poppins when we saw the movie back in salina, kansas in 1960's, my mom took us to the fox theater. brian: ford theater ended badly. steve: that's a different show. it turns out she had just bout us the sound of music album and because it was flat we figured we should put it in the back window that is flat, too. when we came out it was waffled. brian: re interesting. very different. steve: not a good memory but a mary poppins memory. thank you for joining us on this very busy wednesday. start with a fox news alert. special congressional election they held yesterday in the 18th district, too close to call. ainsley: a razor thin margin separating those two candidates right there. one is already declaring a victory. brian: let's go out to eric shawn. this looked like a blowout for a while. conor lamb in the driver's seat a matter of blowing up the balloons. and then what happened?

>> well, this happen. virtual tie. here is the headlines this morning here in pittsburgh. it remains that way right now, brian, although reports are it looks good for conor lamb but it's very close. more than 1,000 absentee ballots were being counted overnight and reports say that has been completed in washington county where they say lamb has an edge over his republican opponent. lamb, of course, is a 33-year-old former marine, former federal prosecutor who has criticized the political climate last night during his speech in which he claimed victory. he was heavily supported by the labor unions of steel and the coal industries. although some of his issues dove tailed with president trump he said our nation's contentious politics must end. >> it took a little longer than we thought but we did it. [cheers and applause] [cheers and applause] >> the race hasn't been called yet. as for rick saccone, his republican opponent a four term state representative,

he said he is not giving up. so both sides in the standoff at this hour this morning and because this race is so close, it appears that it certainly would go to either a recount or a recanvassing over the next several days. back to you guys in new york. brian: eric, am i understanding it isn't automatic recount because it's not statewide both sides have to agree to pay for it? is that correct? >> well, that's one of the problems. also under pennsylvania state law, individual voters have to come forward. you need at least four to claim that there was some type of voter fraud or some type of issues. so their standard is very high here in pennsylvania. certainly there could be some type of recanvassing. steve: eric shawn out in pennsylvania. thank you very much. it looked like president trump probably closed the gap. keep in mind it was just last week that mr. lamb was up by six and donald trump came in and his family and

it's a dead heat. ultimately, keep in mind this as well. mr. lamb ran as a republican. sea democrat running as a republican. he said if he was elected to the congress, he would not support nancy pelosi. he was for the president's border, taxes and tariffs. and he stood with the republicans essentially on issues like abortion. ainsley: if he does win and does make it to washington, of course he is going to vote with the democrats just like joe manchin did. we had donald trump jr. on yesterday. he was saying no democrat is ever going to go against the party. they are not going to go against nancy pelosi. they are not going to go against chuck schumer. those are the two most liberal of all those serving in washington of the democratic party. brian: it was brought up, too. is it true that the democrats have momentum? yes. is it true that all these special elections, even the ones they lost, is their turn out up. is it true in the past when the minority party comes up after losing the presidency and the house and the senate? that is tradition. however, the one thing that's interesting is that

tim murphy, who ran unopposed last time and this was his seat. he was prounion. this is a big union area. and this tariff issue looks as though on the sur fossa to be more of a prounion issue. he goes along with tariffs. is he prounion. saccone is -- h he is not prounion. right there virtual heat. 33-year-old prosecutor a marine as opposed to somebody who is not really known statewide certain solid better. the democrats have reason to be happy? yeah. i'm very curious to see how many pro-life, pro-tax cut, progun, anti-nancy pelosi candidates will be nominated for november. because bernie sanders and elizabeth warren have a different image where the party is going and they're looked at as leaders. if they are saying wow, we are on a roll, yeah. name another candidate like conor lamb. steve: what's interesting about this particular thing that is too close to call is

they both ran as republicans. meanwhile, let's head out west, the president of the united states flew out on 747 air force one. then he took marine one and motorcaded over to a location where he could view with his own two eyes, small slivers of that big, beautiful wall. you know, he has been talking about going out there and looking at it ever sips he signed the executive order asking the department of homeland security to build them. ainsley: when you see the video of the prototypes. there are eight of them. i didn't realize they are as tall as they are. steve: 30 feet. ainsley: when you see the president standing next to them you understanding how massive they are. here he is talking about those prototypes. >> the border wall is truly or first line of defense. and it's probably, if you think about it, our first and last other than the great ice agents and other people moving people out. we are looking very much with the wall with some see through capability on the other side and solid

concrete on top or steel and concrete on top. getting over the top is easy, these are like professional mountain climbers. they are incredible climbers. they can't climb some of these walls. some of them they can those are the walls we are not using. build and saying oh, gee, i wish we did it a different way. but, if you didn't have it, you would have a tremendous problem. and even the walls they have now, they are not holding out, they are not holding up. brian: the president, this means a lot to him. in san diego, it is known to be the truth that the wall has absolutely worked. but they didn't finish it. there is still holes in the san diego wall and in areas where it was built it works. for this attorney general of california, fellow congressman from california basara to come out and say mid evil technology, really? could you tell that to the israelis it seems to have shut down the suicide bombers the day it was finished. number two it seemed to work in san diego. when you say things like

