[applause] so, you have two issues there. let's unpack the soul because you have the fact that as you call it fisa abuse. abuse of sake and the government to really have the power to look in the most intimate areas of our life. you have abuse of that. number one, and then you have this question, it is a bold charge of a cover up. covering up the fact that that

ever happened or you know, explaining in a way that does not really give clarity to the american people. >> let me give you an example of cover. one of the things in the memo that they're all have to talk about is that in a footnote before the fisa court they put in a very convoluted complicated answer for something that was, buried at the end, okay? of the application. about this was politically motivated. and you will all be able to read this shortly. however, wouldn't have been a lot easier to just say, hey, mr. judge. we want to let you know the hellyer clinton campaign the democratic party paid a lawyer who hired a firm who hired a foreign agent to go to the russians and get dirt on mr. trump. it would've been easier to say that.[applause] we will not have a fisa court in the country any longer if the fbi and doj will continue to do that. [applause] >> i can -- i can speak from

some experience here. after 9/11, some of the extra steps were taken to get the federal government greater powers and leeway to fight terrorism to find our enemies. and we were all told when people said, what if anybody ever misuses this? what if somebody is this for their own personal gains and i remember the answers even the port of the previous republican administration which is, there will be somebody say president moon could use it in a way that would be separate from our national security. do you just not have these safeguards? >> let's make one thing clear. this is our ability to track down terrorists and bring them to justice. it is critically important. so is this court. if we can get, we are

conducting an investigation. ultimately there will be an investigation done by somebody over at doj and fbi who can look at this all and ãin that investigation, they will have to determine whether or not there was abuse or not. whether or not the law needs to be changed and also holding people accountable that did this abuse. [applause] until that happens, you will see a very skeptical congress as it relates to what can or cannot be brought before this court. the one question i think a lot of us have, because you have been as i said, courageous, you have stepped up. it is partly due because of this really important while you have to be the chair of the house intelligence committee. this is one of the most important jobs in congress. usually doesn't get a lot of press. usually doesn't get a lot of attention. what was the first thing that caused you to really go after

this and to really go after the truth? what was the flag, what was the trigger? >> there were a lot of flats. i would say the first flag is, let me back up a few minutes on this. because that was like a year ago. let me tell you, the house intelligence committee, we prefer to stay out of the press. or at least the republicans do. we prefer to just be down in the basement, helping out intelligence agencies. only making appearances when there is an issue of national emergency. where we need to go out and talk about whatever it is the american people need to know. that was traditionally how we did our work. let's talk about russia. in 2013 and 14 and 15, the republicans had been warning the obama administration that russia was a problem. and vladimir putin was a

problem. this was an administration who and a lot of people talk about what the administration, the current trump administration doing against the russian threat? let's talk about how what the obama administration did with the recent policy that actually created and emboldened vladimir putin to be in a position to be such a threat. [applause] just a few facts that people forget. number one, we went through, we did a reset. we had a reset button. with hillary clinton. then, we said that we were going to pivot to asia because we're going to be friends with the russians. we went the whole european infrastructure consolidation process of the military installations across europe. he abandoned a lot of our capability and in the north atlantic in order to track russian subs. wesley had the president of the

united states who said on a hot mike -- mic he did not realize it was targeted just tell that in your have to wait until the election. that was president obama who said that. at the same time, mitt romney in 2012 said russia was a grave threat. and president obama had that great line. it was really funny at the time. all of the media laughed about it and made fun of mitt romney. that that is one of the foreign policy -- everyone laughed. who created this question correct? it was the last administration who put us in this position. [applause] but -- here is the kicker to all of this. it culminated finally with great frustration on my part. where, in april 2016, just months before the election, i

came out and said on national television, that the biggest intelligence failure since 9/11 was our failure to understand what a miracle his plans and intentions. this was in april 2016. and all of a sudden, fast-forward, what were the lines of that could be a problem? >> late summer when i had people in it ministration coming to me saying we should should have a problem with the russians. and i said i'm glad you finally figured that out. then after the presidential election, the president trump is elected. a couple days later i was asked to serve. >> were there listening at cpac. the congressman, head of the house intelligence committee, devin nunes talking about what has famously been referred to as the nunes memo. he has been speaking about how important the memo is and essentially, that it was meant to show that fisa abuse has

