opportunity to take it back but you still lied. so they are crooked but you are not? you are in the news because the office of professional responsibility after the inspector general's investigation said you made unauthorized disclosured to the news media and you lacked candor. you lied about the clinton foundation investigation and leaked information to the "wall street journal" and "new york times" which you are not authorized to do. but we shouldn't be surprised. your boss james comey also leaked information to the "new york times" because he didn't have the guts to stand up and say what he wanted to say. you think you are being targeted? you are not that important. nobody is looking to bring you dune. but your wife gets $700,000 from the clinton cash machine and you handle the clinton foundation

godfather," andrew mccabe is the enforcer. and peter strzok is the button man. it looks like strzok who signed the warrant application to the fisa court was a close friend of judge contreras who signed the warrant. the cover of a dinner party so the judge wouldn't be required to take himself off the case. even bob mueller enough enough to take strzok off his investigation because strzok was so dirty. mccabe you can complain all you want that you were unjustly fired. but the facts contradict that. you should have been fired a long time ago. you should lose your law lie even and you should have been -- law license and you should have been taken out in cuffs.

joining me now, gop house majority leader kevin mccarthy. thanks so much for being on "justice" tonight. what do you say regarding the fact that mccabe is fired and he lost his pension? >> welcome to california. i hope you are finding we are not all like the san francisco values, there are a lot of conservatives out here. judge jeanine: especially in kern county where i saw you last night. great republican county. >> you gave a great speech. one thing you have got to look at. i know a lot of democrats are trying to make this a political problem, but it's not. an independent, knob partisan unspector general found the information of mccabe lying. thought it was severe enough even before the final report came forward to send it to the fbi, send it to the ethics

department of the fbi, the office of professional responsibility. they are non-partisan independent. they look and they believe he should be fired, because everybody fbi agent i know, he or she believes in integrity. there are so many people they bring before the court they uphold because they lie. they did not want them to take down the fbi integrity by lying and going forward. oner one of the most of interesting things i have found post the firing what mccabe said. take his statement. if i was comey i would be worried. he said in there when he leaked to the wall street general that it was on the authority of the director and they knew they were doing this. that's direct opposite of what comey told congress in may 2017 when he was asked the question regarding a trump or clinton investigation, did you ever

authorize anybody to leak information, he said no, never. so we know that mccabe has lied by the independent inspector general found it. now he's saying about comey, comey may have lied as well. so i don't think this is the end of it. but that's why we need a second special counsel. i give chairman gowdy and goodlatte a lot of credit. think sent that letter to jeff sessions, he's looking at it. the inspector general does not have seen a power outside of the direction. so we need somebody to look at this not from the inside because you can't trust what's happening right now. judge jeanine: you know what's interesting, congressman, you have got jim comey gone, the director of the fbi, now you have the deputy director of the fbi, and i think it's just a matter of time. the amazing part of this is we have to wait for this stuff to hit the public record before anything happens in the swamp.

but it appears strzok and page are next, especially with the claim of their relationship with the judge who signed the fisa warrant that was based on unverified information. do you have any shotso thoughts on that -- do you have any thoughts on that? >> i want to give the judiciary committee a lot of credit. there is 1.2 million pieces of paper that deal "this subject. there is only 3,100 that has been sent to the judiciary committee and a lot of that was redacted. when we were talking about the fisa court judge that was the work of the committee member finding that because much of that was redacted. for five months they have been fighting to find that information. we are separate but coequal. congress is suppose to hold them

accountable. if they are withholding that information, i believe a lot more information will judge jeanine: you said 3,000 of 1.2 million? >> yes, there is only 3,100 pages of the 1.2 million that i know that have been sent to the judiciary and oversight. they went back over and found the other parts they couldn't see and pieced it together of what they were talking about, trying to get that small dinner party of six people, maybe try to influence this judge. if you know from all your work in the law. a fisa court is different from any other court. the way they went before this fisa court knowing hillary