that you lose all credibility just because you are pro-illegal immigrants. ainsley: the governor is at war with the administration saying they are sanctuary states they are not going to follow immigration laws. they filed 28 lawsuits against the administration. it's a different animal. it's california. steve: speaking of california. the president of the united states did talk about jerry brown the governor of the great state of california. he said jerry brown is doing a terrible job, taxes are two or three times more high. sanctuary state. a lot of criminals living in sanctuary city areas as well. some people had thought that the president would actually walk down the -- through the prototypes and say that's my winner. but he did not do that by the way, it's not going to be built in california. they are actually going to build sections of it in the great state of texas. brian: but the problem is the president has not -- did not sign onto the deal. many of you are happy about it that would have given him 28 or $25 billion to begin massive construction and put it into some type of account

that would not be touched depending on who is in power. meanwhile the president wasn't done on california just on the visit to the wall and the beverly hills fundraiser. he also went to camp pendleton and saluted the marines. listen. >> i have a message for you straight from the heart of the american people. and you know what that is. we support you, we thank you, we love you, and we will always have your back like you have ours. we are finally going to lead again. very soon we are going to mars. you wouldn't have been going to mars if my opponent won. [laughter] >> that i can tell you. you wouldn't even be thinking about it. new national strategy for space recognizes that space is a war fighting domain just like the land, air, and sea. we took off the gloves. in one year, we did more

damage to isis than other administrations. a certain other administration did in many years. steve: the president got a very warm reception there at miramar. he was greeted with a lot of applause. in fact, we are going to have somebody coming up in the next section talking about the reception that he did get. he told those gathered he said we are going to get you new planes and everybody is going to get a raise. ainsley: so nice to hear him say that to the men and women who sacrifice so much for our country. brian: he also pointed out general mattis doing a great job. general kelly over there him and his four stars. we are very pro-military here. and by the way he getting his parade it looks like, too. without the tanks. i have always said what's a parade without tanks but they would try it anyway. steve: the tanks would screw up the streets. brian: in you new york we screw it up without the tanks. in washington they get it down. ainsley: don't carry a cup of coffee down the street.

brian: in a tank it's very bumpy. jillian: good morning to you guys and to you at home as well. get you caught up on what is happening in florida right now. school shooter nikolas cruz will be back in court today to be formally arraigned as prosecutors announced they will seek the death penalty. his attorneys claim he is willing to plead guilty in term for 34 consecutive life sentences. it has been one month since the shooting killed 17 people. students across the country today will walk out of class for 17 minutes in honor of the victims and to push for stricter gun laws. a major victory for law and order in texas overnight. federal appeals court ruling that most of the state's sanctuary cities law can remain in effect for now. the ruling allows police officers to ask police officers during routine stops whether they are in the u.s. legally. it also threatens sheriffs with jail time for not cooperating with ice. still on hold is a provision punishing elected officials who don't enforce the law. president trump hitting the road to saint lewis today to tout his tax cuts. he will speak with

steve: hundreds of supporters chanting build that wall. so, what do they want in the wall? our next guest took part in that rally and joins us right now. former california assembly man and congressional joins us from l.a. good morning to you. >> good morning steve or middle of the night at least out here. steve: it's 3:18 where you are at, tim. tell us a little bit about the reception the president got there at the border. >> you know, the president was greeted with great fanfare and the media tried to cover it up. they kept making a big deal about how it was his first visit and he was coming to the state of resistance. he was going to meet all these massive protesters and so far they were a real dud. his supporters outnumbered the protesters 3 to 1 in spite of all kinds of attempts to obfuscate and confuse people about where they should be rallying. steve: what do you mean they tried to confuse folks on

where they should be gathering? >> well, i shouldn't say they. i mean, in one sense it was security for the president to not necessarily say what his route was going to be. i totally get that but the place where the opposition were sent was the place where the motorcade went. and, yet, a number of us supporters found our way there and still outnumbered the opposition even though the official rally was about four miles away and there were 600 or 700 people at the rally in support of the president and maybe 100 protesters. steve: i know you are not crazy about the fact that california is a sanctuary state now. here is what the president said regarding that listen. >> they are the best friend of the criminal that's exactly what is happening. the criminal take refuge in these sanctuary cities and it's very dangerous for our police and enforcement folks.