occurred. his entire focus. he is speaking about that and really shoring up his thoughts on the memo in the release. even as we wait for the democratic memo, the rebuttal memo to eventually come out. now we listen to our correspondence, if you have any news we would love to hear it. >> thank you. good afternoon. we have been in a holding pattern over the last 24 hours. waiting for this democrat memo to be transmitted by the white house of the house intelligence committee. we can now report that the transmittal has occurred. we understand that the memo has now gone up on house intelligence committee website. just to recap, this memo is in response to a republican staff member that was released earlier this month and there were a number of key findings about surveillance abuse by the fbi. the justice department during the 2016 presidential campaign. and the targeting of trump

campaign associates. among the key findings that the fbi and this is department relied heavily on what is called the anti-áuntran4á and verify dossier that was opposition research to secure a surveillance woman for a trump campaign and quarter page but also the fbi justice department never disclosed to the national security court called the fisa flight at is very much a political -- funded by the dnc and the clinton campaign. they also found that the researcher who was behind the project, the british spy, christopher steele, had a personal animus against then candidate trump and the cut off lines with him because he lied about the distribution of the memo with the media.despite being cut off officially by the fbi, christopher steele continued to pass the information to the bureau contacts, to a justice department official who had then been -- final key point is

that the then deputy fbi director andrew mccabe testified under oath to the house intelligence committee behind closed doors that they would never have thought of surveillance warrants for the trump campaign and quarter page if it had not been for the trump dossier. i'm setting the table for you here. so when you look at the democratic memo you can ask a number of critical questions. and they include, does surveillance work recorded. was justified because there was additional intelligence that was available to the fbi and justice department at the time. i'm getting a copy of the memo right here. this is the democratic memo. it is just been released is on the website. it is 10 pages and left. as you can see, there are significant reductions on this memo. this memo was reviewed by the fbi justice department and kicked back to the committee by the white house because both of those felt that there were

significant issues with sources, methods and other national security information. maybe we can read through this live on t.v. or fun, right? press absolutely! i'm sure there are a lot of people chomping at the bit. by all means, if you see something that catches your eye. >> okay i will do that. the key thing to look for here, based on what i understand is the democrats make the argument there was additional intelligence available to fbi and just department in 2015 agape probable cause to request a surveillance warrant or the trump campaign foreign policy advisor, quarter page. and the dossier is really not that central to the application. what i would tell people is that quarter page was a nonentity to the fbi at the time. he had become a cooperating witness with the fbi in 2013 and a counterintelligence, that is an espionage case involving

russian nationals in the quarter page had cooperated with the bureau and help secure a -- in 2015. i'm looking for this now. let's see, the first section deals with christopher steele intelligence reporting. let's see -- >> okay so this is the first point that we were just discussing. make the argument that the fisa application was made on the basis of intelligence. and here is the key phrase. it was quote - unrelated to the dossier. >> i will continue reading. >> you raise a good point because initial nunes memo made the argument that the steele dossier forms an essential part moving forward of the quarter page fisa application. the argument being made that it was vital that this dossier, the dirty dossier so many have referred to it as, played such a large role in getting the

courts permission to essentially watch and keep an eye on the trump advisor, quarter page. it will be interesting to see if there's any pushback in that regard. >> here is another key section on this point. that is essential. as is doj or justice department cited multiple sources to support the case for surveilling christopher page. and made use of information from steele about the trump dossier. about specific activities in 2015. chiefly the suspected july 2016 meeting in moscow with russian officials. then an exception here is reductive so i do not know what that says right there but then it goes on to say in fact, the fbi interviewed him with contact with russian intelligence the same time he was named an advisor. >> i'm sorry if i can jump in. the multiple sources, and kind

of jumps -- the next line is where there is a reduction? the obvious question would be, is there anything in there as we look there is speak to what the sources may have been? >> i don't want to speculate. he said that they said multiple sources to support surveillance for quarter page. and that as i said before they making the argument that there was additional intelligence beyond the trump dossier to justify quarter page in order to get a surveillance warrant from the national security court called the foreign intelligence surveillance court. this is really ultimately one of the highest to cross from a legal standpoint because you are allowing law enforcement to spy on an american citizen inside the united states. this is an extremely high bar. the republicans made the

observation that without the dossier, the fbi and justice department would never have sought a surveillance warrant for the trump campaign. and then in the republicans deck memo they say very clearly that then deputy i fbi director andrew mccabe that we didn't have a dossier we wouldn't have gone the extra step to secure the surveillance warrant. i'm looking for this now. i've not seen that aspect of the republican memo challenge yet. maybe further the document i have not seen it yet. >> reason interesting point in the testimony because after this came out as part of the nunes memo, there was a lot of pushback from the democrats and others in committee about this testimony which had been part of the memo. there have been arguments that he was misquoted or that he had been -- [multiple speakers] that was one of the major talking points to pushback against the republican staff memo. sid mccabe testified under oath