host of radio leslie marshall and dan bongino. the question for me is if mccabe is gone, and if mccabe seems to have contradicted what jim comey said under oath, saying he leaked with the permission of jim comey, do you think these two will be at odds with each other? >> i think they will. there are many on the left that don't have a problem with the firing. we have the problem with what happened sense subsequent to that. the president's vindictive-like tweet. and the president's attorney saying we got to get rid of this, fire mueller, get rid of the investigation. i'm speaking on behalf of the president, no, i'm not. judge jeanine: i don't know that

that makes any difference in terms of his being gone, what they are saying. he said he was targeted, his family's life was ruined because of the president. dan bongino what do you say to what leslie just said? >> leslie, i disagree. i think the world of you. but this is nonsense. donald trump and his family have been under relentless assault by the hard left and their political allies. they were spied on. they were under investigation for a crime you can't produce a scintilla of evidence even happened. now he takes some kinds of victory lap because he's getting justice? one more point on this. although not you specifically, a lot of those liberal blue checkmarks on social media, they want him fired tomorrow, they want him impeached.

they have no evidence to impeach him, but there is plenty of evidence about mccabe's misfeasance and they are upset about the firing. judge jeanine: dan, what do you think took so long? do you think strzok and page are next? >> i think they are afraid of what strzok, page and mccabe will say when they are released from the bureaucratic chains of the government. judge jeanine: do you think it's inevitable? >> i think with mckaibt was timing. you had mueller do what the president said he didn't want him to do, subpoena records of the personal business and trump family dealings. that's where part of the problem comes for me. those -- i do trust the a.g.'s

office but when the president is pick up the phone and saying you need to do this, then the timing before the retirement is sticking it to him. judge jeanine: if you are a member of the fbi, you deserve to get it stuck to you. what people from the fbi are saying mccabe was arrogant, he drove his porsche to work. he was on the 7th floor and he thought he was going to control the primary and presidential election. >> leslie, you and i are in the private sector. if nobody listened to our stuff, you and i would get fired. andy mccabe was the number two for three of the most of he normous apostles in u.s. history. they screwed up the flynn

case,ed the hillary case. but if you believe in big government, you have to believe in accountable big government. every american works. he screwed up and he lost his job for it. it's as simple as that. judge jeanine: dan, you were in law enforcement. do you think in the end these people are going start testifying against each other? i think mccabe has to be indicted. i don't think it's a question of wanting him to or not wanting him to. but if martha stewart gets indicted for lying to the fbi, and general flynn is indicted for lying about something that isn't criminal, mccabe has to be indicted to. >> where they are in a world of trouble will be the leaks. there were suspicious leaks to

david ignatius in january right before the flynn case started. these are criminal charges, releasing sensitive transcribed unmasked information to reporters. that flynn interview, remember those agents in that interview were pretty convinced flynn was being truthful. were those 302s changed? this is serious stuff. judge jeanine: leslie, what do you think about that, leslie? flynn, even people in the fbi think what he said was not intended to be a lie. >> quite frankly i'm not looking at the information that robert mueller is and he's the guy that has the power. i don't. and i trust him and i trust what he's doing, i say let this investigation play out. judge jeanine: if mueller got rid of strzok because he was that bad which is pro hillary

this president. nobody cares about him. judge jeanine: what do you think? >> if a crime has been committed. conspiracy is underlying it. judge jeanine: collusion is not a crime, so why are all the democrats saying we are look for collusion. >> clielings an anti-trust crime only. but conspiracy is a criminal crime. judge jeanine: why aren't they talking about conspiracy? >> i do every time i come on here. judge jeanine: conspiracy is what hillary clinton did with uranium. >> why do they not talk about hillary the way we are talking about donald trump. judge jeanine: why don't they call barack obama and cfius, all the people who approved 20% of our uranium going to russia.

understanding of conspiracy? >> that's a different standard. but we don't know what the president knows yet. judge jeanine: tell them why we don't know? >> 15 months we can't figure it out. there is no smoking gun. they want to take this president out so badly. i would like to see more about benghazi, but that one was shut down. >> that was fully investigated by trey gowdy who came to a conclusion. judge jeanine: what evidence do you have? >> robert mueller is investigating. >> how much longer is this going to go? judge jeanine: in the city of leaks the one thing that's not leaked is that of trump conspiracy? when are we going to find out? >> we'll find out when mueller announces it.