steve: tim, how many people in california like the fact that they are a sanctuary state? >> i don't know of anybody who likes the fact this is a sanctuary state ? they should be arrested for aiding and abetting criminal illegal aliens as well as obstructing justice. and i think president trump is maybe the guy that would do that. steve: i know yesterday at the rally you did call for their arrest. the arrest of the mayor and the governor and kevin leon as well obstructing law and order out in california. we thank you for you getting up to tell us about your day yesterday. it's middle of the night. 3:20 in l.a. thank you, sir, for joining us live. >> thanks for having me on. steve: interesting stuff. meanwhile, straight ahead, as soon as president trump picked gina haspel to lead

mileage. she has worked for more than 30 years in the agency. she has earned the right to be there. she can go to work on day one. the other thing is that if president trump wants a nonpartisan cia director, she is the perfect choice because she is going to tell him what's going on based on the best intelligence available without filtering it through some kind of a political lens to either please him or achieve some political goal or via for a better job in government. she is the perfect choice for this particular job. brian: she is going to break a ceiling here there has never been a female cia director before that didn't stop the bashing, listen. >> later in her career haspel was heavily involved in the cia's controversial torture program. in 2002, she ran a secret cia prison for suspected terrorists in thailand that used harsh interrogation

tactics including waterboarding, sleep deprivation, even squeezing detainees into con fins. >> look at her past record. her commitment moving forward, it's an issue of concern. brian: does it concern you? >> is that a question to me, brian? brian: yeah that was my voice. i know we just played three. after seeing that montage, do you have the same concern that those newscasters did and senator cardin. >> not at all. you have to remember of the program was the policy at the time. it came from the highest levels of government. it was operated under the direction of the presidency with the president, with the consent of the national security agency. the attorney general approved of the program and said that it wasn't torture. and hundreds and hundreds of people were involved in that program in the agency. whether or not she was. and i think it's not right to hold people accountable to a different set of

standards than were in place at the time. that program stopped attacks, disrupted plots, and saved lives. so, i'm not concerned about that kind of talk. brian: go ahead. >> no. you go ahead. brian: politics and reality. you know the reality. you don't necessarily note politics. so when she is asked that question directly, did you torture people in thailand in black sites in eastern europe? how do you answer? >> i have no idea how she is going to answer that i can tell you how i would answer it. i would say no. brian: because. >> because that's not true. it's as simple as that it's just not true. the cia did not have a torture program. the sites are still classified. so i'm not going to opine on that. i can't confirm or deny any of that stuff. i can't confirm or deny she was part of that program. i can tell you if i was

asked that question you asked me i would say no, full stop, period. america. brian: a lot of people like you, i read your buick, are proud that they were able to take the worst of the worst and stop the next attack. >> absolutely. she is a hero. she should be the next director of the cia. and america will be safer with her behind the wheel. brian: it's going to be fascinating. i think we will get to see her in april according to senator corker. is he going to try to schedule this quickly. obviously we're all in support of that. dr. mitchell, thank you for your unique perspective. >> thank you, sir. brian: coming up straight ahead, hillary clinton still blaming everyone else but herself for that election loss. now she is doing it overseas and launch ago brand new attack on trump supporters. >> his whole campaign, make america great again was looking backwards. you know, you didn't like black people getting rights. you don't like women, you know, getting jobs. brian: tomi lahren is fired up about that as as are you.

we have her exclusively this morning. thanks for getting up with us. >> of course. i'm still on the high prosecute frump visiting my state. i think he made it a little greater. it's a great morning. great day to be an american. steve: what did you make of him taking a shot of your governor out there jerry brown saying he is doing a terrible job? >> i thought he actually was very restrained in his approach. i would added many more things to say about our lovely governor. i think president trump did a great job of reigning it in. steve: very good. brian: many people i was stunned at the remarks that came out of india. i believe that hillary clinton's remarks in its entirety were by far even worse than when she called frump voters a basket of deplorables. here is how it sounded as she continues to promote her book and make sense of her loss. steve: plus we will play her campaign manager right after her. brian: wow, that's a surprise u. >> his whole campaign, make america great again, was looking backwards. you know, you didn't like black people getting rights.

you don't like women, you know, getting jobs. you don't want to see that indian american succeeding more than you are. whatever your problem is i'm going to solve it. >> this, this is bad. you know, i can't sugar coat it she was wrong. and clearly it's not helpful to democrats going into the mid terms and certainly not going into 2020. she has put herself in a position where democrats are going to have to distance themselves from these remarks and distance themselves from her, particularly those democrats that are running in the states that donald trump won like ohio and pennsylvania and wisconsin and michigan. ainsley: what's your reaction, tomi? >> well, my goodness, i mean, this woman claims to be the leader of women. she claims to be the ultimate feminist icon and then she goes ahead and insults white women that we can't think for ourselves and we can't vote for ourselves. further along she says we

