown a russian fighter jet today. happening in the same area russia claims are killed more than 30 militants one week ago. the pilot apparently survived the crash but was killed later in a firefight on the ground. we are live from the london bureau with the latest. >> the russians are saying it did -- he did not just survive but he exchanged fire with the group of rebels and he came into contact with when he hit the ground. they wanted to take him alive. the russian military says, he died effectively trying to fight back. and it is not just the russian military is also from witnesses on the ground that that is what took place. we are talking about northwest syria. as a province, one of the last strongholds of the rebels. and there are reports that this russian jet fighter was taken down by a group of rebels

associated with al qaeda. when the russians are doing in the area effectively is trying to provide air support for the syrian military which is trying to drive those rebels out of the region. there is a highway there that links the capital up with aleppo, the city that syrian army pushed the rebels out of and they want to control the highway. one thing to keep in mind is that syria has become a very crowded battle space. you have got iran there. you have the russians, turkey, interestingly, the russians are asking turkey to help them repatriate the body of that russian pilot. but turkey is in northern syria fighting the kurds that are backed by the us military. finally, the us military has its own troops there. so when you get an incident like this, there is all of the potential for this to escalate

american citizen, for what? they must continue doing their jobs. as he out of line by writing on twitter? >> lesson. the director knows that is not at. in fact, what i encourage americans to do is to look at the memo and in the context of what we already know. that goes back to the emails and texts of peter strzok, the head of counter intelligence for the fbi. and the bias that was in those text messages that we saw going back and forth between peter strzok and lisa paige. you have to look at what is going on within this memo and in the context of that. and that is what has brought the integrity of the fbi and the doj into question.

listen, as a lifelong law enforcement officer myself, i have the utmost respect for the fbi and the good men and women of the fbi and doj who are every day of their protecting america. but when i see this at the top, i know the rank and file in with this kind of bias can potentially not only bias but impropriety. they want to rip this out by the roots. especially when is at the top of the organization. >> was deeply troubling is the partisan bias behind all of this. not only from the top of the fbi would also from the fact that the surveillance was obtained based on mr. for steel antitrust dossier and that was enough to get a warrant? i mean clearly, there is a huge error in place. and the indictments actually follow because at this point, somebody needs to be held accountable. this can happen. what will prevent this from happening again? >> is a law enforcement officer i want to make sure the

information out there and all of the evidence out there is revealed. that is why i want to call for the release of, as much as we can, the actual, the primary application. the first application that was signed off on by director james comey. for the surveillance warrant. and what was the colloquy between the judge and -- you know this is a process. what was the discussion between the judge and the fbi and the doj representatives? i would like to see that because i would like to know what was presented and what was omitted. and then we can draw conclusions about the impropriety that actually may have taken place in effect, not just impropriety but potentially criminal involvement. >> is what i want to get next your criminal involvement. because first of all let's talk

james comey. defecting is going out on twitter and bringing this kind attention to himself yet again, he did it as fbi director. he loved the attention. no little director, he is still drawing attention to himself. let's not forget he leaked not only unlovely but never know the fbi waited at least one month before notifying congress about the discovery of thousands of emails could potentially relevant to the investigation into hillary clinton use of a private server. could james comey maybe, possibly just curious here, be a good candidate for indictment at the end of all of this? >> i think it depends on what he knew and when he knew it. and so, as sheriff for 12 years, i wait to draw this conclusion until the investigation is complete. and i have all of the evidence and puritan others initial evidence out there. for example, one of the things that is curious about this whole investigation is the fact that not only was there the original starter page buys a warrant issue, but there were

three renewals. each of those renewals were 90 days apart. they require additional animation to substantiate the issuance of the warrant. . and so, it tells me that there must be something that the fbi and doj was presenting to the fisa court that convince them that they were on the right track with their investigation and it needed to proceed. i want to know what that information is and i would like to see those renewals as well. >> i am sure the american public would like to see that also. the same way that the memo was handed out. the fisa abuse and it should all be out there for the american public. and when you listen to jim jordan, he appeared on fox and friends this morning slamming james comey for his tweet referring to it as, that's it? let's listen.

>> we had is in the midst of a presidential election, the fbi takes one campaign research political document to a secret court to get a secret warrant to file an american citizen and they do not tell the court who paid for. namely democratic national committee and the clinton campaign. that is a violation of the fourth amendment. james comey says, that's it? this is someone who is supposed to protect the bill of rights, the amendments and he says that's it? >> is there an investigation now going to be launched by someone to investigate how in the world this happened? >> yes. julie i think we will continue to go down this road map that has been laid out by the memo. and then will go back and find all of the evidentiary information out there. to substantiate what my good friend just said. that there was not only a propriety within the fbi but there was potentially criminal activity as well and presentation of this information from the dnc to the

fisa court. so if that is proven, then i think you will see indictments. and you know it may take a federal grand jury to bring all of this out because look, you have to protect sources and methods. but if your sources are liars, if your sources are creating evidence, andrew methods are criminal, you cannot hide behind sources and methods. >> all right, you can't. it just takes time. i always say, if you like, it will come out eventually. that is all the time that we have. congressman, thank you very much. >> thank you. >> and there are roughly twice as many republicans planning to retire from congress as democrats. and one congressman says is vividly politics and go back to

work in the criminal justice system.caroline shively has more. >> house republicans are running for the door this year. and nothing retirements more than doubled in democrats. 34 republican house seats will be up for grabs this november. 22 of those are retiring. 12 are running from another office. compare that to 16 democrats leaving. of those there split 50-50 on retirement and running for other positions. the total is more than twice the normal dropout rate. according to roll call, since 1976 an average of 22 house members retire and recycle. this year the reasons for the exodus range from sexual scandals to poll numbers. members of those parties have been accused of sexual harassment. several republicans also look at the presence of low poly numbers which could rub off on them. history is also not on their side. in a presidents party usually loses seats in the midterm election. another notable. unlike democrats, republicans have a rule that term limits length of time members can
