they were the pillars in their department, the pillars of their community. always reaching out. we should point out that at 12:02 pm they were responded to a 9-1-1 hangup call. at 12:10 pm the officers arrived at the scene. they entered into the house or apartment and were immediately fired upon. an investigation is still underway at the shooting scene. the chief went auntie sadie is with two of the best we had. they knew how to do policing. this was their life and they gave their life. this is a small town so a lot of people really know police officers. as you'd expect in a small community. there were 40,000 people, westerville, some 15 miles outside of columbus, ohio. that town is now in mourning. this is a very sad time for them this sunday afternoon.

>> very sad. our thoughts and prayers to all those affected in ohio today. we'll go back to our top story now. that is the democratic memo that we are awaiting about alleged surveillance abuse of the fbi. it will be released but not just yet. that is because the white house is asking for a redo. it says it creates significant concerns for the national security and law enforcement interest. what is in it and why was in there? the democrats, did they do it on purpose? the president tweeting that they knew would be heavily redacted but did it anyway so they could blame him for lack of transparency when it was rejected. now we have a former missouri state representative and founder of pine street strategies. and a former deputy assistant to george w. bush. thank you very much for talking to us. the democrats have apparently included classified information in their memo. the accused republicans of doing the same. so is playing politics with the
1:38 pm
democratic memo on the fbi? >> they are! this is a fraud. have the benefit of looking at the republican memo. they use that as a rebuttal. and loaded it up with classified information knowing that the way it was written could never be released. and had another day. they wanted to give it to the fbi to the fbi to describe it. they did that and give it to the white house and this that we cannot release it as is. and the democrats went out and scream all over the place, the president does not want to release the memo. the president does want to release the response but not in its current form because it contains classified information. as the democratic ploy. another gotcha. democrats have to try again. >> did democrats know the celestial probe memo just too sensitive for public release? >> of course not. i think what democrats knew that we had been a year into this experiment now. one of the president asked with
1:39 pm
neither integrity more consistency. i think they probably knew he would not release it regardless of what was in it. ranking member schiff has been consistent in saying that the democratic memo is a direct response to the nunes memo. they went point for point and talked about exactly specific rebuttals to what nunes talked about. we can release the nunes memo which the president did by the way over doj and fbi objections, there was nothing in this which was a direct response to that which was objectively a threat to security or could not have been released. we knew the president was not going to release it. his excuse is cute but it does not hold much water in light of him replacing the republican memo over administration objectives. >> basically democrats are contending there is a double standard. when this nunes memo was released republicans had classified information in the memo and the president released and with your will classified information on a talking about? the fact that these fisa warrants an application were given based solely on this debunked antitrust dossier?
1:40 pm
that it were not for the fbi following with his former spy dossier that affect surveillance warrants would not be issued? because if that is the case it is a huge example of abuse by the fisa court in the fbi and department of justice. is that the classified information and talking about was that the information that democrats are talking about? >> they knew by loading up the memo it was not a rebuttal to the nunes memo. it was the opposite. to make sure that would not be released and blend the president for sending it back. all the president is doing is sending it back for reductions of the fbi is requesting. we chose when the republicans released the memo not to go to the fbi. they chose to go to the fbi. don't they trust the fbi? this is the mantra that we should be trusting fbi when
1:41 pm
they are not earning the trust to the leadership that we have seen. and they are biased against the president. as a candidate and president-elect and now is present to request a fisa warrant application for this type of event. it is a long intricate document. does the memo, the republican memo accurately portray the warrant process as apparently it was broken in order to obtain surveillance and the information that they used in order to do so. >> thank you so much for that question. it is very important that we examine the fisa warrant application process but is a long and arduous process and it has a very high legal standard that has to be met. what you are asking is for the court to give the government the capacity to spy. which of course will hold very dear. the dossier was just a small component of a 1000 page fisa warrant application for the nunes memo essentially

highlights the steel dossier and said this is what the warrant was based on when absolutely is not the case. that was a small component of a much larger and more substantive application. it is important we continue to highlight that. also the political underpinning for the dossier was disclosed to the court in full. to say this is playing politics is either untrue based on your political leanings or a fundamental misunderstanding of the fisa warrant application process. >> i tried to keep it fair. thank you. i try! thank you both. >> immigration a front and center after congress passed a big government spending bill. but is the deal possible for the dreamers? and the wolf huffed and puffed...