vote because our husband is our boss and our sons tell us how to vote. could there be more antifeminist statement than that? i don't think so. every time hillary clinton opens her mouth we are reminded why we voted for donald trump. that makes me feel just a little bit better. brian: is incumbent on democrats to rebuke her? after all, they have an election to win in november. right now she is the most popular democrat in the country. why until someone steps up, we assume everybody believes that on the democratic side. >> there are some certainly on the far left that do believe that i think if the democratic party want to win they will definitely have to distance themselves from that because they still need to win middle america, they might have a real disdain for middle america but they still need to cater to us and care about us. when she goes and makes those comments i think it makes them sweat a little bit. i really do. steve: it was very unfortunate. speaking of unfortunate commented, joy behar a couple weeks ago was on the show and talking about mike pence and how mike pence

said he has a conversation with god frequently then she said that and i'm paraphrasing her joke people that hear voices like that are mentally ill. and taking a shot at hundreds of melissa, ainsley of americans. ainsley: mike pence was on the show. you probably heard what he said. on the phone because she called him. he wanted her to go on the air and apologize to the tens of millions of americans that she offended as well. yesterday she did apologize. listen to this. >> oh, i think vice president is right. i was raised to respect everyone's religious faith and i fell short of that i sincerely apologize for what i said. ainsley: are you buying it? what do you think? >> i think it might be a little bit too late. hey, i have to give her credit. i sat right next to joy behar. i disagree with everything

the woman says. i do think she is a good person. i would hope that the apology is genuine. i'm happy that abc made her do it even if it was forced. i give abc a round of applause for that i didn't expect them too. brian: evidently bob iger sat down with a bunch of investors and they wanted an explanation for her comment and they basically had none. doesn't that turn around to the talent and put the pressure on her to speak up? >> i would hope. so and i would hope in the future the commentators on "the view" of all places would keep that in mind because there are probably a lot of viewers out there that happen to be christians and then, you know, to hillary's comment, white women as well. they really need to watch what they say if they want to have an audience. steve: coming up, the audience of "the view" is going to see the former fbi director james comey sitting around the coffee table as well because he is going to be out promoting his new memoir. is he going to go to the ladies of "the view" to help sell books. what do you think of that?

>> he is going to go to get softball questions and get a pat on the back. these are the people that had a real disdain when lost the election for hillary clinton. now they think he is some kind of hero. the reason is he a hero because they want to see this president and country fail. we watched joy behar celebrate when she thought there was collusion. we watched her celebrate on air of course is he going to go and be patted on the back. my question is will you come on fox news and get questions from people that might not agree with you. will you go on with tucker and sean and laura? that's what i would like to see. brian: tomi brought up a great point he should if he wants to sell the book, number two is, he is not going to have an easy time elsewhere because every other person blames james comey. ainsley: i think they will ask him tough questions. because they are furious with him. >> you would think. so they think is he going to bring down this president. very confuse you had as to what they really want.

steve: now to a fox news alert. ainsley: new information from austin police as their manhunt intensifying for that serial bomber accused of leaving explosive packages on victims' door steps. >> this evidence makes us believe that these incidents are related. >> we are just not going to ignore the fact that the three victims that were targeted specifically that we know of were all people of color. >> we are not ruling out terrorism. we're not ruling out hate. brian: all right. i would say one. fox news contributor and police chief ed davis led the investigation into the boston marathon. had years of great service to that city and joins us now to react. so if i put this case in your lap, what would be the first thing you would look to investigate? what's in the bomb or how these bombs might be relate

related? >> >> good morning, brian. the first thing you take a look at is witnesses at the scene. this is the suspect's main vulnerability is that he is appearing at the scene himself or having someone go there he is not using a postal service or delivery service to drop these bombs. so, that's the first area. then you have to look at the construction of the lawn, what kind of equipment is used in putting the bomb together? the atf probably has rebuilt these things and on the marathon we had it rebuilt in two days. they are looking at all the components and tracking those things down. and then the other big thing, which is used in investigations now across the board is the presence of video from the area. you know, these places people have home security cameras. so there is a lot of video that's being reviewed right now why the police. steve: obviously as well,

ed, they are trying to figure out is there some commonality between the victims? is there some reason somebody would target these people? ainsley: is it a hate crime? >> right. and they have said that they are looking at the idea of a hate crime. that would be the first independent occasion when you look at the circumstances here. so, they are going to look very closely at that. and then try to find people that have, you know, espoused a philosophy where part of what they are doing. they are looking at everybody in the area. ainsley: is there a way they can look at all the pieces and particles in these three bombs and track them down to wherever they bought these items? steve: the boxes? >> yes. i can assure you there are agents and police officers from the austin police department. i worked with austin ph.d. tremendously professional organization. they are running down every single piece of equipment that is used in these bombs to try to find out where they came from.

