335 points, over concern about facebook. concern about the federal reserve which is expected to hike interest rates tomorrow. the fallout from that tomorrow. we are on it. "the five" is now. >> jesse: i am jesse watters with kimberly guilfoyle, juan williams, dana perino and greg gutfeld. it's 5:00 in new york city and this is "the five" ." andrew mccabe was supposed to be retired right now. he had served in the fbi for more than two decades and rose to be the bureau's deputy director. on friday night around 10:00 p.m. eastern, he was stripped of his federal pension 48 hours before it was set to kick in. fired by attorney general jeff sessions for "lack of candor under oath on multiple occasions." president trump, a lone critic of mccabe, called it a great day for democracy.

mccabe maintains he was sacked to undermine the grid ability of the special counsel's investigation. he has turned over memos of his conversation with president robert mueller steam. there is a firestorm of reactio reaction. >> and the president said is a great day for democracy yesterday, i think it's a horrible day for democracy. to have firings like this happening at the top from the president, the attorney general, it does not speak well for what is going on. >> his firing may be justified. there's no way for us to know at this point. even though it may have been justified, can also be tainted. it was clearly rushed, and i think their questions about that and whether the administration is putting pressure on the justice department to take this action. it appears to have have been compressed in order to take vengeance on this guy. >> andrew mccabe destroyed his credibility all by himself. >> jesse: former director john

"when the full extent of your venality and moral turpitude and political corruption becomes known, you will take your rightful place as a disgraced demagogue in the dustbin of history." a little over the top there. when i found interesting is in the montage, adam schiff, a pretty partisan democrat. he says it could be a possibility this firing of mccabe was completely justified. what do you think? >> kimberly: that tells me everything you need to know. he wouldn't be saying anything like that that might displace his partisan base to think president trump is running amok here. saying that tells me he has knowledge and information to suggest in fact it was justified. i don't think he would go out of there way to do it if they didn't have good reason and full

costs. in fact, the people making the recommendation, the people who work with him at the fbi. you brought a humanitarian point to it last week. you said it's two days before the guy's. look at that aspect of it. nevertheless, the facts are there, persuasive and compellin compelling. >> jesse: juan, people are saying if it was just a regular guy in the fbi out the field and he did what mccabe did, he would be treated the exact same way. do you understand that argument? >> juan: i don't think that's true. but i understand the argument. i think what's truest fbi agents are not rich people and they really rely on pensions. typically there's a lot of leeway given, especially when there's two days ago. i think what happened here is we

don't know. you're seeing adam schiff say it could be that adam schiff is protecting himself from possible blowback. if you get a report from the inspector general that indicates mccabe either lied or was not forthcoming with them, then you say okay, so there was justification for it? what we do know is that mccabe has said that's not true. he either was in chaos and was misunderstood. he says he did not lie or mislead them. that's all we have on the table at the moment. given the james comey firing inn the house intelligence committee saying russia, they did in donald trump, it looks like when you look at this, you can't ignore the politics. and the politics are stinky. >> jesse: obviously a lot of politics in washington. to be expected, dana. do you think it was a little harsh? do you think internal investigators think he did a bad

"west wing" script left over. after he says that, this magical, manicured stuff, samantha power retweets and writes "you don't want to get this guy angry." it's like being in a high school cafeteria. the cheerleader says let me hold your jacket. you're going to get into fight. maybe that is a submission that hillary keeps talking about. it's his anger. it reflects the deep animosity that validates trump's assumptions and assertions about people in power who want him gone. that is the hood ornament. the tweet is the hood ornament of all these people who sincerely believe there's a bad man in the white house. it is the circle of media and the trump critics and they match perfectly. self-perpetuating engine of panic to the media says oh, my god. he's evil. then you have this dude and you