nunes speaking at an event outside of washington. he is at cpac on a panel. we listened to him live. they were talking about the memo that nunes had released some time ago. then nunes, even before this memo was released started to make illusions as to what may or may not be in the democratic rebuttal. he says there is nothing in this memo, our chief intelligence correspondent is still going through this in detail. that would reject what had been presented in the gop memo. saying that putting out a memo in the first place, this is nunes speaking, was to show that fisa abuse had occurred. his claim was that there was nothing in this memo that the three of us now have. this is the copy of it that we have here in the studio. as catherine put out these black lines show some of the reductions. it makes it difficult for us to go through it in real time. the point that devin nunes has made, it was nothing at all in this memo that we are looking at right now that would reject

the original claims that fisa abuse had occurred. he says that was the whole point of putting up the republican memo. >> republicans tried to consistently put that out. that whatever was put up a democrats that it will not change that the dossier that was collected by the british spy had been paid for by the clinton campaign, by the dnc and information ultimately passed on to the second port which should have a very high bar as far as what they are giving permission to do. for instance, in this case the argument is getting permission to spy on the federal campaign advisor and the trump campaign. really explosive allegations. they argue nothing will change by looking through these documents as they come out right now could we know that catherine herridge who has an incredible mind for this type of thing and can almost remember all these details and also to complicating timelines right now, pouring over the document. she has a few more insights to share with us i will take it back to catherine who is just

getting a couple of minutes now. >> i want to draw your attention to page number four. it is a critical section of the memo because it makes the argument that the justice department provided additional information obtained through multiple independent sources that corroborated steele reported. in this section you can see the bottom, it is left out or heavily redacted. the reason it has my attention is that in january 2017, when president trump was the incoming president and he was briefed by then fbi director, james comey at trump tower, he said in a written statement that he still consider the trump dossier to be largely salacious and unverified. that to me is a conflict with what is actually being said by the democrats here. that there were multiple sources, independent source of corroborating the reporting by steele. that is not with the fbi director testified to before the senate intelligence committee. that is one conflict at least

coverage on the release of the democratic memo. it is its own subject aimed at correcting the record. this released moments ago with significant reductions. let's rejoin catherine herridge our chief intelligence correspondent in the washington newsroom. great job going through this on the fly. right before the break he talked and he will pick up on this with what up to uncovered about page number four. i was looking at this as he was speaking. we took the commercial break and they are talking with the sponsor renewal. talk about the department of justice providing information obtained through multiple independent sources that would corroborate the famous or infamous steele memo. almost all of what is below that three bullet point is rejected. i guess we do not know what the sources are. >> we don't know what it is but

what comes out about that is it is in direct conflict with what then fbi director james comey testified to before the senate intelligence committee. several months later, with the incoming president when he was at trump tower he briefed him that these allegations were largely unverified and salacious. so this seems to be a far cry or a lot of daylight between what james comey testified to and what is being claimed in the democrat memo. i'm now halfway through my page 5. i want to draw your attention to a key section here. it goes to one of the central findings of the republican memo that the dossier funding, it was funded by the dnc and the clinton campaign. it was never directly shared with the national security court that granted the surveillance warrant for trump campaign aid carter page. and they really should have known the specifics of this research document. there was really an agenda behind it. and what the democrats say on

the front is that the information, the dossier was a political document, it was shared by the fisa court. but the issues surrounding the specific identities of the individuals and were not hard with the court.there are shielded and she is my language, this would, in keeping with the fbi standard practice of trying to protect sources and methods, you and folks at home can decide whether that was a legitimate use of the shielding tactic in this particular case. rather than tell the court they chose to use language such as, person one was hired by law firm one and use research firm number two in order to put this together. they describe this as a political document but they do not get to the specifics of the dnc and the clinton campaign funding it. now, when the critical issues

in the republican memo is that christopher steele, his contact was terminated with the fbi after they concluded that he lied about contact with the media. he was directed by fusion gps, the opposition research firm to brief a half-dozen american media outlets. about the findings of the dossier in an effort to supersede that narrative in media reporting here with the democrats version says right here is that once the fbi cut off contact with christopher steele, the british spy, this was shared with the court and also shared with the court in a january 2018 renewal. so there were multiple renewals of the surveillance warrant for carter page.one of the reasons steele may disclosures was he was frustrated with