brian: ed, what about the coordination? you have the feds in there. this is an fbi situation. local cops you know the area best. who leads? >> well, in a homicide investigation, it will be led by the austin police department. but if it turns into a terrorism case, the fbi will take jurisdiction of it quite frankly, everybody is working together on a case like this. there is really good cooperation. it's not like it was 20 years ago. people pulling in the same direction, i'm sure. the fbi is looking at the behavioral exonts of this. this is a serial killer. he has killed three people which is a definition. and the atf is doing all the technical work, i'm certain. steve: that's why 150 people called the austin police yesterday saying there is a package out in front of my house. i'm worried it's a bomb and the cops came and took them all out. >> great to see you. steve: straight ahead on wednesday president trump head to slam the state's governor jerry brown.

going to walk out. instead you are going to pray for 17 minutes? why are you doing this. >> we decided estates as we looked at the issue and what students in other schools were doing, we decided as a school what we could do is something different. by praying for the victims. we could bring great focus to the victims in this situation and by prayers and unified prayer we can be a powerful impact on the situation. >> planned to have mass together and in the context of that mass have a prayer service whereby students will -- 17 of our students will step forward and read the names of the 17 victims from the parkland shooting. they will read their names and a little biography to make it real to all of us who will be in attendance that these are real people who died. and then we will offer them up in prayer and pray for an end to school violence. and doing something that we as a catholic school can and should do and that is pray and unleash that power of prayer. ainsley: that's very sweet

won, he ran as a republican. the democrat ran as a republican. ainsley: because his district is changing, they could actually run against each other if they both decide to run again in november because their houses are in different districts. brian: or run for separate seats and have to declare by may. cop graduate legs for a month enjoit job and start running again. it's going to be very interesting. if you are looking at clues to success. if you are a democrat. you have got to say i have have to run from current leadership. i have to not disagree with president trump because he was not taking on trump on almost anything. is he obviously a marine so military background helps. he was pro-the tax cut. ainsley: progun. brian: pro-tariff and pro-ice. this guy ran and a prosecutor. so he ran very moderate. for democrats to be successful they have to run from elizabeth warren. they have to run from bernie sanders. ainsley: i think they do. this is an exception. democrats have to say what did he do?

what did we do right here? he is young also. is he more moderate like you said and more of a republican agenda than a democratic agenda. now you look at nancy pelosi and chuck schumer. they need to start thinking they need to be out because they are so extreme. brian: ainsley, i don't think they agree with you though. i don't think that chuck schumer thinks he has got to change and i don't think nancy pelosi think she has to change. ainsley: those two don't but the rest of the party might. steve: this guy said if i'm elected i won't vote for nancy pelosi to be the speaker. ainsley: that is so not true. he will vote along party lines. brian: tim ryan got a lot of votes. ainsley: for the speaker, i got it. steve: in november, keep in mind a bunch of votes with the house of representatives. this guy if he is seated will he vote for the president or will you run from the positions? ainsley: we will see. steve: to win the job. stay tuned. ainsley: president was there. he visited twice i think and joe biden was there stumping for the democrat.

these sanctuary cities and it's very dangerous for our police and enforcement folks. i think a lot of people in california understand that a lot of people from a lot of other places understand it and they don't want sanctuary cities. these policies release dangerous criminal offenders to prey on innocent people. and nullify the federal law. brian: this is really coming to a confrontation right there, you know, it's california against the -- of the united states of america. when it comes to sanctuary state and big move yesterday. i think it's noteworthy that a federal court upheld its ban in texas of sanctuary cities. and that is the u.s. fifth circuit of appeals. that attorney general sessions vas very happy about this. obviously it bolsters his claim of last week that it is not allowed for the governor and the attorney general to declare that state a sanctuary state while still pushing back against ice. steve: while the president was in attendance looking at

the prototypes, there were a number of rallies from supporters. there were also a number of people who tonight like president trump. but tim donley does. and he says the protests were a dud. and he said this just about an hour ago on this program. >> the president was greeted with great fanfare and the media tried to cover it up. they kept making a big deal about how it was his first visit and he was coming to the state of resistance. he was going to meet all these massive protesters. and so far they were a real dud. his supporters outnurved the protesters 3 to 1. ainsley: he was actually there he said the president's supporters outnumbered the protesters 3 to 1. you won't see that in the headlines. steve: you went. that guy also said that he is calling for the arrest of jerry brown and also the oakland mayor because they have obstructed justifiable. brian: right. meanwhile 11 minutes now after the hour. you don't watch "the view"

brian: president trump ousting rex tillerson abruptly with a tweet. replacing him with mike pompeo saying he and mike pompeo have a similar thought process. steve: our next guest argues firing people can sometimes be a good thing. joining us now is robert charles, a former assistant secretary of state for president george w. bush, he joins us from our nation's capital. good morning to you, robert. >> good morning.