accountable. every one got to retire or stay on the job. this is the first time the american people are seeing some responsibility for someone who misled, didn't do his job, then changed his story when the administrations changed. judge jeanine: flynn lies to the fbi he's a felon. martha stewart goes to jail. this guy doesn't get his pension, really? nothing has been done like this. i'm convinced strzok and page are next and the whole thing will come tumbling down. you were on oversight reform. we talked about the fact it's so difficult that right now they only have 3,000 of the 1.5

million document they subpoenaed. first of all they don't have them. and how do you possibly get through them? >> it it's an amazing process. you word search, you tell them what you want. they identify the number, then they slowly go through them deciding what to redact. it's like trying to ask for the documents from the manhattan project. they do it with human beings and do it slowly. this is a problem congressional oversight has over republicans and democrats. they won't give you the raw documents. eric holder was held in contempt 7 years ago for withholding documents. he said there were 200. we just recently began getting additional documents and discovered he deliberately with hold a whole category of documents they are now going back through and identifying and

they will give to oversight. brian terry dies in 2011. we are still trying to get justice for this border patrolman's family. to bring up the president's trip to california. he wa -- he was looking at these wall fences. people like brian terry shouldn't die in the open. they are targets for the bad guys. judge jeanine: so much time, the excesses of this administration, the benefits, the regulations that have been reduced. the improvement in the economy, the unemployment at an all-time low. we have people who are criticizing this president, a fantasy about russian collusion. what do you say?

you are leaving congress. you announced you are not going to run again. but i'll get to that in a minute. your fellow colleagues are saying i know there is collusion, i know it but i haven't found it yet. >> if you spend this long look for something and you haven't gotten the first whiff of it, obviously you have to question why you are still look. i'm leaving congress after 18 years. but i'm an old reaganite. if you go back through hut. when reagan was putting tariffs on anti-dumping on foreign countries, there was a terrible, the sky is falling, we are becoming protectionists. now donald trump actually mirrors, it's now china primarily. he's beginning to look at sanctions against dumping into the market that's hurting

judge jeanine: welcome back to "justice." joining me now republican strategist, attorney and committee woman for the rnc here in california. harmeet dhillon. we know a federal employee can be fired. but does andrew mccabe have any recourse. he's kick and screaming, but does he have recourse? >> most of public employees have the right to appeal. but unless he can show there is a violation of his constitutional rights, but i think he's out of luck. he doesn't lose his pension all together. he simply can't take it right away it's an exaggeration to say

he doesn't get it. judge jeanine: he isn't getting his pension now but he gets in 57. >> and he doesn't get to juice it because he gets to take it early. but he's not out of luck with the money he paid in. judge jeanine: general petraeus recused himself, he took himself off the case, now he's coming up with strzok and his girlfriend page's conversations, we should meet with him so nobody knows in a dinner party setting. where are your antennas going? >> this judge contreras is a judge on the fisa court. we don't know if he issued the

subpoenas for the wiretapping of carter page. but these two page and strzok are having conversations talking about ways they can have a social meeting with the fudge and they talk about ways they can cover it up. and they talk about the fact that the judge is close to strzok. surely knows strzok is in charge of foreign counter-intelligence at the fbi. they are talking about inviting other people for cover to make sure it doesn't like out of the ordinary. and to get close to the judge, but not so close the judge is forced to recuse himself. judge jeanine: they are recommending a dinner party so it doesn't look obvious they are talking to each other. this smells to high heaven. you have got one judge who is on the flynn case who takes himself off because he did something. he got caught in something. >> it's not clear he recused

himself. he took the plea december 1 and december 7 the court announced he has been recused. judge jeanine: that's even worse, someone took him off the case a week later. he's the same judge strzok is saying i can wheel and deal with him. >> and it involved other fbi people. they seem to have a willing group of people who would show up at a dinner party or cocktail party to get close to this judge they know is on the fisa court. they are talking about an insurance policy and texting how they hate the president. this is before the election. this is a deep game these people are playing. judge jeanine: we'll be right