have comey and the other guy and this guy who were in the government saying the same thing. these are the same people. the media, i guess you would call them washington insiders or establishment, whatever. the reactions are 99.9% identical. that's where you get the hysteria and the panic because there is no you nine -- no yind yang. when it is this uniform and hysterical, it makes me think it's emotionally driven. >> jesse: uniform was the reaction to this and everybody said the next app, mueller is gone. let's hear some of that. >> i don't know what the designs are on mueller but it seems to be building toward that. i hope it doesn't go there. because it can't. we can't in congress except

that. >> he tried to do that, it would be the beginning of the end of his presidency because we are a rule of law or nation. >> i would hope it would prompt democrats and republicans in the house to pass an independent counsel law and reinstate bob mueller. this would undoubtedly is often a constitutional crisis. i think democrats and republicans need to speak out about this right now. >> jesse: kimberly, do you believe there is momentum building for firing mueller or is it a self perpetuation of the media and the democrats where they almost want this to happen. >> kimberly: a little bit of the self perpetuation merry-go-round. the one you want to get off of before you throw up. i don't think is going to make a move like that. i think it would be ill-advised at this point to do something like that, given this has already gone so far down the road. let them complete the investigation. i don't see any upside for the president in removing him at this juncture.

the only downside is tremendous amount of fallout and criticism. we saw that when that happened with comey. we don't think this should follow in the footsteps. you have mccabe gone. do the investigation, completed, come to the conclusion. see it through, all the way through fruition. >> juan: >> juan: this isn't tht time the president has maybe thought about firing mueller. they were reports in january that he's been thinking about it. people say no, he would never do it. that it was confirmed that in fact he was thinking of doing just that. and now again what we have seen this weekend, i thought he was manic in the tweets, the attacks on the intelligence community, fbi. >> greg: it was a deflection. trump was tweeting so you didn't notice he was colluding with putin to enact the election in russia. i wanted to give you a new conspiracy. helping put in become president for life.

>> dana: fox news alert. we want to update on the deadly bombings in texas. four mysterious attacks and also have killed two, injured four and with the state capitol on high alert. the latest from casey stegall. >> at this hour, police are still processing what is described as a very large and elaborate crime scene. investigators say they have quite a bit of evidence that they have to go through and collect. not to mention they have been making multiple sweeps of this residential neighborhood. 8 miles southwest of downtown austin. to ensure no additional devices were planted. residents of them told to shelter in place until an all clear is been given. this is an all hands on deck situation with local, state and federal law enforcement pouring into. >> what we are doing, as we

talked about before, this has to be a community response. this is something we are going to solve as a community. the officers working the neighborhood are paying attention not only for the suspicious packages but items that may look out of place. department of public safety is going to send additional troopers into the austin area. to be visible and help look for suspicious items. >> authorities will not elaborate on the similarities between the device used last night and those used in the previous three crimes. other than that this one was much more elaborate and this had a tripwire connected to it. in other words, a filament or wire that would cause the package to detonate. they believe that's what happened when two guys rolled through on bicycles last night, they may have hit the tripwire, causing the blast. authorities say they believe this is the work of the same

nearly three times the amount seized in 2016. if we don't get tough on the drug dealers, we are wasting our time. we will be focusing on the penalty that i talked about previously for the big pushers, the ones that are really killing so many people. and that penalty is going to be the death penalty. >> dana: the president said he would have three focuses. one was law enforcement, the second was prevention and education. a sizable advertising campaign, a little bit of a throwback. the third one was improving the ability to fund treatment through the federal government and those impacted by the epidemic to help them find jobs while fighting addiction. what do you about making the penalties stiffer for drug pushers? will that actually help cut down demand? >> greg: i don't know if it

will. trump won because he was a law and order guy. if you look at everything from immigration to terror, it's all about strength. this issue provided him a perfect opportunity to exercise that. when you say you're going to kill the dealers, you're not going to find much opposition. conservatives must be consistent with the argument. with gun control, you talk about protecting law-abiding citizens and going after the bad guy which is what i think trump is saying. you do not want to cast a wide net over people who need actual perception medications to deal with cancer pain or other pain disorders. these drugs are necessary. if you start making them feel like criminals, that's wrong. be consistent and go after the criminal. finally, this is where my libertarianism kicks in, i don't trust the government on health issues. if you look at the war on drugs, it hasn't worked out. if you look at prohibition, not a good idea. the hideous nutrition pyramid.