steve: so tillerson and trump were not on the same page. this was ultimately going to happen. >> yeah. i think so. you know, bottom line is that the president sees rough waters ahead and he needs seasoned pilot at the ship estate. and have you got north korea with a great potential opening on the horizon there. you have got russia testing him every day china just has a leaders that declared indefinite tenure and iran with a go no go accord in may. you no, really the truth is rex tillerson was a steady hand for the next year but he never learned to salute smartly and execute the president's decisions. and i think ronald reagan, frankly, probably would have shown him the door last july 20th when the secretary said that the president was a moron. at a certain point, you just have to act and be done with it. brian: robertrobert the other thing is he did a terrible job at the state department. he stripped it and had no plan to build it up again.

he wasn't communicating with the people underneath him. whether he had best or worst people around it wasn't effective model. have you heard the same thing. >> i have. the bottom line again is i work for colin powell who was a great secretary of state. whatever else people think. and he created buy in. he brought the foreign service officers together with the politicals together with the civil servants and have you got to do that. you also can't be captured by the bureaucracy. in many ways i think tillerson maybe was a little more tentative. he had been a number one in his world at exxon and it's hard to be a number two or three or four and then to management it's tricky. steve: bobby, it's one thing to disagree with your boss behind closed doors but he was very open in the fact that he and the president were not on the same page. >> you are absolutely right. you owe it to the president to give him your best opinions behind closed doors and then when that is said and done, the president has made a decision, you salute smartly and you go execute that decision which was problematic for him. brian: word is in the next one to go could be the v.a.

some questions i think we have to list and add one more it should probably be 43. that additional number is hillary clinton herself. ainsley: she should blame herself? >> she has said that she has taken responsibility on numerous occasions. i think it is in the best interest of democrats to look at everything that is on that list as we see the democratic norms that make america great. coming under a full force attack. so, it is a good thing for democrats to analyze that maybe more behind the scenes than in front of the camera. but, hillary clinton has every single right to answer questions, to talk about her race trying to describe it being bitter and angry, i find that to be really a little bit sickening. and what hillary said is not what the democratic party says those two things are not necessarily connected. >> jehmu i find that to be

congressman, good morning to you. >> good morning, guys. steve: can you explain to us why these democrats who are aligned with him or met with him or whatever have not cut ties with him because if a republican were to be aligned with somebody with that kind of rhetoric, they would be in big trouble. >> one reasons i introduced this resolution. it's going to be a test, i'm certain republican colleagues are going to join condemning this hate filled speech this hate filled man. will my democratic colleagues. you know not new language in this resolution. there was a similar resolution in 1994 passed by a democratic house. and so this should be a bipartisan issue. this is a test. this resolution is a test to see whether my democratic colleagues, if they are under fire, if they feel any kind of remorse or pressure or want to right the ship at all, they should join this resolution. ainsley: todd, were these democrats, were they just seen next to him while he was talking or how close are these ties? >> well, some of them, a

lot -- there is about 10 with ties. 8 have had meetings. some have left the door open for repeated meetings. like my fellow indiana congressman andre carson. he has said he would be willing to meet with him again. this is an opportunity for him to correct the record and allies like senator joe donnelly, they are on radio doing a commercial right now. call on joe donely to denounce this kind of action and tell andre carson to get on this resolution. brian: president obama when he was senator obama took a picture with farrakhan that reportedly was buried for years now that he is out of office. >> it goes to show the hypocrisy of the media elites. we put this resolution out yesterday, it just got filed. you are the only news organization that has shown any interest in exposing what's happened here. the media elites and the democrats work together to stop that picture you are talking about from being -- from surfacing for over a decade u that's how hypocritical they are. steve: why do you think that

steve: while president trump visited california yesterday to see border wall prototypes. he stressed the importance of the wall and those who protect it. >> the border wall is truly our first line of defense. we must enforce our laws and protect our people.

and i have to say law enforcement, ice, border patrol, all of the people that have been so good to me for so long, they are really doing a job. steve: so what are the men and women who protect the border daily want in the wall? here to weigh in, one of the border patrol agents who was in attendance with the president yesterday, the president of the san diego chapter of the national border patrol counsel terrence. good morning to you. >> thank you. good morning. steve: good morning to you. so you were there you when the president was at the border. what did he say that you wanted to hear him say? >> i think for our guys, the important thing is the fact that he was there. he didn't really even have to say anything. but a lot of the points that he touched on, as far as building the wall and building the infrastructure that we need to do our job safely and to protect the public. that's what our guys really enjoyed hearing and the fact that he was actually there to see the environment that our guys work in every single day. that was a good thing.