james comey decision to reopen the clinton email case just 10 days before the 2016 election. so the talked about the frustration with james comey north end i think we see reference here to the on statement by steele that there was personal animus and wanted to do whatever it took to stop candidate trump. and there has been widely reported that the fbi paid christopher steele for this work on the dossier. but the democrat memo states very clearly that the justice department never paid steele for the dossier work. it was correct that the fbi had authorized payment for the work. but in effect the check was never written and sent and cashed by steele pierce of the authorized payment but ultimately, never received payment from the fbi for any dossier related information. in summary here, they make the

argument that the fbi justice department really did everything they needed to do when they told the fisa court it was a political document. they do not go because the fbi has standards in terms of shielding sources and methods, they did need to get into the specifics of it was the dnc and the clinton campaign that paid for it. number two, they say they shared with the court that he had been terminated and that he was personally angry with the director james comey for reopening the email case just a few days before the election because this is very damaging to prospects. number three, to make the case, steele was never paid by the fbi for his work. i will let you know as i get more. >> exactly. all important points. thank you. we have some guests set up to talk about this. as you learn more, jump right in. >> think you could do it catherine continued to look over the memo and bring us more insight as she has and information. in the meantime will bring in our fox news contributor and a

we are beginning to get a look at the democratic memo in response to the nunes memo. she has no information. >> a handful of final points. number one, i've been through the democrat rebuttal memo now. i will go through it again. it is important to note what is not here. but the omissions are. in this particular case, the republicans found that the former fbi deputy director, andrew mccabe, testified under oath in december 2017 that they would never have thought the surveillance warrant for carter page if it were not for the dossier. but that is not directly challenged in the democrats memo. i will do it again but i do not see a direct repudiation of that claim. and certainly based on initial reading it does not cite or give a verbatim if you will, of the testimony from mccabe. it is extremely important because of his testimony come from the former deputy fbi director. also, at the end of the

democrats version, it talks about how the republicans were disingenuous when they included evidence from the text messages for the two fbi officials peter strzok and the fbi live lawyer, lisa paige. send this was prejudicial, that they had a hatred of many candidates not just donald trump and specifically to the fact that peter strzok directed the exoneration statement that was read -- it is not a masochistic ability prosecuted by the us attorney. that drafting the democrats memo frankly, it is misleading based on the facts of what happened. because what we know now, is that two months before the exoneration of statement, agent peter strzok and others, senior level at the fbi for drafting a

statement that was going to clear hillary clinton when key witnesses had not been questioned. including hillary clinton. and it was peter strzok to talk about the phrase, grossly negligent for extremely careless because that's important. under the legal standard that is a prosecutable case. >> it is fascinating to hear your analysis of this going forward. so many family names mentioned in these documents, the back and forth as to how and why each side saying things are not done properly or were done properly in order to get what was achieved through the fisa court. catherine, thank you so much. we will be leaning on your analysis for the days to come. a spring in our panel, -- let's bring in our panel again. jason, i know you have been chomping at the bit. you got bruising by commercial but i want to get your insight as we are seeing the democratic

memo. which for a little while we were not sure was coming out. a lot of people thought maybe or maybe not but here it is. your thoughts? >> you bet! i have been going to this is much as possible on the fly like everyone. one thing jumps out to me. as a political matter. i think we all understand that both sides are engaged in a battle to either on the democrat side to advance notions and arguments that this entire investigation is credible and devoid of politics in any way whatsoever. and of course, many on the republican side are convinced and continued to advance arguments that this is nothing but a political and i believe the presidents that a number times, witchhunts. there was one thing memo so poor that jumped out to me. and what it leads me to believe is that there is nothing here that is going to change opinion on either side. that one thing was confirmation that the report was in fact used. it played some role in the fisa

warrant process. they said they did not disclose the political -- but the fact that there was an admission that it was using the fisa court process, the warrant excuse me, plan for the warrant. whether it is right or wrong really does not matter. it is a political matter. that will lean on -- put gasoline on the fire. >> you make a good point because devin nunes speaking before cpac made a similar argument.that this information relates will do nothing to change when he sees as proof of abuse in the fisa court. jessica, as you see this information and was just mentioned, possibly some politics at hand here. your thoughts? >> i completely agree that is a political document.

our coverage continues not the democratic memo released in the last hour. we had joined now for the daily caller. like the rest of us you been skimming this memo from the democrats. it says that they said attempts to correct the record on the russia investigation. any first impression or reaction from the white house? >> i've done just about half of this on a tiny phone screen. from what i can get so far, it was pretty significant that catherine herridge already brought up. on page number for the democrats note in the footnote about the political nature of the dossier. the fbi did not disclose who the clients work and so the saying there that this standard