we talked about a bad mistake. we had heart disease and diabetes on the rise. the nutrition pyramid said eat low-fat, high carb food. that was a mistake. i am always suspicious of the government trying to get involved in our health. however, dealing with hard-core dealers who do kill more people and mass shooters commits not such a bad idea. remember that when you make something illegal, it is street drugs that are killing people. the drug delivery mechanisms that are so unreliable on the street. we have learned that with medical marijuana legalization of legalization of marijuana. >> dana: kimberly, what happens for prosecutors if you increase the penalty? more cases to include the death penalty, is it a deterrent for drug dealers? >> kimberly: is a live different studies on it that point to, as a deterrent.

he is trying to show he's serious. i have to tell you even among republicans, it's going to be very difficult to get anything like this in terms of the death penalty for this type of situation. i was a death penalty prosecutor and i was on a panel reviewing cases that were eligible and/or appropriate. even if they were eligible for the death penalty. it's a tough sell. you better have a very compelling case with lots of different elements to qualify. i think he is well intentioned. it shows how serious he is about this but i think would be really -- the chances are negligible he's going to be able to get something like this through. >> dana: juan, one of the hopes for some people would be that the president is saying stiffer penalties for those big dealers. then you have people letter languishing in jails who might've been a small time drug, a problem and they have something on the record. is there a way to do both? increase the penalties for top dealers and have some sort of criminal reform or -- prison

reform our criminal justice reform for those in fairly in prison. >> juan: i think the people involved in trying to reform the sentencing, that includes republicans as well as democrats, have concluded the war on drug thing didn't work out. i have not seen any data that would suggest the war on drugs was effective. to the contrary, the situation situation, we see is that people say when you take the sledgehammer approach and say we've got to get tough with the drug dealers for what you do is hike up or spike the prison population but you don't necessarily reduce drug use. we have that on the record. we know that for a fact. when you say these kinds of things, it reminds people that well, we need ideas. alex azar, the new secretary of health and human services, said just that. that's the kind of policies producing. that's not what the president to same. i don't know if it's rhetoric but it seems like a step back into another world where you

think yeah, if we throw them in jail. who are you going to throw in jail? the people who run the big pharmaceutical companies who are meeting a real need in terms of pain prevention? i don't know. a lot of what we are talking about is that people become addicted on the basis of perception drugs but then can't -- then they go to the guy on the corner. >> dana: the president brought up a family. they didn't know they were going to be asked to speak. the mother who lost her son to a half years ago to somebody who had started taking drugs out of the kitchen cabinet and then had to go to the street for it, it was very moving. there is a personal side of this and i think the president does a good job reaching out to them. >> dana: >> jesse: it's probablf his most effective methods of communication, humanizing the issue. greg just made me think the food pyramid. we really need to go after it. >> greg: we do. >> jesse: is dangerous. we need to start reorganizing i

analytica used from facebook. what they did was they hired five staff members from cambridge and they had to sign a deal to get the staffers to come work with them in texas but they never used any of the so-called psychographic modeling. they used data and research from the rnc and their own internal data network. a lot of it is trying to paint the trim campaign as if they reached into facebook and ripped out all of this. it's just not true. but like you said, it's more about facebook and protecting their customers information. obviously they didn't do a great job about it because they didn't let people know their data was being mined. i think facebook has to answer to that. >> juan: i think this is another reminder that propaganda and sort of a psychoanalytical profile of play -- are at play in elections. you can use it without peoples