steve: you know, terrence, there are a number of political leaders in washington, d.c. who, actually in both parties, who don't want to build a wall. they could be listening right now. how would you appeal to them that the wall would make your job easier and your life safer? >> i would invite them to come down to san diego because, first of all, we already have a wall. so when people assume that there isn't already a barrier there or some type of wall, that's incorrect. if they come down to san diego, they will see the benefits of it you can look at the businesses, the homes that have sprouted up. the crime rate that's gone down. so it's easy to prove that walls work. that the barriers are efficient and they make it easier for us to do our job in a safe manner. >> you know, when the state of california essentially adopted sanctuary state status, what does that say to people who are not in this country and are thinking, you know what? i should go to california because the coast is clear.

look at the map, overnight more than 1000 absentee ballots were countied in washington county. we're told basically 60% of those votes in evenly split county went to conor lamb. so the trend is looking good for conor lamb. there is a way to go. that didn't stop him from claiming victory in the race. 33-year-old former marine and federal prosecutor who relied heavily on steel and coal union epdoorsments and foot power to gain traction in his race against the republican opponent. he said the issue is common ground. he dovetailed on many of president trump's issues. he did say the nation' contentious politics must end. >> it took a little longer than we thought but we did it. [cheers and applause] our work on the problems our people face, secure their jobs and pensions, protect their family. and i will work with anyone to do that.

republican. he is a democrat running as a republican, in a republican district will not exist after november. it is just a job for a couple months. brian: couple weeks ago the president had a opportunity to april a deal with democrats that mike rounds put forward, cosponsored, a republican, would give him 25 billion for a wall and legalized these daca kids young adults, 1.8 million, would give them 10-year pathway to citizenship. he didn't want it. you have to include chain migration and include visa lottery. however 25 billion is not there. and the president was in san diego to stalk about -- talk about what the wall with like like had we had money to build it. >> the border wall is truly our first line of defense and it is probably, if you think about it, our first and last, other than the great i.c.e. agents and other people moving people out. we're looking very much at the wall with some see-through

nation at risk. gop senator marco rubio joins us now to weigh in. senator, pretty wild scene as president checks out prototypes. the attorney general was taking on the state. where do you stand where it comes to sanctuary states and cities? >> states need to follow federal law. i don't know what is so complicated about it. i don't know why it is controversial. if you don't agree with federal law you have two senators, dozens of members of congress come up here to change the law. try to change the law. you have to follow the law. that simple. you can't have states that are countries. they have their own jurisdiction in 10th amendment under the constitution on certain matters but under immigration that is federal topic. that they have to follow federal law. it is simple as that. brian: how important is it to follow through as attorney general sessions to allow i.c.e. agents access? this country crumbles if we don't listen to federal laws. >> yeah, that's right.

i'm one of the first people out there pushed back against federal overreach on things like education and things of that nature this, is purely federal function. this would be equivalent of california saying we sign a treaty with china and we don't care what u.s. foreign policy is with regards to that. same thing here. this area of law belongs to the federal government at that level. california has no right to ignore it. it has to be enforced. i'm glad they're enforcing it. brian: let's move to guns, senator, if we can. this legislation put forward by the states, you guys along with senator nelson are encouraging a red flag gun law. we have somebody in the midst, not necessarily violated law, but all the people around him no him or her but haven't seen that yet, this person could potentially be a danger but the state has not been empowered to act. what does a red flag gun law do? >> it allows somebody to go to court, family member, someone that lives with you, law enforcement, present evidence to a judge, clear and convincing

evidence that this person is a danger to themselves and to others. the judge can issue a restraining order. the way you do with domestic violence and other things to keep the person from buying any gun and takes away the ones they have. you have to go to court. it is due process. not just knock on the door to get it done. if something like that had been available in florida, you potentially see where someone would have used that. yesterday, one of the fathers here, ryan petty, father of elena petty, one of the 14 student that died at stoneman douglas high school. this killer was the worst-kept secret in parkland. as soon as shooting happened they knew he was. was never arrested despite multiple visits to the home. we don't know where he was in the school discipline chart, just look at reporting everybody knew i was still a problem. not only around these kids, this guy was able to buy guns. there was no way to stop it. there was no follow-up on the calls to the fbi and the

sheriff's office either. brian: i love this. nra, have they weighed in. >> well i think, i don't know what their position on it would be. we haven't spoken to them about it. my sense, knowing about where they stand they would want to see strong due process protections. we all agree with that the is second amendment is constitutional right. you can not deny a constitutional right without due process to prove that person forfeited that right. that would exist here. judges would have to sit there, there would have to be clear and convincing evidence. present it to a judge, make a clear case. it is not permanent, by the way. it has to be extended every 12 months. the person can come back reexamine whether circumstances have changed. brian: i love this. mental health is the thing and law enforcement needs to be empowered to do what they're tripped to do. senator rubio is working with senator nelson. thank you, senator. >> thank you. brian: we change gears. proud mom of a son with down syndrome. what happened when congressman

spend time with cole. our son is 10 years old. yes, when we got that news it, was tough news. it is not what you expect. it is not what you dream. just because something is tough doesn't mean that it is not positive. and cole had a tremendous, positive, impact on me, on our family, and everyone who meets him. he is a delight and he has huge potential. and we should be celebrating the potential of every person in this country. we should be warriors for human dignity and human value. and that is, that is my passion and that is my message to ruth. ainsley: well the facts are that more than 2/3 of u.s. women choose abortion when they find out that their child has down syndrome. what do you say to women that are watching that are struggling with this, trying to make a decision if they found out they're in that position? >> well, to women that are in this situation i know it's a tough situation. it is difficult news to receive. it is overwhelming.

i remember at the time that the doctors gave us a long list of everything that potentially could go wrong. that is overwhelming. but it would be overwhelming to any parent upon the birth of their child they're given this long list of the potential of car accident, or getting cancer, whatever it may be, becoming a parent can be overwhelming in of itself. i would encourage them to also look and see this child as having huge potential and they don't understand in that moment how that child is going to postively impact their lives and this world. here on capitol hill, it has given me a whole new passion. i'm excited in the tax bill we got able to work provisions. this was legislation i introduced to allow those with disabilities to go explore work. let's focus on their abilities. let's focus on what they have to offer. we live in an amazing time in history where we are not bound by the conditions of our birth. ainsley: congresswoman, what do you say to the women who can't

afford it and worry about the doctor bills? does the government help them? >> there is a lot of support. there is more that needs to be done but early on i was surrounded by a team of people. the social workers as well as doctors, therapists. we have early intervention. that is very important. those early year, early intervention. cole now is in fifth grade. so for the kids that are in k to 12, they're mainstreamed. they're given the opportunity to learn, which not that long ago they weren't. cole is reading. he loves math. not too long ago, they said, oh, you can't learn how to read. we need to stop putting limits on their ability. focus on what they can do. the next frontier is open up that opportunity to work. many with disabilities now that have been through early intervention, been through the k-12 system would love to have the opportunity to work. we as a culture need to give them that opportunity, to see what they can do.

ainsley: i remember when we were young a lady stood up in our church. she had three chirp, one with down syndrome. people say they feel sorry for me or they're praying for us. she said don't feel sorry for me. he brings so much love and joy to our family. we are complete because of him. what kind of joy and light does coal bring to your family? >> when cole walks into the room he lights it up. he is positive, enthusiastic little guy. he loves playing basketball. he loves being with other people. people are drawn to him. he is such a positive on our family but also on everyone who meets him. that is what i want people to see. i think we should see that about every person. let's focus on the ability. let's focus on what someone has to offer. ainsley: congresswoman, thank you so much. god bless you and god bless that precious child. >> i am blessed. thank you. ainsley: yes you are. thank you. louis farrakhan is known for his hate-filled comments. listen.

in the u.s. army as helicopter pilot. joins us from the nation's capitol. >> good morning. steve: tillerson and trump not on the same page. one of them had to two. i guess it will be rex. >> it was. i think it was time for new leadership at the state department. aside from them having fundamentally separate points of views with the way that they see the world, they also just never developed a pour that the president feels is necessary and rightfully so, to have someone leading the department of state to success. they never had the relationship needed to get to that point. so i think the president, he wants to bring in new energy. he wants to bring in someone he has as a trusted senior advisor that can have the opportunity to lead the department to success and advance his agenda. that is what he is looking for. he hasn't seen that in the past year. ainsley: sometimes it takes a good little while for you to realize if you will mesh with

someone, when you hire someone to work with you and it appears a little more year in that's what's happening. do you anticipate other changes in the future? there is rumor, david shulkin, head of the va might occur there, with your military experience, what do you think? >> it has been over a year and he has been able to assess what he sees within his cabinet, his advisors what is working for him, what is not. i think we are going to continue to see some changes. i don't necessarily think that is a bad thing. we want the right people in the right positions that are going to be successful and get the job done for the president. i do have to say that i am very surprised that secretary shulkin outlived secretary tillerson in a cabinet position because he has some, you know, high-level cloud hanging over him. steve: has some problems, no kidding. when you think, amber, back after donald trump was elected

president, you know, suddenly going down to washington, he has only a core number of people who are on the trump team. so he goes down there, and you know, you have reince priebus and establishment saying you need some more establishment guys. now we're a year in, it is kind of like, i didn't get here with establishment guys. i got her with disruptors. that is what i need more of! >> i think he need more people who want to advance the president's agenda, not their own agenda. so i think anybody who joined this administration with the intent of saying, i'm here to be the adult in the room or i'm here to keep country on track that is absolutely the wrong way of doing things. you serve at the pleasure of the president. you're there to advance his agenda. so i think anyone who is trying to do something other than that is playing a losing game and it will sooner or later catch up with them. ainsley: thanks. amber smith, thanks for being with us. steve: thanks for your service.
